NEW'HANOVER COUNTY ~ ~ ', BOARD OF COMMISSIONERS ~~ WHEREAS, the Town of Kure Breach; North Carolina;.~has been.designated the- lead: agency in the 3.2 miles project for Public Beach Renourishment known as the Carolina Beach and Vicinity - Area South; Hurricane Wave and Shore Protection Project; and , ,. WHEREAS, the Town of Kure Beach h"as obtained over 90% of the perpetual` easement and right-of--way over and across landowner's property in Ku,~e Beach and oufsde`the town limits i;n~the extraterritorial limits of Kure Beach that lies in New Hanover County; and - ` ~ ~~' WHEREAS, these easements are located between the LAMA Line and the Atlantic Ocean, there still remains ten property owners in Kure Beach and five property owners in New Hanover County that refuse to voluntarily participate in this program. . .NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of New Hanover County hereby approves and designates the Town of Kure Beach as the lead agency in this project and to proceed to~ take whatever legal action: or recourse under law to obtain the necessary easements required to construct the Beach Renourishment Project in order to preserve public safety; welfare and property rights. Copley, County Attorney ~~"'''/~ RE: Beach Renourishment DATE: March 4,.1996 The Town of Kure Beach, as part of the Corps of Engineers beach renourishment project, has been acquiring necessary easements from oceanfront property owners over the past year. You may recall this undertaking was discussed at the May 15, 1995 Commissioner's Meeting. The project area includes some tracts in the unincorporated County adjacent to the~Town. All but 15 property owners have now given the necessary easements. Five of the hold-out tracts are in New Hanover County. Pursuant to its extraterritorial condemnation powers, the Town intends to initiate action involving the five parcels. The Town will perform the condemnation rather that the .County because Countizs do not clearly have eminent domain authority to quickly acquire easements for such purposes. The Town will either bear ensuing expenses itself qr seek reimbursement from the Room Occupancy Ta.Y Beach Renourishment Fund. Town Attorney, Andy Canoutas, will prepare a proposed Resolution of Support for the Commissioner's consideration at the March 18, 1996 meeting. North Carolina is actively pursuing the German market to increase international visitation with part of,a $5 million dollar budget funded by DOT. The German residents of New Hanover County are an.~ious to participate and establish connections both historically and culturally. They have pledged to match funding in developing this project. Total legal fees will be $500 and we are also requesting a commitment of $300 toward the start up fee. Gay Hieb representing the German communitywill .present the proposal. I was among the first peoples to recognize that job training needed to be incorporated into the public assistance (welrare) program, which I saw as more of a woman's issue than a man's. I also reported and wrote about date rape before the term and .extent of which existed . Thus , I have been on the forefront of these and other women's issues. I starte3 Virginia Woman magazine for a number of reasons but mostly because I felt that women needed a media vehicle which was produced by women for women. I also hoped to help women to ..learn about themselves especially in regard to how to recognize and Q celebrate their and other women's accomplishments.. In operating Virginia Woman it became obvious that there are s multitude of women's issues that need to be addressed and I would like to have a hand at. once. again, crusading such issues as women's health and safety, financial equality and independence through empowerment. I have worked diligently as a homemaker,' mother, social worker, volunteer and business owner and have come not only to ,~, recognize the different tasks that women take upon .but also the problems that may ensue within each of.t~ese. tasks and have successfully worked towards rectify some of the problems. Also attached is a copy of the memo to the County Manager concerning the request for the proposed project to be located of the intersection of Highway 132 and 117. RECOMMENDED MOTION AND REQUESTED ACTIONS: Staff does not recommend allowing a privately owned and operated wastewater treatment discharge into the District's effluent line for the following reasons: A. Sets a precedent for additional privately owned operated plants to come on line. B. Complications which may be associated with the transfer of the NPDES permit to the new Northside treatment plant. C. Overall complications and potential liability associated with accepting discharge from a privately owned and operated treatment plant from which the County does not control. The Contractor further agrees that when agreement on implementation of any of the above mentioned items is reached, the details of such an agreement sha11 be reflected in a Worksharing Agreement whose, effective date will run consistent with the effective dates of this contract. Upon execution, the Worksharing Agreement dated September 1, 1995 is herein incorporated by reference into this contract. C. For Charges originally received by the EEOC and/or to be initially processed by the EEOC, the FEPA waives its right of .exclusive jurisdiction to initially process such charges for a period of 60 days for the purpose of allowing the EEOC to proceed immediately with -the processing. of such charges before the 61st day. - In-addition, the EEOC will initially process the following charges: -- All Title VII charges .received by the FEPA 180 days or `mere after the date of violation; --Concurrent Title VII/EPA charges; -- .All charges against the FEPA or its parent organization where such parent organization exercises direct or indirect control over the charge decision making process; -- All cha=ges~filed by EEOC Commissioners; -- Charges also covered by the Immigration Reform and Control Act; -- Complaints referred to EEOC by the Department of Justice, Office of Federal Contract .Compliance, or Federal fund-granting agencies under 29 CFR § 1640, 1641, and 1691. . -- Any charge where EEOC is a party to a - Conciliation Agreement or a Consent Decree which, upon mutual consultation and agreement, is relevant to the disposition of the charge. 'Such.: variations shall not ~-be inconsistent with the objectives-of•this Worksharing Agreement or the Contracting Principles.- .. C. Each Agency will on a quarterly basis notify the other of all cases in litigation and'wll notify each other when ~` a new suit is filed. As charges are: received by one •• Agency against a•Respondent on: the other.Agency's litigation list, a copy of Ghe new. charge will be sent to -' the other Agency's litigation unit within five working days. - s~ ~I IV . EXCHA:tiGE OF INFORMATION A. Both the FEPA and EEOC shall make available for inspection and copying to appropriate officials from the other Agency any information which may assist each Agency in carrying out its responsibilities. Such information shall. include, but' not necessarily be limited to, investigative files, conciliation agreements, staffing information, case management printouts, charge processing documentation, and any other material and data as may be related to the processing of dual-filed charges or administration of the contract.- The Agency accepting information agrees to comply with any confidentiality requirements imposed on~ the agency providing the information. With respect to all information obtained from EEOC, the FEPA agrees ,to observe the confidentiality. provisions of Title VII, AREA, EPA, and ADA. B. In order to expedite the resolution 'of charges or facilitate the working of this Agreement, either Agency may request or permit personnel o~f the other Agency to accompany or to observe its personnel when processing a • charge. • V. RESOLUTION OF CHARGES y A. Both agencies will adhere to the procedures s.et out .in EEOC's Order 916, Substantial Weight Review Manual, and the State and Local Handbook. B. For the purpose of according substantial weight to the FEPA final finding and order, the FEPA must submit to the EEOC copies of all documents pertinent to conducting a substantial weight review; the evaluation will be designed to determine whether the following items have been addressed in a .manner sufficient to satisfy EEOC requirements; including, but not limited to: 1. jurisdictional requirements., 2. investigation and resolution of all relevant issues alleging personal harm with aopropriate documentation and using proper theory, 3. relief, if appropriate, 4. mechanisms for monitoring and enforcing compliance with all terms of conciliation agreements, orders . after public hearing or consent orders to which the FEPA is a party. C: In order to be eligible for contract credit and/or payment, submissions must .meet all the substantive and administrative requirements as stipulated in ~ ~e • Contracting Principles: n D. It is anticipated that some requests for data will require as little as 3 working days to prepare while other requests may take as much a 10 working days to complete. ~, - in general, the requester should allow approximately 5 working days for preparation. To insure that all requests for data are handled in a consistent fashion, a detailed policy that provides adequate guidelines for handling these requests is established. To that end, the following policy concerning County data will be followed by each department that receives a request for data. a. HOW TO REQUEST DATA FROM COUNTY. FILES: The fo[Iowing procedure shall be followed by a citizen who wishes to receive computer- based data from the County. The citizen should contact the agency who has primary responsibility for that data and make the request known to the Department Head. Example: If the citizen needed some tax information on his/her property, s/he should call the Tax .Department and make that request. The .Department Head will then follow the procedure describedbelow to process the request. - ~ ~ b. RECENLNG-REQUESTS. FOR County DATA: The responsibility for ~ handling public requests for County data is assigned to the department that is the prirnary user ("owner') of that data. When a request for data is ' received, the Department Head shall .insure that the top portion of the "" attached re uest form is com feted and si ned b .the re uester. Nc Brunswiek Plant Taken Qt~Line For Repairs T'o Service Water Pumps oth Units of Carolina Power & Light Co.'s Brunswick Nuclear Plant have been B taken off~line to repair an inter~aal component of the service water putaps. Service water .pumps provide cooling water when, the nuclear reactors are shut down. The pumps acre currently operating and performing their function, shut because of corrosion to bolts in one of the components inside the pumps, they do snot aaeet operating license requirements for operation of the plant, said Brunswick Vice President Bill Campbell. As a result, said Campbell, boat units of the plant were taken off-line Sunday night for replacement of the bolts. The replacement is expected to take several days. During this time, CP&L's other electric generating plants will. provide the electricity to replace the power that Brunswick normally produces. ~ ~ ~~ "Last week,. as the result of investigation into the failure of one of our pumps, corrosion was found irY some small bolts internal to the pump, Campbell said. "This corrosion was determined to be caused by the use of incompatible metals in the bolts and the pump. After disassembly of other similar ;pumps showed the same type of corrosion, a decision was made to remove the plaint from service to correct tho problem." Service water pumps provide coolir-g four a number of plant functions dur~ g normal operation. Eaciz unit has five service water pumaps. Goofing for the s down units is being provided. by some of the pu;~aps while others fare being refurbished. and retu~oied to ser'~ice. Since both units were being taken out of service,.. plant operators declared a discretionary Unusual Event, the lowest level of emergency classification, at 7:20 p. m. Sunday.
