ASSEMBLY -
The regular semimonthly meeting of the New Hanover County Board of Commissioner's
was held on this date at 9:00 A. M. in the Commissioners' Office of the Court House with
the following members in attendance: Chairman J. M. Hall, Jr., Commissioners Peter H.
Braak, L. E. Broadhurst, J. Uan B. Metts, Jr. and Ernest R. Mayhan, County Auditor
T. D. Love, Jr., and County Attorney L. Bradford Tillery. ,I

' INVOCATION - I
The Chairman called the meeting to order and asked Reverend C. L. Stamp, i
Pastor of the Church of the Open Door at Seagate, to give a prayer of invocation. i
APPROVAL OF THE MINUTES
The Executive Secretary requested the Board to decide iY they wished to re-
cord the minutes of the Budget Discussion Meetings in the permanent records as in his
opinion some of the decisions were policy making. After a brief discussion, Mr. Metts
offered a moion that the minutes of the regular meeting on July lsth be approved as writ?'-
ten and that the Budget Discussion Minutes be left until a later date. It was seconded b.i
Mr. Niayhan and unanimously carried. '

JOINTLY OWNED TAX FORECLOSED PROPERTY -
The Executive 5ecreLary reported that he had an offer for the purchase of the II
County's undivided interest in two lots located in Bl.ock 350 which has been approved for
sale for a total of $1230.00 subJect to approval of the City Council. The Council is not '
Willing to sell their undivided interest at the appraised value of $1230.00. After a
brief consideration, the Board decided that since all the past ,jointly owned property had
been sold by mutual agreement, they are not inclined to sell their undivided interest
without the City agreeing. By common consent, the Board zgreed, however, thet they would
1 sell at the C1ty's appralsal value of $1730.00.
\ AIR CONDITIONING - PLANNING OFFICE
The Chairman advised the Board of a written request from the Board of Trustees
of New Hanover Memorial Hospitai for air conditioning their Planning Office in the Court
House occupied by the Director. By common consent, it was decided that since it was so
late in the season and it is hoped that the office is only temporary that they would not a,;r
condition it this year.
?CLEAN UP- JOINTLY OWNED PROPERTY '
The ExecuLive Secretary reported that City Nanager E. C. Brandon, Jr. had re-
quested a policy from ttie County with reference to bearing the cost of cleaning up the
,Jointly owned property which has been allowed to grow up in weeds and much of it has ,
debris thrown on it. The Health Department has insisted that the City Ordinance be
enforced.on all vacant lots. It is inconsistent and untenable to enforce thetlean-up li
Ordinance on privately owned lots and charge the cost to the owners and not clean up i?
the ,}ointly owned lots in the same manner. After a brief discussion of this subject, it I
was decided to allow the City to clean them up and charge the cost on the same basis as
?the undivided interest owned by the County. It will then be deducted from the sale price.l
NUISANCE COMPLAINT -
-- Mr. A. I. Lee and a group of citizens from the Myrtle Grove neighborhood of ?
the County reported that some property owners in their vicinity were allowing hogs to be
kept on a commercial basis. It is very obnoxious from the standpoint of ,odors and the ?I
flies are Lerrible. They report that raw slop is being fed to the hogs which is against 'I
the law. This has been reported to the Board of Health which has made an investigation '
,., of the matter and have ordered the owners to either cook the raw slop or change to dry
feed. The hog pens are a legal distance from any house and the Health Department has no
further legal ,jurisdiction. The situation is so bad that the citizens are appealing to
the Board of Commissioners for some relief. The County Attorney ruled that the Planning
and 2oning laws are not yet effective and therefore the County Commissioners have no legal
authority to interfere with it. He suggested that the only ,..gpparent redress is for the.
citizens to employ council and seek to have it declared a nuisance and let the Court
make legal disposition of it. The Chairman explained that the County is now in the pro-
? cess of setting up a Planning and Zoning Board and that eventually restrictive ordinances will be passed that cen control future situaLions of this nature but at present they zre
unable to go beyond their present legal authority. The ExeCUtive Secretary was instructed to
see if he could determine the names of the owners of the hogs and explain the complaint thct
has been made about the obnoxious conditions.
\ ELECTION MACHINERY -
Complying with the requests made at the Budget Discussion Meeting on July lOth,
Mr. A. Webb Chenbweth, representing the Shoup Voting Machine Corporation, reported that
he had made a survey and analysis of the election machinery in New Hanover: He used the I
1960 election voter participation figures and the 1963 registration and found that many
voters have not re-registered and,the potential need is clearly indicated for a more effect- ?
ive system. Based on these observations, he recommends a minimum of 50 voting machines wi&
a maximum of 55 in order to adequately serve the voters. The approximate cost would be ?
$1850.00 per machine. They may be purchased on a cash basis or on a lease purchase basis
over a period of up to 10 years with a nominal interest rate. The Chairman then requested ,
a report from the committee comprised of Messrs. L. E. Broadhurst and Ernest R. Mayhan.
Mx. Mayhan acted as spokesman and reported that after studying the overall election picture,j
they recommend that the voting system remain as is for the time being. He moved that the
report be accepted and that the recommendation be approved and thzt further negotiations
be made with the City of Wilmington in reference to their participation in future elections.
It was seconded by Nr. Broadhurst and unanimously adopted.
ENTERTAINMENT - BATTLESHIP REUNION
, The Chairman informed the Board thzt he had been approached by local residents
to participate equally with the City in a modest reception for the members of the former
crew of the USS Battleship North Carolina who are having a reunion for the first time
I since the war. He explained $hat it would not be a recurring item. The total cost
I amounted to $225.00 and the City will pay one-half of it or $112.50 and the County is to
1 pay a like amount. Mr. Mayhan moved that the bill for $112.50 be approved for this pur-
pose and a check issued to cover it from the Entertzinment Fund. It was seconded by Mr.

MICROFILMING -
Mr. James B. Swails, Chairman of the Committee, appointed sometime ago for the
purpose of studying the feasibility of changing the method of recording instruments in the
offices of the Clerk of Superior Court and the Register of Deeds, reported that after in-
vestigation by his Committee they have come to the conclusion that it would be unwise to
change the method now being used during a period of the last 65 years and they strongly
oppose the use of photographic or processing for real estate conveyances for New Hanover
County. Upon motion of W. Broadhurst, seconded by Mr. Mayhan, the report was accepted
and the invoice for expenses incurred in making the investigation ordered paid.
CONINIUNITY HOSPITAL - DIRECTORS ?
The Chairman read a letter from the Administrator of Community Hospital report-
that the Board of Directors recommend the reappointment of Messrs. Milton Fleishman and
E. L. Ward as members on that Board and the appointments of Dr. James G. Boyes,.Jr. to
represent the Medical Staff on the Board. Upon motion of Mr. Braak,. seconded by Mr. Mayhan,
the Board unanimously approved these recommendations.
PUBLIC INSTITUTIONAL PROPERTY - ?
The Chairman read a report from the State Fire Insurance Rating Bureau making
certain recommendations for improvements in connection with the Public Institutional Pro-
perty Insurance Coverages now being written on County Buildings and equipment. It was re-
ferred to Mr. Metts who recommended that the Executive Secretary have the custodians cor-
rect as much as possible.
WILMINGTON COLLEGE - . ?
The Chairman read a letter from the President of Wilmington College calling
attention to what he considers a dangerous situation at the intersection of the college
camptis entrance and College Road (N. C. #132). He recommends that a.study be made of the
situa.tion and some thought given.to remedy the difficulty which is experienced in trying
to turn either right or left on the heavily traveled road. He suggests that investigation
might show that a stop light is desirable or at least some sort of turn out strips. He
requests the Board to do whatever it can do to improve the matter. By common consent,
the Board authorized the Executive Secretary to refer the matter to the State Highway Depart-
ment for Lheir investigation and recommendation.
BLOGADE RUNNER ACCOMODATIONS - /
The Chairman informed the Board that before going to the 5tate Association of
County Commissioners' Convention to be held on August 18th - 21st and renewing our invita-
tion to the Association to meet in New Hanover County in 1964 he has contacted the man in
charge• of reservations and discovered that the only open date at this time for 1964 is
September 15th. He has notified Secretary J. Alex McMahon, who will come to Wilmington
on August 9th and make a further investigation about accomodations for Lhe 1964 Convention.
BIRD SANCTUARY - ?
The County Attorney presented the Board with the following Ordinance at the re-
quest of C. McD,Davis estah23shing a Bird Sanctuary, within the boundaries of the property
described:
O R D I N A N C E
Pursuant to the provisions of N. C. General Statutes 160-166.1, 166.2, the
Board of Commissioners of New Hamver County hereby declares that the following
described property is a bird santtuary:
8eing all of Tracts 1, 2 and 3 contained 3n a warranty deed from R. B. Davis,
' et al, to C. McD. Davis, which deed is duly recorded in Book 624 at Page $68,
of the New Hanover County Registry, reference to which is hereby made for a
more complete description. Excepted from the provisions of this Ordinance are
all tracts excepted in the deed above referred to.and all tracts which have
been conveyed by C. McD. Davis subsequent to February 12, 1959, and prior to
the date of adoption of this Ordinance.
It shall be unlawfui for any person to hunt, kill, or trap any birds within'the
boundaries of the above described property. Any person violating the provisions
of this Ordinance shall be guilty of a misdemeanor and, upon conviction, shall be
fined not more than FIFTY DOLLARS ($50.00) nor imprisoned not more than thirty
(30) days.

Resolution and authorized the Chairman to sign it in behaif of the County. •
STREET CLOSING - '
' The Chairman read a petition from the City Council giving notice that the
Board of Education has applied to them for the closing of Taylor Street between 8th 8 9th
N and a portion of-Brooklyn Street between Howard d Taylor and Taylor and Nixon. They re-
quest that any objecLion be registered by 10:00 A. M. on August 8th. The Board had no
obJections.

ever be able to return to her work. The question of some extra help to carry on the
work was raised and the Register of Deeds needs to know how long they would be willing
to carry the sick employee and if she should immediately employ extra help to keep up ?
the work. After a brief discussion, it was decided that it should be left up to the
Department Hezd to use her own judgemenL as she is far more familiar with the circumstance?s
( and conditions than enyone else. .
TAX SUPERVISOR -
The question of a Tax Supervisor for the next two years was discussed, after
which Mr. Mayhan moved that T. D. Love, Jr. be reappointed as Tax Supervisor for the next '
two years. It was seconded by Mr. Metts and unanimously approved. I
? RECORDERS COURT - AUDIT
County Auditor T. D. Love, Jr, reported that he had made an inspection of the
Recorders Court records and reconciled their.balance with the bank and found them in ?
agreement, however, he did report that there had been considerable lax and faulty handling,
inasmuch as some of the deposits were not being made on a day to day basis and some of
the records were sloppily handled but he has made suggestions for improvement in the '
handling and corrections are being made which he thinks will prove satisfactory for handli'1g
future business. He suggested thzt if the Commissioners would allow him. to make his
report at th¢ meeting at the middle of the month instead of the first it'would be much j
easier for him to get a complete record. After a brief discussion which established that !
no extra help is deemed necessary to maintain carrent records, the Board, by unanimous
common consent, approved making the report in the future on the third Monday of each month
instead of the first.
l MAP RECORDING -
Mr. Howard M. Loughlin, a local surveyor, reported that during the early part
of 1963 he had mapped out a subdivision called Northwoods and had checked the records
with reference to certain names with the County Commissioners' Office and found no dupli-
cation, therefore, they proceeded with planning the subdivision. Last Saturday, August
3rd, when he attempted to register the map of the Northwood Subdivision he found that
another surveyor had recorded a map which evidently had not been checked against the
records for duplication for names and he requests the Commissioners to have it withdrawn.
After conferring with the County Attorney, it was decided that the Commissioners have
no legal right to interfere with the recording of subdivision names but they do have
authority for the naming of streets, roads, etc. The Attorney suggested that the Plannin
and Zoning Board should take up matters of this kind and help to resolve them by recom=
mending ordinances or some control over the names of developments and subdivisions. ,
MEETING POSTPONEMENT -
The Executive Secretary called attention to the fact that the next regular
meeting of the Board is scheduled to fall on August 19th at which time most of the Board
would be attending the State Association Convention. By common consent of the Board,
it was decided to dispense with the meeting scheduled for August 19th with the understand-
ing that an.emergent meeting can be called at the discretion of the Chairman, otherwise,
the next meeting will be held on Tuesday, September 3rd, inasmuch as Monday, the 2nd,
\ is Labor Day. _
? xon GuaxD -
The Chairman stated that he had been approached for the purpose of selecting
possible leaders to organi2e a cadre to replace the National Guard in event of an emer-
gency and they were called out of the County or into Federal service. It might become
, necessary for local protection of life and property in event of emergencies.
CERTIFICATES OF AWARDS -
The Executive Secretary reported Lhat he had interviewed the Wilmington Print-
ing Company who furnished descriptive certificates suitable for making the awards which
the Board authorized at the last meeting. By common consent, authorization was given for
ordering 500 certificates to be presented at the meeting on September 16th.
