The vote by the Board was unanimous. The matter will be heard by the Wilmington City Council June 6th. The wording recommended by the Planning , Board and City Planning Commission is as follows: Policy 4:10 (additional language in bold) Not allowing new dredging activities in Primary Nursery Areas (PNA), Outstanding Resource . Waters (ORW), or Shellfishing Waters (SA), except for the purpose of scientific research, , designed for the purpose of protecting and enhancing water quality, and where supported by sound scientific and technical knowledge. Hanover County permit application, the Field Investigation Report (EF Brooks, December 20, 1999), and my understanding and :interpretation of the policies presented in .the Wilmington-New Hanover County 1997Land Use Plan. ~ ,, The applicant proposes to locate. Mason Inlet 3,000 feet to the north of its present locatior and to dredge the shoaled Mason Creek to provide a sufficient tidal prism to maintain locational stability of the new inlet channel. The location and complete description of the project are in the Field Investigation Report. } . . L~4ND USE CLASSIFICATION: Conservation (Estuarine and Public Trust Waters, Ocean Hazard Areas, and Coastal Wetlands) CLASSlF1CATION DESCRIPTION Conservation The purpose of the Conservation class.is to provide for effective long-term management and protection.of significant, (imited or irreplaceable natural. resources while also protecting the rights or the ,property owner. Management of the areas maybe required for a number of reasons including natural, cultural, recreational, productive orsceriic values. In order to promote the highest and best use while preventing a negative impact on wafer quality, site specific flexibility and creativity is desirable. Generally, estuarine areas of environmental concern (AFC's) as defined by the State of North Carolina and adjacent lands within the 100-year flood plain have been classified as conservation.. Natural Resource Constraints 3.4 Ensure the protection of coastal and federally regulated wetlands that have important functional significance through early identification in the development process. Review of development proposals should seek to ,achieve the hierarchical goals of avoidance, .minirriizatio,n, :and/or compensation. Conservation areas should be preserved in their natural state. The Planning -Board unanimously ' recommends` approval based on the following three conditions. 1) The existing 20' buffer remain undisturbed, 2) The proposed addition must meet the required setbacks of the zoning ordinance unless a variance is granted by the Zoning Board of Adjustment, 3) if a variance is approved by the Zoning •Board of Adjustment; the.addition may not exceed 1,797 s.f., which is the area. proposed on the submitted site plan. Other conditions would remain in place. ~ - STAFF SUMMARY: The existing CD(A-I) District was established in April 1991 to permit a small woodworking shop specializing in outdoor playground equipment. There were three conditions of approval for the original conditional use zone, which should continue to be in effect if this request is approved. The woodworking business only operated for a short time. Between 1991 and 1998 the building fell into a state, of decay and disrepair. In order to operate an office for a communications contractor, the petitioner revised the conditional use permit in 1998. Since the business has been successful, the petitioner is requesting an amendment to the approved conditional use site plan to add 1,797 square feet to the existing building. Although it appears that additional parking is necessary, the petitioner only needs to add one parking space to be in compliance with the minimum parking standards established by the Zoning Ordinance. In order to meet the setback and buffer requirements of the County Zoning Ordinance the petitioner will also need to _ reduce the size of the proposed addition or get a variance from the Zoning Board of Adjustment. In considering this request it is important to note that, the existing building was initially authorized by a special use permit for a convenience food store in June 1976. That business as well as the woodworking business ultimately failed. Staff's lingering concern, which was noted in the 1991 rezoning and again in the 1998 revision, is to assure that the rezoning does not lead to further erosion of the AR District on this side of North Kerr: There is a large enclave of residential uses to the south and east of the subject property. To the south is a series of single family lots fronting North Kerr. To the east is a large mobile home subdivision known as Glynwood. In the previous rezoning, the Planning Board noted that the existing non-residential structure and its proximity to North Kerr and the Wilmington International Airport made redevelopment for residential ~~,~,~„w,.,,purposes unlikely,.~It was also determined that being able to control the range of uses and implementing Oki%~~ria'eas es to'mrtigate impacts adequately protected nearby residential uses. Protection is crucial, because ' too'~m ch~expari'sion could lead to a quick deterioration of the housing stock. However, given the history of the?.unsuccessful commercial activity on this site it is also important to retain this us'e. The NHCO Planning Department has been concerned and involved with ntunerous problems that have existed and plagued the Seabreeze Community for many years, as evidenced by the aforementioned Seabreeze sfiidy. Since that study the.area has continued to deteriorate, dwindle, and decay.The community has served as a dumping ground for outsiders onto many properties owned by uninvolved, absentees. One sign of a dying community is the lack of children, which is evidencedby the very few seen standing at the school bus stops. The study identified and categorized 4 major issues and concerns, including housing conditions and waterfront development. On a positive vein for the community, a recent major clean up and revival effort has been initiated and undertaken by the Seabreeze Coinmtulity Association. This corrunittee was formerly known as the Seabreeze Revitalization Committee, formed as a result of the Planning Department's decision to ~~ develop a plan for the area, and to enhance the community's image. Notable results of this unified effort is apparent and has been inspirational and encotuaging to the community. The Turtle Beach subdivision encompasses approximately 7 acres and is located between Scout Camp Hatila Road and Myrtle Grove Sound. The zoning density regturement allows for . up to 2.5 units per acre of either. single or duplex tulits. However, in keeping with the current concerns of New Hanover County, lot sizes have. been vohultarily increased for lower density, to enhance privacy and to preserve as much green space as possible: The... community and pier is intended to . help improve and stabilize the Seabreeze area and enhance the economic development and increase the property values. Currently there are 24 lots/homeowners .but only 14 boat slips. The proposed addition would add 10 slips for a total of 24. Expansion of the docking system from 10 to a total of_26-slips .was previously authorized by CAMA Permit Number 147-91. Only 4 of the additional slips were constructed at that time given .the current total of 14 slips. The existing and proposed slips are 21 feet long. Boats will be limited to 21 feet in length. Only boats without heads will be allowed. There will be a total of 12 floating fingers 4 feet wide by 21 feet long (7 existing plus 5 new). The main floating dock will be expanded from 6 feet wide by 193 feet long to 6 feet wide by 331 feet long. The number mooring pilings will be increased from 8 to 13. The existing floating dock system will be extended north by approximately 83 feet (6 slips) and south by approximately 55 feet (4 slips). This arrangement will not encroach on the property line corridor on either side. The average water-depth under the system is 4 feet at MLW. No dredging will be required for construction or~ maintenance. The system is approximately 500 feet from the edge of the AIWW at the closest point. The floating system is accessed by a ramp and fixed pier which extends approximately 16OO~feet across open water and marsh areas to the MHW. STAFF SUMMARY The petitioner is requesting a B-2 Highway Business Rezoning. The subject property is currently zoned R-15 Residential and B-2 Highway Business. The residential portion of the site is occupied by a mobile home park and the commercial portion has several different commercial , businesses. The surrounding zoning is a variety of residential and commercial. The adjacent parcel to the~south occupied by the Ogden Baptist church is zoned R-15. The adjacent Planters Walk , subdivision to the west is zoned R-10 residential and the remainder of the surrounding zoning is B-2 Highway Business. The B-2 parcel directly to the north is occupied by Jones Seafood.and the large B-2 parcel to the west directly adjacent to the Coastal Carolina Subdivision is currently vacant. The most important factor affecting the rezoning of this site is traffic. The intersection of Market Street and Middle Sound Loop Road has one of the highest traffic counts in the county. It is critical for a road connection to be made through this property to provide better and safer access to Market Street from the residential subdivisions to the northwest. Several thousand ~, ~ ~-,homes wilheventually be seeking access onto Market Street. The facility was.built with a State grant. After Hurricane Fran damaged it, FEMA paid to have it .rebuilt. Once again, the ` alpine tower is in the wrong place at the wrong time.,.. .. f~ The new jail /sheriff's administrative facility is being built on the Blue Clay Road property, and the access road must go within a few feet of the alpine tower.. It is not possible to operate the tower with it that close to the road. I met, last week, with Margaret Stargel) and Shawn Johnson of Coastal Horizons to gather information about the impact of this situation on their operations now and in the future. They provided me with information showing that the cost to relocate the tower will be $35,320. Coastal Horizons does not have the funds to pay for this relocation. They respectfully ask that the County pay for this relocation as part of the Jail /S'heriff's Administration cdpital project cost. If this is not acceptable to the Board, an alternative could be for the County to enter into an agreement to fund the cost, and allow Coastal Horizons to pay the County back over a number of years. The long term plan for the course is to work with our Parks. Subsequent research by Coastal Horizons Adventure Programs staff revealed that the tower could not be moved intact due to the power lines that run adjacent to the Juvenile Detention Center and would have to be disassembled and moved in pieces. Blanchard SUBJECT: Letter of Intent to Participate with the Lower Cape Fear Water and Sewer Authority BRIEF SUMMARY: The Lower Cape, Fear Water and Sewer Authority (LCFW&SA) had their engineer prepare an engineering study providing information on the methods of supplying potable water to the U.S. 421 north corridor. The most feasible method is the construction of a surface water treatment plant. , This water source would replace the well system which is presently be operated by the County for the Flemington community in that area. We had three (3) wells and are now down to two (2) wells due to iron bacteria. These two wells are deteriorating and may have to be replaced soon. The next phase in this process is to prepare sufficient plans and specifications to be able to make application for available grant money. According to Kurt Taube, there are sufficient funds available to finance the project and he feels he has a good chance of acquiring the funds. The key is that everything must be prepared and submitted by September 30, 2000 to be eligible for any funds. The attached letter of intent provides the LCFW&SA with assurance that the County is on board with the Authority in developing a new potable water source. By approving and executing this letter, the County is not committing any funds at this time. The intent is for the project to be totally supported by grant money and user fees. I • ~. This sewer line will serve the River Road area south of Saunders Road, including the Veterans Park Schools. The school system intends to construct a gravity sewer line from the Bellamy School to the Mott Creek Station to take the school off the septic system. This gravity Fine would parallel approximate 2,130 feet of the force main. Staff recommends that the 2,130 feet of the proposed parallel force main not be constructed and instead replaced with the proposed gravity line. This would save approximately $37,000 of cost ~ ' to the schools, and prevent, parallel sewer lines. In order to prevent delaying the River Road Project, staff has already requested and reviewed bids of $163,800 from State Utilities and $109,365 from Thomson and Company who presently has a contract with the County at Veterans Park, for the gravity line. Based on this information, we recommend that Thomson and Company's contract be amended in the amount of $109,365. The District would contribute $37,000, which would have been paid for the force main. The remaining $72,365 will be paid by New Hanover County Schools.. The District may have to pay approximately $5,000 to terminate the State Utilities contract. See attached map for location. Our Legal Department has prepared a letter of agreement with the schools for the money. It appears that the two best alternatives, are (i) an Authority treatment plant in the vicinity of Kosa using Authority surface water and (ii) the Authority purchasing treated water from the City of Wilmington. I have contacted the State of North Carolina concerning clean water bond funds for the project. I am encouraged by my discussions of the possibility of a grant for the project. It is not unrealistic to expect that the project could be fully funded by grants although there will be many other competitors across the state for the available funds. I o have any chance for the grant, the Authority's grant application with preliminary plans, environmental assessment and other related documents for the project must be submitted to the state by September 30, 2000. It is important that the Authority authorize the necessary work relating to the grant at its July 10, 2000 meeting and that the work begin almost immediately thereafter. I, therefore, request that you return the signed Memo of Intent at your earliest convenience so that it will be available for the upcoming Authority meeting. I understand from Wyatt that the County will meet on this on the night of July 10 and that the County's Memo of Intent would not be available at our meeting. I will nevertheless ask the Authority Board to give the necessary approvals to proceed subject to receipt on July 11 of the County's Memo of Intent. The regulations presently state that if an existing platted lot. is too shallow to comply with the 30 foot buffer, then the single gamily structure must comply to the maximum extent feasible and must be limited to a 1,000 SF footprint. The 1,000 SF footprint does not limit the structure to one story. The Town wishes to exempt all previously platted lots from all of These conditions. The Town's resolution states that the imposition of these conditions would create a "significant hardship" on many lots. This issue does not appear to impact development in the unincorporated County. The State asserts that a 30 foot buffer helps prevent non point pollution runoff. RECOMMENDED MOTION AND REQUESTED ACTi0N5• The Board should consider the request from the Town. Box 169 Kure Beac{; NC 28449 June 21, 2000 Chairman Bill Caster New Hanover Board of Commissioners Wilmington, NC 28401 Dear Chairman Caster: As Chairman of the Fort Fisher Restoration Committee, Inc., I am pleased to report to you and members of the New Hanover County Board of Commissioners that the visitor center at Fort Fisher State Historic Site reopened to the public on May 15. The Center was closed in February 1999 for major renovations and upgrades.. Total cost for this project was $450,000. _ A separate $400,000 project to design, fabricate and install new exhibits is also moving forward. Upon entering the visitor center a site orientation panel will include a map of the Federal Point showcasing area attractions. An exciting centerpiece for the new exhibit area will be a fiber optic relief map of Federal Point displaying troop movements and formations during the 1864/65 battles. Other exhibits will include blockade runners, construction of the Fort, weapons and technology and everyday life of the garrison soldiers. Another planned exhibit entitled "Shifting Sands" will describe the loss of the Fort over the years due to erosion along the oceanfront. As you know, these improvements have been anticipated for a number of years and that reality is finally in sight. Exact dates for reopening and dedicating the new exhibits is not yet known because the project contract has not been awarded. When that occurs, we surely want you and other members of the County Commissioners to take part in the ceremonies. Due to several factors, not the least of which is the State's efforts to mitigate flood relief from Hurricane Floyd, some funds we had hoped to use for this project were lost. Site Manager Barbara Hoppe and I would be delighted to discuss this project with you and the County Commissioners at your earliest convenience. The Fort Fisher Restoration Committee, Inc. is a 501 (c)(3) non- profit organization dedicated to enhancing and promoting Fort Fisher State Historic Site. We extend a personal invitation to you and the Board of Commissioners to visit Fort Fisher for a tour and briefing on the renovation project, the exhibit project and the revetment repair project. The repairs to the revetment are due to be completed by July 24 and the entire oceanfront area reopened to the public. Simply let Ms. Hoppe know when you would be available for such a tour and briefing and we shall make the arrangements. Fort Fisher State Historic Site is an important economic engine for the area. The site averages approximately 200,000 visitors each year. It is urgent that we return the site, in its entirety, to the public as soon as possible.
