Smith Clerk MINUTES OF CONTINUED PUBLIC HEARING OF THE 1984 BOARD OF EQUALIZATION AND REVEIW MEETING, JUNE 4, 1984 ASSEMBLY Chairman Gottovi called the meeting to order at 8:16 o'clock p.m. on June 4, 1984, stating this was a continuation of the Public Hearing for the 1984 Board of Equalization and Review from May 21, 1984. Members present were: Commissioner Jonathan Barfield, Sr. Commissioner Donald P. Blake Chairman Karen E. Gottovi Commissioner Nolan O'Neal Commissioner Claud O'Shields, Jr. I PUBLIC HEARING TO CONSIDER REQUEST BY MR. JOHN L. LEGWIN, MAP '5044-12-001-007-001, SOUTH BRANCH ESTATES Appraisal Supervisor Jim Bethune commented on an approved 50% reduction for this property due to influence of soil characteristics at the May 21 meeting requesting action to restate value approved at 50% of $9,800 for $4,900 instead of the value of $4,500 as presented in the complaint form. After discussion, Commissioner O'Neal MOVED, SECONDED by Commissioner Barfield to approve the correction in the reduction as presented by the Tax Department. BOARD OF EQUALIZATION AND REVIEW MEETING - JUNE 4, 1984 (CONTINUED) PUBLIC HEARING TO CONSIDER REQUEST BY DONALD AND CONNIE VIGUS, MAP 'R062-27-006-004-002, 120 QUAIL RIDGE ROAD, FOR REDUCTION OF ASSESSED VALUE Appraisal Supervisor Jim Bethune stated due to soil characteristics, the contractor was unable to build on the property and the Tax Department recommended a reduction in the assessed value from $10,000 to $5,000. Chairman Gottovi asked if anyone wished to speak on the request. No one commented. Commissioner O'Neal MOVED, SECONDED by Commissioner Barfield to approve the reduction in the assessed value as recommended by the Tax Department. Upon vote, the MOTION CARRIED UNANIMOUSLY. PUBLIC HEARING TO CONSIDER REQUEST BY MARSHALL M. DESCHAMPS, MAP 'R066-l0-002-0l2-008, (3342 REGENCY DRIVE) Appraisal Supervisor Jim Bethune gave background information on the request recommending an adjustment to the assessed value from $82,430 to $76,930 since revenue stamps were incorrectly valued when recording the purchase. Chairman Gottovi asked if anyone present wished to speak on the request. No one commented. Commissioner O'Shields MOVED, SECONDED by Commissioner O'Neal to approve the adjustment as recommended by the Tax Department. Upon vote, the MOTION CARRIED UNANIMOUSLY. PUBLIC HEARING TO CONSIDER REQUEST OF BARLEE KIRKUM, MAP 'R072- 00-005-007-000, MASONBORO SOUND ROAD Appraisal Supervisor Jim Bethune gave background information on the split of this property giving up previous water frontage stating the Tax Department recommended a reduction from $50,000 per acre to $20,000 per acre as reflected on the land pricing maps for a new valuation of $55,050. Chairman Gottovi asked if anyone present wished to speak on the request. No one commented. Commissioner O'Neal MOVED, SECONDED by Commissioner O'Shie1ds to approve the recommendation of the Tax Department. Upon vote, the MOTION CARRIED UNANIMOUSLY. PUBLIC HEARING TO CONSIDER REQUEST BY FRANK & LILLIE TALMAN, MAP 'R065-00-003-010-000, CAROLINA BEACH ROAD Appraisal Supervisor Jim Bethune gave background information on the request for reduction of the assessed value stating the Tax Department recommended no change in the property value at $17,000 per acre. Chairman Gottovi asked if anyone present wished to speak on the request. PUBLIC HEARING TO CONSIDER REQUEST BY J. H. FUSSELL, & HELEN N. FUSSELL, MAP 'R055-07-004-006-000 Appraisal Supervisor Bethune gave background information on the owner being seriously delinquent in payment of taxes for many properties in the County and takes issue with letter of intent to foreclose. (Current tax obligation has escalated to approximately $38,000 and payments have been a problem dating back to 1976). Mr. Fussell blames the Tax Department for errors which are of insignificant impact to his obligation, yet he has not met with the Tax Department to define his complaints so that if an error exists, it can be resolved. Chairman Gottovi asked if Mr. Fussell was present. No one came forward. I It was the general consensus of the Board that since Mr. Fussell was not present to make his complaint that he has taken no exception to this value. PUBLIC HEARING TO CONSIDER REQUEST BY TOM KENAN Appraisal Supervisor Bethune gave background information stating that the Kenan's had ordered a survey and based on that survey will request approval to correct the 1984 charge for marshland. He stated this item will be placed on the Consent Agenda for the correction. Chairman Gottovi asked if anyone from Eakes Investment was present and wished to speak. No one commented. Commissioner O'Shields MOVED, SECONDED by Commissioner Blake to accept the Tax Office's recommendation to make no change in the assessed value. Upon vote, the MOTION CARRIED UNANIMOUSLY. Commissioner Gottovi asked if any other people were present to discuss tax problems other than the Masonboro Sound property owners. No one commented. I PUBLIC HEARING TO CONSIDER REQUEST FROM MASONBORO AREA PROPERTY OWNERS Attorney Algernon Butler, Jr., representing property owners from the Masonboro Sound area, expressed concern for not receiving information requested from the Tax Department with reference to factors in determining the reappraised values placed on the properties. He also expressed concern for a reappraisal of property in an off year. Appraisal Supervisor Bethune gave background information on the value placed on the property and reappraisal of property. ~ 14 BOARD OF EQUALIZATION AND REVIEW MEETING - JUNE 4, 1984 (CONTINUED) ~ After a lengthy period of questions and answers by Attorney Butler and the Board, Chairman Gottovi asked if anyone present wished to comment. The following persons commented expressing strong opposition to the value place on their property. Mr. Harold Dobbins Mr. Van Reid Commissioner Blake asked Attorney Butler if he had considered having an independent appraiser to appraise the value of the properties in question stating this would be an unbiased opinion and would furnish him the fair market value. After discussion and comment, Commissioner O'Shie1ds MOVED, SECONDED by Commissioner O'Neal to uphold the 1984 values placed upon the Masonboro Sound properties by the Tax Department. Upon vote, the MOTION CARRIED as follows: Voting Aye: Commissioner Barfield Commissioner O'Neal Commissioner O'Shields Chairman Gottovi Voting Noe: Commissioner Blake Commissioner Blake requested that the record show that due to some unanswered questions, he had no choice but to vote noe.
