Sehult,Clerk to the Board i 4 Exhibit j Book XkW Page STATE OF NORTH CAROLINA BEFORE THE BOARD OF COUNTY OF NEW HANOVER COUNTY COMMISSIONERS IN THE MATTER OF CLOSING ORDER A PORTION OF DIVISION DRIVE It appearing to the Board of County Commissioners of New Hanover County that a Resolution to Abandon a portion of Division Drive (SR 2813) located between its intersection with Castle Hayne Road and extending east to the ramp of Martin Luther King Boulevard approximately 675 feet in length and 50' in width and removing said portion of the road from j NCDOT public maintenance was adopted by the County Commissioners on April 2, 2012 and it further appearing that said road resolution was officially abandoned by NCDOT June 7, 2012, and further appearing that a Resolution of Intent to close the same portion of Division Drive was j adopted bey the County Commissioners August 6, 2012 and called for a public hearing to be held on the 4 day of September, 2012 at which time the County Commissioners would hear complaints and comments of interested persons, and it further appearing that notice of said hearing was published in the Wilmington Star News in accordance with the Road Closing Ordinance of New Hanover County, and after conducting such hearing the County ? Commissioners are of the opinion that closing said portion of Division Drive is not contrary to the public interest, and that no individual owning property in the vicinity of the road would be j deprived of reasonable means of ingress and egress to his property by such closing, the legal description of said road being as follows and along with companion exhibit: I Located in Cape Fear Township, New Hanover County, State of North Carolina and being described as follows: BEGINNING at a N.C.D.O.T. iron road and disk, said iron road and disk being located at the intersection of the southern line of Division Drive and the eastern line of Castle Hayne Road, said iron rod and disk being located North 46 degrees 14 minutes 12 seconds East-62.97' from N.C. Grid Monument "Hiway", said grid monument having N.C. Grid Coordinates of N = 188,437.67 and E = 2,322,258.79, coordinates are based on NAD 83 (NSRS 2007) datum, and runs thence from said beginning iron rod and disk beginning corner, North 43 degrees 13 minutes 09 seconds East-67.50' to an existing "MAG" Nail, said "MAG" Nail being at the intersection of the northern line of Division Drive and the eastern line of Castle Hayne Road; thence with the northern line Division Drive, South 89 degrees 19 minutes 29 seconds East- 641.24' to an iron rod; thence with the southern line of Division Drive, South 13 degrees 59 minutes 19 seconds West-51.18' to an N.C.D.O.T. iron rod and disk; thence with the southern line of Division Drive, North 89 degrees 19 minutes 06 seconds West-675.10' to the point of BEGINNING, containing 0.752 Acres more f or less, and being that portion of Division Drive located between Castle Hayne s Road and the Access Ramp to Martin Luther King Parkway. I NOW, THEREFORE, IT IS ORDERED AND DECREED that the above described road be and the same hereby closed with the exception and reservation of a 50' public utility easement for the purpose of installing water and sewer as noted in Deed I Book 5704, Pages 391-398. It is further ORDERED that a copy of this order be filed in the office of the Register of Deeds of New Hanover County.
