Section 2: Explanation
The NC Department of Transportation has awarded a federal TAP(Transportation Alternatives Program)
grant to the County to construct a multi-use path along Middle Sound Loop Road from Oyster Lane to the
Middle Sound Village driveway. The Board approved the application for this grant on November 4,2013.
The grant requires a match in the amount of$22,500. The developer of Middle Sound Village is contributing
1 $15,000 towards the project and the County will use$7,500 from the escrow account which is intended to be 9
used for development of recreation,park or open space area.

This ordinance shall be effective upon its adoption.

County,North Carolina,that the Ordinance for Budget Amendment 14-068,amending the annual budget

Received additional allocation of$33,892 for the Crisis Intervention Program(CIP).The CIP Program
assists low income persons with heating and cooling related crisis.The CIP Program is part of the Low
Income Home Energy Assistance Program block grant.Households apply for the benefits at the local social
services agency.Each county receives an allocation to fund the CIP Program based on the poverty level in
the county and the county Food and Nutrition Services case load numbers.Counties have the option to set an
annual minimum allowable assistance amount up to a maximum of$600. Payment amounts vary based on
the crisis and the amount needed to alleviate the energy crisis.These additional funds will potentially assist a
minimum of 56 additional households.
Section 3: Documentation of Adoption
This ordinance shall be effective upon its adoption.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of New Hanover
County,North Carolina,that the Ordinance for Budget Amendment 14-069,amending the annual budget

AN ORDINANCE OF THE COUNTY OF NEW HANOVER
AMENDING THE SUBDIVISION ORDINANCE OF
NEW HANOVER COUNTY,NORTH CAROLINA
ADOPTED OCTOBER 18, 1965, AND SUBSEQUENTLY AMENDED

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Subdivision Ordinance of the County of New Hanover adopted October 18,
1965, as amended be, and the same is hereby further amended to read as follows in the section(s)
noted:
The following language indicated in red shall be added to the Subdivision Ordinance.
Deletions have strikes through them:
Section 32-2 Contents of the Preliminary Plan
(21) The approximate delineation of Corps of Engineers Section 404 and Section 10
Wetlands. (10/99)
(22) Should locations of conservation resources be shown on a preliminary site plan,
Special Use Permit site plan, Performance or Conventional Residential site plan,
Conditional Zoning site plan, Conditional Use Zoning site plan, Exceptional Design
Zoning District site plan, Riverfront Mixed Use District site plan, or Planned
Development site plan, field verification of resource areas shall be performed by a
member of the New Hanover County Planning and Inspections staff prior to map
approval to ensure accuracy.
Delineations shall be valid for a period of 5 years from the date of recordation of any
final plat in the Register of Deeds or 5 years from the enactment of this provision,
whichever is later. A one(1) year administrative extension of this validity period may
be granted by the Planning and Inspections Director so long as site conditions have not
substantially changed consistent with Section 112-6 of the New Hanover County Zoning
Ordinance.

preliminary plan that will generate more than 100 trips during the peak hour. The study
shall be prepared in accordance with Standards and Guidelines approved by the County.

Section 33-1 Contents of the Final Plat
(13) If the Subdivision is within a Conservation Overlay District, locations and types of

available at the County Planning& inspections Department.

Section 2. Any ordinance or any part of any ordinance in conflict with this ordinance, to the
extent of such conflict, is hereby repealed.
Section 3. This ordinance is adopted in accordance with NCGS 153A-341 and the Board of
Commissioners has found the amendment consistent with the policies adopted in the 2006 Land
Use Plan and reasonable and in the public interest.
Section 4. This ordinance is adopted in the interest of public health, safety, morals and general
welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full
force and effect from and after its adoption.
