CONSTITUTION WEEK 2012
PROCLAMATION
WHEREAS, September 17, 2012 marks the two hundred and twenty-fifth anniversary of '
the drafting of the Constitution of the United States of America by the Constitutional
Convention; and
WHEREAS, it is fitting and proper to officially recognize this magnificent document
and the anniversary of its creation; and
WHEREAS, it is fitting and proper to officially recognize the patriotic celebrations
which will commemorate the occasion; and
WHEREAS, Public Law 915 guarantees the issuing of a proclamation each year by the
President of the United States of America designating September 17 through 23 as
Constitution Week.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of ,
Commissioners that September 17 through 23, 2012 be recognized as "Constitution
Week" in New Hanover County and asks that citizens reaffirm the ideals the Framers of
the Constitution had in 1787.

RESOLUTION AUTHORIZING THE DONATION OF
EXPIRED DENTAL SUPPLIES TO CAPE FEAR COMMUNITY COLLEGE
WHEREAS, GS 160A-280 allows a city or county to donate to another governmental unit within
the United States,a sister city,or a nonprofit organization incorporated by: (i) the United States,(ii)
the District of Columbia,or(iii)one of the United States,any personal property,including supplies,
materials, and equipment, that the governing board deems to be surplus, obsolete, or unused; and
WHEREAS,the County's Health Department has dental supplies that have expired and cannot be
used by the department in their current operations; and

WHEREAS, Cape Fear Community College uses expired supplies to train dental students in their
dental program; and
WHEREAS, County staff has posted a public notice at least five days prior to the adoption of this
resolution approving the donation as required by the statutes.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of
Commissioners approves the donation of expired dental supplies to Cape Fear Community College
l for use in their dental program and directs County staff to process any required documents to
complete the transaction.

WHEREAS, Cape Fear Literacy Council, in conjunction with ProLiteracy, UNESCO (United Nations
2 Educational, Scientific, and Cultural Organization), and thousands of community-based literacy 1�

organizations, is celebrating September as "Literacy Awareness Month" and September 8th as
J�m "International Literacy Day"; and
WHEREAS, since 1985, Cape Fear Literacy Council has provided reading, writing, spelling, math and
English communication tutoring and classes to thousands of New Hanover County adults; and t -fit
i le#11WHEREAS, the National Adult Literacy Survey indicates that over 61,000 adults in New Hanover County all

are at the lowest levels of literacy and struggle to use printed and written information to function in
society, achieve their goals, and develop their potential; and

WHEREAS, these adults have difficulty securing jobs and a livable wage for themselves and their
families, do not have access to adequate health care because they lack necessary reading and life skills, I

community-based learning, and special topic classes as indicated by students' needs; and
A WHEREAS, Cape Fear Literacy Council helps over 500 adult learners each year improve and thereby
improve their job potential and performance, their community involvement, their families' quality of life,
and their own ability to reach their goals and potential.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that

benefits the Nation's overall well-being, the U.S. Department of Health and Human Services (HHS),

Office of National Drug Control Policy ONDCP , invite all residents of New Hanover County, North

Carolina Beach and Kure Beach are scheduled to have its beach renourished in fiscal year 2013. Total
estimated project costs are$14,096,200 of which the federal government is contributing$4,400,000.
Additionally,$3,510,328 is already included in the FY2013 budget for erosion control payments. The state
will also contribute$1,180,000 and will reimburse the County for this amount after payment is made to the
Army Corp of Engineers.

County,North Carolina,that the Ordinance for Budget Amendment 13-039,amending the annual budget

STATE OF NORTH CAROLINA BEFORE THE BOARD OF
COUNTY OF NEW HANOVER COUNTY COMMISSIONERS
IN THE MATTER OF CLOSING ORDER
A PORTION OF DIVISION DRIVE
It appearing to the Board of County Commissioners of New Hanover County that a
Resolution to Abandon a portion of Division Drive (SR 2813) located between its intersection
with Castle Hayne Road and extending east to the ramp of Martin Luther King Boulevard
approximately 675 feet in length and 50' in width and removing said portion of the road from j
NCDOT public maintenance was adopted by the County Commissioners on April 2, 2012 and it
further appearing that said road resolution was officially abandoned by NCDOT June 7, 2012,
and further appearing that a Resolution of Intent to close the same portion of Division Drive was
j adopted bey the County Commissioners August 6, 2012 and called for a public hearing to be held
on the 4 day of September, 2012 at which time the County Commissioners would hear
complaints and comments of interested persons, and it further appearing that notice of said
hearing was published in the Wilmington Star News in accordance with the Road Closing
Ordinance of New Hanover County, and after conducting such hearing the County
? Commissioners are of the opinion that closing said portion of Division Drive is not contrary to
the public interest, and that no individual owning property in the vicinity of the road would be
j deprived of reasonable means of ingress and egress to his property by such closing, the legal
description of said road being as follows and along with companion exhibit:

Located in Cape Fear Township, New Hanover County, State of North Carolina
and being described as follows: BEGINNING at a N.C.D.O.T. iron road and disk,
said iron road and disk being located at the intersection of the southern line of
Division Drive and the eastern line of Castle Hayne Road, said iron rod and disk
being located North 46 degrees 14 minutes 12 seconds East-62.97' from N.C.
Grid Monument "Hiway", said grid monument having N.C. Grid Coordinates of
N = 188,437.67 and E = 2,322,258.79, coordinates are based on NAD 83 (NSRS
2007) datum, and runs thence from said beginning iron rod and disk beginning
corner, North 43 degrees 13 minutes 09 seconds East-67.50' to an existing
"MAG" Nail, said "MAG" Nail being at the intersection of the northern line of
Division Drive and the eastern line of Castle Hayne Road; thence with the
northern line Division Drive, South 89 degrees 19 minutes 29 seconds East-
641.24' to an iron rod; thence with the southern line of Division Drive, South 13
degrees 59 minutes 19 seconds West-51.18' to an N.C.D.O.T. iron rod and disk;
thence with the southern line of Division Drive, North 89 degrees 19 minutes 06
seconds West-675.10' to the point of BEGINNING, containing 0.752 Acres more
f or less, and being that portion of Division Drive located between Castle Hayne
s Road and the Access Ramp to Martin Luther King Parkway.

NOW, THEREFORE, IT IS ORDERED AND DECREED that the above
described road be and the same hereby closed with the exception and reservation of a 50'
public utility easement for the purpose of installing water and sewer as noted in Deed
I
Book 5704, Pages 391-398. It is further ORDERED that a copy of this order be filed in
the office of the Register of Deeds of New Hanover County.
