BRIEF SUMMARY: ' The Hazard Mitigation Grant Program property acquisition project stipulates that in order for property owners to qualify for the program they must meet several minimum requirements set by the Federal Emergency Management Agency (FEMA) and the North Carolina Department of Emergency Management (NCDEM). Properties that meet these requirements must be ranked according to an approved prioritization plan. In order to prioritize qualifying properties, a plan which ranks properties according to the following criteria is proposed: 1. Amount of Damage to Structure 2. Repetitive Nature of Flood Events i 3. Property Occupancy Status at time of Flood (Owner/Renter/Vacant) 4. Contiguous.to Qualifying Buyout Property RECOMMENDED MOTION AND REQUESTED ACTIONS: Recommend approving the prioritization plan and signing the attached resolution. FUNDING SOURCE: The Hazard Mitigation Grant Program is funded at 25% State and 75% FEMA. No New Hanover County funds are requested. Stafford Disaster Relief and Emergency Assistance Act that requires each HMGP project be cost-effective (see U.S.C.517c) and; WHEREAS, it is the finding of the State and New Hanover County that exposure to the risk of future flooding is directly related to cost-effectiveness. THEREFORE,-the County of New Hanover has established the following method to prioritize property owners who have expressed an interest in participating in the proposed voluntary HMGP acquisition program in the County. METHODOLOGY Projects must meet the basic requirements as set forth by the Federal Emergency Management Agency and the North Carolina Department of Emergency Management. Each structure is then evaluated based on its exposure to the risk of future flooding and the likely benefit a buyout would incur. The following criteria were considered in prioritizing quantifying properties: 1. Amount of Damage to Structure 2. Repetitive Nature of Flood Events 3. Property Occupancy (Owner/Renter/Vacant) 4. Contiguous to Buyout area Acquisition offers will be made in chronological order based upon the above priority ranking. Homeowners will have thirty (30) days to accept or reject an offer. If the homeowner does not respond within thirty (30) days, funds will no longer be reserved for their acquisition and the offer will be invalid. The subject property is served by private well and septic. B. The site is located in the Winter Park VFD C. Access to the facility will be conferred to the residents of the proposed subdivision. 2. The Board must find that the use meets all required conditions and specifications of the zoning ordinance. A. The subject property is zoned R-I5. and the land classification is Conservation. Community boating facilities are permitted by special use permit in the R-15 zone. B. The zoning ordinance requires that the petitioner must demonstrate that the project will have minimal impacts on water quality, primary nursery areas, shellfish grounds. and conservation resources. (The petitioner has applied for permits with CAMA & the Corps) C. Off street parking must be provided on site at one space per boat slip; or on nearby residential lots. D. The number of boat slips must not exceed the number of residential lots or dwelling units within the associated development. (A subdivision site plan has not been submitted to the Planning Department. The petitioner will submit a subdivision plan based on the number of approved boat slips) E. The right to use the facility must be conferred by an easement appurtenant to the residential project it is intended to serve. F. Commercial activities, including but not limited to the sale of gasoline, oil, marine supplies, and foodstuffs, shall be strictly prohibited. 3. The proposed Community Docking Facility at Fales Subdivision is a 360'-tong, 100'-wide, 6'-deep inland boat basin dug into high ground and connecting by way of a 300'-long, 30'-wide, 6'- deep access channel to the existing channel of the 0}~ster Bay Community Marina and then to the Atlantic Intracoastal Waterway (AIl"VW). The proposed facility will provide docking space for 10 boats and asmall-boat launching ramp all for use by the residents of the intended Fales Subdivision located west of the boat basin. Plans showing this work and the completed application for a Major CAMA Permit are attached to this Assessment. 1.02 Construction. A. Access Channel. The access channel is to be located immediately adjacent to the north edge of the Oyster Bay Marina, such that the channel excavation tivill take place within the "prism" slope of the Oyster Bay basin. In order to limit the impact of this new channel on the marsh and mud fiats to the north it is proposed that, prior to the excavation of the access channel, a retaining wall will be constructed along the north side of the new channel. Excavation of the channel will then proceed, utilizing abarge-mounted excavator, which will transport the excavated material to the shore of the Fales property where it will be spread within the designated high-ground disposal area. Mud and surface sediment will be placed along the north side of the retaining wall to bring that area up to the elevation of the adjacent mudflats. B. Inland Basin. The inland basin will be excavated entirely on high ground behind an earthen "plug" separating the work from Masonboro Sound, All bulkheads, piling, and all other construction steps that can be taken within the unconnected basin will be completed prior to removal of the plug and connecting the basin to the Access Channel. Excavated material will be spread evenly across the designated spoil disposal area and placed as needed behind the bulkheads. Upon completion of all excavation and the connection of the basin and channel, floating docks will be constructed and positioned as slwwn. 2.00 EXISTING ENVIRONMENT 2.01 General. This project is located on and east of the Fales Estate immediately north of the existing. Oyster Bay Subdivision in New Hanover County and north of Whiskey Creek adjacent to the Atlantic Intracoastal Waterway (AI~V<~. The property extends from Aasonboro Sound Road eastward approximately 1900 feet to the mean high water of Masonboro Sound and consists of approximately 11 acres of high ground, none of which contains jurisdictional wetlands subject to Federal and/or state wetland regulations. The land elevation at Masonboro Sound Road is approximately 30 feet above mean sea level and gradually slopes downward toward the east to form a terrace approximately 5 feet.above msl at a point PAGE 1 27 about 600 feet from the shoreline. It is5within this terrace that the inland basin and spoil disposal area is to be located. Existing and past land use is residential. The "terrace" area where the basin and disposal areas are proposed has been extensively used,in the past for a family,°vegetable garden. The existing Oyster Bay Marina north dock is immediately adjacent to the Fales south property line without benefit of any setback. 2.02 Soils. Soils in the "terrace" area are mapped as Lynn Haven poorly drained fine sands; soils at the higher elevations are mapped as Leon poorly drained fine sands 2.03 Surface Waters. The tidal surface waters of Masonboro Sound are located east of the Fales property and the access channel is proposed to be constructed within these waters. The waters are desigriatad as a "Primary Nursery Area" by the North Carolina Division of Marine Fisheries and;,although the waters are designated as "SA", the zrea is closed to shell fishing because of its proximity to the Masonboro Boat Yard Marina. 3.00 NEED 3.01 Private Need This property has been in the Fales family for over 100 years, but the family is now scattered and unable to continue to personally occupy or use the property. In fairness to the remaining heirs, it has therefore become necessary to selt the tract in the form of single family residential lots and equitably.distribute the proceeds., In pursuing this goal, and recognizing the very limited access to navigable water that, is naturally available, it has been determined that there is a clear private need ...for the Fales family to improve the navigable,water access by utilizing some of the property for the construction of an inland boat basin.with a narrow access channel to the nearest (boatable) navigable water. 3.02 Public Need. New Hanover County derives much of its revenue from. the influx-of retirees and others seeking the tranquility of coastal living and the enjoyment of water related sports and other activities. These amenities are best realized when persons are able to locate their residences where-water vistas and access are available such as within the Fales Subdivision as proposed. The public need for this particular project is accentuated when one considers the rapidly decreasing inventory of similar available properties in the area; and, in this case, the very near proximity of high ground to the waters of the Atlantic Intracoastal Waterway. - g.00 ALTERNATIVES ANALYSIS , 4.01 General. This analysis will be limited to the issue of navigable water access. 4.02 Alternative 1: Expansion of Ovster Bav Marina. This alternative has been discussed with representatives of Oyster Bay, the Fales family.and with the Iti'orth Carolina Division of Coastal Management to determine its feasibility, cost, and acceptability. This alternative.involves extending the north dock ~of the Oyster Bay Marina 90'eastward and the south dock 75' eastward to accommodate the dock space needed for the Fales project. Additional dredging would be necessary and would approximate 1500 cubic.yards of material to be removed.. Approximately one-quarter, acre of Public Trust waters would be utilized by the addition to Oyster Bay. This alternative would require the Fales family to enter into a development agreement with the developers of Oyster Bay, the terms of which cannot be clearly determined.. The details of such, a.complicated agreement ,were considered beyond the wishes of the Fales heirs, especially since they all are not located in North Carolina. This alternative, therefore, is not practicable. PAGE 2 28 4.03 Alternative 2: Construction oP Pier and Gazebo. Plans were drawn and considered for the construction of a pier and gazebo for use by the residents of Fates Subdivision. Soundings of the depth of water eastward from the Fates shoreline (except adjacent to the Oyster Bay north dock) was generally less than 1'' at high tide and most of the mud flat is exposed at low tide. This alternative envisioned that the pier would extend eastward from the Fates shoreline beginning at a point greater than 15' from the Oyster Bay property (as stated by CA~IA guidelines} and extending about 150' waterward to a 500 square-feet covered Gazebo. Thie alternative would involve some excavation along the south side of the pier to accommodate small boat docking adjacent to the Oyster Bay basin. The construction of such a substantial pier would involve considerable expense and construction effort, and when completed would not provide sufficient useable boat access for the Fates Subdivision, nor would the esthetics of an exposed mud flat be attractive for frequent use of the pier. • 4.04Alternative 3: Do Nothing to Provide Naviuable Z~'nter Access. The alternative to forgo any effort to improve the navigable water access was considered. This alternative would meet neither the private or public needs as stated above, and is therefore not practicable. 4.05 Alternative 4: (Preferred) Construct an Inland Bo~it Basin and Access Channel. This is the least environmentally damming (to the estuarine resources) practicable alternative that will satisfy the private and public needs that have been identified_ It is the most damaging to the private land owned by the Fates family, but the cost of this damage is clearly offset by the benefits of improved navigable water access and enhanced value to the remaining property. Construction bf the project will be accomplished in an appropriate season and phased so as to minimize and limit impacts to surrounding waters.. At such season as is advised by tl,e N.C. Division of Marine Fisheries, it is planned that construction of a retaining wall along the north side of the proposed access channel will be accomplished first. The top of this wall will be slightly above the elevation of the existing mud flat surface to the north and will serve to prevent the development of aside-channel slope into the mud flat. This wall will be constructed of treated timbers or pre-cast reinforced concrete panels. Upon completion of the wall; excavation of the access channel will begin at the shoreline .and advance eastward utilizing abarge-mounted excavator with capability to transport the excavated material back to shoe where it will be off-loaded and spread on high ground in the .designated disposal area. During the course of this work, suitable muddy substrate material will be deposited on the north side of the wail to bring the level of the surface up to the elevation of the surrounding mud flat. The channel is to be located, insofar as possible, within the northern side-slope of the Oyster Bay basin, thereby minimizing the dredging to about b00 cubic yards and utilizing the retaining wall to eliminate future slope erosion caused by future dredging and boat traffic (from this project and from Oyster Bay}. Upon completion of the wall and channel, the consttuction effort will then focus on the . inland boat basin.. This work will be separated from the tidal waters by an earthen plug, which will remain in place until all excavation, and sidewall stabilization has been completed. The e;icavation wit! be accomplished with a trackhoe or similar excavator, which will place the excavated material on high ground where it will be transported and spread within the designated disposal area. As the excavation proceeds, the installation of treated timber or reinforced concrete bulkheads around the basin will begin and continue until completed. The Final work will consist of the removal of the earthen plug separating the basin from the channel and the installation of the final bulkheads. Floating docks will be broueht into place and secured. `" 5,00 ENVIRONIVIENTAi, CONSEQUENCES 5..01 Chan es in Land Use. The existing and past use of this and neighboring land is Residential. This use will not change. Threatened or endangered plants listed regionally are: Cooley's meadowriie, Rough- leafed loosestf-ife, and the Seabeach amaranEh. A few.square feet of sparsely spaced coastal. wetlands (Spartina alterniflora'~ and Spartina patens) are located at the shoreline in the path of the proposed access channel and will-be ,. destroyed., 'The stabilization of the remaining shoreline will enhance the growth of adjoining marshes and quickly. replace that affected by this work. There are no inland.404 Wetlands onthis site. 5.03 Prime or Unique Agricultural Lands. Not Applicable .. _ 5.04 Public Lands., Not Applicable . 5•.05 Sceniror Reereational Areas. I~To public areas existing: This area will .be:a scenic recreational area for the residents of Fales Subdivision. ~ ,. S.O,G Areas of Archeological or Historic Value. There.are no known archeological sites.on this tract. The Fales house may be of some historicsignificance, and if so, appropriate. steps will be taken to prepare documentation or other records necessary to satisfy all. requirements of the Federal•and/or state.Guitural Resource agencies. The house is not within or will actually be affected by the work that is the subject of the requested permit, but it is within the overall area of the Fales~ Subdivision. 5:07 Air Quality:, No;impact is aniici.pated; 5.08 Ground Wa#er Quality. Some temporary-impacts on ground water.may occur. within the spoil disposal area because of t;he leaching,of salt water through the soils: This impact is expected to be minimal and not unusual since the disposal area, is seasonally subject to exceptionally high tides. The excavated .,materials from the channel wild. have high salinity but will not be deposited directly onto the ground, but will be transported after allowing time for decantation and drainage. .Other soils will not be saline and will not affecGgrourd u,•ater. Tn any,case, the short-term minimal impacts will be localized and not affect- ~ . potable water in the area. ~ • , 5.09 Noise Levels. Noise levels will temporarily increase•during the construction period.: 5.'10 Water Supnlies.;No impact - ~ . 5.11 Shellfish; Fish and:~Vildlife.and Their Rabitats: The channel excavation will affect some scattered shellfish (within this closed area), however shellfish habitat will.be increased and enhanced by the presence of the proposed retaining wall and the .creation of additional rnud flat area to its n.orth_ Shrimp, crab, and .fish habitat will be increased and enhanced by the addition ofphesheltered waters~ofthe boat~basin. Regionallylisted endangered aquatic mammal species are: Finback whale , Humpback whale . Right whale - :. Sei,whale - Sperm whale . ' . West Indiari manatee Endangered fish are. Shortnose sturgeon a Endangered reptiles are: American alligator (threatened) Green sea turtle Hawksbill sea turtle Kemp's ridley sea turtle Leatherback sea turtle Loggerhead sea turtle No suitable habitat for any of these species is present on the site. Some of the aquatic species may visit the offshore waters,. particularly the deeper waters of the AIWW, but no adverse impact on the.species or their hal;itat will occur because of this project. 5.12 Infroduction of Toxic Substances. Care will be taken during construction to assure that fuel or grease spills do not occur from the equipment. The boat basin will not provide fueling facilities and will caution users to avoid spills of fuel or other substances. A "Locked Head" policy wild be in place and monitored for enforcement by the homeowners. 5.13 Eiitrophication of Receiving Waters. The waters in this area are subject to daily tides ranging nearly 4' and this tidal exchange of water within the basin will prevent eutrophication from occurring. S.Id Mitigation or Avoidance of $i~nificant Adverse Environmental Impacts. The design of the access channel with its retaining wall and the phasing of the construction as described in Paragraph 4.OS (above) will clearly avoid the occurrence of significant adverse environmental impacts to the State Waters. Conditions no-tiv are such that continued niaintenance dredging of the Oyster Bay basin and/or prop wash from Oyster Bay boats can cause advancement of side-slope erosion well into the Fa!es proposed access channel. The retaining wall will stop that advancement and the placement of suitable organic substrate north of the wall will restore that mud flat area that hae previau_cly been subject to dredging and/or prop- wash disturbance. Most of the land within the City of Wilmington is designated as developed, except for some Urban Transition and Conservation areas. Density may exceed 2.5 units per acre within the developed class, depending upon local zoning regulations. PLANNING BOARD RECOMMENDATION (March 2, 2000) Based on discussion during the meeting and based on the petitioners presentation of a site plan the planning board recommended that the petitioner modify his request to a Conditional Use (B-2) rezoning with uses restricted to those permitted in the B-1 and the 0&I districts. STAFF SUMMARY: The subject property was zoned O&I office and Institutional in September 1996. The petitioner is requesting a change from that request to B-2 Highway Business. As shown on the attached site map there have been several zoning cases along this narrow corridor between Lobos Lane and Carolina Beach Road. As a result of the different zoning requests there are several different zones surrounding the subject site. The northern boundary is.adjacent to CD(B-2') Conditional Use Highway Business added in March 1999 and a small piece of O&I. The property to the south is a continuation of the O&I zone and to the west is R-] 5 residential. The reason there have been so many different cases along this corridor is because it is a transitional area from the developed commercial core at Monkey Junetioti. This existing O&I district acts as a terminus for the commercial development and provides some protection for the existing neighborhoods across the street. Without the adjacent CD(B-2) zone, the subject property does not meet the minimum B-2 Highway business size requirement. The applicant is seeking this rezoning in order to create a mixed use type of project that will provide retail services to support the Myrtle Grove Business Park. While staff supports the mined rise concept this particular location already has the retail component directly to the north aacross Soufh College~Road. With the exception of Monterey Heights to the north which is R-10, the surrounding ' zoning is R-15. The Monterey Heights Subdivision was completed over 30 years ago. The property directly adjacent and to the west of the petitioners site is'zoned. R-15 residential and.is part of the Tidalholm Village at Tidewater Plantation. Several of these adjacent lots were platted in 1995. The Trip Generation Manual, 6"' Edition, published by the Institute of Transportation Engineers (ITE),.contains tables, rates and equations'that provide projected volumes based on specific land uses. The Trip Generation; Version 4;aoftware, developed by Microtrans based on ' the information in the Trip Generation Manual, was used to determine the number of trips gener- ated by a portion of the proposed special use permit. In my discussions with. Most roadways experience two peaks; one in the morning; generally between 7:00 and 9:00 AM, and the other in the evening, generally -~ ` - ~-.:. ~ - between 4:00 and 6:00 PM. The only definitive way to determirie the traffic impacts of this, or any project would be to evaluate how some of the adjacent intersections operate during the peak periods when traffic from the project is added to the existing volumes. This is an elaborate, costly and time-consuming procedure that would require the collection of a significant amount of data. In my experience, given the peak hour volumes in the table above, I would not anticipate any impact on the sur- rounding roadways. In addition, I estimated the amount of traffic that could be generated under the current zoning. The tract consists of approximately 1 I acres zoned RI S and could sustain approximately 29 single-family homes. In my professional opinion, neither use would generate sufficient traffic volumes to have any impact on the surrounding roadways and/or neighborhoods. It is also clear to me that, not only would the uses proposed by the special use permit generate significantly less traffic than the current zoning, the volumes are so small that their impact would be insignificant. Further, even if the traffic volumes estimated to be generated by the uses not contained in the Trip Generation Software are low, they would still be insignificant; especially in comparison to what could be gen- erated under the current zoning. Andy Atkinson S - - SUBJECT: Grant Applications BRIEF SUMMARY: We are beginning to create a lot of activity with Griffin Grant Writers. We have held many meetings with them either in person or via phone to hone in on the most advantageous grants for the County to begin working on. The following have been identified and I have submitted Letters of Authorization for them to begin working on these grants. If we are successful, the County will be able to contain our local dollar investments at the current level, while getting more opportunity for providing better services. The grants are: DOT Job Access and Reverse Commute Competitive Grant, Pat Melvin is working with Social Services on this grant. This will enhance our ability to transport those low income individuals in need of transportation to their work sites. While there is a match required, the dollars we are already spending or have budgeted wilt cover the requirement. Next, the Department of Justice Office of Juvenile Justice Deliquency Prevention (DOJ OJJDP) Juvenile Mentoring Program will fund a portion of the Pathways Program, thereby freeing up State Office of Juvenile Justice (OJJ) dollars to fund other needed intervention programs. The Department of Justice Community Oriented Policing Services (DOJ COPS) School Resource Officers aka COPS in Schools grant would fund school .resource officers in our middle . schools. This is currently being funded by State dollars. If we received the grant, those state dollars could _ be used by the schools elsewhere. The Health and Human Service Substance Abuse Mental Health Services Administration (HHS SAMHSA) School and Community Action Grants are another try at funding a program previously applied for under the Safe Schools Grant initiative. It is amulti-agency effort to work with those youths in our community that need special attention to be able to succeed and stay out of the - criminal environment. These grants are in the infancy stage and no dollar amounts are know at this time. The Sheriff also is asking for approval to apply for a State Highway Safety Project Grant. The grant is ,basically for 2 vehicles and radios for 7 officers. Federal funds on hand are being used for the required ' match. Amount ofthe grant request is $50,341.25, match of $15,413.75.
