ASSEMBLY
The New Hanover County Board of Commissioners met for a Special Meeting on Monday, May 20, 2013,
at 12:00 p.m. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street, Wilmington,
NC.
Members present: Chairman Woody White: Vice-Chair Beth Dawson: Commissioner Jonathan Barfield,
Jr.: Commissioner Brian M. Berger:and Commissioner Thomas Wolfe.
Staff present: County Attorney Wanda M. Copley: County Manager Chris Coudriet: and Clerk to the Board
Sheila L. Schuh.
Others present: Assistant County Attorney Sharon Huffman and Deputy Clerk to the Board Teresa Elmore.
Representation for Commissioner Berger: Attorney Christopher J. Anglin.
Chairman White called the Special Meeting to order for the purpose of considering an Amotion Petition
and whether Commissioner Brian Berger should be removed from office.
The Board conducted the Amotion Hearing with Chairman White calling breaks from 1:25 p.m. until 1:38
p.m. and from 2:57 p.m.until 3:10 p.m.
After a lengthy question and answer period and deliberations, hearing no further discussion, Chairman
White declared the Amotion Hearing closed and requested direction from the Board.
MOTION: Commissioner Wolfe MOVED, SECONDED by Vice-Chair Dawson, to remove Commissioner Brian
Berger as County Commissioner of New Hanover County. Upon vote, the MOTION CARRIED 3 TO 2.
Commissioners Barfield and Berger voted in opposition.
The Board directed staff to expeditiously prepare the Findings of Fact and Conclusions of Law to be signed
and seined on Mr. Berger.
ADJOURNMENT
There being no further business, Chairman White adjourned the meeting at 3:56 p.m.
