The current CoastalCare Provider Council President is Ms. Rena Davenport, a resident of Hanover County. (LINC) to Apply for Grant Funding from the N.C. Governor's Crime Commission with New Hanover County as the Applicant Agency BRIEF SUMMARY: Leading Into New Communities, Inc. (LINC) facilitates the successful reentry of previously incarcerated persons back into society. The goal of the program is for clients to achieve sustained employment and be drug-free and crime-free, not returning to prison or jail. It is estimated that eighty to one hundred persons released from prison will receive services at the ME Roberts II Facility during 2014-2015. A request has been received from the Executive Director of LINC,Frankie Roberts, that New Hanover County participate as the applicant agency for a $75,000 grant application to N.C. Governor's Crime Commission. LINC will be responsible for the required 25% cash match. The County has served as the applicant on behalf of LINC for the past seven years. (LINO, Inc.) is the implementing organization. The approximate amount of the grant request is $75,000 for one year. Leading Into New Communities (LINC, Inc.) will be responsible for the required 25% cash match. LINC, Inc. has the vision of creating a successful re-entry into society of previously incarcerated persons through advocacy for policy change and individual rights and the provision of direct services through a strong, focused collaboration of organizations to develop knowledge, understanding and resources regarding re-entry. Priority outcomes are for clients to achieve sustained employment and be drug-free and crime-free, not returning to prison or jail. As eighty to one hundred persons released from prison are projected to receive services at the ME Roberts 11 Facility during 2014-2015, there are staff, equipment and supplies needed to provide intensive case management, substance abuse treatment and vocational education, training and experience effectively. NC Governors Crime Commission funding will be utilized to fund those activities in order to achieve the goat of decreasing County recidivism, decreasing substance abuse and acquiring employment for clients so they can become more self-reliant. Currently, the Department of Environmental Management has a 1998 Caterpillar D7R bulldozer that has exceeded its useful life at 13,526 hours of use and is no longer functional for the department's operations. Location: Saylors Watch, South College Road at Abaco Lane PIDs: R07100-003-420-000, R07100-003-388-000, R07100-003-061-000, R07100-003-060-000 Summary of Request The request is to modify Special Use Permit S-525 (03/05) to add an additional 20 residential units to the site, bringing the total from 82 units to 102 units. The increase to 102 total units would maximize the density allowed on the site, which is a High Density Residential Project within the R-15 Zoning District called Saylors Watch. The proposed change is in conformance to the additional requirements within the Zoning Ordinance and Subdivision Ordinance in regards to open space, landscaping and buffering requirements, parking, and impervious surface coverage. Access to the subject site is through an existing driveway to South College Road. A traffic count in October, 2013 near the subject site yielded that the average daily trip county (ADT) was 41,468. This figure represents an "F" Level of Service (LOS), meaning that traffic counts exceed the design capacity of the road, which is listed at 29,300. Based on the submitted Traffic Impact Worksheet, the modification does not warrant a Traffic Impact Analysis (TIA). On October 9, 2013, the Technical Review Committee (TRC) preliminarily reviewed the modification request. In general the TRC had no opposition to the modification request. After some discussion regarding a second vehicular access to the site, the item was tabled. On October 23, 2013, the TRC passed a motion to approve the modification request, which was altered from the previous TRC meeting to include a future stub to the adjacent, undeveloped property to the west of the site. S-525M, (11/13) Page 1 Board of Commissioners- December 9, 2013 ITEM: 15-2- 1 Preliminary Staff Findings of Fact (In Accordance with Section 71 of the New Hanover County Zoning Ordinance) Finding 1: The Board must find that the use will not materially endanger the public health or safety where proposed and developed according to the plan as submitted and approved. A. The subject property is located in the New Hanover County Fire Service District. B. The subject property is currently served by public water and sewer provided by the CFPUA. C. The site has direct access to South College Road which is classified by the Thoroughfare Classification Plan as an Arterial road. The Average Daily Trip count (ADT) on South College Road at Saylors Watch in October 2013 was 41,468 trips per day, representing a Level of Service (LOS) of "F", meaning that traffic counts exceed the design capacity of the road, which is listed at 29,300. D. The subject property is not located within any flood or archaeological areas and does not host any CAMA Areas of Environmental Concern (AEC). Staff Suggestion: Evidence in the record at this time supports a finding that the use will not materially endanger the public health or safety where proposed. Finding 2: The Board must find that the use meets all required conditions and specifications of the Zoning Ordinance. A. A site plan that meets the requirements of the Zoning Ordinance has been submitted. B. No significant trees exist within the proposed development area. C. The primary entrance to the property is through an existing commercial driveway that aligns with a median crossover. The additional units warrant a driveway permit revision from NC DOT. D. The Zoning Ordinance allows a maximum density of 10.2 units per acre for High Density Development projects in the R-15 zoning district. An increase of twenty units to a total of 102 units would not exceed the allowable maximum density of the site. E. Prior to release for construction of the proposed final phase, all existing permits would need to be updated as necessary or required. Staff Suggestion: Evidence in the record at this time supports a finding that the use meets all required conditions and specifications of the Zoning Ordinance. A. The subject property is zoned R-15, Residential District. B. High Density Development is permitted by Special Use Permit in the R-15 zoning district. C. The proposed project is adjacent to an existing High Density Development and an existing church, and a large vacant parcel under the planning and zoning jurisdiction of the City of Wilmington and zoned for multi-family use. D. Other High Density Development projects exist to the north and south along the South College Road corridor. E. Adequate landscaping can be accommodated on site. F. No evidence has been submitted that this project will decrease property values of residents who live nearby. Staff Suggestion: The evidence in the record at this time supports a finding that the use will not substantially injure the value of adjoining or abutting property. Finding 4: The Board must find that the location and character of the use if developed according to the plan as submitted and approved will be in harmony with the area in which it is to be located and in general conformity with the plan of development for New Hanover County. A. The 2006 Wilmington-New Hanover County CAMA Land Use Plan classifies the subject tract as Urban. The purpose of the Urban land use classification is to provide for continued intensive development and redevelopment of existing urban areas. B. The subject parcel is proximate to a recommendation in the 2013 Wilmington-New Hanover County Comprehensive Greenway Plan called the Central College Trail, a 3.5 mile trail that would connect the Hugh McRae Complex with the Monkey Junction and Myrtle Grove neighborhoods. Staff Suggestion: The evidence in the record at this time supports a finding that the use if developed according to the plan submitted and approved will be in harmony with the area in which it is to be located and in general conformity with the plan of development of New Hanover County. The Zoning Ordinance requires members to be appointed from different areas within the County's zoning jurisdiction. k Brief on Functions: The Board of Adjustment is recognition of human frailty. If it were possible for the legislative body to write a perfect zoning ordinance which would meet the needs of the community while at the same time avoiding hardship in individual cases, there would be no need for this board. Because that has been found near impossible,the Board of Adjustment has been introduced as an integral part of almost every smoothly operating zoning enforcement mechanism, serving as a "pop-off valve" to relieve pressures resulting from hardship cases. In New Hanover County, the duties of the Board fall into two general categories: Interpretation and Granting Variances. Interpretation: The function of the Board of Adjustment which is most closely similar to that of the courts is interpretation of the Ordinance. This function involves (a) interpreting the meaning of a parts of the Ordinance which are unclear,(b) applying the Ordinance to particular fact situations, and, if necessary, (c) correcting any mistakes or abuses of discretion which the zoning official may have made in administering the Ordinance. In exercising this power,the basic principle for the Board to keep in mind is that it must not vary the Ordinance. Its function here is to interpret and apply what the governing body has written, not to vary that legislative pronouncement to fit its own ideas. Its decisions must be in accord with what the Board believes to be the actual meaning and intent of the Ordinance. i Granting of Variances: General Statute 153A-345(d) provides that, "when practical difficulties or unnecessary hardships would result from carrying out the strict letter of a zoning ordinance, the 5 Board of Adjustment may, in passing upon appeals, vary or modify any regulation or provision of the Ordinance relating to the use of land, so that the spirit of the Ordinance is observed, public safety and welfare secured, and substantial justice done." Basically, a variance is a permit, which the Board may grant in certain situations, enabling a property owner to make use of his property in some way which is in conflict with the literal provisions of the Ordinance. Sometimes a lot so small or so peculiarly shaped that the owner would have great difficulty in complying with the yard requirements and yet erecting a suitable building. Sometimes contours of the terrain are such as to create hardships in complying with these requirements. Sometimes the lot is located in a cluster of nonconforming uses which will prevent the owner from securing any reasonable return from his land if he complies with the Ordinance (as where a lot in a residential district is surrounded by nonconforming business structures). When the Board grants exemptions from harsh provisions, it is"granting a variance."
