Berger (91 O) 798-7145 FAX Commissioner i WWW.NHCGOV.COM Richard G.Catlin 1 Exhibit �► ' C mmissioner Book Page ' Sheila L.Schult Clerk to the Board RESOLUTION I EXCEPTION TO COMPETITIVE BIDDING PROCESS WHEREAS, New Hanover County's Fire Services would like to piggyback a contract for the purchase of Kenworth Dryside Tankers awarded by the Fremont County Fire Protection District, Riverton, WY, to Pierce Manufacturing, Inc., on August 31, 2010; and 1 WHEREAS, North Carolina General Statute 143-129(g) allows an exception to the bidding process known as i "piggybacking" when purchasing apparatus, supplies, materials, or equipment from any person or entity that has, within the previous 12 months, after having completed a public, formal bid process substantially similar to that { required by this Article, contracted to furnish the apparatus, supplies, materials, or equipment to: I 1) The United States of America or any federal agency; I 2) The State of North Carolina or any agency or political subdivision of the State; or 1 3) Any other state or any agency or political subdivision of that state, if the person or entity is willing to furnish the items at the same or more favorable prices, terms, and conditions as those provided under the contract with the other unit or agency; and I s WHEREAS, the Purchasing Supervisor has verified that the conditions of"piggybacking" on the original contact I have been met; and WHEREAS, a public notice of this purchase without competitive bidding was placed on the County's website on `. November 8, 2010; and I WHEREAS, funds have been approved in this year's budget for the purchase of one(1) fire tanker; and WHEREAS, Pierce Manufacturing, Inc. has agreed to extend the same pricing to the County as was extended to Fremont County Fire Protection District and sell the tanker at a cost of$198,696. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of New Hanover County that the exception to the bidding process is approved and staff may proceed with the purchase of the tankers from Pierce # Manufacturing, Inc. using the piggyback procedure.
