NCDOT Safe Routes Supplemental AgreementNORTH CAROLINA SUPPLEMENTAL AGREEMENT NEW HANOVER COUNTY NORTH CAROLINA DEPARTMENT OF TRANSPORTATION DATE: 6127/2013 TIP #: SR- 5001BO AND WBS ELEMENT: 40924.3.66 COUNTY OF NEW HANOVER CFDA #: 20.205 TOTAL SUPPLEMENTAL FUNDS [NCDOT PARTICIPATION] $200,000 THIS AGREEMENT is made and entered into on the last date executed below, by and between the North Carolina Department of Transportation, an agency of the State of North Carolina, hereinafter referred to as the "Department ", and the New Hanover County, hereinafter referred to as the "County." WITNESSETH: WHEREAS, the Department and New Hanover County, on 4/2512012, entered into a certain Locally Administered Project Agreement for the original scope: construct an 8' off road multi -use pathway from Red Cedar Road connecting to sidewalk at Ogden Elementary School, programmed under Project SR- 5001BO; and, WHEREAS, the parties wish to expand the project scope, increase the project funding, and extend the project completion dates; and NOW THEREFORE, the parties wish to supplement the aforementioned Agreement whereby the following provisions are amended: SCOPE In addition to the original scope,the project consists of installation of a multi -use path or sidewalk from existing sidewalk at Ogden Elementary School to both SR 1823 (Kenmore Drive) and SR 1986 Agreement ID # 4247 1 (Oyster Drive), on -road bicycle improvements (sharrows & signage) along SR 1930 (Bright Leaf Road), SR 1971 (Humphrey Drive), and SR 1929 (Wendover Lane), and a 10' off -road multi -use trail with pedestrian bridge off of Bright Leaf Road to Thais Trail to make connection with the Bayshore Estates subdivision. The Department's original participation was $100,000. The Department agrees to reimburse the County an additional $200,000 of Safe Routes to School funds. Subject to compliance by the County with the provisions set forth in this Agreement and the availability of federal funds, the Department shall participate up to a maximum amount of Three Hundred Thousand Dollars ($300,000), as detailed below. The County shall be responsible for all costs that exceed the total estimated cost. Except as hereinabove provided, the Agreement heretofore executed by the North Carolina Department of Transportation and New Hanover County on 4/2512012, is ratified and affirmed as therein provided.
