Meeting Minutes— Real Estate/Building Committee
The New Hanover County ABC Board Real Estate/Building Committee attended a meeting hosted by
LS3P at their Wilmington office on February 4,2014 at 1:00 PM.
1. Attendees:
NHC ABC Board:
Board Members: Robert Martenis,Vice Chair and David Matthews, Committee Member.
Staff: Gary Cain, Retail &LBD Operations Manager and Dan Sykes CEO.
Board Consultant: T.J. Land, Construction Manager.
LS3P Associates, LLC: Charles Boney, Principle and Taylor Simms, Senior Associate/Project
Manager.
2. The purpose of the meeting was to discuss an adjustment to the architect fee because the
construction contract bids came lower than anticipated. Mr. Boney provided proposal to the
Committee (Attachment "A"). The Committee did not render a formal decision at the time; the
information was to be discussed with the full Board at the next scheduled meeting(2/18/2014).
3. The group then turned its attention to the 17th/Castle Street project. Mr. Boney fielded several
questions from the Committee. Several options were briefly discussed regarding the project. It
was requested that Mr. Sykes prepare a presentation for the next Board meeting to present the
options for Board discussed.
4. A future meeting was not scheduled.

PLANNING In a meeting with the Building Committee on February 4,we presented the attached fee comparison
between our original fee,our amended fee,and the fee as bid. (See attached fee comparison dated
February 4, 2014).
We agreed to a reduction of our fee of$66,187,accompanied by the addition of$24,832 to cover our
added expenses associated with CFPUA's extensive permit requirements.The fee reduction was to be
CHARLESTON made from the remaining services in our contract.
COLUMBIA
GRE.NVLEE We now request an amendment to our contract to reflect these changes as follows:
CHARLOTTE
A) Reduce fee to reflect actual bid price: -$66,187
RALEIGH B) Add CFPUA-required services:
WILMIR'GTON McKim&Creed permitting services 14,062
LS3P permitting services 10,770
TOTAL FEE REDUCTION -41,355
We propose to incorporate these changes as two separate tasks on our invoices and will invoice them with
our services for the remaining months of construction. McKim and Creed's additional permitting services
will be invoiced immediately.
Thanks to you and the Board for considering our added efforts with CFPUA in making this fee adjustment.
Please forward this request to the County for preparation of an amendment. Call me if you have any
questions.
