HANOVER AMENDING THE ZONING ORDINANCE OF NEW HANOVER COUNTY, NORTH CAROLINA ADOPTED OCTOBER 6, 1969 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN: Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended, be, and the same is hereby further amended as follows: 1. Amend Section 23, Definitions by adding the following New Definition: 23-57. TOWNHOUSE. A principal structure containing two or more single family attached dwelling units with each unit on its own individual lot. All townhouse developments shall be subjected to the multi- family development provisions of this Ordinance with the following exceptions: a. All units shall comply with the minimum lot area requirements of Section 73 of this Ordinance on its own individual lot or by provision of open space or by a combination of lot area and open space. b. No unit shall be connected on more than two (2) sides by common walls. c. All yard dimensional requirements shall apply to the exterior building line of the principal structure only. No individual unit shall be required to meet the yard dimensions except those units that have an exterior faall of the principal structure. 2. Amend Section 51-3, Special Uses, Subsection (5) to revise the subsection to read as follows: (5) Multi-family developments; including apartments, townhouses, or condominiums. 3. Amend Section 52-3, Special Uses, Subsection (5) to revise the subsection to read as follows: (5) Multi-family developments; including apartments, townhouses, or condominiums. 4. Amend Section 53-3, Special Uses, Subsection (4) to revise the subsection to read as follows: (4) Multi-family developments, including apartments, townhouses, or condominiums. Section 2. Any ordinance or any part of any ordinance in conflict with this ordi- nance, to the extent of such conflict, is hereby repealed. Section 3. This ordinance is adopted in the interest of public health, safety, morals and general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption. Commissioner Commissioner RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF NEW HANOVER COUNTY OF INTENT TO CLOSE ALL OF THAT PART OF IP~iPERIAL DRIVE AS SHOWN ON THE MAP OF HORNDALE SUBDIVISION RECORDED IN MAP BOOK 8 AT PAGE 71 IN THE NEW HANOVER COUNTY REGISTRY FROM THE EASTERN RIGHT-OF-WAY LINE OF HORNDALE DRIVE 458.57 FEET TO THE WESTERN RIGHT-OF-WAY LINE OF COLCHESTER PLACE AS SHOWN ON THE MAP OF SECTION 4, WATERFORD SUBDIVISION RECORDED IN MAP BOOK 18 AT PAGE 111 IN THE NEW HANOVER COUNTY REGISTRY WHEREAS, the Board of County Commissioners of New Hanover County, North Carolina are of the opinion that a portion of a road known as Imperial Drive as the same is more fully described on a map recorded in Map Book 8 at Page 71 in the New Hanover County Registry running from the eastern right-of-way line of Horndale Drive as shown on the same map eastwardly 458.57 feet to the western right-of-way line of Colchester Place as shown on the map of Waterford Subdivision, Section 4, recorded in Map Book 18 at Page 111 in the New Hanover County Registry in the near future, should be closed and that the closing of same is in the public interest; NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COMMISSIONERS OF NEW HANOVER COUNTY, NORTH CAROLINA IN 'A REGULAR MEETING ASSEMBLED ON THIS THE 2nd DAY OF January , 197 9, AS FOLLOWS 1. That New Hanover County intends to close a portion of Imperial Drive as the same is more fully described on a map recorded in A~ap Book 8 at Page 71 in the New Hanover County Registry, running from the eastern right-of-way line of Horndale Drive 458.57 feet eastwardly to the, western right-of-way line of Colchester Place, a street shown on the map of Section 4 of Waterford Subdivision, and the County Clerk is hereby directed to cause this. resolution to be published once a week. for four (.4) successive weeks, pursuant to the provisions of N.C.G.S. ~153A-241. 2. That the Board of County Commissioners of New Hanover County will hear all persons interested in opposing said closing at a hearing to be held on the 5th day of ., February , 19 7 9;- at 9 : 00 A. M. in the Assembly Room, First Floor, New Hanover County Administration Building, 320 Chestnut .Street, Wilmington, North Carolina, and the County Clerk is hereby directed to send by registered mail or certified mail a copy of this resolution to all owners of property adjoining the above described named streets as reflected by the tax records of New Hanover County and to post in at least two (2) places along that portion of Imperial Drive proposed to be closed, notice of said hearing.
