WHEREAS, the-Board of Commissioners of New Hanover County recognizes that religious liberty and religious expression are among the most fundamental rights granted to citizens of the democratic governments of the United States of America and the State of North Carolina; and WHEREAS, organized religion contributes greatly to the strength of the fabric of our society, and WHEREAS, respect for the sanctity of all places of worship is essential to ensure that religious congregations carry out their respective missions and programs; and WHEREAS, the current rash of arsons and denigration of places of worship, has directly threatened one of the most positive aspects of American life. A local bill was passed by the 1993 Legislature allowing the County to adopt such regulations. Although the .County Commissioners briefly discussed the item in 1993, no action was taken. Regulations could be designed to regulate safe operation and designate areas unacceptable for operation due to such impacts as noise, dangerto swimmers, and environmental impacts to estuarine areas. Damage to Masonboro Estuarine Reserve and Zeke's Island Estuarine Reserve may be of particular concern. Lisa Robertson, a County property owner, has given each of you a packet of information and may be available for a presentation. MINUTES OF REGULAR MEETING, JUNE 7, 1993 PAGE-526 Mr. Andrew Watkins, a property owner on Norwood Drive, requested changing the name oP the road to Bellwood Avenue instead of Bellwood Farm Road. Commissioner Barone agreed with the proposal and emphasized the importance of naming roads one name in order to assist with emergency responses. Vice-Chairman Mathews inquired as to whether Mr. Watkins was ,involved with the survey for the road renaming process? Mr: Wa"tkins reported he was involved,'but after reviewing names, such as Hoot and Holler, he feels Bellwood Avenue would be more suitable. Planning Director Flayes explained the pcoposed modification to . Bellwood Avenue could be approved since only three responses were received from the survey which were as follows: (1) Memory Lane; . (2) Bellwood Farm Road; and (3) Hoot and Holler Road. ' Chairman.Greer closed the Public Hearing. Motion: Commissioner Barone MOVED, SECONDED by Commissioner Caster to rename Norwood Drive to Bellwood Avenue and assign 'new house numbers as recommended by the Planning Department. The floor was opened for discussion. - Chairman Greer hesitated to rename the road without notifying the other property owners. Mr. Paul Grossnickle, a property owner, reported he did respond to the survey for naming the road to Bellwood Farm Road; however, he has no objection to renaming the road to Bellwood Avenue. Discussion was held on the impact of ::his bill upon the municipalities. Commissioner Sisson reported the bill" was introduced to preserve waters adjacent to Ma.son•~oro Island and will not impact on municipalities. Wrightsv.ille.eea:h now regulates jet skis adjacent to tJrightsville Beach."-~ ;County Manager O'Neal reported•once a copy of the bill is received, this item will be placed on the agenda for discussion and consideration. •Opposition-to the Broposed Federal Energy Tax on Local Governments County Manager O'Neal reported on tfie .proposed energy tax th"at does .not provide an exemption for local governr.:ents. REQUEST' FOR BOARD ACTION Meeting Date: 08/19/96 Regular Item #: 6 Consent Item #: Additional Item #: Department: County Manager Presenter: Dave Weaver Page Count In Agenda Package: Contact: Dave Weaver ~_ SUBJECT: Consideration of Paving Gordon Acres Drive BRIEF SUMMARY: Residents of Gordon Acres Drive are petitioning (attached) the Board to pave their road for eventual acceptance by NCDOT. The project would be performed pursuant to G.S. 153A-205 (attached) which allows the County to improve the road and assess all the property owners along the road to recover costs, provided at least 75% of the owners agree, Gordon Acres Drive is approximately 1/3 mile long and would probably cost between $50,000 to $80,000 to improve, depending on engineering and drainage requirements. Staff will present additional information on the costs at the meeting. Concerns about this project include demands on Engineering staff who are already stretched thin and the precedent that will be set by the County taking on a paving project. These concerns will be heightened if similar projects are proposed. He told me the following: . 1) The cost is approximately $120,000.00 per mile. 2) DOT will assist with and inspect the project but will not incur any engineering costs, etc.. 3),A public right-of-~vay must exist. 4) There is a residency requirement of 2 homes per 1/10 mile or a minimum of 4 homes. 5) If the road is private, the homeowners must give DOT a deed for aright-of--way with no encroachments, and a plat must be recorded making the road a public right-of-way. The provisions of this Article, other than G.S. 1~3A-1fi6, G.S. 1~3A-187 and G.S. 153A-190 through G.S. 153A-193, apply to street light assessments under this section. (b) Basis of Assessment. The estimated costs of providing street lights and street lighting shall be apportioned among all benefited property on the basis of the number of lots served, or subject to being served, by the street liQhu, at an equal rate per loc. (c) Amount of Assessment. The county .shall determine the amount of the assessments on the basis of an estimate of the cost of constructing or operating the street lights during the ensuing year, and the board of commissioners' determination of the amount of the assessment is conclusive. In determining the total cost to be in- cluded in the assessment, the board may also include estimated costs of necessary legal service, projected utility rate increases, and the costs to the count~• of administering and collecting the assessment. - ` (d) Procedure. The count~• may approve the levy of street light assessments under this section upon petition of at least two-thirds of the owners of the lots within the subdivision. The request or petition shall include an estimate from the appropriate utility of the charge for providing street lights and street lighting within the subdivision for one year. Upon approval of the petition, the peti- tinning owner or owners shall pay to the tax collector the total estimated assessment amount for the ensuing year as determined • by the count}•. This payment shall be set aside by the county tax office in escrow as security for payment of the assessments. (e) Collection and Administration. The county .shall levy the .street light assessments on an annual basis and shall pay the costs of providing street" lights and street lighting to the atapropriate utility on a periodic basis. Should Animal Control take possession of any animals pursuant to a judicial order, warrant, or administrative seizure by any law enforcement officer or animal control officer, said animal shall be coned at Animal Control or another appropriate facility designated by the Director of Animal Control, for a period of five (~) business days. Prior to the end of the fifth business day of said holding period, the owner must remove the animal to a site acceptable to the Director of New Hanover County Animal Control, pending resolution of any pertinent judicial proceeding. Any animals not removed in accord with the above specified manner and time shall be deemed abandoned. Any such abandoned animal shall become the sole property of New Hanover County, and may be offered for adoption, destroyed or otherwise disposed at the County's election. Any and all incurred costs, expenses and~fees for maintenance, transportation and.care, whether within or outside New Hanover County, shall be the duty and liability of the owner whose animal was impounded hereunder. Should a Court order any injunctive relief permitting the subject animal to remain within the County at the New Hanover County Animal Control Facility or at some other facility within the County acceptable to the Director of Animal Control, the owner must pay all costs, expenses, and fees for maintenance and care on a weekly basis, in advance of the weekly term. Should such costs, expenses, and fees not be paid within two (2) woiking days of the same being due, the animal shall be deemed abandoned and shall become the sole property of New Hanover County. RECITALS AND OBJECTIVES: The City owns certain parks and recreational facilities in the City of Wilmington including but not limited to Legion Stadium, Godwin Field and Robert Strange Park. Legion Stadium traditionally has been used by the New Hanover County Board of Education ("Schools") as a venue for scholastic athletic events. The Schools ot.~n certain athletic.,and gymnasium facili- ties in New Hanover County that have been used in City recreational programs for the benefit of all County resi- dents. Our purpose is to provide emergency communications to supplement government and other volunteer agencies during times of overload and/or. failure. To that end, we have been prepositioning equipment at designated shelters, the National Weather ~ Service (NWS) and Emergency Operation Centers to provide these services when called upon. During our recent encounter with Hurricane Bertha, the ARES network provided twenty-four hour communications with three local shelters, the American Red Cross Emergency Operations Center, the National Weather Service Office in Wilmington, the State of North Carolina EOC in Raleigh, the North Carolina Area C Office in Burgaw and the New Hanover County Emergency Operations Center "'°(EOCj:-During this period we were often the only communications link to the shelters. Up to the minute weather information was provided to the EOC faster than was available by regular means. :New Hanover ARES has more than seventy licensed amateurs who regularly participate in training exercises and drills such as the Carolina Power ~ Light Nuclear Drill this past May. We work closely with the NWS in providing ground truth reports to help forecast the path of severe weather, and ,gather data for the NWS through the SKYWARN program. New Hanover ARES has purchased and installed in excess of 525,000 worth of emergency communications systems in New Hanover County, including three repeaters, one digital bulletin board system and one digital repeater. Antennas have been installed in appropriate locations to afford us wide area coverage. Local industry and citizens have seen the value of ARES over the years and have generated much of the equipment and labor in developing the existing network. Hurricane Bertha showed that our primary voice system (146.670 MHZ repeater). does not afford coverage to several areas of the county. The current antenna is located at a site with an elevation of 200 feet and no emergency power. The simple act of relocating that antenna to a location with an elevation of approximately 400 feet and having emergency power access will allow us to provide emergency communications coverage for the entire county. ~~~~Od~D ~ ~ ~u~ ~ ~ ~sys83 ~~~ NEW HANOVER CO. 6D. At that time the New Hanover County. School Board began funding these positions and contracted with the city to provide said crossing guards. The contract for this service expires this year. Our Board has been noted by our.Attorney, William Hill, that continuation of such a practice places our School System in a very precarious legal position. He states that our Board will incur a legal liability should any accident happen involving- the guards contracted by the school system. Gabriella HEIB, a member of the Wilmington Sister City Commission, informed the Commission that the County had allocated $~00 to the County tourism office for Sister City filing fees for Hanover, GERMANY. As a result, the Chairman of the Commission decided to send a note to Mary GORNTO asking if the City and the County might discuss coordination of what might develop into separate sister city programs. The action was not a judgment on the merits of any initiatives but merely a suggestion that the City and the County should discuss whether coordination would be appropriate. I put this in writing for your attention because we have met frequently during the County's participation in the . City's Sister City Commission programs during the time ~i~hen I was chairman of the Commission. It seemed if the Count}- was interested in coordinating with-the City_ it was a matter for the staffs to consider and was not a matter of protocol.
