The ~ ~ "~' ~~~ annual award recognizes library administrators who have shown significant leadership in developing library services either locally or statemvide. Mr. Paynter was praised for securing support for two anajor Nemv I3anover County Public Library building projects, his role in developing electronic resaurces for libraries in North Carolina; and the high level of services offered by the New I~anover County Public Library. I-Je accepted the award on behalf of the library star; the Friends of the Library, and the Library Advisory Board, all of whom have worked tirelessly on behalf of the library. 1~1r. Paynter also accepted an award from the Directors' Association honoring the Northeast Regional Library for #~ne design in the category of remodeled facilities over 26,000 square feet. BRIEF SUMMARY: The New Hanover County Tidal Creeks Program was established in 1998 following a grant award from the North Carolina Clean Water Management Trust Fund. In receiving the S6 million grant, the County agreed to spend 511,580,000 in local funds over afive-year period. The program is a • comprehensive effort to protect-,'restore, acid enhance water quality within the Futch, Pages, Howe, Bradley, Hewletts, and Whiskey Creek watersheds through the implementation of specific water quality enhancement strategies including the acquisition of Airlie Gardens. Letters of endorsement have also been submitted by the County's Tidal Creeks Advisory Board, the NC Coastal Federation and the Pender County Soil and Water Supervisors. In November 2001, this agenda item was postponed to allow time for the Pender County Commissioners.to review this request; their letter of endorsement is now enclosed. The N.C. Division of Water Quality has asked for your position concernng the reclassification. The major difference between SA and ORW(also referred to as SA-ORW) is that the State's "high density" development option can be used along SA waters, while in ORW waters no high density development can be undertaken within 575 feet of the shoreline. High-density development, according to State regulations, is where lots are less than 1/3 of an acre or the impervious surface is greater than 25%. High Density development requires an engineered stormwater design that retains up to 1 '/2 inches of the rainfall. Considering that the County zoning generally is R-20S or R-20 (/12 acre lots - 20,000 sf) in the Futch Creek which severely limits the potential for high-density development, a reclassification from SA to ORW should have little effect on development. An -attached memo from Planning staff provides more detail on the State regulations. RECOMMENDED MOTION AND REQUESTED ACTIONS: The .Board should consider the reclassification. At that tine, the Board voted to hold a public "hearing" to accept comments tom Pender Co~ulty residents who would be most affected by this reclassification. On December 17~'; the Board held this public hearing and voted unanli-nously to il-lforrn 4 you that Pender Co~.~ity supports this designation. One local landowner in`ormed the Board that her fa~-n?iy had owned land along Futch grid Foy Creek for over 200 years. She said they have sold a 300 foot easement to the Ciean Water Management Trust Fund, and has designzted ether portions to a consecration land trust. She said she is willing to give up her developrrient rights to this land ar~d marshland because it marl be protected. Blanchard SUBJECT: Consideration of Drainage Concerns -Greenbrier Subdivision SRIEF SUMMARY: ' Staff has received a request from residents .near the entrance of the Greenbrier Subdivision concerned about the excessive flooding which occurs during major rains. We have assessed the situation and have found that a problem does exist down stream of the culvert under Greenbrier Road. The bottom of the down stream ditch has filled in to an elevation higher than the pipe, causing water to flood onto the street. The ditch banks have grown up with large trees malting it impossible to clean the ditch with a machine without cutting most of the trees. • Staff is in the process of acquiring written permission to enter the properties with a prison crew to remove the brush and the debris from the ditch and ditch bank. The prison crew is not allowed to dig out the ditch Once the debris is removed a survey will be performed on the ditch bottom to determine the amount of dirt to be removed. It appears that up to two (2) feet of dirt will need to be removed for a distance of about 350 feet. Based on Section XIII, Paragraph 13.3, Public Nuisances, of the Drainage Ordinance (copy attached) the lot owners are responsible for removal of the dirt and debris from the ditch on their property. The owners may remove the material or the County may perform the work and assess the landowners. They would be assessed for the actual cost only, not the work performed by the prisoners. The penalty assessed for any of the above violations shall be increased by twenty-five percent (25%) of the amount assessed for any spill not properly reported by the violator once he has knowledge of the violation. (3) In the event there are subsequent penalties assessed by the state against the County for improper disposal or illegal dumping, or illicit connection into the municipal separate storm sewer system, caused by any person, such person shall be assessed the equivalent amount of civil penalty. 13.3 Public i~TUisances (1) Nuisances. The following enumerated and described conditions are found, deemed and declared to constitute a detriment, danger and hazard to the health, safety, morals and general welfare of the inhabitants of the County and are found, deemed and d declared to be public nuisances wherever the same may exist and the creation, maintenance, or failure to abate any nuisances is hereby declared unlawful: a) Any condition which constitutes a breeding ground or harbor for rats, mosquitoes, hannfiil insects, or other pests. b) Any open place of concentration of combustible items such as mattresses, boxes, paper, automobile tires and tubes, garbage, trash, refuse, brush, old clothes, rags, or any other combustible materials or objects of a like nature. ' c) An open place of collection of garbage, food waste, animal waste, or any other rotten or putrescible matter of any kind. d) Any furniture, appliances, or metal products of any kind or nature openly kept . which have jagged edges of metal- or glass, or areas of confinement. e) Any condition which blocks, hinders, or obstructs in any way the natural flow of branches; streams, creeks, surface waters, ditches, or drains, to the extent that the premises is not free from standing water. (2) Notice to abate; emergency abatement by County. If any person shall violate the provisions of this ordinance, it shall be the duty of the County to give notice to the owner or to any person in possession of the subject property, directing that all unlawful conditions existing thereupon be abated within ten (10) days from the date of such notice or within ten (10) days from the date of a final decision if appealed to the County Manager; provided, that if, in the opinion of the County, the unlawful condition is such that it is of imminent danger or peril to the public, then an " authorized representative of the County may, without notice, proceed to abate the same, and the cost thereof shall be charged against the property. (3) Abatement by County where owner fails to abate. Upon the failure of the owner or person in possession of any premises to abate any unlawful condilion existing thereupon within ten (10) days, it shall be the duty of an authorized representative of the County to cause the removal and abatement of such unlawful condition. 13.4 Remedies Any or all of the following procedures maybe used to enforce the provisions of this ord inance: (1) Injunction. Any violation of this ordinance or of any condition, order, requirement, or remedy adopted pursuant hereto may be restrained, corrected, abated, mandated, or enjoined by other appropriate proceeding pursuant to state law. (2) Civil penalties. Any person who violates any provision of this ordinance shall be subject to the assessment of a civil penalty. _ (3) _Denial ofpermit. BRIEF SUMMARY: In May 1997 the County went through the formal bidding process to establish a term contract, contract # 97-0205, for the purchase of 800 MHz radios on an as needed basis. This was before the current sole source provision/exemption was enacted and including in the General Statutes. This contract established pricing at a percentage discount off manufacturer's ,suggested retail price. Therefore, if the prices decreased duririg the contract, the County's price would also decrease. Staff is recommending renewal of the existing contract # 97-0205 through the sole source provision in the General Statutes. Contract provisions would remain the same except the pricing component will be updated with a current pricing proposal from Motorola. The establishment of this contract does not require any purchases. It is a term contract for the County's use when and if radio purchases are needed. The contract was renewed in April of 1999 and then again in April 2001 and now it is time to renew again. Because many state and local entities are on similar term contracts with Motorola, Motorola requires these contracts to be on a calendar year. Therefore this renewal will extend the contract through December 31, 2002. RECOMMENDED MOTION AND. In addition to the increased formula allocation of Rural General Public (RGP) Program funds disbursed on October 24; 2001, the Public Transportation Division is pleased to announce that an additional 51.6 million of discretionary RGP hinds is available.. These discretionary RGP funds will be disbursed to selected counties; and must be suballocated to Community Transportation Systems to be used to provide viral general public transportation service. We know that there are many systems that have desired to expand their general public service. This represents an opportunity to do so. For those Community Transportation Systems that may not have sufficient RGP hinds available to sustain the level of service that is currently being provided, or for those that have an identified need to provide additional rural General public transportation service for the last quarter of this fiscal year, this is an opportunity to apply for discretionary RGP funds for the period April 1, 2002 through June 30, 2002.
