To budget New Hanover County's share of the 2010 JAG Grant award, applied for with the City of
Wilmington, for assisting with efforts to prevent or reduce crime and violence. Funds will be used to
purchase vehicles. The Board of Commissioners approved the joint application with the City of Wilmington
at their June 7,2010 meeting.There is no local match requirement.

RESOLUTION 1
TO ADOPT THE NEW HANOVER COUNTY
MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN
I
WHEREAS, New Hanover County is vulnerable to an array of natural hazards that can cause loss of life and
i
damages to public and private property; and
i
i
WHEREAS,the County desires to seek ways to mitigate situations that may aggravate such circumstances;and
1
WHEREAS, the development and implementation of a hazard mitigation plan can result in actions that reduce the
long-term risk to life and property from natural hazards; and
WHEREAS, it is also the intent of the Board of Commissioners to fulfill its obligation under North Carolina
General Statutes, Chapter 166A: North Carolina Emergency Management Act and Section 322: Mitigation Planning,
of the Robert T. Stafford Disaster Relief and Emergency Assistance Act to remain eligible to receive state and
federal assistance in the event of a declared disaster affecting the County; and
WHEREAS,New Hanover County, in coordination with the Town of Kure Beach, Town of Carolina Beach and the
City of Wilmington, has prepared a multi-jurisdictional hazard mitigation plan with input from the appropriate local
and state officials; and
WHEREAS, the North Carolina Division of Emergency Management and FEMA have reviewed the hazard
mitigation plan prepared for New Hanover County for legislative compliance and have approved the plan pending
the completion of local adoption procedures.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners of New Hanover County hereby
adopts the New Hanover County Multi-Jurisdictional Hazard Mitigation Plan;and
BE IT FURTHER RESOLVED that the Board shall take such future official action as may be reasonably
y necessary to carry out the proposed actions of the plan.

WHEREAS, the North Carolina Department of Transportation organizes an annual fall
statewide roadside cleanup to ensure clean and beautiful roads in North Carolina; and
WHEREAS, the Fall 2010 LITTER SWEEP roadside cleanup will take place September
18 - October 2, 2010, and encourages local governments, communities, civic and
professional groups, businesses, churches, schools, families, and individual citizens to -'
# participate in the Department of Transportation cleanup by sponsoring and organizing
local roadside cleanups; and = j
WHEREAS, Adopt-A-Highway volunteers, Department of Transportation employees,
Department of Correction inmates, and community service workers, local government ='
agencies, community leaders, civic and community organizations, businesses, churches,
schools, and environmentally concerned citizens conduct local cleanups during LITTER
SWEEP and may receive certificates of appreciation for their participation; and = ``
i
WHEREAS, the great natural beauty of our state and a clean environment are sources of
great pride for all North Carolinians, attracting tourists and aiding in recruitment of new
industries; and
WHEREAS, the cleanup will increase awareness of the need for cleaner roadsides,
emphasize the importance of not littering, and encourage recycling of solid wastes; and
.y `t WHEREAS, the Fall 2010 cleanup will celebrate the 22 d anniversary of the North
}
Carolina Adopt-A-Highway program and its 5,815 volunteer groups that donate their labor
and time year-round to keep our roadsides clean; and

€` WHEREAS, the LITTER SWEEP cleanup will be a part of educating the children of this '
great state regarding the importance of a clean environment to the quality of life in North
Carolina. _ )
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of

RESOLUTION FOR THE APPROVAL IN PRINCIPLE OF SPECIAL
PURPOSE PROJECT FOR WILBARA, L.L.C. AND THE FINANCING
THEREOF WITH RECOVERY ZONE FACILITY BONDS IN THE
PRINCIPAL AMOUNT OF UP TO $14,000,000
WHEREAS, The New Hanover County Industrial Facilities and Pollution Control
Financing Authority (the "Authority") proposes to assist in the financing under the North
Carolina Industrial and Pollution Control Facilities Financing Act, Chapter 159C of the North
Carolina General Statutes, as amended (the "Act") of a "special purpose project" the proceeds of
which will be loaned to Wilbara, L. L. C., a North Carolina limited liability company, or an
affiliated or related entity (the "Company"), has undertaken the acquisition, construction and
equipping of a sulfuric acid manufacturing facility (the"Project"), in Wilmington, New Hanover
County, North Carolina (the"County"); and
WHEREAS the Act and the Internal Revenue Code of 1986, as amended (the "Code")
require that the governing body of a county approve in principle any project to be financed under
the Act after a public hearing; and
WHEREAS, on August 16, 2010, the Authority received an allocation of authority to 4
issue recovery zone facility bonds for the Company's Project from the North Carolina Tax (I
Reform Allocation Committee in the amount of$14,000,000; and
WHEREAS, this Board of Commissioners today has held a public hearing with respect to
the advisability of the Project and the issuance of recovery zone facility bonds therefor, as
evidenced by the Certificate and Summary of Public Hearing attached hereto as Exhibit A; and
WHEREAS, the Authority intends to issue its Recovery Zone Facility Bonds (Wilbara,
L.L.C. Project), Series 2010 (the "Bonds") in the principal amount of up to $14,000,000 which
will be issued as a variable rate bond that is either privately placed with a bank or supported by a
letter of credit issued by a bank; and

WHEREAS, Section 147(f) of the Code requires that the Board of Commissioners
approve the plan of financing for the bonds; and
WHEREAS, under Section 159C-4 of the Act the issuance of bonds under the Act must
be approved by the governing body of the county in which the project to be financed is located.
NOW, THEREFORE, the Board of Commissioners of New Hanover County, meeting in
regular session at Wilmington,North Carolina, on September 20, 2010, does the following:

BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR NEW HANOVER
COUNTY:
1. The proposed "special purpose project" consisting of the acquisition, construction
and equipping of a sulfuric acid manufacturing facility (the "Project"), to be owned and operated
by Wilbara, L. L. C.. a North Carolina limited liability company, or an affiliated or related entity,

and the issuance of recovery zone facility bonds in an amount not to exceed $14,000,000 therefor
are hereby approved in principle.
2. The Board of Commissioners hereby approves the plan of financing as required-
by Section 147(f) of the Code.
3. The issuance of the Bonds in the principal amount of $14,000,000 is hereby
approved for purposes of Section 159C-4 of the Act.
4. THE BONDS DO NOT CONSTITUTE A DEBT OF THE STATE OF NORTH
CAROLINA OR ANY POLITICAL SUBDIVISION THEREOF, INCLUDING THE
AUTHORITY OR THE COUNTY, OR A PLEDGE OF THE FAITH AND CREDIT OF THE
STATE OF NORTH CAROLINA OR ANY POLITICAL SUBDIVISION, INCLUDING THE
AUTHORITY OR THE COUNTY.
