BEFORE THE BOARD OF COUNTY
COMMISSIONERS
ORDER
It appearing to the Board of County Commissioners of New Hanover County
that a resolution of intent to close all of Monroe Avenue, Franklin Street
and that portion of Magnolia Drive lying East of U. S. Highway #421 as the
same are shown on map of Battle Ground Park Subdivision in Federal Point
Township in New Hanover County, North Carolina, was adopted on the 17th day
of October , 1977, and it further appearing that said resolution called
for a public hearing to be held on the 2 st day of November 1977, at
which time all persons would be heard on the question of whether or not the
closing would be detrimental to the public interest, or the property rights
of any individual, and it further appearing that notice of said hearing was
published in the Wilmington Star-News Newspaper in accordance with General
Statutes 153A-241, and that all persons were heard on the question of whethez
or not the closing would be detrimental to the public interest, or the prop-
erty rights of any individual, and the County Commissioners are of the
opinion that said public roads in the County of New Hanover should be closed
and removed from dedication and the closing of same is in the public interest
the legal description of said street being as follows
All of Monroe Avenue and Franklin Street and that portion
of Magnolia Drive lying between the Eastern right of way
line of U. S. Highway #42I and the Western right of way
line of Saint Joseph Street all as shown on map of Battle
Ground Park Subdivision which is recorded in Map Book 4
at Page 52 in the New Hanover County Registry
NOW, THEREFORE, IT IS ORDERED AND DECREED that the above described
roads be and the same are hereby closed and removed from dedication. It is
further ORDERED that a copy of this Order be filed in the Office of the
Register of Deeds of New Hanover County, North Carolina.

Dear Mr. Powell:
I have recently conferred with Donald E. Britt, Esquire and
with i~Ir. Lancing E. Smith, C.P.A., concerning th+~~ above matter.
As you may recall, it was our position that there had been a double
listing of property which resulted in an overpayment of taxes. This
overpayment has entitled Lemon Tree Inn of Wilmington a refund.
Please be kind enough to make the refund of taxes payable to
Douglas P. Connor, Trustee, in the amount agreed upon by you and
and b7r. Smith. Please be kind enough, when forwarding the check
to me, to send a copy of the covering letter to N1r. Smith with
the stated amount of the check appearing in the body of the letter.
I shall, and pursuant to a prior order of the bankruptcy court,
then distribute said check to the present receiver, Franklin Block,
Esquire. By copy of this letter all appropriate parties are being
advised.

1977 Tax Bill No. 57586 covering an assessment of the chemical
airomatics stored at our Wilmington Terminal This tax notice
is being sent to you for presenting to the board of tax review
to waive the late listing penalty for both county and city
You will recall there is a controversy over the annexation of this
property to the City of Wilmington. This bill does include the
City of Wilmington tax and we will appreciate the bill being adjusted
by eliminating any city tax until this controversy is settled.
