Meeting of October 22, 1956 - Continued - A record form concerning data on real estate transactions and transfers kept by the Regis- ter of Deeds was requested by the Director of the Pederal Bureau of the.Census and was re- .ferred to Mr. R. L. Black, Register of Deeds. ? The following resolution concerning a request of the City of Wilmington to be released from P°"fll-'? the operation of certain restrictions in the Deed conveying the Legion Stadium property from the County to the City was received from Wilmington Post 10, American Leg-ion, in which the County Comnussioners, upon motion of rIr. Holton, seconded by.Mr. Braa dhurst, concurred with the request of the Legion: _ WIIEREA5, Wilmington Post 10 of the American Legion, DeparUnent of North Carolina was instrumental in the development of the Legion Stadium property; and CML+'EE?EAS, this Post has been requested to give an expression of opinion to the Board of County Coromissioners of New Hanover County re.lating to the request made by the City of Wilmington, the present owners of said property, that certain restrictions limiting the use of said property for recreational, educational,'athletic and other like purposes be re- moved; and WHEREAS, the membership of this Post has no desire to impede development of the facilities at the Legion Stadiwn and wholeheartedly concurs in all efforts to make it self- sufficient, but feels that the basic purposes for which the Stadium and facilities were es- tablished should be maintained, and feels that as an added safeguard to this end it is wise to have the concurrence of both the Governing Body of the City of Wilmington and of New Han- over County after a Full disclosure of all facts and full knowledge oP what proposed'uses are contemplated before the present restrictions are removed; and WIIEItEAS, this Post feels that in no event should there be any ftmther encroach- ment upon the area now set aside for parking facilities; ' • NG[J, THEREFORE, BE IT RESOLVEA by Wilmington Post 10 of the American Legion, Department of North Carolina, at meeting assembled on this the 18th day of October, 1956, that in the opinion of the membership of this Post that should the occasion arise where the Governing Body of the City of Wilmington feels that it would be advisable to devote any part of the present Legion Stadium property to any specific use, or for any purpose other than for recreational, educational, athletic,, or other like mitnicipal purposes, that at such time such proposal should be submitted to the Governing Body of New EIanover County, who could at such time in the light of the circumstances_then existing, and if they deemed it advisable and in the best interests of the Community and the Legion Stadiwn facilities, then remove the existing restrictions on such specific portion of said property, or for such specific use; _ BE IT 1'URTfiER ftESOLVED, that it is the opinion of the MemUership of this Post that in no event=sYiould any further encroachment be made upon the a"rea now set aside for parking facilities. Mayhan, seconded Uy Mr. Hall, approved. Inasmuch as the Board has agreed to take steps during the 1957 Session of the Legi.slature to secure the passage of an Act to enaUle the Board to appoint a County IIuilding Inspector, Mr. R. T. Burne,y, b'oreman of the Grand Jury advised the Clerk of the Board that it would U be necessary'for the Commissibners to report further on the mai;ter at the October 29th Term of the Grand Jury as was 'requested. A resolution urging the County Commissioners to include Henniker Ditch in Federal Point Township, in the County-wiiie drainage program for clearing and maintenance, was received from the Town Council of Carolina Beach. fIenniker Ditch, lzowever has been maintained by the County for a nwnber of years. ? A list of ditch cleaning and drainage requests received from a number of residents through- out the County were turned over to 41r. Dave Rivenbark for investigation and processing. I A dragline drainage progres report was received from Mr. llave Rivenbark showing 983 feet completed on the Castle Hay???'}?'Ntigct for the weele ending October 26. .? A couununication was received from National Association of Assessing Officers urging attend- ance of County representatives upon the 22nd International Conference on Assessment Adminis- tration at Diiami Beach, Florida, November 25 through the 29. No action was taken at this time. A report was made to the Board of persorial injuries to Mr. Rhoda Farrow, County Employe while serving in the line of duty and damage to County's Truck at 7th and Orange Streets at l approximately 3:15 P.M., Friday, October 26, 1956, when struck by a Bostic riusic Company's hiotor Vehicle, necessitating Hospitalization for Mr. Farrow at James Walker Hospital. The matter was upon motiun of Mr. IIolton, referred to the County Attorney for legal handling. Upon motion of Mr. Broadhurst, $400.00 was ordered transferred from salaries to Capital Out- lay within the tax listing Budget toward the expense for the purchase of an electric type- writer for the Tax Listing llepartment, recommended by P4r. T. D. Love, County Auditor and Tax -Ta? Supervisor as a saving to the County in time and expense in tax work. Zn tlzis connection it was a greeable to the Board to let Air. Hollis, Superintendent of Public Welfare have the PhonAudograph (Dictaphone) formerly used in the Conwiissioners' Office, or to sell the same whichever may appear best. Upon motion of Pir. Hall, seconded by rir. Holton, Zebulon Vance Lewis, 63-year old indigent ? citizen xaho was discharged from James Walker Hospital and unable to feed himself or to meet his personal needs, was admitted to the County Home on recouvnendation of the Superintendent of the I'ublic Welfare. Atr. Hall reported progress on the County IIome repairs, and wiring in prison building tempor- arily held up pending the services oP an electrician. Mrs. Nina B. Tenuta, Bookkeeper for the Board of Education appeared at the reqixest of the J Board to explain that the amount of School Teachers'Retirement payments are based on fifty (50) percent of the avera.ge salary received for the five (5) preceding years to retirement, and the percentage of payment between the State and County is deteruiined by a New York Actuary based on the teacher's experience and time of service. The following resolution was upon motion of Mr. Hall, seconded by Mr. Broadhurst, adopted ?on recommendation of the Superintendent of Public idelfare: W1iFREAS, the County of New Hanover is the holder of record of an Old Age Assist- ance lien against J. A. Rivenbark filed in Lien Book No. 2, Page 463 on April 30, 1955, in the Office of the Clerl: of Superior Court of said County, and WHEREAS, the property owned by the said lienor is in need of necessary repairs and ? the Peoples Savings & Loan Association of Wilmington, North Carolina has made a loan to said •,Q?`' lienor, subject to the said Old Age Assistance lien being subordinated to the lien of the r6w` same Savings & Loan Association, and SJHEtiEAS, it is deemed to be to the best interest of the County that said loan be made to enable the lienor to malce necessary repairs to said property, and that the County lien for Old Age Assistance should be subordinated and made inferior to the lien of the Deed of Trust to G. lludley Humphrey, Trustee for said Association. That the lien of Neia Hanover County, recorded in Lien Book 2, Page 463, against J. A. Aivenbark is hereby subordinated to, and made inferior to the lien of that certain Deed of Trust executed by J. A. Rivenbark and wife, Aelen Rivenbark to G. Dudley Humphrey, Trustee for the Peoples Savings and Loan Association in the amotint of 61,500.00 and duly recorded in the Office of the Register of Deeds of Neca Hanover County on the lst day of November, 1956, and further tlzat the Chairman of this Board be and he is hereby authorized and directed to enter the subordination of said lien on the docket in the Office of the Superior Court of New Hanover County. f Upon notion of Pir. Diayhan, seconded by P1r, Hall, County bills No. 4500 to 4602 were approved for payment. A proposal to.amend the Act setting weekly meetings of the Board to tlaice a month instead of weekly was discussed briefly, but no action was taken. Pir. Mayhan, however, expressed him- self as not being in agreement caith the proposal, feeling weekly meetings kept the Commission- ers in closer and constant touch with the people which is to the best advantage ancl interest of all coiicerned. Love, County Auditor pi°esented.his Annual Report for the fiscal year ending June 30, 1956, and explained in detail the top items ancl reported tliat the County is in good sounci financial COI1CY1t.1011, and total Revenue received 'for the fiscal year was $3,168,211.72 and that approximately twenty (20) tnillion dollars inerease in tax values for 1956. ldith reference to insolvents 1953 and 1954 which represents uncollected personal property tax -ro-/ in the amount of $64,287.17 was on motion of Mr. Hall, seconded by Mr. Ptayhan ordered dropped from the list of County assets on reconunendatioii of the County Auditor, but was contained on the list of unpaid taxes for collection. Pir._Love further reported that the City was not properly reimUursing the County in its just proportionate share of the expense incurred in the preparation of the City-County Tax Books. At this point Mr. FIolton suggested that a compilation of the cost of the preparation and com- pletion of the City-County Tax Boolcs ancl taz listing January 1 be made and the City billed with half the cost. Mr. Hall said that tYie other Afunicipalities in the County should be billed accordingly. A copy of the Auditor's Report was furnished to each of the County Commissioners. Mr. Broadhurst suggested that bids on County Insurance be secured and consid.eration be given '?js°` to a blanket policy covering all insurance as a possible saving to the County. Afrs. Louise E. Jordan appeared to ask for improvements to the old Ford La,nding Road which runs from the 14rightsville Beach Highiaay at Seagate to the Sound, a distance of approximately 1/4 mile on which four (4) families reside. She was given a road petition on wl-,ich to make ap- plica.tion to the State Highway & 1'ublic ldorks Commission for improverrcents. Instructions were given to have P1r.
