Since first rated to the County Commissioners in September, 2001, plans for the continued opment of Airlie Gardens have been further refined and revised based on significant ial discussion, consultant input, and public .review. The resulting plan outlines the wements needed to better serve visitors and residents visiting Airlie Gardens, thus asin~ visitation and achieving economically sustainable levels. The staff at A-irlie developed a prioritized site improvements list, which was lrther refined and approved by the T'acilities Committee of the Airlie Gardens oundation 1~oard. These improvements where conceptualized in written and plan form y consulting landscape architects and presented to the Board for their review and pproval. Detailed plans for the priority development areas have been developed. These J reas include the Entrance Area, the Rain Garden, Bradley Craek Overlook, Garden etvices Center, and the Showcase Garden. The environmental education mission is ~rthered, in particular, by the Rain Garden and the Bradley Creek Overlook. The public has had ample opportunity to review and comment on the plans. Cations have been made to several interested groups, the plans are available for on the County's web site' for Airlie Gardens, the plans have been displayed at the Garden Show, and at the central and northeast branch of the public library. A presentation was held on 1 eb.13 at the northeast branch of the public library. The resulting Master Plan is a summary of the planning and design work ndertaken thus far, This plan h.as been formally adopted by the Airlie Gardens Foundation Board. The plans offer a clear mission, and coals for the Garden, focusing on _ ii nplementing basic visitor and operational in£~astruchue needed to operate Airlie as a ~ublic garden, The plan indicates what is required in order to begin operating Airlie at (more financially sustainable visitation levels. The County Commissioners assigned this Commission the responsibility of studying and preparing recommendations for the best use of the 3 % Occupancy Funds to be presented to them for approval and expanded the membership by adding the Mayor of Kure Beach on 4/ 16/84. Minute Book 19. Purpose of Commission: To investigate, initiate and support general water resources development projects to include (but not limited to): (1) Port Improvements and growth of the shipping industry, (2) Beach renourishment and conservation; and (3) mitigate declines in water quality. The Commission will weigh the benefits of these water projects against the possible detrimental effects on the area's environmental quality enjoyed by area residents. The Commission is constantly studying and staying informed on various projects trying to obtain new and beneficial projects for this area. The main projects for the area deal with the U.S. Army Corps of Engineers in requesting studies, seeing if a project is beneficial from a cost benefit ratio, and attempting to obtain approval and then funding in the U.S. Congress and on the State level, but this mission is not carried out in isolation. The Commission maintains an awareness of projeirt effects on the quality of the waters-and their interrelations with natural resources. Brief on Functions: The Commission works closely with the N. C. Department of Resources Commission for assistance in obtaining approval of state funding and projects. An annual meeting is held in Washington for the purpose of lobbying. Brunswick and Columbus counties and the City of Wilmington; was named one of the top general government county programs in the state for 2001 by the North Carolina Association of County Commissioners and will receive an Outstanding County Program Award: The winning programs were selected for superior innovation and collaborative efforts in the categories of General Government, Human Services and Public Education/Participation. Fourteen programs were selected from nearly 100 entries. The "Cape Fear Regional Growth Team" program was one of six General Government programs in the state to receive the prestigious award. The program was nominated by Pender County Commissioner Carolyn Justice and Region O Council of Governments Director Chris May. A framed certificate will be presented to the New Hanover County Board of Commissioners at their Feb. 18 meeting at 9:00 a.m. The following is a brief summary of the program.. The Cape Fear Regional Growth Team was created in November 1999 to facilitate discussion of growth related issues from elected officials in the region. The program evolved from an event originally sponsored by LTNC Wilmington that involved all the elected officials in the four counties and the City of Wilmington. The officials liked the idea of getting together regularly, and the Cape Fear COG took over the task of coordinating the monthly meetings and soliciting topics to be discussed. ~-~- p ~ Proj,ects~embraced by the team include improvements on Highway 130, A US 17/I-40 J r.,..~-,,, ~• `Outer L,o~op, a'Re'`g~~oynal Heritage Tourism map of sites and an Economic Development Network involving; all {fourlcoutities. u~ i= {~, t ~~ - "Immediately following our lobbying efforts as a group, suddenly the improvements were moved up on the schedule," said May. "Highway 130 is scheduled for improvements this spring and summer. And the I-40 project is moving its way to the top. Showing the unity made it easier for the legislature and for the DOT officials to get behind it and approve it. "This has enhanced a greater understanding of each other's counties and has reinforced the commonalities that we all have." By acting as a team, the resources of the four counties and the city are pooled. For instance, the team produced 300,000 copies of the Heritage Tourism map, which might have been cost prohibitive for some of the less wealthy counties. In addition, the four Economic Development Agencies, which had previously viewed each other as competitors, signed an inter- local agreement and are now marketing the four counties together. "Typically there is a lot of competition between economic developers," said May. "They are not agreeing to just give away the fort, but they are agreeing to make referrals and share information rather than see someone just leave the region altogether. So if a particular client comes in that is interested but just doesn't see a fit in that county, then they can say that the county next door might have what they are looking for. It's just a much better picture of the entire region." This is the 10''' year the NCACC has been sponsoring the Outstanding County Programs Awards. Section 56-3.7 (b)(4)' (copy attached) requires each residential unit to pay a development fee in the amount of 5720, when water service is provided. This request is for back up service not continuous service; therefore, Mr. Moore is asking that the development fee be reduced or waived. RECOMMENDED MOTION AND REQUESTED ACTIONS: I recommend that consideration be given for reduction in the development fee unless the demand ,for water becomes full-time. (1) Water service will be supplied to a convenient point near the street right-of-way line, where a meter, shutoff valve and meter box will be placed by the county. Each customer will be responsible for the piping from.the meter box to his house. ' (2) Every effort will be made to locate the meter box in accordance with the wishes of the customer. The customer should. be aware, however, that field conditions may prevent location of meters exactly as requested. Those customers with a preference should attach a sketch showing the preferred location along the property line and/or mark the location conspicuously on the ground at the desired point.- (b) Water service connection fees (tap fees). (1) No existing tap. Whenever an applicant desires water service in a situation where there is not an existing tap, there shall be assessed a fee set from time to time and contained in appendix B. (2) No meter. When an applicant desires water service on a system with an existing tap not installed by or otherwise paid for by the district, without a water meter; there shall apply a fee set from time to time and contained in appendix B. (3) Easic user charges (user fees). User fees shall consist of a fixed fee and. water usage charges for actual water consumed with the applicable minimum water usage charges set from time to time and contained in appendix B. (4) Development fee. A fee shall be imposed on all development connecting to the water supply system, based on average daily flow. The fees shall be used to pay for cost of elevated tanks; trunk lines, and wells. The fee shall consist of an elevated storage component, and transportation facilities component set from time to time and contained in appendix B. The fee shall be paid at the time the building permit is obtairied, to be~determined as follows: a. Residential. A development fee shall be assessed per single-family residential unit set from time to time and contained in appendix B. b. Commercial and industrial. The plant treated the. waste water and discharged it to the Northeast Cape Fear River. The discharge to the river was eliminated and the treatment plant was taken out of service, A special one time facility fee of $10.00 per daily gallon was established to assist in paying the cost of the treatment plant. Since the treatment plant is no longer necessary, consideration should be given to reducing the $10.00 per gallon fee to the standard District fee of $3.75 per gallon for commercial customers.. (1) Whenever the district constructs sewer collection lines into a new service area, all development is required to connect to the sewer within six months of the initial availability of the sewer system. During the six-month period the residential and nonresidential tap fees shall be as follows for a lot on which is situated a structure requiring waste disposal: a. For four-inch and six-inch taps, installation cost shall be as set from time to time and contained in appendix B. Provided, however., a vacant lot for which a sewer tap is installed shall pay the above-reference tap fees regardless whether application is made within the initial six months of sewer availability. b. For eight-inch and larger, installation cost shall be estimated by the district and paid at time of application. Taps for eight-inch and larger only include the actual connection to the collection system. (~1 A.II development shall pay tap fees set from time to time and contained in appendix B, except development which complies with either subsection (a)(1) in this section or section 56-312(x)(2). (b) Basic user charges (user fees). User fees consist of the sum of a fixed fee plus gallonage rate as set from time to time and contained in appendix B. (c) Cost of installation of meters. The cost of installation of meters shall be as set from time to time and contained in appendix B. (d) Facility fee. The facility fee shall be as set from time to time and contained in appendix B. The facility fee will be determined as specified in section 56-312(b); however, the minimum fee will not apply in the following circumstances: (1) Nonresidential development or unit obtaining a certificate of occupancy where the structure is~not new development. (3) Industriai application fee. The industrial. application fee shad be the current city fee plus ten percent (4) Cancellation penalty. The cancellation penalty shall be 20 percent of all applicable fees paid, with a minimum penalty set from time to time and contained in appendix B. (5) 1-40 Business Park sewer improvements project assessment fee. In addition to any other charges, fees, and costs required by this chapter, users connecting to the I-40 Business Park sewer shall be required to pay to the district an assessment fee set from time to time and contained in appendix B: This fee shall be paid in full prior to connecting to the system at time of application of building permit. The 1-4.0 Business Park sewer assessment fee shall not be imposed oh any business that is owned by low- and moderate-income individuals or any residence that is owned or occupied by a low- or moderate-income franchise; as defined by state department of commerce CDBG regulations. Savings Clause. Grant funding in the amount of $155,836 is provided annually to cover the cost of our Pretrial Release program and the Day Sentencing. program. There is no required County match for these funds. The Pretrial Release program is coordinated through the County Manager's Office, while the, Day Sentencing Center is operated through contract with Coastal Horizons. The Pretrial Release program, assisted by a position in the Sheriff's Department, has saved the County hundreds of thousands of dollars through reduced jail cost. .With the rising numbers of inmates this program will continue to be more and more valuable to the County. Without the Pretrial Release program, our jail would have as many as 60 more inmates per day over the current level. The Day .Sentencing Center provides the judges with an intermediate sentencing option for those sentenced to lesser crimes, saving the valuable prison space for dangerous felons. This project will provide much needed enhanced access. to Airlie Garden's waterfront and a setting for water quality based environmental education programs for casual visitors and organized field trips and tours. This walkway will allow all visitors to Airlie to view and appreciate the Bradley Creek waterfront arid the unique coastal/tidal creek ecosystem found there. The project will enhance the visitors experience to Airlie and support the environmental education mission. The original grant. of $56.,250 was provided in 1999 for a one year period. The contribution is estimated at $9,375, which is already in the Airlie Garden's budget for this fiscal year. This period was extended in order for the Airlie Gardens Master Plan to be completed. The grant expires at the end of March, 2002. The project bids are due February 20, 2002. It is necessary to see commissioner approval prior to bid opening in order to complete the project within grant deadlines. RECOMMENDED MOTION AND REQUESTED ACTIONS: Recommend authorization of the County Manager to sign necessary contract with lowest qualified bidder in order to achieve substantial completion within the funding agency's required time frane.
