2008-03-10 Water & Sewer NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 3 REGULAR MEETING, MARCH 10, 2008 PAGE 276 ASSEMBLY The District Board of Commissioners of the New Hanover County Water and Sewer District met in Regular Session on Monday, March 10, 2008 at 6:27 p.m. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street, Wilmington, North Carolina. Members present were: District Chairman William A. Kopp; District Vice-Chairman William A. Caster; District Commissioner Ted Davis, Jr.; District Commissioner Robert G. Greer; District Commissioner Nancy H. Pritchett; County Attorney Wanda M. Copley; Clerk to the District Board Sheila L. Schult; and County Manager Bruce T. Shell NON-AGENDA ITEMS District Chairman Kopp announced that time had been reserved for anyone from the public to present an item that was not listed on the Regular Agenda. He requested all persons to limit their remarks to three minutes. No items were presented. APPROVAL OF MINUTES District Chairman Kopp called for a motion to approve the minutes of the Water and Sewer District regular meeting held on February 18, 2008, as presented by the Clerk to the District Board. Motion: District Vice-Chairman Caster MOVED, SECONDED by District Commissioner Davis, to approve the minutes of the Water and Sewer District regular meeting held on February 18, 2008, as presented by the Clerk to the District Board. Upon vote, the MOTION CARRIED UNANIMOUSLY. PRESENTATION OF PROPOSED CHANGES TO THE CITY OF WILMINGTON WATER EMERGENCY MANAGEMENT ORDINANCE AND WATER CONSERVATION RESTRICTIONS Interim County Engineer Dennis Ihnat reported that City of Wilmington and County staff met with representatives from landscaping companies, pool companies and other associated industries in an effort to propose common water use policies for water emergency stages and align them with State water emergency stages. Mike Richardson, City Superintendent of Water Treatment, provided the following overview of the guidelines developed by the working group: Recommended changes will: ? Allow for a more uniform ordinance within the City of Wilmington and New Hanover County. ? Provide a more thorough ordinance that clearly defines restricted activities under each advisory stage ? Enable a gradual increase in prohibited activities as conditions or triggers are determined. ? Promote and encourage efficient water use. Current water restriction stages: ? Stage 1 Water Conservation Alert - is voluntary, may be declared in the event of an immediate water shortage or when there are three consecutive days when water demand exceeds 80% of the water production capacity. ? Stage 2 Water Shortage Warning ? is mandatory, may be declared in the event of an immediate water shortage or when there are two consecutive days when water demand exceeds 90% of the water production capacity. ? Stage 3 Water Shortage Danger ? is mandatory, may be declared in the event of an immediate water shortage or when there is one day when water demand exceeds 100% of the water production capacity. Proposed water restriction stages: ? Everyday ? efficient water use and water conservation measures are highly encouraged. No restrictions apply. Stage 1 Advisory May be declared if water use under the normal conditions and voluntary water conservation o best management practices have not resulted in sufficient reduction of the average daily customer water demand from our distribution system, or Declaration of a D1 drought has been issued. o ? Stage 2 Advisory May be declared in the event of an immediate water shortage, or o Three consecutive days when water demand exceeds 80% of the water production capacity, or o Declaration of a D2 drought has been issued. o ? Stage 3 Advisory May be declared in the event of an immediate water shortage, or o Two consecutive days when water demand exceeds 80% of the water production capacity, or o Declaration of a D3 drought has been issued. o ? Stage 4 Advisory May be declared in the event of an immediate water shortage or severe emergency, or o Demand exceeds 100% of the water production capacity, or o Declaration of a D4 drought has been issued. o Continuing, Mr. Richardson stated that any advisory level can be increased if it is necessary to implement additional mandatory water use rules to protect the public health, safety, and welfare through the provision of adequate water for drinking, sanitation, and fire protection services. Restrictions apply for Stage 1 ? Stage 4 Advisories for established lawns and landscapes; new lawns and landscapes; swimming pools, hot tubs and spas; vehicle washing; hydrant use; pressure washing; restaurants, eating/drinking establishments; fountains, artificial waterfalls, misting machines, reflecting pools, and ornamental ponds; and non-essential use, leaks, and water waste. ADOPTION OF BUDGET ORDINANCE AMENDMENT 2008-07 ESTABLISHING THE REGIONAL WATER AND SEWER PROJECT WITH THE NEW HANOVER COUNTY BOARD OF EDUCATION ADJACENT TO THE HOLLY SHELTER ROAD SCHOOL SITE Interim County Engineer Dennis Ihnat reported that on November 5, 2007 the District Board approved an Interlocal Agreement with the New Hanover County Board of Education tocooperate in the construction of a new water tower and regional sewer pumping station adjacent to the school site, rather than designing and constructing separate facilities for water and sewer. The cost is anticipated to be in the amount of $5,963,690. New Hanover County Board Education is contributing the cost of design and construction administration in the amount of $706,310 plus a portion of the construction costs in the amount of $1,043,690, for a total of $1,750,000. The Board of Education will pay the sum of $706,310 directly to the architect. Installment loan proceeds are approximately $4,920,000. Staff is requesting the District Board adopt Budget Ordinance Amendment 2008-07. District Chairman Kopp requested direction from the Board. Motion: District Vice-Chairman Caster MOVED, SECONDED by District Commissioner Greer, to adopt Budget Ordinance Amendment 2008-07 establishing the budget for the regional pump station, sewer lines, water lines, and a water tower on or adjacent to the Holly Shelter Road site. Upon vote, the MOTION CARRIED UNANIMOUSLY. A copy of the budget ordinance amendment is hereby incorporated as a part of the minutes and is contained in Water and Sewer Exhibit Book III, Page 26.1. NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 3 REGULAR MEETING, MARCH 10, 2008 PAGE 278 APPROVAL OF CONTRACT AWARD TO COLT CONTRACTING FOR THE CONSTRUCTION OF PUMP STATION 77 Interim County Engineer Dennis Ihnat reported that Pump Station 77 Alternate Force Main Capital Project was established by the District Board on December 3, 2007 and advertised for bids in early January. Pump Station 77 currently discharges to the Southside Waste Water Treatment Plant via the Bradley Creek Pump Station and the Northeast Interceptor. This alternate force main will allow flow to be diverted to the Ogden Interceptor and conveyed to the Northside Waste Water Treatment Plant. The purpose of this diversion is to reduce wastewater flow through the Northeast Interceptor and manage flow based on capacity at both treatment facilities. McKim and Creed developed the Engineer's Opinion of Probable Construction Cost in the amount of $855,000. Interest in this project was high in the utility contracting business sector, and a total of six bids were submitted. The apparent low bidder is Colt Contracting with a bid in the amount of $615,440. Staff is requesting the District Board approve the contract to Colt Contracting in the amount of $615,440 for the construction of Pump Station 77, and authorize the District Chairman to execute the contract. District Chairman Kopp requested direction from the District Board. ADOPTION OF RESOLUTION AWARDING CONTRACT TO STATE UTILITIES FOR THE OGDEN PARK WELL HEAD CONSTRUCTION PROJECT Interim County Engineer Dennis Ihnat reported that the District Board took action to expedite construction of three well sites that are included in the Water Treatment Plant and Well Field Capital Project. These wells will increase system capacity and provide potable water before the Water Treatment Plant is completed in 2009, and then provide raw water to the plant as part of the new well field. Staff is now ready to permit and construct the well heads for wells M, N, and O. State Utilities was the successful bidder to construct raw waterlines for the wells in Ogden Park and completed that work successfully and on time. In order to expedite construction of the well head in Ogden Park, staff has negotiated a contract change order with State Utilities in the amount not to exceed $435,000 and to complete the project by July 15, 2008. Staff is requesting the District Board adopt the resolution authorizing the change order to the contract with State Utilities for the construction of the Ogden Park well head. Interim County Engineer Ihnat read the resolution into the record. In response to District Board questions, Water and Sewer Engineer Gary McSmith, reported that the addition of the Ogden Park well head will increase supply by 31%. The competitive bids process will be initiated for the additional well head work. District Chairman Kopp requested direction from the District Board.
