"~i` ~~m~oltz~~vnu~ March 1, 2000 To: New Hanover Gounty Commissioners From: Bill Atkinson Subject: NHRMC Open MRl Certificate of Need Application On March 15, 2000, New Hanover Regional Medical Center will submit an application to the Certificate of Need Section to acquire a magnetic resonance imaging scanner (MF2i), with open architecture. This will expand the availability of services we provide to the community and surrounding areas. NHRMC has three (3) closed MRI units today. Patients requiring special needs are required to travel considerable distance tb have scans pertormed by an open MRI. Open architectural magnets allow closer monitoring of patients with. a.higher and more acute level of illness, better monitoring of pediatric patients, and imaging of patients with orthopedic problems. There are some procedures, whic}~ are interventional in nature, which can only be performed in an open architecture magnet. From a regulatory standpoint, the State Medical Facilities Plan has identified the need for one (1 }additional magnetic resonance imaging device in Southeastern North Carolina as defined by the State. The Board of Trustees recently approved the submittal of a Certificate of Need application for the acquisition of an open architecture MRI. NC 28401 RE: Recommendation on -Child Support Sirs: ® On March 3, 2000, the New Hanover County Board of Social Services met to hold its annual budget retreat, As part of our statutory duties, the Board considered the operation of the child support program in New Hanover County. . New Hanover County's contract with Corrvantis, Inc.; to operate the Child Support Program will end on June 30, 2000. -Under the terms of the contract, each party must notify the other as to its intention to continue the contract or to terminate the contract no later than Ma_y_l., 2000. The Board reviewed the operation of the child support program under the current contract . We considered the Status Report Submitted for Time Period Ending December 31, 1999, prepared by Corrvantis, and a report prepared by New Hanover DSS staff from information furnished by the State Child Support Office. (Both reports are attached.) We find much cause for concern. It appears Corrvantis will not meet four of the six performance goals established by the current contract and customer service is less than desirable. During the last quarter of 1999 according to Corrvantis' report, the average hold time for.. telephone calls to Corrvantis' centralized customer service center iri Asheville increased from two minutes twenty seconds for the third quarter of 1999 to seven minutes fifty seconds. During the same two periods the total number of callers abandoning their calls rose from 1,307 of _ 32,019 calls to 8,434 of 40,294 calls. Since then New Hanover County DSS has received over 600-calls from New Hanover County_chld support customers complaining that their calls to Corrvantis' operation go unanswered. We are distressed that staffing in the Wilmington office has been reduced significantly creating a loss of jobs in our community. We are also troubled by ~ the fact that Corrvantis, Inc. has failed to pay their local child support attorney, Carter Lambeth, since No_v_ember_1.999.. This failure has serious implications .for the continued provision of child support services in New Hanover County. After careful consideration and in keeping with our duty under North Carolina law and taking into account informal estimates by Corrvantis on the increase in costs for the continued operation by Corrvantis of the program, the Board of Social Services voted unanimously with all members present to recommend the County offer to Corrvantis, Inc., the opportunity to extend its current contract until °December 31; 2000, at a rate not to exceed five percent increase over present contract cost; to recommend the County seek competitive bids for the service; to recommend the Board of Commissioners authorize staff to develop a.Request for Proposals from all qualified providers including Corrvantis, Inca and to direct staff to develop a budget. assuming responsibility for operation of the program to be considered with the bids of other providers. Should Corry.~nti~s_.decline_the~i.x_month_extension, the Board of Social Services recommends that the operation of the child support program be returned to the Department of Social Services effective July 1, 20_00. We note that even by Corrvantis' informal estimates, the DSS can operate the program at a savings of $74,000 to the County. . The impact "Parking Area E"may have on Neighborhood Drainage - The property for the proposed parking area has recently been cleared and not a grass parl~ng area as indicated on the pzoposal. When it rains, it is mud. I fail to see how this area is going to be used without a solid surface. Presently during heavy rains, intersection 1 and 2, as marked on the enclosed map, floods. If a solid.surface lot isprovided or if the area is compressed withgravel, where will it drain? Without drainage, we would also need to consider our septic tank systems. What about dust? ' . Traffic/Safety - To my knowledge there is not another soccer complex in the County that has the entrance to a field through a residential area. For example, Trask Middle School, Hugh McRae Complex, Ogden Field. I have been informed from other soccer organizations that it is the norm to have approximately 15 kids per team. This proposed complex consists of two fields that would which would mean that approximately 60 cluldren would be in the 2 field area at one time. This means an additional 30 cars going down our street for one game per field: If each field had three games in one day, we could be looking at an additional'180 cars traveling.down Rockwell Road in one. day. On game days I would not feel comfortable letting my child visit neighborhood friends with the excess trafiic.(Durina the week of January lOth,2000, the field .goals for field `B" were removed but the access to reinstall these after the hearing is still available.) Parking - According to the plans, the parking area is approximately 200' x.50' and plans to ® accommodate 30 to 40 cars. If every parent drives their child to game and there is one game on each field, where are a total of 60 cars going to park? If there is a 2nd game at each-field, and another .b0 children show up and wait for the ls` game to finish up: so they can play, where is the 2~d group of 60 cars going to park? They are going to park in the street and in front of our homes. Noise - I can speak on this subject from experience since the complex has already been.used and the noise problem was quite evident. The proposed bamer does not work for noise or haclryard privacy for that matter. It is not a pleasant event to sit in your back yard for a cook out and listen to parents and children cheering and screaming for their team. I realize everyone gets excited at games but when the:noise is that loud and that close, it infringes on quality of life at my residence. The plans submitted state there is a tree line with 40' - 50' tall trees separating the complex from the back ofmy property. On paper that may seem fine to some, tart what if there is only 6 or 7 -trees behind each residential property. This is not adequate For those of yort that may have made a site visit to ~riew the foliage separation may have been mislead by the backyard fences. My property line does not end at the backyard fence. IVIy property line extends an additiona130' from my fence towards the parking area. I have taken picttu-es from my property line to show what kind of foliage separation is being provided to the parking lot. The bulk of the foliage separation from my fence to the parking lot is being provided on my property. Restrooms -How can a permanent facility have temporary restrooms. According to New Hanover County Health Department, this group has not applied for a lot evaluation to install a septic tank for this project. This area is extremely wet and may not be stutable for a septic tank system to accommodate such.activities. Cooking -Since this parking area has been cleared, I have observed a person with a pig cooker, cooking behind my home in a wooded area. ~ I work in public industry and see the abuse and neglect the public.impose in public facilities. It is. unfortunate but it seems that people do not take care of facilities as;ifthey were their own. Mypoint being, if the Meeting Area D is sturounded by trees and is used for team cook outs on a regular basis, what kind of protection is going to be pro«ded to my property if the public(team members) does not properly ea-tingtush its fire in this heavily wooded area? In summation, I fail to see how this facility can increase-my property value. We must put up with excessive traffic, noise, nights lights, flooding, parking issues, and lacl of privacy for a facility that the neighborhood can't even use. I.don't feel that our neighborhood and our childrens safety should be compromised for quick-fix due to lack of County facilities. The current trend in the drugstore industry is for the super store. "The typical new store has a footprint ranging from 10,500 to 15,000 square feet." This type of large retail business in the O&I Office and Institutional District is contrary to the intention of the district as a ' transition zone between commercial uses and residential uses. Staff proposes to limit the square footage of drugstores permitted in the O&I Zone to 3,000 square feet. Recommendation #6a from Sharpe's feasibitity study has a new parking structure next to the main library building and a. new, administration building at the corner of Third and Grace Street. Recommendation #6b is a reverse of the first scenario with the new administration building next to the main library building and a parking structure on the corner of Third and Grace Street. The development of this site would provide enough office space to relieve the County's space shortage as well as provide parking for the new Judicial expansion. RECOMMENDED MOTION AND REQUESTED ACTIONS: After review of the recommended options, it is staffs opinion that Recommendation #6a provides the most flexibility with regards to the needs of the Library as well as the Judicial Expansion project. Staff recommends that a change order to the architect's contract be negotiated and Sharpe Architecture be instructed to begin the development of construction documents for Recommendation #6a for development of the site next to the County's main library. Also, it is recommended that representatives from the Library Advisory Board and the Friends of the Library be added to the project review team. The desire to centralize the County's administrative functions along with the increased parking requirements for 500 vehicles necessitated the County to examine the feasibility of various methods to meet the current needs. The course of this study and subsequent analysis of alternate sites has resulted in the development of six alternative proposals based on the following evaluations: The site at 5~' and Chestnut Streets would require a 10-story parking deck to accommodate parking needs and leave no room for an Administration Building. We recommend that the site be used for surface parking. • It is not cost effective to renovate the Annex Building. We recommend that it be demolished and replaced with landscaped surface parking. • The existing Administration Building at 4"' and Chestnut Streets is nearly 50 years old. To renovate the building for an additional 25-year life span will require a total gut andupfit of the building and its mechanical, electrical and plumbing systems. The cost per square foot of this work is approximately $1 S per square foot less than. new construction. If any aesthetic upgrades of the building exterior are added to the renovation, the cost per square foot will be close to that for new construction. We have identified three options for the existing Administrative Building: Renovate to provide 50 percent for the administrative space needs and construct a new 40,000 sf Administration Building on a downtown site. Utilize the building as is, implement ADA upgrades and make repairs as necessary. Additional Judicial Services space needs could be accommodated or it could be leased to the private sector. Leasing the space may require additional code upgrades. Raise the building and develop a landscaped park at that site. • The existing Law Enforcement Center will require extensive interior and exterior renovation in order to accommodate current administrative needs. Due to the type of construction, size and configuration of the building, demolition and renovation of the existing building may be substantially more costly than constructing a new facility while only providing approximately 70 percent of administrative spatial needs in a less than efficient building configuration. We have identified three options for the existing Law Enforcement Center: 1. Renovate to provide 70 percent for administrative spatial needs and relocate unrelated departments to alternative annex locations, i.e. the existing Administrative Building, third floor of the Bell South Building,"third floor of the Library Building, etc. 2. Renovate only to the extent to include 911, Emergency Management and holding for the Judicial Complex., 3. Raise the existing building and build a new Administrative Building and new Administrative/Judicial parking deck to accommodate atl administrative space needs. • We recommend a ~arking deck for approximately 580 vehicles (750 if the City participates) be built between 2"d and 3` Streets to the north of the Library. This will provide the required parking capacity 6 8 for the Administration Building, Judicial Services, and the displaced Library parking. When groups or individuals make reservations to use a facility, the following Rules shall be followed: 1) EXCESSIVE NOISE: It shall be unlawful to violate New Hanover Code, Section 11-54, Article 'III. Noise, hereafter referred to as the "Noise Ordinance." In addition, the County Parks Department Director or his designee may make'a determination that an activity or event is in violation ofNew Hanover County Code, Section 11-57. "Sounds-Generally," Subsection (b)(5), when the volume of suclisound-magnifying device is observed by said designee to be annoying or such sound causes complaints to be lodged by the general public: 2) POSSESSION AND DISTRIBUTION OF ALCOHOL: A) Possession of fortified spirits (liquor) is prohibited from any park facility. Beer and unfortified wine may be possessed and consumed by those in attendance at a reserved event only within fifty (50) feet of the perimeter of the picnic shelter or area where the event is being held. B) Sale of any alcoholic beverage, whether by direct sale or through the price of admission to any event, is prohibited under any circumstances. C) All North Carolina laws relating to drinking age, operating a motor vehicle, or any others are in full effecf on County park facilities. D) Any distrbutio~of alcoholic beverages by tfie sponsors of an event Hoist follow the rules Set forth in the ABC, permit for that event: A copy of a valid ABC permit forthe went shall be su(~mitted at the'time the reservation s made. 3) SECURITY: - Any event which is expected to attract more than two hundred (200) people shall require the filing and approval of a written statement detailing the Security Plan for the event when-the reservation for the facility is made. Department ~.~ t .~_ Director shall have the authority to waive this requirement when it is determined to Q be ~.~- unnecessary. . w' +* r y~ NEW IiANOVER COUNTY PARKS DEPARTMENT ORDINANCES Special Rules. and Regulations In accordance with the New Hanover County Ordinances, Section 13-2, "General Regulations," Subsection (c)(1), the following "Special Rules and Regulations" are in effect: Control of Pets on County Parks: The following rules shall apply to the presence of dogs and other pets on County Parks: 1) Dogs and pets must be on a leash and under control at all times. 2) Dogs and pets are prohibited from entering any park building (rest rooms, community centers, etc.) 3) Dogs and pets are prohibited from any established athletic field or court (i.e. baseball/softball fields, football/soccer fields, tennis courts, basketball courts). 4) Dogs and pets. are prohibited within fifty feet (50') of any children's playground. 5) Dogs and pets are prohibited within one hundred feet (100') of any concession or vending area. 6) Dogs and pets are prohibited for any mass gathering, identified as any planned gathering of two hundred (200) or more people. 7) The owner or person in charge of a dog or a pet on a County Park is responsible for removing feces or other litter left behind by that animal. 8) The owner or person in charge of a dog or pet on County Parks is subject to Sectionl3-4, "Authority of Parks Director to Eject Disorderly Persons;" and Section 13-5, "Penalty for Violation of Chapter." ~~ Paragraphs 2,3,5 and 6 of these Rules do not apply to assistance dogs accompanying persons with disabilities. The scope of work will include: 1) master planning research, 2) garden plant material research, 3) programming, 4) the development and presentation of three (3) preliminary Master Plan options, 5) the development and presentation of a final Master Plan. The scope of services is defned in contract 99-0394 and further outlined in the proposal dated January 28, 2000. These services are to be provided to the County for a fee not to exceed $85,333 plus an appropriate contingency. These policies and regulations are applicable in all situations as described. However, the primary purpose of the Assembly Room is for the meetings, scheduled and unscheduled, of the New, Hanover County Board of Commissioners.. The Board of Commissioners, therefore, reserves the right to_utilize the room at ..any time.. This authority of reservation supersedes all other reservations. ,1. AVAILABILITY: The Assembly Room is available to government agencies and community organizations for meetings or functions deemed appropriate by the County Manager or his designee. Reservations for the room shall be arranged on a first-come, first- served basis. Standing reservations will not be accepted: County government activities have priority over all other activities. 2. USAGE: The Assembly Room and adjacent public space shall not be A used for any unlawful purpose. Persons using the room are subject V to all policies and regulations regarding- County facilities. ~3. CAPACITY: The Assembly Room is located on the second floor of the New Hanover County Courthouse. The Assembly Room holds 225 persons. This capacity may not be exceeded under any circumstances. =~-4. PARKING: Catering services, rental equipment suppliers, etc:,. should enter the parking lot on Third Street, enter the building through the rear entrance-and use the elevator to bring in food, tables, etc. 5. TIMES OF EVENT: The room is available Monday through Friday from 8:00 AM until 10:00 PM. Bookings for Saturdays, Sundays and holidays are considered on an individual basis. Violation of this rule will prevent the lessee from use~of the room in the future. 9. ARRANGEMENT: The Assembly Room is usually arranged auditorium style with approximately 150 chairs. If you will be billing a straight "major medical plan" such as BCBS, Aetna, Seaboard Cigna, etc., you will utilize a HCFA 1500 to submit•a claim fo'r payment. Note that, in some cases, you may first need to obtain a billing provider number from that private insurer in order to be paid for claims submitted. In the event that the insurer does not assign numbers, you should at least ensure that your health department is listed as a registered provider with that insurance carrier prior to submitting your first claim.. 2. If you wish to bill an HMO (BCBS Personal Gare, Doctor's Health Plari, etc.) then your.agency must be listed on their provider panel in order to bill for the service. Each HMO must be separately researched to determirie the requirements and process for getting "listed." .With some HMO's (such as Doctor's Health Plan) you may be able to provide the service, have the patient pay and then the patient submits a claim form to get their money back (you would need to provide them with appropriate documentation of services provided.) There are a number of tasks which remain to be done: - .DMA has agreed to reimburse public health for the "preventive medicine codes" (99384-99387 and 99394-99397); however rates for those codes have not yet been established since DMA has never reimbursed for these codes in the past. - Codes Y2012 and Y2013 will be redefined to include only nurse-managed services (i.e., all components which can be billed using a CPT code will be "pulled out") and once redefined, new rates will need to be determined. Some of you may have heard or heard about comments made by Allen Gambill at the October meeting, of the North Carolina Association of Local Health Directors related to federal legislation which will eliminate the use of our Y and W codes in 2 years. That statement was :based on D1VIA's interpretation of language iri the Health Insurance Portability and Accountability Act passed in 1.996. In case their interpretation is correct, we are busy exploring .options for addressing this; however,. we are,.in agreement that regardless of that issue, we will implement this crosswalk effective July 1, 2000 as planned to give ourselves the two years to"select the best option, and develop and implement plans to achieve that option. The Medicaid and Managed Care Committee of the,NCALHD has been directed to work closely with state staff to assure a satisfactory solution to this new "problem." Please: note that the federal rules related to this legislation have not been.finalized, so our options are not entirely clear at this point. Finally, we would like to remind you of a critical deadline for local health departments. Once this switch in billing occurs on July 1, 2000; health departments. will have 3 months to rebill denied claims .and/or correct/adjust claims using the "old"`(i.e., current or pre-CPT) codes for services which are . transitionng to.CPT coding. Following that 3 month period, the only way to rebill'will be to go back and review the documentation in the chart, assign the appropriate CPT code and resubmit the bill. In some cases that may result in a~ decrease in reimbursement for that service. Therefore, health departments need to "stay on top of denied claims during this fiscal year and rebill as soon,as possible to avoid having a~`°backlog"~ of denied claims or those needing corrections/adjustments, which will make complying with this deadline difficult.' Dear Mr. Lewis: As you and I have discussed, residents of the Villas at Landfall whose property abuts the Summers Rest Road bike path have asked Landfall Associates to assist them in acquiring the small parcels of land between their lots and the fence through.the County property. The parcels range in size from about 380 square feet to about 7,000 square feet and total 30,463 square feet. There are 15 property owners involved. To accomplish their request, Landfall Associates asks that New Hanover County deed the parcels of land.numbered l0A - 14A , 16A - 20A, 27A, 28A and 30A - 32A shown on the attached map to the 15 lot owners. Currently the County and the property owners each have maintenance problems with the small parcels. County access is restricted due to the tight quarters between the existing fence and.the private property boundaries, The property owners are concerned that the parcels are not part of a regular maintenance program and most do not desire to maintain property they do not own. Transferring ownership to the lot owners should solve the maintenance concerns of all parties. The recommendation of our Commission is that 95% of the repair costs of $135;000 be reimbursed to Wrightsville Beach from'the Room Occupancy Tax.'
