' , BRIEF SUMMARY• . - A group of New Hanover County citizens organized and.requested that the Commissioners form a task force to study public safety issues and environmental issues relating.to the operation of personal watercraft. Personal Watercraft Task Force makes the following recommendations: 1) New Hanover County agrees to . fi.uid and post signs of PWC ordinances. 2) PWC ordinances shall become effective on the day of adoption. 3) Establish a permanent watercraft safety committee to review and implement ordinances and recommendations of the PWC task force and ther water uses and safety issues. Representation of watercraft safety committee shall be as the original PWC task force. 4) The New Hanover County Sheriffs Department shall establish amarine/boat patrol for enforcement of these PWC- ordinances. ' ~ ~ . 7 .~ DRAFT ~; AN ORDINANCE OF THE NEW HANOVER COUNTY 80ARD OF COMMISSIONERS The Board of Commissioners of New Hanover County, North Carolina, does hereby enact Article XV, Personal Watercraft Safety, to be codified in Chapter 12;.~tQffenses, of the New Hanover County Code: ~ ~' Section 12-143. Definition. For purposes of this ordinance, "personal watercraft" means a small, ~_ vessel which uses an utboard mo or an__inboard motor ao~Pr;ng a=wa1"er jet.p.u.~~t~~~--~~-- - sour~ of mot, ive owes and which is designed to be operated by a person sittin sta.ndin or being..towed behind the vessel, rather.than in the conventional manner of sitting or standing Section 12-144. Operator. • ~ ~ ;~ A person shall not lease, hire, rent, operate, or knowingly give permission to operate a personal watercraft on the waters in this County unless the operator is 16 years of age; provided,. however, said prohibition is subject to the following exceptions: . °n, ~, (a) A person between the ages of 13 and 16 may operate a personal watercraft ifhe has completed a boater's safety education course approved by the N. C. Department of Wildlife and Natural Resources, U. S. Coast Guard Auxiliary or National Association~of State Boating Law Administrators, `and is in possession of the certificate at time of operation. (b) A person between the ages of 13 and 16 may operate a personal watercraft without certification if accompanied by an adult age 18 or older. The lanyard of the persohal.wate~craft must be ` attached to the adult. Section 12-145. Reouired Eouipment. - A person shall not operate a personal watercraft on the waters of New Hanover County unless such personal watercraft is equipped with aself-circling device or a lanyard-type engine cutoff switch. If equipped with aself-circling device, such device must be fully operational. If equipped with a lanyard-type engine cutoff switch, the lanyard must be attached to the operator's clothing, body, or personal flotation device. Section 12-146. Speed. In the following specified areas, no person may operate a personal watercraft in excess of headway speed which shall not exceed five~m h~ (a) Within the posted waters of the University of North Carolina at 1/Vlmington Research leased area. (b) Within three hundred (300') feet of posted waterbird sanctuaries or management areas. (c) Within fifty (50') feet of a person in the water or an anchored vessel. (d) Within fifty (50') feet of marsh or shore within the area bounded by the Atlantic Intracoastal Waterway to the west, Masonboro Island to the east, Masonboro Channel to the north, and rolina Beach Inlet to the south (this marsh area is within the boundaries of the Masonboro Island l.1 ~mponent of the North Carolina National Estuarine Research Reserve System). This subsection do not rohibit the o eration of ersonal watercraft in bodies of water less than one hundred (100') feet 'n w•---idth' L ~._. oJ' .. _. (e) Within thirty (30') feet of a pier or dock in the waters of New Hanover County excluding . the waters of the Intracoastal Waterway. (f) Within the New Hanover County waters of the Atlantic Ocean, a person may not operate a personal watercraft at any time in excess of headway speed which shall not exceed five mph within three hundred (300') feet of persons in the water or surf fishermen. Section 12-147. Wildlife. _ • ~ In accordance with N. C. General Statute 113-291.1, it shall be, unlawful for an operator of a,personal'watercraft on the waters in New.Hanover County to chase, harass. est. worry or disturb any wildlife except when .lawfully angling for, hunting or trapping such. wildlife.. Section 12-148. Sale. At the time of purchase, a dealer in personal watercraft shall require the buyer of a personal watercraft to view a safety video addressing safe operation of the watercraft. Section 12-149. Lease. A ersonal watercraft live owner or h I~v . P ry t e r erys agent or employee shall: (a) Postpersonal watercraft regulations; (b) Require all renters to read the regulations;. (c) Require all renters to sign a rental contract, containing a clause stating that the renter read and understood all applicable safety regulations; and ` (d) Require all-renters to view a New Hanover County approved video relating to personal watercraft safety operation, Section 12-1.50. Penalties. Any person who shall violate the provisions of this Article shall be guilty of a Class 3 misdemeanor punishable by a fine of not more than Two Hundred and Fifty Dollars (S250.00) or imprisonment for not more than twenty (20) days, in the discretion of the Court, as provided 6y Section 14- 4 of the General Statutes. Falcon fully intends to comply with all Federal and New Hanover County (the "Count}/') rules and guidelines. As a result of our meeting ,and in response to the County's Notice of Technical default dated January 30, 1997, Falcon intends to make the necessary changes to come into compliance with the 30 second limitation on hold time. The next semi-annual proof of performance test should be completed in April. Once the levels were reset in all area amplifiers, normal service was resumed. The disposition of the 5 service complaints faxed to my office since January 2T". is as follows: The Dittmer's -This residence has 5 TV's connected to cable. Their large screen TV was .receiving a Tess than desirable picture. Because there are 5 outlets at this residence ,the signal was attenuated more than the ideal situation calls for, due to the sputter involved. At our fast trip to the residence we ` provided a small .power amplifier for their home. This Geared up most of the problems. However the - CBS station we deliver from Florence SC. does not provide the quality picture as the local ABC 8~ NBC stations , bemuse of the distance from their transmitter site. The Florence station however does provide us with the best possible CBS transmission available to our local tower site. The Stich's -Upon arriving at their home , we found the problem had already been resolved. The problem was the result of an amplifier going into cross modulation brought on b a sudden than a in Y 9 temperature. After technicians reset the proper levels normal service was resumed. In 1983, I supported the Safe Roads Act, which was" passed by the General Assembly, and made North Carolina one of the toughest states in the country in punishment for drank drivers. The Governor's Highway Safety Program, through campaigns such as 'Booze It and Lose It', is working with state and local law.enforcement agencies o make sure we•are . apprehending as many drunk drivers as possible. But, we must do even more. I recently met with leaders from organizations such as Mothers Against Drunk Drivers and Students Against Drunk Drivers, public school educators, top officials in state government and even victims from the recent drunk driving accidents in Charlotte and Winston-Salem. The strike force would operate under authority of the Chief Justice of the state Supreme Court and would be run by the Administrative Office of the Courts. ..Take Repeat Offenders Vehicles • Allow arresting officers to seize a suspected drunk driver's vehicle at the time of arrest and hold it pending trial • Require judges to take the vehicle if driver is convicted of drunk driving and was driving the vehicle with a revoked license from a previous DWI conviction. • In cases where the offender was driving someone else's vehicle, allow that owner to petition the court for return of the vehicle by showing with clear and convincing evidence that they did not know the offender's License was revoked. Increase Jail Time and Revocation • Mandatory jail time for repeat convictions for driving while license revoked. • Increase jail time from 7 days to 60 days for offenders convicted of second DWI offense within 3 years. • Increase from 10 days to 30 days the amount of time a suspected drunk driver's license is revoked upon arrest. Based on information provided, the total fee would be a $1,11 ~ impact fee and a $446 development fee, for a total of $1,561. The sewer lines serving the Porters Neck area were constructed by the Porters Neck Company under contract with the County. The impact fee is the amount the County would normally charge. The development fee is an additional premium that must be paid because the line was constructed to allow the Porters Neck development to receive sewer ahead of schedule. Under this contract, Porters Neck would receive fifty-six percent ($250) of the development fee. They have agreed to waive their portion. The County would receive the $1,116 impact fee and the remaining $196 development fee; for a total of $1,311. The General W&S capital project fund is being established to track water and sewer purchase/construction contracts that are not large-enough to constitute a separate project but require ~, a period of time for completion that is greater than 12 months or a fiscal year. The ordinance is being established with two contracts which have previously been approved by the County Commissioners. The first is Contract n 96-0452 with Landmark Developers, et al in which - an 8" sewer line will be constructed from the Tidal Holm Pump Station to the Motts Creek Pump Station. The project will require 18 months to complete with a cost of 5100,000. The second is Contract # 96-043 in which the County Commissioners approved on January 21, 1997 to spend 510;000 for the construction of a 400,000 gallon water tanl: with Conoco, Inc. This contract will ~, not be completed within FY96-97. ' I hope this fully explains our position for establishing a new capital project ordinance (fund). Contact: Andy Atkinson .SUBJECT:' Criminal Justice Partnership Program Continuation Grant 97-98 ` BRIEF SUMMARY: .~ This grant has provided funds to operate the County's Pre-trial Release program and the Day Sentencing . Center. Both programs work with the rest of the criminal justice system to provide alternative punishment s for those less dangerous offenders. With the pre-trial release program, valuable jail space is maximized. For the current fiscal year this pre-trial program has saved over 6,000 jail days worth of space, saving approximately $35,000 so far. The Day Sentencing Center provides many programs (GED, anger :management, NA, AA, etc.) to work towards rehabilitating offenders. Our number one target for this program is felony probation violators. The DSC is operated by Coastal Horizon's. The grant is for $155,836. The pretrial .release program costs $30,836 and the Day Sentencing Center budget is $125,000. ~. . Three (3) formal bids were received for the management and operation of the of the system on February 21 ~`. The bids were reviewed by the Executive Committee of the New Hanover Transportation Advisory Board. Two(2) of the three(3) bidders was deemed responsive to the request for proposals. Those firms were Progressive Transportation Services of Asheville, NC and Yellow Cab Company d/b/a Professional Transportation Services, Inc. of Wilmington.. Both firms were determined to; be responsible-bidders: Both firms proposed the same per mile charge for services. Yellow Cab's proposed per mile' cost was $1.15; which includes a 5.05 surcharge which is refunded to the County to cover the cost of services and assist in provision of local matching funds for capital purchases:. Progressive Transportation.Services' proposed per - mile cost of $1~.15.included a $.0250 surcharge amount... Progressive .Transportation Services received the highest ratings in review of Technical Criteria. Thus, the Committee determined that Progressive Transportation Services was the most responsive bidder. - Since; contract award is a^decision made by the Board of County Commissioners, this item. will be included on the Board of County Commissioners Agenda for March 24`h.
