These assurances shall be interpreted in accordance with the regulations published under the Act in 31 CFR, Part 52. Whenever the Secretary of the Treasury after affording reasonable notice and an opportunity for a hearing finds there has been a failure to comply substantially with any assurance set forth below in items 1 through 11 further payments will not be made to that government until such time as compliance is achieved. The regulations also provide that payments may be temporarily suspended for non- compliance with the discrimination prohibitions of the Act and regula- tions. The references below in parenthesis are to sections of the Act. RCCT NO 34 1 065 065 taEW MAN~1°ER COUNTY COUNTY FINANCE OFFICER COUNTY ADM IN BLDG - RM 5 13 320 CHESTNUT ST WILMINGTON N C 28401 1 All payments received under the Act will be used for the maintenance to the extent practical, of levels of public employment and of basic services customarily provided to persons in the State or in the area under the jurisdiction of the unit of local government which is consistent with the provisions of Section 204 of the Act. (Section 205 (1)) 2. This recipient government will use fiscal accounting^and audit procedures which conform to guidelines established by the Director (Section 205 (2)(A)) 3. The Director and the Comptroller General of the United States will be provided, on reasonable notice, access to and the right to examine such books, documents, papers, or records as may be reasonably required for the purpose of reviewing compliance with the Act. (Section 205 (2)(B)) 4 The Director will be furnished upon request reasonable reports in the form and containing the information required by the Secretary to carry out the purposes of the Act. Such reports will be published in a newspaper of general circulation in the jurisdiction of this recipient government unless the cost of such publication is excessive in relation to the amount of the payments received by such government, or other means of publicizing such report are more appropriate, in which case such report will be publicized pursuant to rules prescribed by the Director (Section 205 (3)) 5 No person in the United States will, on the grounds or race, religion color national origin or sex, be excluded from participation in, be denied the benefits of or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under the Act. (Section 207 (a)) 6. All laborers and mechanics employed by contractors on all construction projects funded in whole or in part by payments under the Act will be paid wages at rates not less than those prevailing on similar projects in the locality as determined by the Secretary of Labor in accordance with the Davis-Bacon Act (40 U.S.C. 267a to 276a-5) (Section 208) 7 This recipient government will report to the Director on a form to be provided, any increase or decrease in any tax which it imposes and any substantial reduction in the number of individuals it employs or in services which such government provides. Each recipient State government will report to the Secretary any decrease in the amount of financial assistance which the State provides to its units of local government during the twelve-month period which ended June 30, 1976, together with an explanation of the reasons for such decrease Each report will be made as soon as practical and, in any case not later than six months after the date on which the decision to impose such tax increase or decrease, such reductions in employment or services, or such decrease in State financial assistance is made public. (Section 209) 8. Funds received under the Act will be spent before the end of the six month period which begins on the first day following receipt of each payment. (Section 205 (7)) 9 Funds received under the Act will be spent only in accordance with the laws and procedures applicable to the expenditure of this recipient government's own revenues. (Section 205 (8)) 10. This recipient government has made reasonable efforts to make substantial economies in its operations, and payments under the Act are necessary to maintain essential services without weakening Federal Government efforts to stimulate the economy through reductions in Federal tax obligations. (Section 211) 11 This recipient township government has the present-fegal authority to expend and has expended within the last two fiscal years, revenues within two or more governmental expenditure categories as set forth in Section 52.2 (p) of the regulations.
