WHEREAS, a petition has been filed with the Board of County Commissioners of the County of New
Hanover requesting that the above described road(s), the location of which has been indicated on a map, be
added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above described road(s)
should be added to the Secondary Road System, if the road(s) meets minimum standards and criteria
established by the Division of Highways of the Department of Transportation for the addition of roads to the
System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County of New Hanover
that the Division of Highways is hereby requested to review the above described road(s), and to take over the
road(s)for maintenance if they meet established standards and criteria.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
RESOLUTION TO RETURN PHRST ASSETS AND EQUIPMENT
TO THE DIVISION OF PUBLIC HEALTH
WHEREAS,New Hanover County purchased certain personal property itemized and on file in the
Finance Department, hereinafter referred to as "surplus property," with funds received through a
Public Health Response Surveillance Team grant,hereinafter referred to as"PHRST"; and
WHEREAS,PHRST funding requires that any property purchased will be returned to the funding
agency upon expiration of the grant; and
WHEREAS, the North Carolina Department of Health and Human Services, Division of Public
Health has notified New Hanover County that the PHRST Team shall transition from a County Team
to a State Regional Team, therefore grant funding shall expire.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of New Hanover
County as follows:

1. The personal property is hereby declared to be surplus property.
2. That the Finance Director's designated representative is authorized to return surplus property
to the funding agency, and that said representative be further authorized and directed to
execute necessary documents, transfer title, add/delete items from the surplus list, and
perform all necessary functions associated with this disposal.

BE IT ORDAINED by the Board of County Commissioners of New Hanover County, North
Carolina, that the following Budget Amendment 11-256 be made to the annual budget ordinance for the
fiscal year ending June 30,2011.

Section 2:Explanation
To budget a 2009 Port Security Grant award of$31,334 for the purchase of a 2012, 4x4 Crew Cab truck to
provide assistance in protecting the Port. The vehicle will be used to pull the boats purchased with the 2010
Port Security Grant. The total project cost is $41,779 and the grant award is $31,334. The Sheriff will use
funds in the Sheriff s Office Administrative Reserve account for the County's 25%match of$10,445.
Section 3:Documentation of Adoption:
? This ordinance shall be effective upon its adoption.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County, North Carolina, that the Ordinance for Budget Amendment 11-256, amending the annual

In the Matter of Closing ORDER
An Unnamed Road
It appearing to the Board of County Commissioners of New Hanover County that a Resolution of
Intent to close a portion of an unnamed road located near the 8500 block of Bald Eagle Lane
' (west side) was adopted by the County Commissioners on the 181h day of April 2011, and it
further appearing that said resolution called for a hearing to be held on the 6`t' day of June 2011,
at which time the County Commissioners would hear complaints and comments of interested
persons, and it further appearing that notice of said hearing was published in the Wilmington Star I
News Newspaper in accordance with the Road Closing Ordinance of New Hanover County, and
' after conducting such hearing the County Commissioners are of the opinion that the unnamed 3
road in the County of New Hanover should be closed and are satisfied that the closing of same is
not contrary to the public interest, and that no individual owning property in the vicinity of the j
roads will be deprived of reasonable means of ingress and egress to his property by such closing,
the legal description of said road being as follows along with an attached exhibit:
Being a twenty (20) foot right-of-way beginning at a point and intersecting with
the northwestern right-of-way line of Bald Eagle Lane (SR-1491) and the
northeastern property line of lot 31 as shown on the map of sections E & F of
' Porters Neck Plantation, recorded in Map Book 6, Page 1 of the New Hanover
County Registry; running thence from said point 500 feet northwest to the
northwest corner of lot 31; running thence 20 feet north to the northern right-of-
way of said private road; running thence from said point southeast approximately
520 feet to the southeast corner of lot 32 as noted in Map Book 6, Page 1; running f
thence 20 feet south to the point of beginning. f
NOW, THEREFORE, IT IS ORDERED AND DECREED that the above described road be and a
' the same is hereby closed. It is further ORDERED that a copy of this order be filed in the Office
of the Register of Deeds of New Hanover County, North Carolina.

The County Commissioners for New Hanover County having held a public hearing on June 6, 2011 to
consider application number S-603 submitted by Greenbrier Development on behalf of Plantation Village,
Incorporated, for a special use permit to obtain a Continuing Care Retirement Community (CCRC)
Designation in an R-20 Residential Zoning District at 1200 Porters Neck Road, and having heard all of ;
the evidence and arguments presented at the hearing,make the following FINDINGS OF FACT and draw
the following CONCLUSIONS:

1. The County Commissioners FIND AS A FACT that all of the specific requirements set forth in
Section 71-1 of the County Zoning Ordinance WILL be satisfied if the property is developed in
accordance with the plans and findings submitted to the County Commissioners and attached as part
of this special use permit.
2. Therefore,because the County Commissioners conclude that all of the general and specific conditions
precedent to the issuance of a SPECIAL USE PERMIT HAVE been satisfied, IT IS ORDERED that
the application for the issuance of a SPECIAL USE PERMIT BE GRANTED subject to the following
condition:
A. If any of the conditions imposed by this special use permit shall be held invalid beyond the
authority of this Board of Commissioners by a court of competent jurisdiction, then this permit
shall become void and of no effect.
B. In accordance with Section 71-1(4) of the ordinance, the permit shall become null and void if
construction or occupancy has not commenced within 24 months of the date of this approval.
C. That the applicant shall fully comply with all of the specific requirements stated in the Ordinance
for the proposed use; all other state, federal and local rules; and any additional conditions
' hereinafter stated.

The County Commissioners for New Hanover County having held a public hearing on June 6, 2011 to
consider application number S-604 submitted by Thomas H. Johnson, Jr. on behalf of American Towers
and AT&T Mobility, for a special use permit to erect a 90' monopole telecommunications tower in an
R-15 Residential Zoning District at Parcel ID R02700-001-003-000, located at the end of Mabee Way,
and having heard all of the evidence and arguments presented at the hearing, make the following
FINDINGS OF FACT and draw the following CONCLUSIONS:
1. The County Commissioners FIND AS A FACT that all of the specific requirements set forth in
Section 71-1 of the County Zoning Ordinance WILL be satisfied if the property is developed in
accordance with the plans and findings submitted to the County Commissioners and attached as part
of this special use permit.
2. Therefore,because the County Commissioners conclude that all of the general and specific conditions
