He stated that it was his understanding when the Tate Ambulance Company li agreed to establish a service here in the County that the County would not support any ?I other ambulance service and that since the County had paid insurance on some of'the vehicles used by the Rescue Squad he feit that it was not ethical. He has been informec by the Civil Defense Agency that it likewise is a violati.on of the proper use of the vehicles which i?ere secured through that agency and in which title is still vested in ttie Civil Defense Aaency. The Execvtive Secretary was instructed to investigate to see if it is feasible to cancel the insurance and recover a portion of the premium. (After discussing the cancellation of coverage with the Civil Defense Director, Mr. Spotswood t. Huntt, it was decided that the coverage should not be cancelled until after the vehicle:' were safely in their possession. The Rescue Squad refuses to give up the vehicles which makes it necessary to take legal stgps for their recovery.) COUNTY FARM AND HOME - ° Commissioner Braak, who is the County Farm and Home Committee, stated that he would like to have an expression from the Board as to how they felt about the con- tinuation of, operating another year. If it is decided to operate the farm another year it will be necessary to employ a farmer, as well as begin preparations of the farm for the crops to be planted. The Chairman explained that he had requested the County Auditor to make a comparative study of the cost of operating the Farm and Home and assur the Board that he would have some figures for their consideration at the next meeting and they could make a decision at that time. (The Executive Secretary was instructed to remind the Auditbr to have the figures ready.) REPORTS - The fo'llowing reports were reviewed and ordered filed for reference: 1- County Agricultural Agent's Report for January 1964. 2- New Hanover Memorial Hospital Revenue & Expenditures from January 1,1962 to December 31, 1963. 3- U. S. O. Report for January 1964 !}- Wilmington Public Library Report for January 1964. March 2, 1964 ASSEMBLY The New Hanover County Board of Commissioners met on this date at 9:00 A. M.I in the Commissioners' Room of the County Court House with the following members in attendance: Chairman J. M. Hall, Jr., Commissioners Peter H. Bra?k,?? Ernest R. May-, han and John Van B. Metts, Jr., County Attorney L. Bradford Tillery and County Auditor T. D. Love, Jr. * L. E. Broadhurst , INVOCATION - Chairman Hall called the meetina to order and asked Reverend R. L. Bame, Pastor of the Fifth Avenue Methodist Church, to open the meeting with a prayer of guida ce. APPROVAL OF THE MINUTES - I Upon motion of Mr. Metts, seconded by Mr. Mayhan, the minutes of February 17th, copies having been mailed to each of the members, were unanimously approved. - ' COUNTY PLANNING AND ZONING Mr. Henry E. Miller, President of the Wilmington Building Contractors ? Association, appeared before the Board in support of the recommendations made by the County Planning and Zoning Board on ,lanuary 31, 1964 and recorded in the minutes of February 3, 1964. He reported it is the opinion of the Associatidn that the Connty should have a competent Building Inspector not just someone to issue permits and collec fees. He suggested the feasibility of having a combination Building and Electrical ?? Inspector which should be on a self supporting basis. They recommend that it be tied in with the City Planning Board in order for them to work together but there should be ? a County Inspector controlled by the County Planning and Zoning Board. He further j recommended that an ordinance be passed to standardi2e the buiidings in the County, particularly in:small construction where a code is most needed. He stated that the General Statutes had passed an Enabling Act for this purpose and pledged their coopera- tion. The Chairman thanked Mr. Miller for discussing this important matter and sug- gested that the recommendation for the ordinance be passed on to the County Planning ? and Zoning Board for their consideration. (The County Planning and Zoning Board has a meeting scheduled for Thursday night, March 5th and invited representatives from the Wilmington Building Contractors Association.) SENCSA - ? Director Mr. W: C. Mitcham, Executive/of SENCBA appeared before the Board in support of letters which were read by-the Chairman requesting that the Board appoint two repre- sentatives to serve as members of the Board of Directors for SENCBA, one of which should be the Chairman of the Board of County Commissioners and recommending that the continued- ` I ' ?? ? Herbert D. Hale, a retired marine, appeared before the Board and stated Ithat he was interested in reactivating soft ball leaguesin New Hanover County for this year ? and alleged that the center of population is near the Lincoin Forest Subdivision. He pro-?? posed to clean up an areaof Hugh MacRae Park on the southwest side of South College Road ? (A?.C. #132) and make it more attractive, as at present it is strewn over with garbage and trash. He stated that a preliminary survey indicated that a suitable soft ball playino field could be constructed by cutting only three trees. He reported that this area would bannexed by the City of Wilmington and that the Parks and Recreation Department of the 'City wovld assist and cooperate in the project. ?The Chairman explained the terms of the 'deed grar.ting the land to the County contains certain restrictive provisions and suggested that the matter be discussed with heirs of the NacRae family. He stated that Mr. Mayhan was the County Commissioners'representative for Hugh IviacRae Park and would be glad to cooperate in bhe development of t]'iis idea provided there would be no expense to the County. Mr. Hale reported that he had an appointment with Mr, Hugh Morton tomorrow morning to discuss the mat- . II ter and promised to report to Nr.,Mayhan whatever agreement was reached. CITY AND COUNTY AGREEMENT - County Attorney L. Bradford Tillery reported that he and the City Attorney had • finally drawn a deed covering the transfer of a certain parcel of land amounting to 44 acres in accordance with an understanding between the County Commissioners and the City Council on Auaust 20, 1962. He suggested that the Soard authorize the Chairman to execute the deed of Iconveyance, subject to the approval of the County Attorney and in agreement with the.under- ,standing recorded in the minutes of August 20, 1962, After a brief discussion, Mr. Metts offered a motion that J. M. Hall, Jr. be authorized to execute the..deed as outlined above. It was seconded by Mr. Mayhan and unanimously carried. FORT FISHER EROSION Mr. Metts recalled that on Janvary 6, 1964, a delegation appeared before the Board m the interest of the erosion at Fort Fisher. At that time, the Executive Secretary was dir- 'ected to write certain people connected with the State Highway Commission, North Carolina ISeashore Commission and others who mioht be interested. He suogested that since we have not iheard abouL any moves being made to take any action on this problem, that the Chairman should Igo to Raleigh and discuss it to see just what can be done. After discussing the matter, Mr. Metts offered a motion that the Chairman be authorized to make this trip. It was second- led.by Mr. Broadhurst and Mr. Mayhan and unanimously carried. INDUSTRY APPRECIATION 4JEEK Chairman Hall reported to the Board that he had received a letter from the Pres- ident of the State Association of County Commissioners, as well as the monthly Newsletter from Mr. McMahon,calling attention to the plans which are under way for Industry Appreciation Week for April 12-18th. The State Association is cooperatina with the North Carolina Depart- ment of Conservation arid Development in organizing the observance which they feel will be ex- itremely beneficial to the County's industrial growth. He recalled that the last time it was in connection with the Chamber of Commerce and the Committee of 100 and suggested that similar plans be made this time. After discussing this subject, Mr. Metts offered a motion that it be approved in principal and that the Chairman proceed with plans.as outlined. It was second- ed by Mr. Braak and unanimously approved. ICOURTS COtUiMISSION HEAR.ING The Chairman reminded the Board that the North Carolina Gourts Commission will hold a Hearing on March 13th at 10:00 otclock A. M. at the Institute of Government in Chapel ,Hiil. He stated that the legislative committee of the State Association has scheduled a meeting for 10:00 A. M. Friday, March bth at.the Institute of Government for Lhe purpose Ilof developing the position the State Association will take with reference to matters relat- ing to the uniform court system such as the responsibiliLy of the courtrooms, determination of salaries of employees in the offices of the Cierk of Coirrt and other questions which might Idirectly affect county government. He urged all the Commissioners who could go to attend this Hearing and instructed the County Attorney and the County Auditor to arrange to be at athis meeting if at all possible, ISAAC BEAR BUILDING RAZInIG The Chairman read a Resolution from the New Hanover County Board of Education which stated that after due investigation and consideration they found as a fact that it would not be economical to try to repair the building and recommended that it be torn down and dismantled, preserving only the auditorium wing of the buildino. It requests the acquiescence and consent of the New Hanover County Board of Conmissioners. After a brief discussion, Mr. Metts offered a rr?otion that the Board concur in the recommendation providing the cost of demolition is paid out of the proceeds of the existing School Building Budget, at no additional cost., It was seconded by Mr. Mayhan and unanimously adopted. The Chair- man instructed the Executiue Secretary to write the Superintendent of Schools and advise him of this action, ",HEACH EROSION COPITROL - The Chairman read a letter from the County Extension Aoent, D. D. Baggett, saying Ithat they are planning three demonstration plantings of American Beach Grass for the pvrpose lof beach erosion control. They are planning one of these for Wrightsville Beach and two ?at Carolina Beach of one-fourth acre each. They request the assistance of some prison labor, about 10 men, to help put out the demonstrations on Thursday and Friday, March 12th and 13th. IAfter due consideration, the Board instructed the Executive Secretary to arrange to furnish whatever help is needed. i A F` 295, Minutes of the_Meeting .......Narch 2, 1961a. Cont,inued_ BEER PERMIT - The following application for a Beer Permit was reviewed and upon motion of Mr. Broadhurst, seconded by Mr. Metts, was unanimously approved and referred to the Sheriff's department for investigation and consideration: Eugene C. Newman T/A Newman's Grocery 603 Red Cross St. CORONER - TELEPHONE I Mr. Braalt reported that the newly appointed Coroner, L. Starr P?iacMillan,had ? to make an emergency telephone call in connection with his duties recently. Normally, I? they are made on a collect basis but on this particular instance, it did not seem wise or expedient to call collect. The Coroner requests permission to have the charges to his telephone paid by the County when it is official business. After a brief discussiorl, Mr. Braak offered a motion that the Coroner be authorized to charge emergency calls to the Commissioners Office or Sheriff's Department telephone, provIded that a record is made and notice given to the Secretary. It was seconded by Mr. Mayhan and unanimouslyll approved. TAX ABSTRACT - The Executive Secretary presented two tax abstracts coverino taxes levied in 1956 and 1957 on property which was acquired by the Federal government as part of thelIr buffer zone tract. One of them amounted to $3.87 on Lot 11 in Bloc}t 25 at Fort Fisher, formerly owned by R. A. Ellis, the other amounts to $4.99 for New Hanover County and $5.26 for the Town of Carolina Beach. It is on Lot #19 in Block 116 of Carolina Beach, formerly owned by C. A. Slate. The attorneys overlooked these taxes when they were I seatcfiing titles and the Federal government refuses to pay the tax and the criginal ownei?,s have received payment for their property on which the tax was levied. After a brief discussion, the Board deci ed not to abate the taxes but instructed the Executive Secre- tary to urge,th Ta Coll tor to lpga,tee,the original owners and see if he could collect from them. MERIT SYSTEM COUNCIL - The Chairnan read a letter from the Merit System Supervisor stating that the , Council, after reviewing the pay plan for ali local agencies, have agreed to leave it I unchanoed for the next fiscal year. He called attention to the possibility that this ' decision to hold the line at this time may result in a fairly substantial change in the fiscal year 1965-1966. DISTRICT MEETING Mr. Metts reported on the District Neeting held in Kenansville on the 27th. He suggested that the County make a survey of approximately 500 businesses to determine the wages paid for certain job classifications inside the County. He thinks this will prove helpful in discussing salary ranges with the Merit System Council in the future. He suggested that the type of questionnaire be left up to the Executive Secretary but stated that a job description should be included. After a brief discussion, the Board, by common consent, instructed the Executive Secretary to proceed to make this survey by Budget time. . TRAFFIC SAFETY COUNCIL - Mr. Metts reported that he had attended a meeting on Monday, February 24th at which time it was explained that the new interest in a City - County Safety Commiss- ion did not propose to dissolve the present Citizenst Traffic Council but to coordinate the Safety activities of the Greater Wilmington area by enlisting the cooperation of the Sheriff's Department, Judge of Recorder's Court, Chairman of the County Commiss- ioners and to request the cooperation of the other governing units in the County, in- cluding the Chief of Police of each, along with Sgt. A. H. Clark and the Mayors, to ; form the Greater Wilmington Safety Council. The functions of this committee are record- ed in the minutes of the meeting of February 17th. The president will act as liason officer between the Citizens Traffic Council and the Greater Wiimington Safety Council. Aftes;some-discussion, Mr. Broadhurst offered a motiori that the Board go on record as approving the Safety Council for the County to work with the Citizens Traffic Council. It was seconded by Mr. Braak and unanimously approved. The Executive Secretary was in- structed to write the various persons informing them of their appointment as members of the Greater Wilmington Safety Council. HOLIDAYS - A discussion of the established holidays resulted in a suggestion by Mr. Braak that holidays be established for the following calendar ysar at the last meeting of the Board in December and that for the balance of 1964 the question be brought up at the next meeting in view of some of the established holidays coming on Saturday and some of them on Sunday. It was the common consent of the Board that the County should observe holidays on the same basis as business offices, banks and savings and loan associaLions, SCHOOL COSTS - The question of the costs of building schools was discussed at which time it developed that the S'tate has a miximum per square foot cost above which they will not participate. Generally,additional per sqvare foot costs depends on the "extras" or "frills" which the State will not help pay for. Some question has been raised as to what the local building costs amount to and the Chairman agreed to look into the matter and report to the Board at a later meeting. WELFARE LIENS The County Attorney reported that he had looked into the matter of handling welfare liens but had no definite recommendation to make in regard to it. He has dis- cusse_d the matter with W. Allen Cobb, the Assistant Solicitor,who disclaimed any know- ledge of an agreement with the Board of Commissioners for handlino this extra work which was placed.on him at the meeting of Aucust 3rd, 1959 as an amendment to the appropria- tion resolution granting an 8% raise in salary provided the welfare liens were handled by his office. The County Attorney does not think it'Is a part of a solicitors duty and after some discussion agreed to tentatively accept the responsibility of handling the welfare liens on the basis that he would receive 25% of the first $500.00 collected, and 20% of any additional as a fee. Upon motion of Mr. Metts, seconded by Mr. Braak, the Board unanimously approved this transfer. Henry ` Kure Beach 200.00 1963 2.80 After an exptanation on each one, which satisfied the Board with the exception of #3102 Ilwhich is a case where a large land owner sold a lot in November of 1963 out of an acreage on wnich the taxes were paid and in order to separate the lot from the valuation which was placed on the lot and taxes paid for the two months. The Tax Supervisor had interpreted this as a duplication in payment of taxes but the Board instructed the Tax Supervisor that this was incorrect and in the future no adjustments would be made of this nature. They Nthen, by common consent, approved the abatements. REPORT - GRAND JURY The Chairman read the Grand Jury report for the month oi February, 1964 Criminal term of covrt in which they recommended parking facilities be made available for members of ?the Grand Jury. As this is an impossibility with the present parking facilities; no action was taken in this matter.
