1951-08-13 Regular Meeting Wilmir.gton, N. C., August 13, 1951. The regu7.ar weekly meeting of the Board was held at 10:00 o'ctock A.M. Present: Addison Hewletty Chairman, Claud O'Shields, Thurston C. Davis, Hal J. Love, ar:d Cour.ty Attorney Marsden Bel)amy. Copies of the minutes of the Board of August 6, 1951, having been furr.ished to the members of the Board and approved, reading of the same was therefore dispensed with. A request of Mr. Raymond D. Ghristmar, president of the Winter Park Civic Club for abatement of the 1950 taxes charged against the Club's property, lots 17/18/19 Winter Park, which was deeded by Hugh MacRae and Companp Niay 5, 1949, and actual construction of the building thereor, started December 23, 1949, to be used exclusinely for educational purposes, was upon motion of Mr. Davis, seconded by Mr. Love, granted upon receipt of auritter; statement showing the above faets. This beir,g the date set by the Board at meetirig of August 6tht 1951, to receive and open bids for the purchase of a station wagon for the John C. Wessell Tuberculosis Sanatorium, and notiee by advertisement to that effect having first appeared on Tuesday, August 7th, the County Attorney ruled that one weeks notice had not been given as required by law, therefore opening of the bids and further consideration of the matter was postponed until Tuesday, August 14th,1951> at 9:30 A.M. Walker and Lloyd S. Elkins, Special Attorneys appointed by the Court to defend and represent Wil2iam A. Burnett charged with murder, July term 1951, was approved on order of the Honorable Walter J. Bone, Judge Presiding. A request of ffir. Emmeo Bellamy to permit Oscar.Alleri to reclaim his property? lot 12 1 in block 6, Lone Grove, bought-in by the City and County for taxes, was upon motion of Mr.Love, seconded by Mr. O'Shields, grar,ted upon payment of $148.19, which is the amour.t of the taxes'and costs envolved, of which amount the City's 72? interest would equal $106.70, and the County's 28% interest $41.49, to which the City Council has agreed. And the Chairman and Clerk of this Board are hereby authorized and directed to sign a deed conveying the said property as aforesald in the name and on behalf of trhe Cour,ty. Upon motiox. of n4r. Tay].ortJr.1 Mayor of Wrightsvi]l.e Beach, cai..ling attei:tion to the traffic problem arisirig from the number of times the draw bridge over the inland waterway at Wrightsviile is raised to permit boats of different tqpes to pass through and urged that something be done in the way of having a draw bridge six to eight feet.higher than the present one, which would take care of small gasoline cruisres, or approxirr,ately seventy-five percer:t or more ,r of the boats using the waterway. Upon motion of Mr. 0'Shields, seconded by Mr.Lovej . the Board directed that the matter be referred to Mr. A. Wilbur Clark, Third Division State Highway Commissioner with request that cor.sideration be given the same when the State Highway and Public Works Commission undertake to repair the bridge during the current program of road improvements there. • Reports of the Grand Jury for the,June and July Criminal Terms of Superior Court were received and filed. Upon motion of Mr. Love, seconded by Mr. Davis, Benjamine James Bryan, 75 years old, ? sick ar,d unable to take care of himself, was on recommendation of the 5uperintendent ^C? of Public Welfare, admitted to the County Home. He is placing his home with an agent for rent and wili. pay board out of the rer:t. Upon motion of Mr. 0'Shields, seconded by Mr. Davis, the Board agreed to pay for current N,e for lights on the North Fast Cape Fear River Bridge outside the City, if the City will .,? take care of the lighting inside the City, provided the State Highway and Public Works Commission will put the ].ights ir: order for use, and Mr. James R. Benson, City Manager,be' , advised of this action and a copy of the letter forwarded to Mr. A. VJ11.bur CI.ark$ Third Division State Highviay Commissior;er at Fayetteville. A statement was received from the State Board of Public We].fare advising that $45,881.75 was sent to this Coui.ty for July for Old Age Assistance, Aid to Dependent Children, ? Permar.ently and Totally disabled, and for Administration. Upon motion of Mr. Loves seconded by Mr. Davis, the following resolution was adopted: WHEREAS, the New Hanover County Bar Association has advised the Board of Commissioners of New Hanover County, that it has been informed by Mr. John M. Strong, Administrative Assistant,to the Chief Justice of the Supreme Court of North Carolina, r; that it will be necessary to car:cel the first week of the regul.ar two week October CiviZ Term of Superior Court because of the fact that no Judge will be available to sit at that termq that a Judge wiil be available for a one week special term beginning September 249 1951, and WfiEREAS, the New Hanover County Bar Association has formallq requested that the Board of County Commissioners, by resolution, request the Chief Justice to assign a Judge to hold this Special. Term of Court. BE-ST-THEFiEPORE`RESOLVED that the Board of County Commissioners of New Hanover County u_animously request the Horiorab7.e Walter P. Stacy, Chief Justice of the Supreme Court of the State of icorth Carolina, to order a special, term of the Superior Court, for New Hanover County, for the trial of civil cases, to cor.vene on Monday, September 24, 1951, in lieu of the first aueek of civil court which was scheduled _to convene on Mor:day, October 8, 1951. BE IT FURTHER RESOLVEID that the C1erk of the Board of County Commissioners be, and he is hereby directed to furnish a copy of this'resolution to the Honorablo. Walter P. Stacy, Chief Justice of the Smpreme Court of the State of n orth Carolina at the earliest possible moment. It was borought to the attention of the Board that the incinerator at John C. Wesse?1 Tuberculosis Sat,atorium is r.ot functioning properly and wi11 not ur.til additional burners are instai_ied. Thereupon Mr. Love moved ar.d it was secorided by Mr. 0'Shields' and carried that the Architects be ir;structed to take the matter up with the Companq Ahb furi;ished the same to ascertain their attitude toward assuming the liability and the County Auditor take such steps necessary to have the troub].e corrected.
