Board of Commissioners - March 24, 2014 ITEM: 2 NEW HANOVER COUNTY BOARD OF COMMISSIONERS POVERTY AWARENESS MONTH PROCLAMATION WHEREAS, poverty is a critical social issue facing our county and state, an issue that has been greatly exacerbated by the recent economic recession; and WHEREAS, 16% of people in New Hanover County and 16.3% in the State of North Carolina live below the poverty line; and WHEREAS, poverty undermines the strength, wellbeing, and health of citizens as well as the fiscal health of our county. NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that March 2014 be recognized as "Poverty Awareness Month" in New Hanover County. New Hanover County Planning and Inspections is partnering with the New Hanover County Sheriffs Office to serve as the lead applicant for the City of Wilmington, UNCW, Wrightsville Beach and any other incorporated jurisdictions in the County who agree to participate, to obtain assistance from the Watch for Me NC Campaign. If selected to be Watch for Me NC campaign partners, law enforcement officers would receive training on relevant bicycle and pedestrian laws and receive educational campaign materials. Training and campaign materials are provided at no cost to the campaign partners. The County requests that in connection with the above mentioned projects that the County Manager or the Finance Director, with advice from the County Attorney and Bond Counsel, be authorized and directed to proceed and negotiate on behalf of the County the Contract for a principal amount not to exceed $20,000,000, for the financing of the projects. WHEREAS, the County hereby determines that the Project is essential to the County's proper, efficient and economic operation and to the general health and welfare of its citizens; that the financing of the Project will permit the County to carry out public functions that it is authorized by law to perform; and that entering into the Contract and the Deed of Trust are necessary and expedient for the County by virtue of the findings presented herein; WHEREAS, the County hereby determines that the Contract allows the County to purchase the Project and take title thereto at a favorable interest rate currently available in the financial marketplace and on terms advantageous to the County; WHEREAS, although the cost of financing the Project pursuant to the Contract is expected to exceed the cost of financing the Project pursuant to a bond financing for the same undertaking, the County hereby determines that the cost of financing the Project pursuant to the Contract and the Deed of Trust and the obligations of the County thereunder are preferable to a general obligation bond financing or revenue bond financing for several reasons, including but not limited to the following: (1) the cost of a special election necessary to approve a general obligation bond financing, as required by the laws of the Board of Commissioners - March 24, 2014 ITEM: 5 - 1 - 1 State, would result in the expenditure of significant funds; (2) the time required for a general obligation bond election would cause an unnecessary delay which would thereby decrease the financial benefits of the Project; and (3) revenues produced by the Project are insufficient to permit a revenue bond financing; WHEREAS, the County has determined and hereby determines that the estimated cost of financing the Project pursuant to the Contract reasonably compares with an estimate of similar costs under a general obligation bond financing for the same undertaking as a result of the findings delineated in the above preambles; WHEREAS, the County does not anticipate a future property tax increase to pay installment payments falling due under the Contract; WHEREAS, Parker Poe Adams & Bernstein LLP, as bond counsel, will render an opinion to the effect that entering into the Contract and the transactions contemplated thereby are authorized by law; WHEREAS, no deficiency judgment may be rendered against the County in any action for its breach of the Contract, and the taxing power of the County is not and may not be pledged in any way directly or indirectly or contingently to secure any moneys due under the Contract; Board of Commissioners - March 24, 2014 ITEM: 6 NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION AUTHORIZING NEW HANOVER COUNTY TO PAY ECONOMIC DEVELOPMENT INCENTIVES WHEREAS, Fortron Industries, LLC, or its parent company, Ticona, LLC, ( "Company ") proposed to expand its industrial facility in New Hanover County, NC; and WHEREAS, the Project will include capital improvements and retaining and potentially expanding high quality, well - paying job opportunities; and WHEREAS, in connection with the development of the Project, the Company shall invest at least $50 million in improvements and facilities that will be located on the property (collectively, the "Facility ") situated in New Hanover County and to retain and possibly expand the current staffing of 60 jobs; and WHEREAS, under a required Incentive Agreement ( "Agreement "), the County would agree not to award the economic development incentive grants until the Company reaches the jobs and facilities investment benchmarks, as those terms shall be defined in the required Agreement; and WHEREAS, the Company's location of the Project at the Facility would, in addition to bringing the jobs described above, produce revenue for local business and the County due to the employment of individuals and the spending of the Company; and WHEREAS, the Company's investment at the Facility would substantially enhance the County's property tax base and increase the County's property tax revenues; and WHEREAS, the employment and retention of sixty existing full -time persons and potential employment expansion at the Facility would create jobs for the area and provide a positive economic impact for the County; and WHEREAS, pursuant to the provisions of North Carolina General Statutes §158-7. 1, this Board of Commissioners deems it is desirable and in the best interest of the County and its businesses and residents to offer certain economic development incentives to the Company and to enter into an Agreement with the Company; and WHEREAS, this Board of Commissioners has organized and approved the holding of a public hearing at the Board's March 24, 2014 regular meeting, to discuss and approve certain economic development incentives to the Company. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of New Hanover County, as follows: 1. The Board of Commissioners approves appropriating and spending from the County's general fund amounts to make cash grants of $100,000 annually, totaling $500,000 over a period of five years, contingent upon the Company spending at least 50 million dollars for capital improvements (buildings, equipment and fixtures) at its New Hanover County facility, Board of Commissioners - March 24, 2014 ITEM: 6 - 1 - 1 and retaining 60 existing full -time employees and potentially expanding employment in New Hanover County. 2. To implement these incentives, the Board of Commissioners hereby authorizes County staff to prepare an Incentive Agreement and authorizes the Chairman of the Board of Commissioners and /or the County Manager to execute that Incentive Agreement on the County's behalf and to take all actions necessary to implement the actions and grants required by that Agreement. 3. By and with the approval of the County Attorney, the Chairman and /or County Manager is hereby authorized, empowered and directed to do any and all other acts and to execute any and all other documents deemed necessary and appropriate to consummate the transactions contemplated by this Resolution, including without limitation to negotiate and approve changes to that Agreement's language that does not increase the amounts of the cash grants the County is required to pay the Company, or decrease the amount the Company is required to refund the County under the Agreement, except that none of the above shall be authorized or empowered to do anything or execute any document which is in contravention, in any way, of the specific provisions of this Resolution. The USACE's systematic survey of the inlet's water depths provides the US Coast Guard the data needed to manage the inlet's navigation buoys. This inlet supports economic benefits to local businesses, commercial and for hire fisheries and the County's tourism industry. The project was annually budgeted by the federal government until approximately 2005. In 2011, it became apparent that there would be no more earmark funding for the project. In 2012, the USACE used supplemental federal funds from Hurricane Irene to fund the dredging. Additionally, the County did not budget any funds in the current fiscal year, knowing the USACE was going to use supplemental federal funds from Hurricane Sandy until they were depleted. To date, the remaining federal funds from Hurricane Sandy and the balance of the remaining state and local funds were used to maintain Carolina Beach Inlet. As of 1 January 2014, the USACE had $150,000 of these combined funds. The remaining will be depleted with the maintenance dredging scheduled in March. Following the USACE's March maintenance dredging, there will be no maintenance dredging funds for the last quarter of fiscal year 2014. Maintenance dredging should be performed in the fourth quarter of FY 2014 to ensure continued proper inlet access. The USACE's inlet maintenance dredging is routinely a cycle of fourteen days with a potential daily removal of 3,000 cubic yards of sand. The USACE is requesting $206,900 for maintenance dredging in the April -June time frame. The costs would be split evenly between the County and the NC Division of Water Resources with each paying $103,450. On March 6, 2014, the PWBC moved for each municipality to request 4th quarter funding participation from their respective boards. At their March meetings, the three beach towns, Carolina Beach, Kure Beach and Wrightsville Beach approved funding their recommended portion of the Carolina Beach Inlet dredging as shown below. The County anticipates the City of Wilmington to hear and vote on the request for their share on April 2, 2014. The purpose of the Comprehensive Plan Policy Recommendation Committee is to review all draft policies and recommendations created from citizen -led theme committees, identify policy conflicts, and finalize recommendations to be presented to the Planning Board as part of the implementation strategy of the Comprehensive Plan. The New Hanover County Comprehensive Plan is a document, used as a guide, that addresses our community's current development trends, determines a vision for how the County should develop over the next 25 years, and determines a plan for how to achieve this vision. Six individual themes have been established for the Comprehensive Plan and include; the Livable Built Environment, Harmony with Nature, Resilient Economy, Interwoven Equity, Healthy Community, and Responsible Regionalism. Citizen -led committees will review issues surrounding these themes, best management practices, and present policy recommendations to the Comprehensive Plan Policy Recommendation Committee. One representative from each theme committee will also serve on the Comprehensive Plan Policy Recommendation Committee. The Zoning Ordinance requires members to be appointed from different areas within the County's zoning jurisdiction. Brief on Functions: The Board of Adjustment is recognition of human frailty. If it were possible for the legislative body to write a perfect zoning ordinance which would meet the needs of the community while at the same time avoiding hardship in individual cases, there would be no need for this board. Because that has been found near impossible, the Board of Adjustment has been introduced as an integral part of almost every smoothly operating zoning enforcement mechanism, serving as a "pop -off valve" to relieve pressures resulting from hardship cases. In New Hanover County, the duties of the Board fall into two general categories: Interpretation and Granting Variances. Interpretation: The function of the Board of Adjustment which is most closely similar to that of the courts is interpretation of the Ordinance. This function involves (a) interpreting the meaning of parts of the Ordinance which are unclear, (b) applying the Ordinance to particular fact situations, and, if necessary, (c) correcting any mistakes or abuses of discretion which the zoning official may have made in administering the Ordinance. In exercising this power, the basic principle for the Board to keep in mind is that it must not vary the Ordinance. Its function here is to interpret and apply what the governing body has written, not to vary that legislative pronouncement to fit its own ideas. Its decisions must be in accord with what the Board believes to be the actual meaning and intent of the Ordinance. Granting of Variances: General Statute 153A- 345(d) provides that, "when practical difficulties or unnecessary hardships would result from carrying out the strict letter of a zoning ordinance, the Board of Adjustment may, in passing upon appeals, vary or modify any regulation or provision of the Ordinance relating to the use of land, so that the spirit of the Ordinance is observed, public safety and welfare secured, and substantial justice done." Basically, a variance is a permit, which the Board may grant in certain situations, enabling a property owner to make use of his property in some way which is in conflict with the literal provisions of the Ordinance. Sometimes a lot so small or so peculiarly shaped that the owner would have great difficulty in complying with the yard requirements and yet erecting a suitable building. Sometimes contours of the terrain are such as to create hardships in complying with these requirements. Sometimes the lot is located in a cluster of nonconforming uses which will prevent the owner from securing any reasonable return from his land if he complies with the Ordinance (as where a lot in a residential district is surrounded by nonconforming business structures). When the Board grants exemptions from harsh provisions, it is "granting a variance."
