The New Hanover County Board of Commissioners supports this effort because of the economic , development potential it presents. The cDc has already demonstrated that they have the understanding, and the capability of developing a successful incubator. We are optimistic about the jobs that will be created for the low income community, and the business opportunities that will unfold. As you know, our ordinance requires that sewer. accounts. will be set up in the owner's name. On the surface this often appears to customers as a rigid and ;inflexible policy; since other utilities such as telephone and electricity may be put in a tenant's - name. However, sewer service is a little different from the other utilities in that termination of service for.non-payment results in revocation of the certificate of occupancy and condemnation `~of the property for lack of sewage disposal;. in a case where a tenant reneges on an account ~' which is in their-name the innocent ro owner will . , p perty suffer serous consequences through no ` fault of their own. .. ~ ~ , _ .There is also the matter of mamtaimng a high collection rate. Over the last five years, we have _ averaged a collection rate of 95%. 1'-laving a high transient population in New Hanover County, we would risk lowering that rate by setting up accounts u tenant's names. Many tenants aze ~ _ judgment-proof, and difficult to locate once they have moved. As you know, I have discussed - :. the issue with other local governments around the state on several occasions. If accounts are ,~ ~ `opened in tenants' names, .deposits become necessary, which are an extra administrative;,expense and burdensome to handle. And in a case where ownership of a property changes hands but-the tenant. remains the same, the Water/Sewer District has no knowledge of the sale.. The following paragraph explains the issues the County faces, the policies, and the rationale behind the policies. New Hanover County has approximately 4,000 water and 16,000 sewer customers. The County bills and collects these accounts on a bimonthly basis. Unfortunately,- some of these customers are not timely in the payment of their water and sewer bills. The County, due to health considerations, does not cutoff sewer accounts that are delinquent. As you can see, we have more sewer.customers than water customers. The County has chosen to bill the owner of the property which is collateralized by the property itself, rather than the tenant. This method avoids time-consuming. deposit requirements of the water and sewer user as well as the County's Finance Department. In an effort to accommodate the user, the County has an alternative method whereby the owner of the property agrees for thebill to be sent to and paid by the. tenant. The County does however, hold the owner responsible for the.bill....This exception has worked for many home owners and may serve your needs as well. ~ - if you should have further questions or ideas, please call Bruce Shell, Finance Director for the County.. NEW HANOVER COUNTYBOARD OF COIVIMISSIONERS WHEREAS, the Piedmont Triad Regional Water Authority was formed in 1986 for the purpose of purchasing land, constructing, and operating a water supply reservoir, known as Randleman Lake; and WHEREAS, the North Carolina Environmental Management Commission, in 1992, granted a certificate authorizing the Piedmont Triad Regional Water Authority to use the power of eminent domain in acquiring land for the project and to divert water from the Deep River, as required by G.S. 162A-7 and 153A-285; and WHEREAS, water quality modeling work completed by Tetra Tech, Inc., in 1998,. co~rmed an earlier Black & Veatch, Inc. conclusion that elimination of the High point Eastside Wastewater Treatment Plant discharge from the reservoir would have no significant impact on water quality at the proposed iritake location; and WHEREAS, the U.S. Environmental protection Agency recommends that ~ lake-wide average chlorophyll ~ concentration of less than 25ug/1 and chlorophyll ~ concentration of less than 15ug/1 at the water supply intake should be attained; and WHEREAS, all modeling studies show that Randleman Lake will meet these goals; and WHEREAS, moving the High Point Eastside Wastewater Treatment Plant discharge around Randleman Lake is estimated to cost $28.8 million and would result in eight (8) times as much phosphorous being deposited downstream; NOW, THEREFORE, BE IT RESOLVED by the New Hanover County Board of Commissioners that it is opposed to the relocation of the High Point Eastside Wastewater Treatment. While this was the desired outcome, there were several points during the EMC meeting when :conf.using, misleading or incorrect statements were made relative to various issues , . .. ~- - ~ ~ associated with tfie`Randleman'project: `We believe that it-is important to address these - misconceptions at the earliest opportunity so that members of the Commission and.the general public have a better understanding of the Randleman project. The specific issues that we wish to address are as follows: 1. Downstream impacts of the Eastside wastewater treatment plant bypass - DWQ staff made an unfair comparison of the downstream water quality impacts associated v~rith the Eastside WWTP bypass when they compared the existing condition (a flow of 10 mgd with a effluent phosphorus concentration of 4 mg/I) to the future condition with the bypass (a flow of 26 mgd with an effluent phosphorus concentration of 1 mg/I). Compared in this manner, it is correct that the bypass would result in a reduction in downstream phosphorus loadings as stated by DWQ staff. However, this comparison is off target since it ignores the significant water quality benefit that Randleman Reservoir is predicted to have on downstream nutrient loads. The modeling work performed by Tetra Tech and confirmed by DWQ indicates that Randleman Reservoir will trap approximately 80 percent of the total phosphorus loading delivered to the lake. When this benefit is taken into account, it becomes clear that the reservoir bypass would result in a significant increase in downstream phosphorus loadings. The correct comparison of downstream loads is shown in the table belov/. Based on this comparison, the reservoir bypass would - result in an 8-fold increase in downstream phosphorus loads, not the decrease that was suggested during the EMC meeting. Comparison of Storm4vater Ordinance Requirements -DWQ staff presented a comparison of the stormwater ordinance requirements for Option A (the NRP ,proposed by the PTRWA) and Option B. For Option A, the comparison was incomplete since it only considered the proposed ordinance requirements for the 15 percent of the Randleman watershed that is not currently protected by existing watershed ordinances. Randolph County, Guilford County, Greensboro and Randleman have previously adopted watershed ordinances that exceed many of the. statewide minimum requirements. A complete comparison of the watershed ~ordiriarice. requirements was..presented iri.T.ab1e 11 ,of. he NRP prepared forthe ,;, ,:.: Authority by Tetra Tech. A copy of this table is attached for reference. 3. Comparison of chlorophyll a levels in Randleman Reservoir to other area lakes-DWQ staff unfairly compared the predicted future chlorophyll a levels in Randleman Reservoir to the. existing conditions for Falls Lake. Since both watersheds are expected to see continued development, it seems only fair to compare similar conditions in'each case. Like the proposed Randleman reservoir, both Falls and Jordan Lakes have one or more WWTP's discharging into streams that feed the upper potions of each lake. The plants with the most potential impact-Durham Noiihside for Falls Lake and Durham South and OWASA's Morgan Creek plant for Jordan Lake, are operating with state-of-the-art tertiary controls, and are under strict effluent limitations, similar to those proposed for the Eastside W~NTP. The table belo4v was generated using the BATHTUB model developed for the Randleman Like watershed. !t is based upon the current land use conditions - coupled with the following NRP components: (1) WWTP at 10.5 MGD and 0.2 mg/f P and (2) minor dischargers removed. No credit is taken for the proposed constructed wetlands or the additional regional detention pond that is planned by the City of High Point. Since both Jordan and Falls lakes seem to be meeting all intended uses, we see no reason not to expect similar performance from Randleman Lake. ~4. Surface water quality standards and the Safe Drinking Water Act - at various ..points during the Commission discussion, it seemed that the distinction between NC surface water standards and the Safe Drinking Water Act were not clearly recognized. Chlorophyll a is the major photosynthetic pigment in most algae, and is used as an index of algal density. Excess algal density is undesirable for aesthetic . reasons, for efficient operation of water treatment plants, and for provision of suitable aquatic habitat. Chlorophyll a is not, however, of direct concern for human health and is not regulated under the Safe Drinking Water Act. EPA has also not promulgated criteria for chlorophyll a concentrations for the protection of aquatic life. The chlorophyll a standard that has received so much attention is a North Carolina surface water quality standard. While chlorophyll a is often used as an index of lake water quality conditions, it is believed that North Carolina is the only state which has adopted a numeric water quality standard for chlorophyll a. A few other states (e.g., ~-...Oregon) have. adopted, target values.. Apparently the staff of the Division of iNater Quality in presentations to the Environmental Management Commission has proposed the construction of a $25 minion effluent outfall around Randleman Lake in spite of the fact that technical. modeling and evaluation confirm that the existing point of discharge will riot have adversr+ impart ort the f~TRWA water supply, The primary wafer quality parameter in question is phosphorus. Studies confirm that Randleman take wii(trap about BO percent of the phosphorus discharged to it. Discharge of the High Point effluent to the Lake will result in considerably less phosphorus remaining in the waters of the Cape Fear River when It reaches the water supply intakes of the Authority and the Clty of Wilrningtan. Access to lots is through mutual. easements along. ,lot lines, without dedicated roads. County Tax Appraisal estimates each five (5) acres "homestead" has a value of about Seventeen Thousand ($17,000.00) Dollars. Given that the quantity of parcels and the number of owners has increased overthe last several decades (heir property, partitions, etc.), County acquisition by either purchase or condemnation would be involved. The undertaking is complicated by the fact that, because the lots were originally marketed by mail, many owners live out-of-state. Vita Mr. Jones retired from the Department of Defense (DoD) in July 1996 after nearly 41 consecutive years of service, the last 12 years as a professor at the Defense Systems Management College (DSMC), an agency of the Office of the Secretary of Defense, at Fort Belvoir, Virginia. A military historian and author, he researches and writes books and articles on the Civil War, World War II, and defense issues. The Civil War book Giants in the.Cornfield: The 27th Indiana Infantry, was published by White Mane in 1997_ The book Gyrene: The Life and Culture of the World War II United States Marine, will be published by White Mane in~July 1998. It began as a grant project .from the Marine Corps Historical Center, in connection with the war's 50th Anniversary. Two other books are scheduled for commercial publication by White ,Mane in coming months. Both are WWII German memoirs he has written/edited one of a faculty colleague who was a nine-year Panzer artillery soldier,. Condemned to Die - Condemned to Live (in 1998); the other of a retired member of the Federal Republic government and member of the Hitler Youth, Forget That You Have Been Hitler Soldiers (in 1999}. IInder contract to DoD, he has written the~book Arming the Ea g1 e: A History of U. S. Wea~ions Acquisition Since 1775 (scheduled for publication in 1998). Articles have been. published in national periodicals, the most recent in the journal Civil War Regiments (V. 5, No. 6). His photographs have been exhibited and published. He is scheduled to teach courses and lecture at the University of North Carolina at Wilmington. Through an affiliation with Military Historical Tours, Inc.,~of Alexandria, Virginia, he leads tours to WWII Pacific battlefields. At DSMC he served as Associate Dean of Information; Director, DSMC Press; Director, DoD Acquisition Historical Center (DAHC}; founding Managing Editor (with ultimate responsibility) of the, Defense Acquisition University journal, Acquisition Review Qvarterly;.and speech writer to the general officer commanding the College. He taught nearly 1,300 hours on defense and weapons acquisition matters, and served as advisor and mentor to DSMC's government military and civilian and industry students. He developed the Fundamentals of Systems Acquisition Course as its first director, and conducted numerous consulting assignments to improve the. defense acquisition process. He was a member of the Defense Acquisition Corps certified at the highest level in program management. AND QUALITY WATER SUPPLIES, INC. ~., WHEREAS, Cape Fear Utilities, Inc. and Quality Water Supplies, Inc. (hereinafter "Cape Fear") are North Carolina corporations engaged in the provision of water service with approximately 11,000 service connections to its water systems that serve numerous subdivisions and areas within the unincorporated area of New Hanover County; and WHEREAS, the systems include two elevated water tanks and approximately 170 miles of water lines which. upon appraisal by Dawson Engineering indicates a value of $21.8 million not including additions to the system since January 1, 1996. This appraisal was in excess of $22 million as of July 1, 1996; and, WHEREAS, the County is statutorily authorized to acquire, improve, maintain, own and operate public _water systems within the unincorporated area of New Hanover County; and WHEREAS,'the County desires to acquire these water systems as part of its expansion of the County's water and sewer services to residents of the unincorporated areas of New Hanover County; and WHEREAS, the County is herein willing to acquire these water systems upon such terms and conditions recommended by the County Manager and County Attorney and their staff for approval by the County Commissioners, which acquisition shall be funded by the issuance of tax-exempt Certificates of Participation or Bonds (hereinafter referred to as "COPs"); and NOW, THEREFORE, BE IT RESOLVED BY THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS THAT: 1. Based on the Engineer's on-site observations, on information provided by the Resident Project Representative and on review of applications for payment and the accompanying data'and schedules, the Engineer shall determine the amounts owing to Contractor and recommend in writing payments to Contractor in such amounts. G. The Engineer shall receive and review. maintenance and operating instructions, schedules, guarantees, bonds and certifications of inspection, tests and approvals that are to be assembled by Contractor in accordance with the Contract Documents and shall transmit them to the County. H. The Engineer shall carefully review all right-of-way agreements executed by the County and City and prepare and administer any necessary corrections or change orders to ensure that conditions of these agreements are included in construction contracts, unless the County and City specifically agree to meet certain obligations outside construction contracts. The Engineer shall conduct a review of construction,to determine if the work is substantially complete and a final review of construction to determine if the completed work is acceptable so that the Engineer may recommend, in writing; final payment to Contractor. Prepare Engineer's Certification that the project has been completed . substantially in accordance with approved plans and specifications. K. Prepare record drawings at completion of construction based on Contractors' field documents and information provided by Resident Project Representative. WATER QUALITY ANALYSIS OF NEW HANOVER COUNTY'S TIDAL CREEKS .Imperative for the Studv New Hanover County continues to experience substantial growth in suburban areas during the 1990's. Hundreds of housing developments have been build in this decade. Among many environmental im acts these suburban develo m nts hav p p e e had both direct and indirect effects on the quality and quantity of surface water reaching the creeks and other estuarine waters that nearly sun-ound the county. These effects include increased loadings of coliform bacteria, nutrients, pesticides, hydrocarbons, heavy metals, sediment and fresh water. Previously pristine estuarine waters have been, and continue to be, under the pressure of population growth in the region. Paradoxically, many new residents cite environmental quality as a primary reason for their selection of southeastern North Carolina as a home. The administrative offices of New Hanover County have carefully considered the impacts of development on estuarine resources, however, the lack of data concerning the role of natural processes in the county's estuarine waters and the effects of some development practices on estuarine environments has made the task of maintaining undefiled estuarine environments difficult. Many county citizens including government and business leaders, conservationists, and scientists are concerned that unless sound scientific data can be collected to serve as a basis for informed decisions, the future productivity and aesthetics of the estuarine waters will be compromised. 110 The University of North Carolina at Wilmington, through the Center for Marine Sciences Research CMSR ro oses the continuation of a stud that focuses on develo in an a ~ )P P y P g 2 .. .. ~' ... ~ . Our tidal studies have rovided us with: g q YP P . 3 valuable information on changes in fecal coliforms, nutrients, and. chlorophyll over tidal cycles and on how rain events affect pollutant runoff and tidal creek water quality, particularly in Futch and Pages Creeks. We have also described the effectiveness of wet detention pounds in reducing pollution to receiving waters. Finally, we are continuing to compile information on how creek water quality affects shellfish growth and abundance. Our intent is to continue these studies until each creek is fully characterized, use these data as a basis for special investigations, and provide suggestions for management-related activities. We are pleased to announce that we have produced a comprehensive report on four years worth of data. This report has directly linked water quality with land use practice and provides a series of recommendations to improve water quality. This report has found wide acceptance among the public; the regulatory community, and scientific community. Scope of Work Scientists associated with the Center for Marine Sciences Research will conduct a study of the physical, chemical and biotic aspects of water quality of four major tidal creeks next to the Atlantic Intracoastal Waterway, namely Howe, Bradley, Pages, and Hewletts Creeks. Two major foci of the study include: , . 1. Physical, chemical and biotic description of the creeks 2. Analysis of similarities and differences in creek parameters The physical, chemical and biotic description of the creeks has been conducted from 1993- 1998 with each calendar year providing a framework for collection of baseline physical'; chemical and biotic data for the creeks under study. The first year we studies two creeks (Howe and Hewletts) intensively while conducting basic monitoring in the other three. The second year F1ut1ch~and Pages Creeks were studied intensively. The physical parameters will include water temperature, salinity and dissolved oxygen. Nutrients-will include nitrate and orthophosphate, and chlorophyll ~ will be used as a measure ofphytoplankton biomass. Ammonia will~also be sampled at selected locations... Fecal Coliform Pollution We will concentrate our analysis of fecal coliform bacteria pollution on Futch Creek. We also plan to conduct selected analyses in stormwater samples. We also have the advantage of our project with the City of Wilmington Engineering Department analyzing the water quality in city drainage systems. ' Pesticide Pollution A number of pesticides, including 2, 4-D, dicamba and acephate are used in area golf courses. We are testing asemi-permeable membrane device (SPNID) as a means of monitoring pesticides in the environment. Variations of the SPMD system are being tested for effectiveness in Howe and Hewletts Creeks (below the golf courses) with the ultimate goal of making practical recommendations for monitoring pesticides. Distribution, Growth and Survival of Shellfish We have monitored bivalve populations in the tidal creek system over the past four years. We have seen significant differences in both species composition and size of organisms among the creeks. Surveys of natural clam and oyster populations will be continued using the quadrat survey ~e~g4i as in the past. In addition, we will utilize clam transplant experiments between creeks of 6 . . Timetable The individual creek study will begin no later than 30 days after this agreement is signed and continue for 12 months. Data will be collected at intervals determined by the principal investigators. Quarterly progress reports will be circulated to all parties and an annual report will be prepared by the project director acid submitted to the funding agencies no later than 14 months following the start of the study. UNCW shall furnish the necessary personnel and other appropriate support necessary to accomplish objectives of this agreement. All fiscal records hall be retained for a period of 24 months after the termination or completion of this project and shall be available to agents of the County. A report summarizing the data collected and the conclusions of the project will be submitted to New Hanover County, and the Division of Environmental Management by October 31, .1999. Monthly progress updates with brief quarterly reports will be made available to assist in identification of pollution types and sources. 6. Fiscal Arrangements. ,The total coasts, including indirect costs, shall not exceed $20,000 for New Hanover County. The University will provide additional funds to cover remaining costs. The County will provide the funds according to a mutually agreed upon schedule following approval of the agreement. 7. Right to Publish. UNCW reserves the right to publish the results of the study in another format. 8. Termination.
