Dolan Award.° Frank has'-been instrumcntal•in-many activities this year for the~fire department. He.was the co-recipient of the 1995 Efficiency Award for this department. He was promoted to the position of Assistant Chief this year after serving as' Captain for the last several years. He--has- assisted with the training of this department and other departments as a certified instructor with the NC Fire and Rescue Commission. Frank has also developed a countywide firefighter .accountability system,adopted by the volunteer fire departments in New t~anover County. This accountability system will be implemented' durinb 1996. As a member of the New Hano~cr County Incident Command Committee, he assistcd,with the redevelopment of .the .document to allow easier understanding during the past year. Bruner Page Count In Agenda Package: Contact: Dexter Hayes Presentation by Zoe Bruner, Division of Coastal Management, to Congratulate the County on the Planning & Management Grant Awards for the Cape Fear River Corridor Study and the Wilmington/New Nanover Land Use Plan Update BRIEF SUMMARY: The Division of Coastal Management/DEHNR would like to congratulate New Hanover County on the recent Planning & Management grant awards. The Cape Fear River Corridor Study is a multi jurisdictional regional study to develop a comprehensive, proactive, regional plan that will address the variety of development pressures on the river corridor. The project is a cooperative effort between New.Hanover County, Brunswick County, the City of Wilmington, and the Downtown Area Revitalization Effort (DARE). Funding for the study includes $60,000 from DEHNR/Coastal Management, $15,000 in local matching funds, and $30,000 in transportation planning funds from the NC Department of Transportation. The Wilmington/New Hanover Land Use Plan Update is a joint long-range planning effort undertaken at approximately five year intervals by the city and county. The fast phase of the update (7/96-6/97) begins _this year with the preparation of technical and background documents, including reports on population, economy, existing land use, environmental resources and others. The second phase (7/97.-6/98) will be the study of future land use needs and the development of policies for growth and development. The road is located between East Brandywine Circle and Whimsy Way in Providence (see map). Engineering has requested that a 20 ft. Portion of the 60 ft. Right-of--way be reserved .and maintained by the County for future utility purposes: The balance of the right-of--way will revert to the adjoining landowners. The County needs an easement across the front of the property identification as "F" on theattached map. The property owner has agreed to grant the easement if Watercrest Street is closed. Watercrest Street is a dedicated street,. however, it has never been built. The property is very wet and is not suitable for building upon. -The County has an agreement on the other side of Providence Subdivision with developer Hall Paynter for the construction of a connector road to Timbercreek. The road stub document was recorded several dayslater in the County Registry. July 26, 1989 The TRC considered and approved a request by Robert Goslee and Associates for Par Associates not to improve and connect Whimsy Way in Providence and Watercrest Street in Brandywine. The Committee's rational for not requiring the construction or connection of both roads was based on wetland concerns. The right-of--way was retained for future access. The TRC did require that a temporary turn-around be created at the end of Whimsy Way for emergency purposes. . April, 1990 '' Providence-Phase 2 was.approved bringing the total number of lots in the subdivision to 126. ~ , L April, 1996 County-Engineering staff requested that the Watercrest Street road stub in Brandywine be . closed to facilitate the creation of a 20 -foot utility easement. Planning Staff Summary Currently, the sub}ect property is split by the B-2 District boundary--approximately .11 acre is • zoned B-2 while the balance of the tract is zoned residential. This division makes it impossible for the owner to fully utilize the site's residential options. For example, even though the total tract encompasses a little over 26,000 square feet, a duplex, which is ordinarily permitted by right, would not be allowed because not enough; of the tract is,zoned R-15. A duplex requires a _ . minimum of 25,000 square feet. The B-2 area reduces the re'sidential' area to just under 22;000 square feet. To remedy that problem, the applicant is asking that the B-2 Zoning line be moved to the eastern property line. In similar situations, the County has granted approval because placing zoning district boundaries along property lines makes it easier to administer land use .regulations and reduces the confusion it creates for appraisal and other tax related matters. In~support of that position, the Board agreed the zoning would be consistent` with nearby zoning and to the ' intent of Land Use Plan to site transitional uses. There was no opposition. Planning Staff Summary The adjacent O-I .zoning district to the north was established in 1994. Though the subject parcel was included in that petition, it was not rezoned. At the time, there were strong objections from other nearby property owners. The greatest impact created by extending the 0-I District_to include this parcel would most likely„ be on residential uses to the south fronting along Oriole Drive. Fortunately; current mitigation measures aimed at promoting transition between competing landuses, such as buffering and ' setbacks, lessen the impact. There have been a number of changes over the years that have greatly reduced the appeal for residential development in this area. The primary change has been the construction of Racine Drive. Its extension from the UNCW campus to Eastwood Road has made it a primary route of travel for nearby neighborhoods as well as university bound traffic. Also, the completion of the first leg of the Smith Creek Parkway has also encouraged greater use of the road. It has also made nearbyland eligible~for higher.densities, which are~probably .more compatible with adjacent non-residential uses. As a condition of approval, the Committee required the developer to provide a road connection to The Lakes at Johnson Farms, a single family high density project located on adjacent property. - - . A previous approval of The Lakes at Johnson Farms in March 1996 included a requirement fora , road stub connecting to Willoughby Park. The original plan for Willoughby Park, which was submitted in September 1995, included a public street that terminated at the property line adjacent to The Lakes. The most recent version of the Willoughby Park Plan submitted by the developer eliminates any connecting streets. Both developers oppose the connection, citing problems with incompatible traffic and the added cost of crossing a drainage ditch. RECOMMENDED ACTION Staff supports the decision of the Technical Review Committee and the need to have multiple access-points to such a large number of dwelling units. Such connections facilitate traffic and pedestrian movements, and the provision of public services, such as transit, utilities, and emergency vehicles. Further, in the 1996-97 budget year, New Hanover County faces a 23 percent increase in the County's share for the Medicaid Program. WHEREAS, as a result of dramatic increases in Medicaid and other social programs, 1.5 cents of next fiscal year's tax rate will be absorbed in the funding of social service programs; and WHEREAS, North Carolina is one of only seven states which requires counties to match 5 percent of Medicaid cost as well as a 5 percent AFDC match. COUNTYAND SHELL ISLAND Responsibilities of the County 1) The County shall have sole authority for all aspects of management, including financing,. design, construction, and maintenance of all projects associated with stabilization of Masons Inlet. 2) The County, at its sole discretion, may re-negotiate the financing arrangements in the third year with SIROA if, in the County's opinion, the actual annual costs over the contract period will be less than or exceed the total contribution of fluids required in this contract. 3) Funds will be contributed from the beach nourishment portion of the Room Occupancy Fund as necessary. Responsibilities of Shell Island Resort Owner's Association SIROA will pay to New Hanover County a required contribution every six months, above and beyond Room Occupancy Tax payments, for use in stabilization of Mason's Inlet. The first four payments will be $150,000 each and will be due every six months, with the first due January 1, 1997. All payments following the first four will be $125,000 and will also be due every six months, with the first due January 1, 1999. Terms 1) This contract will be in effect until July 1, 2008. The contract will be automatically renewed for two year increments if neither the County nor SIROA object. If the County or SIROA wish to amend the contract at the end of the term, then the party seeking the amendment must give notice to the other by July 1, 2007. 2) The contract may be terminated or amended at any time if both the County and SIROA agree. ~, .. .. ~~• :. _ .~ „ 4 ~ ~ ~ .. REQUEST FOR LETTER OF QUALIFICATIONS The Board of Commissioners of New Hanover County, North Carolina, is requesting letters of qualification from engineering firms to provide plans, specifications, inspection and construction management for an emergency sand bag wall structure to protect ahigh-rise building and other property from rapid erosion caused by inlet migration fora 3 to 5 year period. The estimated cost of the project is $400,000. The following describes the project, time schedule for completion and requested services. Project Mason's Inlet is located between Figure Eight Island and the Town of Wrightsville Beach in New Hanover County, North Carolina. The Inlet has a demonstrated history of rapid migration to the south. The Inlet is now within several hundred feet of the Shell Island high-rise resort, a public beach access facility, and the cul-de-sac terminus of a public road. There is general agreement that, if left unchecked, the Inlet could easily reach the resort in six months to one year. Mason Inlet has been moving to the south at a rate of approximately 100 feet per year since 1938, however, this rate of southward movement has not been constant. For example, between 1938 and 1960, the rate of southward movement was approximately 1 SO feet per year. Between 1960 and 1975, the inlet was essentially stable. From 1975 to 1984, the rate of southward movement was only about 25 feet per year. Beginning in 1985, or about the time the Shell Island Resort was constructed, the rate of southward migration accelerated, averaging about 200 feet per year. During the last 3 years, southward movements of 2~0 to 300 feet have been.observed in a single year. At the present time (May 1996) the shoulder of Mason Inlet has moved to within 300 feet of the Shell Island Resort Hotel. The accelerated rate of southward movement during the last decade has been attributed to a reduction in the tidal exchange or flow through the inlet. This reduction in tidal flow is primarily due to shoaling in Mason Creek, the estuarine channel that connects the inlet with the Atlantic Intracoastal Waterway (AIWW). ~ The main flow channel through Mason Inlet is approximately 200 to 250 feet wide with a maximum depth of 10 to 1 1 feet below local mean low water (mlw). The overall width of the ineet, measured between the mean high water (mhw) shorelines, varies from approximately 1,300 feet on the ocean side to around 600 feet at its narrowest point. A conceptual design of a sand bag wall structure has already been developed. The purpose for this preliminary design was to initiate the timely application for a general emergency permit and subsequent variance from the North Carolina Coastal Resource Commission (please see the time schedule below). We will be open to changes in the preliminary conceptual~design if compatible with meeting the time schedule. It is important to note that the sand bag wall structure, to be constructed over the next six months, is an emergency and temporary Phase One measure to protect the resort until along-term permanent Phase Two measure can be designed and constructed over a three to five year period. It is presently anticipated that the Phase II project may be an extensive dredging project to relocate the Inlet at a cost of several million dollars. We will be requesting engineering proposals and will be very open to options. The present project, however, concerns a request for engineering services for only Phase I. Time Schedule The time schedule presented below is very tight due to the need to quickly design, permit, and construct the Phase I sand bag wall structure before the Inlet erosion reaches the resort. June 3 - Board of County Commissioners approves concept of funding the project jointly with Shell Island resort and the concept of the sand bag wall structure. June 4 - Request for Qualifications sent to engineering firms June 8 - Shell Island resort approves funding arrangement June 11 - Deadline for Statements of Qualifications from interested engineering firms June 14 - Engineering firm selected for recommendation by staff June 17 - Board of County Commissioners formally selects and approves contract with engineering firm - Board formally approves contract with Shell Island ~ - Recommended firm makes presentation to Board - Board formally approves selection of engineering firm and authorizes contract. June 20 - Emergency General Permit for conceptual design of sand bag wall structure submitted by County to Coastal Resource Commission (CRC). The permit very likely will be immediately denied. June 26 - Application for variance submitted to CRC July 1 (or before) - Selected engineering firm begins work on final design and specifications July 10 - County agrees on stipulated facts for variance with CRC and submits additional material to CRC for the variance presentation July 25 - CRC grants variance August 1 - County advertises for contractor to build sand bag wall structure based on design specifications from selected engineering firm. Engineering firm will oversee construction. December 1 - Project completed. The County realizes there is very little time available for your response to this Request for Qualifications and for selection of the engineering firm. This short time frame, however, is required by the severity of the erosion problem. We greatly appreciate your quick response. Engineering Services The following services will be required from the selected engineering firm. Assistance in preparing variance presentation materials for July 25 variance hearing Completion of plans and specifications suitable for construction by August 1, 1996. Management and construction inspection. Due to time constraints, only one firm will be short listed from the letters of qualification.County staff will negotiate a percentage fee structure with the firm based upon a range of estimated construction costs. Final approval of the short listed firm will be considered by the Board of Commissioners on June 17, 1996. The firm will present a 10 minute summary of its qualifications and respond to questions from Board members.. The firm must be available to begin work shortly after the contract is approved. The County realizes there is very little time available for preparation of the-letter of qualifications. Firms will be evaluated on experience of the firm in the required disciplines; including sandbag structures; current workload and staff available to perform all functions needed for this project; the pertinent experience of the principal and project engineers that would be dedicated to this project; demonstrated ability in meeting schedules; and, the financial soundness of the firm. The letters of qualifications will be evaluated on content, not form. Representatives from Arcadian and the Department of Environmental Management have been able to initially agree on a contract which will benefit New Hanover County financially, making steam sales as profitable as electrical sales. There are still a few details to resolve which will take approximately thirty (30) days. Unfortunately, the current contract expires on June 4, 1996. At a meeting on Friday, May 24, 1996, both parties mutually agreed, subject to approval by the Board of County Commissioners to extend the current contract for an additional sixty (60) days to allow for final .negotiations and approval of the contract by the Board of Commissioners at a regularly scheduled. meeting. . In an ;attempt to save money, staff rebid the furnishings changing the ,specifications to allow the ,, equipment to be provided to be refurbished equipment. This resulted in a savings of .$50,525.62 from the first bid process. However, the recommended award of $189,225.68 still exceeds the furnishings budget of $164,000.00, by $25,255.68. I am requesting that the.fuiids nec'essary,to meet this shortfall be moved from the Salary/Wages budget line item. The temporary hiring freeze which I implemented in' October 1995 provides us with.. the required funds to meet this obligation..' -This shortfall apparently occurred ,.due to faulty budget estimates provided by Office Showcase and an incorrect count on the number of office cubicles necessary :to relieve the problem of doubled-up staff. This budget will provide 56 new cubicles which will allow us ao place all' staff. in adequate work stations. "' . "Vendor". ~~ WITNESSETH: WHEREAS, County advertised for bids for open plan office system for the Social Services Department, Bid #96-0434, and bids were received and opened as required by law; and WHEREAS, after careful consideration of the bid proposal. submitted by Vendor, the Board of Commissioners of New Hanover County has adopted a resolution authorizing the acceptance of such bid proposal and the execution of a contract with Vendor covering the purchase, delivery and installation of open plan office system, according to Vendor's Bid Proposal No. JA64-98-0311 NOW, THEREFORE, in consideration of the mutual benefits inuring to the parties hereto, said parties covenant and agree as follows: 1. Indemnity. Vendor shall indemnify and hold New Hanover County, its agents and employees, harmless against any and all claims, demands, causes of action, or other liability, including attorney fees, on account of personal injuries or death or on account of property damages arising out of or relating to the work to be performed by Vendor hereunder, resulting from the negligence of or the willful act or omission' of Vendor, his agents, employees and subcontractors. 6. Insurance. Vendor shall maintain insurance from companies licensed to write business in North Carolina and acceptable to New Hanover County, of the kinds and minimum amounts specified below. 7. Certificates and Notice of Cancellation. Before commencing work under this contract, .Vendor shall furnish County with certificates of all insurance required below. Certificates shall indicate the type, amount, class of operations covered, effective date and expiration date of all policies, and shall contain the following statement: z 55 New Hanover County Contract # 96 - 0434 "The insurance covered by this certificate will not be canceled or materially altered, except after thirty (30) days written notice has been received by County". 8. Workers Compensation and Employers Liability Insurance. Covering all of the Vendor's employees to be engaged in the work under this contract, . providing the required statutory benefits under North Carolina Workers Compensation Law, and employers liability insurance providing -limits at least in the amount of $100,000/500,000/100,000. applicable to. claims due to.bodily .injury by accident. or . disease. 9. Commercial General Liability: Including.coverage for independent contractor operations, contractual liability assumed under the provisions of this contract, products/completed operations liability and broad form property damage liability insurance coverage. ~ Exclusions applicable to explosion, collapse and underground hazards are to Abe deleted when the work involves these exposures. The policy shall provide liability limits"at least in the amount of $1,000,000 per occurrence, combined single limits, applicableto claims due fio bodily injury and/or property damage. Coverage shall be written in the amount of one hundred percent (100%) of the contract amount and shall remain in force until t accepted by County. Thy coverage shall be written in the name of Vendor and shall protect the County as its interests may appear. Vendor shall be responsible for any loss within the deductible applicable to this insurance. .The coverage shall be written in the name of Vendor and County and shall protect the subcontractors as their interests may appear. 12. Warranty of Materials and Equipment. Vendor warrants to County .that all materials and equipment furnished under this contract will be new unless otherwise specified, will be of good quality and free from faults and defects, and will conform with the contract documents. 13. Default and Termination. If Vendor materially breaches any one of the terms or conditions. contained in this contract, County may terminate this contract forthwith. Upon termination, County may, without prejudice to an action for damages or any other remedy, enter into another contract for the completion of this contract. County may deduct all costs of completing the contract from any monies due or which may become due to Vendor. 14. Non-Waiver of Rights. It is agreed that County's failure to insist .upon the strict performance of any provision of this contract or to exercise any right ' based upon a breach thereof, or the acceptance of any performance during such breach, shall not constitute a waiver of any rights under this contract. 15. Subcontractors. Vendor shall be fully responsible for. all negligent acts, and omissions of his or her subcontractors and of persons and 4 57 New Hanover County Contract # 96 - 0434 organizations employed by them to the same extent that Vendor would .be responsible for these acts and omissions. Nothing in the contract-documents shall create any 1 contractual relationship between County and any subcontractor or other person or organization having a direct contract with Vendor, nor shall it create .any obligation on the part of County to pay any money due any such.subcontractor or:other person or organization, except as may otherwise be required by law. 16. Assi_ nq merit. The parties mutually agree that this contract is not assignable and shall not be assigned~by:either party without-the written consent:of the other party and the surety to this contract. 17. Non-Discrimination. Vendor will take affirmative action not to discriminate against any employee or applicant for employment or otherwise illegally deny any person participation in or the benefits of the project which is the subject of this contract because of age, race,'creed, color; sex, age, disability or national origin. To the extent applicable, Vendor will comply with all provisions of Executive Order No. . 11246, the Civil Rights Acts of 1964 (P.L. 88-352) and 1968 (P.L. 90=284), and all . applicable Federal, State and local laws, ordinances, 'rules, regulations, orders, instructions, designations and other directives promulgated to prohibit discriminations. Violation of this provision, after notice, shall be a material breach of this agreement and may result, at County's option, in a termination or suspension of this agreement in whole or in part. 18. Familiaritkvvith Laws. The Vendor specifically acknowledges that he has made himself familiar with all Federal, State and local laws, ordinances, rules and regulations, including all federal and State Occupational Safety and Health Act (OSHA) requirements; which may in any manner affect.those engaged or employed in 58 5 New Hanover County Contract # 96 - 0434 the work of the project,. or the materials or equipment in or about such work, or in any way affect the conduct of such work and agrees that he, his employees, subcontractors and suppliers will, at all times, comply with same. If the Vendor shall discover any provisions in the Contract Documents which are contrary to or inconsistent with any such law ordinance, rule or regulation, he shall immediately give notice thereof to the County in writing, identifying any items of work affected, and he shall not proceed until he has received written direction from the County with respect to these items. If the Vendor performs contrary to or inconsistently with any such law ordinance rule or regulation without giving such notice, he shall bear all costs which area consequence of such performance. 19. Notices. Federal Taxes New Hanover County ~s exempt from and will not pay Federal Excise Taxes or Transportation Taxes. North Carolina Sales Tax If bidder is required to charge North Carolina sales tax on bidder's sales, bidder shall not.include it as part of the bid price. County will pay North Carolina sales tax over and above bid prices when invoiced. Price Bidder shall guarantee the prices quoted against any increase for whatever delivery date is specified and contract period required. New Hanover County Social Services, 1650 Greenfield Street, Wilmington, North Carolina and shall be complete and ready for use unless, otherwise specified. The facility is scheduled to be available for delivery of furnishings after July 10, 1996. Delivery of all items shall be coordinated and pre-scheduled with the County. Vendor is responsible for storing all items, at Vendor's expense, until County is ready to accept delivery. Any deviations from specified assembly methods or in function shall have prior approval of County. Instruction i`n Use of Goods ~ ' ~ ~ ~ ~ - . ,. The successful bidder shall be responsible for instructing County personnel in the proper use and maintenance of the goods. ' Acceptance Inspection An acceptance inspection is required. Successful bidder must notify Amy Akin; County Purchasing. Agent, at (919) 341-7190 when the items being furnished are ready for acceptance inspection. Invoices will not be honored by the County without the acceptance inspection being completed. Responsibility of Compliance With Legal Requirements t .. ~ The bidder's products, service and facilities shall be in full compliance with any and all applicable North Carolina building codes, state, federal, local,enyironmental and safety laws, regulations, ordinances and standards or any standards adopted by nationally recognized testing facilities regardless of whether or not they are referred to in the bid documents. 66 I-4 of6 Indemnity Vendor shall indemnify and hold the County, its agents and employees, harmless against any and all claims, demands, causes of action, or other liability, including attorney fees, on account of personal injuries or death or on account of property damages arising out of or relating to the work to be performed by Vendor hereunder, resulting from the negligence of or the willful act or omission of Vendor, his agents, employees and subcontractors. Insurance ® Vendor shall maintain insurance from companies licensed to write business in North Carolina and acceptable to New Hanover County of the kinds and minimum amounts specified below. Certificates and Notice of Cancellation Before commencing work under this agreement, Vendor shall furnish New Hanover County with certificates of alt insurance required below. Certificates shall indicate the type, amount, class of operations covered, effective date and expiration date of all policies, and shall contain the following statement: "The insurance covered by this certificate will not be canceled or materially altered, except after (30) days written notice has been received by New Hanover County." Workers Compensation and Employers Liability Insurance Covering all of the Vendor's employees to be engaged in the work under this contract, providing the required statutory benefits under North Carolina Workers Compensation Law, and employers liability insurance providing limits at least in the amount of $100,0001500,000/100,000. applicable to claims due to bodily injury by accident or disease. Commercial General Liability Including coverage for independent contractor operations, contractual liability assumed under the provisions of this contract, products/completed operations liability and broad form property damage liability insurance coverage. Exclusions applicable to explosion, collapse and underground hazards are to be deleted when the work involves these exposures. The policy shall provide liability limits at least in the amount of $1,000,000 per occurrence, combined single limits, applicable to claims due ' to bodily injury and/or property damage. New Hanover County shall be named as an additional insured under this policy. Contractor's Installation Floater Vendor shall provide and maintain Property Installation Floater or appropriate insurance protecting against loss or damage of the equipment to be installed. Coverage shall be written in the amount of one hundred percent (100%) of the contract amount and shall ,remain in force until accepted by County. The coverage shall be written in the name of Vendor and shall protect the County as its interests may appear. Vendor shall be responsible for any loss within the deductible applicable to this insurance. Because of the uniqueness and incompatibility of the respective open plan office systems available on the market, the County is accepting bids only on refurbished Steelcase Series 9000. Quantity As per the drawings there are eleven (11) 7.5' x 6' (nominal) workstations, forty-five (45) 10' x 8' (nominal) workstations. Colors Paint shall be baked on enamel.
