Section 2: Explanation
To budget $7,000 in funds received from the Cape Fear Memorial Foundation for the Department of
Aging's Medicare Transition Prescription Drug Program. The grant will be used to fund apart-time
temporary staff person (16 hours per week) for a period of 1 year. There is no County match required, nor
is there any requirement to continue the program after the expiration of the grant. The position will
terminate when the grant ends.

This ordinance shall be effective upon its adoption.

Hanover County, North Carolina, that the Ordinance for Budget Amendment 08-238 amending the annual

Section 2: Explanation
Risk Management handles securing and processing insurance coverage for 9 outside agencies. The Risk
Management budget is prepared based on estimates for the upcoming fiscal year. The County pays the
insurance premium for the outside agency when it is due, and then bills the outside agency for
reimbursement. The agency reimburses the County the full amount of the premium plus a contracted
percentage as a Risk Management handling fee.
The Board of Education had a 28% jump in their premium this current year and several other agencies had
small increases.
This budget amendment will increase the insurance expense budget for each agency to cover the estimated
costs for the remainder of this fiscal year. The budget amendment also increases the revenue budget for the
reimbursements by the same amount. Therefore, reimbursement received will match payments and the
County will not be incurring any additional expenditures that are not fully reimbursed.

To budget a $2,000 grant from the Good Shepherd Fund, Inc., located in Whiteville, NC. The Grant will be
used for the Sheriff's Office Safe Summer Program, which is a continuum of the training that the D.A.R.E.
Program (Drug Awareness Resistance Education) provides during the school year. The Good Shepherd
Fund Grant awards are designed to be used for drug abuse, prevention, intervention, and education. The
Board of Commissioners authorized the grant application at its meeting on March 10, 2008. There is no
local match requirement.

This budget amendment increases the operating budget by donated funds available in the escrow account.
No County funds are being used for this budget amendment.
The $3,000 is to increase the budget for the newsletter and the resulting postage cost ($2,000 newsletter
printing and $1,000 postage). The remaining $1,000 is for ancillary supplies used by the tax preparation
volunteers, a free tax program provided by the Department of Aging and their staff of volunteers.

BICYCLE AWARENESS MONTH n ~ 3 ~ • l
PROCLAMATION
WHEREAS, the New Hanover County Board of Commissioners is committed to the promotion of safe
and convenient bicycling exercise, transportation and recreation; and
WHEREAS, New Hanover County is committed to promoting the safe use of bicycles on the County's
roads, bike routes and trailways; and
WHEREAS, education about bicycle safety and maintenance will encourage children and adults to
operate their bicycles in a safe manner on all bicycle and shared access facilities; and
WHEREAS, the New Hanover County Board of Commissioners is committed to alleviating traffic
congestion and ensuring a clean and healthy environment; and
WHEREAS, a Bike Friendly Community is committed to;
1. Good roads: Streets that can be shared by bikes and cars safely and conveniently.
2. Bicycle paths and trails: Paved and unpaved routes where youth and casual riders can bicycle
comfortably and safely.
3. Safety conscious bicyclists: Educated and experienced riders of all ages, who share the road safely
and confidently, obeying all traffic regulations.
4. Safety conscious motorists: Drivers who are alert to bicyclists and share the road with them.
5. Well-planned neighborhoods: Neighborhoods that are conveniently linked to promote bicycle
travel between homes, schools, stores, libraries, recreational and sports facilities, churches, beaches,
and workplace destinations. Traffic regulations and other controls that calm traffic in residential and
other areas that are frequented by children on bicycles.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners
that May 2008 be recognized as "Bicycle Awareness Month" and that the citizens of New Hanover
County are encouraged to participate in each of the bike month activities.

RESOLUTION
OF THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
WHEREAS, G.S. 158-7.1 authorizes counties to make appropriations for the purpose of aiding and
encouraging the location of manufacturing enterprises and locating industrial and commercial plants in the
County; and
WHEREAS, Titan America, LLC is considering expansion of its business located in New Hanover County;
and
WHEREAS, such an expansion would include a real and personal property investment of up to four hundred
fifty million dollars ($450,000,000) and employment of 160 additional employees; and
WHEREAS, notice of a public hearing on an economic development grant was advertised on April l 1, 2008
in accordance with G.S. 158-7.1; and
WHEREAS, the New Hanover County Board of Commissioners desires to encourage such economic growth
and development.
NOW, THEREFORE, BE IT RESOLVED, that New Hanover County will contribute to an economic
development grant for Titan America, LLC not to exceed four million two hundred thousand dollars
($4,200,000), payable over a period of seven (7) years.

RESOLUTION
OF THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
ADOPTING THE
BICYCLE FACILITIES STUDY FOR THE BLUE CLAY CORRIDOR
WHEREAS, the Wilmington Urban Area Metropolitan Planning Organization provides transportation planning
services for the City of Wilmington, Town of Carolina Beach, Town of Kure Beach, Town of Wrightsville
Beach, Town of Belville, Town of Leland, Town ofNavassa, New Hanover County, Brunswick County, Pender
County, Cape Fear Public Transportation Authority and the North Carolina Board of Transportation; and
WHEREAS, the Wilmington Urban Area Metropolitan Planning Organization 2030 Long Range
Transportation Plan identifies the Blue Clay corridor as the second of 17 top recommended bicycle
improvements; and
WHEREAS, Blue Clay Road is designated as part of North Carolina Bicycling Highway 3; and
WHEREAS, Blue Clay Road provides a direct link between northern New Hanover County, Cape Fear
Community College and the City of Wilmington; and .
WHEREAS, the Wilmington Urban Area Metropolitan Planning Organization has completed the Bicycle
Facilities Study for the Blue Clay Corridor in cooperation with New Hanover County, ILM Airport, and North
Carolina Department of Transportation staff, as well as the general public; and
WHEREAS, the Bicycle Facilities Study for the Blue Clay Corridor will be used as a guide to improve bicycle
facilities along the Blue Clay Corridor, with the long-term goal of providing a safe bicycle route between North
23`d Street and Holly Shelter Road for use by both bicycle commuters and recreational bicyclists.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby
adopts the Bicycle Facilities Study for the Blue Clay Corridor.

RESOLUTION
OF THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
WHEREAS, North Carolina Session Law 2007-383 repealed Article 1 and 2 of §62A and added Article 3 to §62A and is
now known as, the Emergency Telephone System; and
WHEREAS, Article 3 requires all voice communications service providers to collect a single rate 911 service fee and
remit collections to the State 911 Board rather than to the local governments; and
WHEREAS, the State 911 Board distributes funds to the designated County Public Safety Answering Points (PSAP)
based upon criteria set forth in the new law; and
WHEREAS, to revise the existing County Ordinances to be in compliance with §62A, Article 3, an Ordinance is
attached for adoption; and
WHEREAS, to meet the fiduciary requirements of Article 3, a budget amendment is attached for approval; and
WHEREAS, Article 3 requires funds established by the local governments to be closed and distributed according to
Article 3, the County Manager, Finance Officer, and $udget Director are authorized to complete closing of Fund 240 and
242 in accordance with Article 3.
NOW, THEREFORE, the Board of Commissioners of New Hanover County does hereby:
1. Ordain that the New Hanover County Ordinances are modified in accordance with the attached
Ordinance; and
2. Approve the attached Budget Amendment Ordinance;
3. Authorize the County Manager, Finance Officer, and Budget Director to complete closing of Fund
240 with the remaining balance to be moved to the general fund;
4. Authorize the County Manager, Finance Officer, and Budget Director to complete closing of Fund

BOARD OF COMMISSIONERS
WHEREAS, North Carolina Session Law 2007-383 repealed Article 1 and 2 of §62A and added Article 3
to §62A;
AND WHEREAS, to be in compliance with §62A, Article 3, the New Hanover County Ordinances require
revisions;
NOW, THEREFORE, the Board of Commissioners of New Hanover County, North Carolina, does hereby
ordain that the New Hanover County Ordinances are amended as follows:
1. Amend existing section title in Chapter 20, to read:
ARTICLE IV. PUBLIC SAFETY COMMUNICATION CENTER
2. Amend Sec. 20-141 to read:
Sec. 20-141. Purpose; adoption of state law.
This article is enacted to adopt all the provisions of G.S. 62A. "Article 3. Emergency
Telephone Service", such statute being incorporated in this article by reference.

5. Repeal Sec 20-144.
6. Repeal Sec. 20-145.

8. Amend Sec. 20-147 to read:
Sec. 20-147. Sole 911 system.
The county shall be the sole provider of 911 service throughout the geographic territory
constituting the county, inclusive of all areas within municipal and political entities in the county.

Section 2: Explanation

RESOLUTION
OF THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
WHEREAS, certain Non-Profit and Government Entities may request and receive a refund for sales taxes paid in New
Hanover County; and
WHEREAS, during the past year, $4.4 million of sales tax refunds were made to such entities for sales taxes paid in New
Hanover County; and
WHEREAS, New Hanover County has received a list of each organization receiving a refund of $1,000 or more from
New Hanover County in the past 12 months; and
WHEREAS, G.S.105-164.14 (f) states that a claimant that has received a refund under this section of tax paid to a
county must give information on the refund to a designated county official after the official makes a written request to the
claimant for the information; and
WHEREAS, the designated County Official is the Chair of the Board of County Commissioners or a county official
designated in a resolution adopted by the Board.
NOW, THEREFORE, BE IT RESOLVED by the New Hanover County Board of Commissioners that Bruce T. Shell,
County Manager, be the County Official designated to request that organizations receiving a refund for sales taxes paid in
New Hanover County provide a copy of the request for refund and any supporting documentation necessary to verify the
request.

RESOLUTION
OF THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
REGARDING THE PROPOSED CHANGES TO THE COASTAL STORMWATER RULES
TITLE 15A. DENR
WHEREAS, the New Hanover County Board of Commissioners recognizes the County's important contribution
to this region's economic vitality in its ability to offer a wide range of employment opportunities, business and
professional services, as well as important historical, cultural, and recreational attractions; and
WHEREAS, the Board desires to maintain the character of New Hanover County and sustain and improve the
excellent quality of life that the area provides by favoring growth and development that is environmentally-
responsible, well-designed and planned, and respects the community as a whole; and
WHEREAS, the Boazd is awaze that the North Carolina Division of Water Quality has initiated proposed
changes to the Title 15A. DENR rules known as the Coastal Stormwater Rules; and
WHEREAS, the Coastal Stormwater Rules are intended to regulate new development activities in the twenty
Coastal CAMA Counties of North Carolina so that stormwater run-off does not pollute and degrade the public
trust surface waters of Coastal North Carolina; and
WHEREAS, New Hanover County is one of only three coastal counties in North Carolina currently regulated
under the Phase IIpost-construction requirements identified in Session Law 2006-246 and adopted July 1, 2007;
and
WHEREAS, the requirements in Session Law 2006-246 require tow density developments within'/z mile of SA
waters have a built upon area of less than 12% and those areas not within t/z mile of SA waters have a impervious
limit of 24% for the low-density option. For higher density options, which do not place a limit on impervious
coverage, will require significant investment in additional design and engineering of stormwater storage
mechanisms; and
WHEREAS, the proposed changes to the Coastal Stormwater Rules, if approved, would provide additional
restrictions from the Session Law 2006-246 rules that currently govern developmental activities within the
County as follows:
o Disallow the inclusion of jurisdictional wetlands or isolated wetlands in the overall project area
to calculate impervious surface density.
o Increased buffer from mean high water line for all areas within the County for proposed
developments from 30' to 50' feet for new developments and from 0' to 30' for redevelopment.
o Prohibit new points of stormwater discharge to SA waters or increasing the volume of flow
through existing drainage networks that drain to SA waters.
o Requirement of residential development activities with sites greater than 10,000 square feet but
less than 1 acre to include rain barrels, cisterns or other Best Management Practices to account
for between LS" and 3.5" of rainfall.
WHEREAS, the proposed changes to the Coastal Stormwater Rules, if approved, would not address vested
rights; and
WHEREAS, the proposed changes to the Coastal Stormwater Rules will affect all new residential, commercial,
and industrial development along with "public good" and government projects such as schools, police stations,
fire stations, governmental buildings and other publicly financed complexes; and
WHEREAS, the proposed changes to the Coastal Stormwater Rules unfortunately, have again ignored existing
areas with large amounts of impervious surfaces and direct discharges of stormwater and any feasible measure to
control and treat stormwater run-off from existing development; and
WHEREAS, the Board finds that the proposed rules are flawed, onerous, and lack clear scientific data and
accuracy to justify drastically expanding the proposed changes to the Coastal Stormwater Rules.
NOW THEREFORE, BE IT RESOLVED that the New Hanover County Board of Commissioners finds the
proposed changes to Title 15A. DENR are technically and economically infeasible, unnecessary and unfair and
asks that the General Assembly submit these Coastal Stormwater Rules to a legislative study committee during
the upcoming short session to allow for adequate study into the many impacts the rules will have, if implemented,
in their current form,
