2014-04-03 Agenda Review NEW HANOVER COUNTY BOARD OF COMMISSIONERS BOOK 33 AGENDA REVIEW MEETING, APRIL 3, 2014 PAGE 51 ASSEMBLY The New Hanover County Board of Commissioners met for Agenda Review Meeting on Thursday, April 3, 2014, at 4:00 p.m. in the Harrell Conference Room at the New Hanover County Government Center, 230 Government Center Drive, Wilmington, North Carolina. Members present: Chairman Woody White; Vice-Chair Beth Dawson; Commissioner Jonathan Barfield, Jr.; and Commissioner Thomas Wolfe. Commissioner Brian Berger was absent. Staff present: County Attorney Wanda M. Copley; County Manager Chris Coudriet; and Clerk to the Board Sheila L. Schult. REVIEW AND DISCUSSION OF AGENDA ITEMS Chairman White called the Agenda Review meeting to order and announced that the purpose of the meeting is to review and discuss the Board’s April 7, 2014, Regular Session meeting agenda. The Board reviewed the following items with discussion as noted: Consent Agenda Item 1 – Approval of Minutes. Consent Agenda Item 2 – Approval of Application for the Waive Landfill Tipping Fees for the North Carolina Azalea Festival. Consent Agenda Item 3 – Acceptance of November 2013 Tax Collection Reports. Consent Agenda Item 4 – Adoption of Budget Ordinance Amendments. Regular Agenda Item 5 – Adoption of Proclamation Recognizing April 2014 as Sexual Assault Activism Month in New Hanover County. Regular Agenda Item 6 – Public Hearing on Proposed $20,000,000 Financing of Improvement Project. Regular Agenda Item 7 – Public Hearing for 2010 Community Development Block Grant Economic Recovery Program for New Hanover County Closeout . Regular Agenda Item 8 – Public Hearing and Consideration of Request by Staff to Amend Section 33-1 and 32-2 of the Subdivision Ordinance Regarding Language Required on Final Plats and Preliminary Plans as it Relates to Conservation Overlay Districts (A-415, 12/13). Current Planning and Zoning Supervisor Ken Vafier reported that staff is requesting changes to the Ordinance so that conservation resource delineations, which have been confirmed by staff and are included on approved site plans, are considered valid for regulatory purposes and establishes a five-year validity test period for qualifying situations. Additional revisions to the amendment include the following language: Delineations shall be valid for a period of 5 years from the date of recordation of any final plat in the Register of Deeds or 5 years from the enactment of this provision, whichever is later. A one year administrative extension of this validity period may be granted by the Planning and Inspections Director so long as site conditions have not substantially changed in accordance with, consistent with Section 112-6 of the New Hanover County Zoning Ordinance. STAFF UPDATE: CHANGES TO NCDOT SECONDARY COUNTY CONSTRUCTION PROGRAM UPDATE District Engineer Anthony Law provided an overview of recent legislative changes requiring the North Carolina Department of Transportation (NCDOT) to prioritize all unpaved roads on a statewide level as compared to the former countywide level system. NCDOT is now required to send the County information showing how highway funds are being proposed to be used; the County will then be given time to review and recommend any changes to the proposed program. For the New Hanover County 2014 Proposed Projects, the Board’s comments are needed back to the regional office no later than April 11, 2014 in preparation for the Board of Transportation’s meeting on April 30, 2014.  2014 proposed projects using available fund balance include:  3C.065020-SR 1400 (Futch Creek Road) 2’ Symmetrical Widening – cost estimate $90,000  SR 1940 (Covil Farm Road) pipe replacement 48” to 66”/78” and 18” to 30” CMPA – cost estimate $95,000  Kings Grant Subdivision – SR 2005 (Lord Byron) at SR 2008 (Sidney) pipe replacement 48” CMPA – cost estimate $20,000  Total cost estimate $205,000  Any remaining funds will be used for road additions; surveys and right-of-ways; overdrafts; property owner participation paving; paving of rural fire departments and rescue squads; and safety improvements; estimated remaining balance in the amount of $4,280.87 NEW HANOVER COUNTY BOARD OF COMMISSIONERS BOOK 33 AGENDA REVIEW MEETING, APRIL 3, 2014 PAGE 52 ADJOURNMENT There being no further business, Chairman White adjourned the meeting at 4:23 p.m. Respectfully submitted, Sheila L.
