Dear Ms. Elmore,
This office is considering adding Soaring Spirit Drive, Fawn Settle Drive and Settlers
Dream Place to the North Carolina Department of Transportation state highway
maintenance system. The requested roadways are located within Deer Crossing (Phase
section 5) subdivision in New Hanover County. After the Board's consideration, if they
concur with our recommendation, please furnish this office with the current county
resolution and official road names for our further handling.

SECONDARY ROAD SYSTEM

Road(s) Description: Soaring Spirit Drive, Fawn Settle Drive and Settlers Dream Place
located within Deer Crossing Subdivision (Phase 1, Section 5) in
New Hanover County (Division File No. 1209 -N).
WHEREAS, a petition has been filed with the Board of County Commissioners of the
County of New Hanover requesting that the above described road(s), the location of which
has been indicated on a map, be added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above
described roads) should be added to the Secondary Road System, if the roads) meets
minimum standards and criteria established by the Division ofHighways of the Department
of Transportation for the addition of roads to the System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County of
New Hanover that the Division of Highways is hereby requested to review the above
described road(s), and to take over the roads) for maintenance if they meet established
standards and criteria.

Adoption of a Resolution Supporting Improved Rail Access
BRIEF SUMMARY:
The Wilmington City Council unanimously approved a resolution asking for an evaluation to study the
feasibility of relocating the CSXT rail line that crosses the Cape Fear River north of the Isabella Holmes
Bridge. If relocation of the rail line is considered feasible the resulting affect is improved traffic movement
within the city.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
RESOLUTION ENCOURAGING THE MPO, NCDOT AND CSXT TO COMPLETE A
FEASIBILITY STUDY TO EVALUATE THE RELOCATION OF THE CSXT RAIL LINE
ACROSS THE RIVER VIA A ROUTE THAT ELIMINATES RAIL TRAFFIC THROUGH THE
HEART OF THE CITY OF WILMINGTON AND WHICH WOULD PROVIDE A MORE
DIRECT RAIL ACCESS CORRIDOR TO THE PORT OF WILMINGTON
WHEREAS, the Wilmington Urban Area Metropolitan Planning Organization provides transportation
planning services for the City of Wilmington, Town of Carolina Beach, Town of Kure Beach, Town of
Wrightsville Beach, Town of Belville, Town of Leland, Town of Navassa, New Hanover County,
Brunswick County, Pender County, Cape Fear Public Transportation Authority and the North Carolina
Board of Transportation; and
WHEREAS, the CSXT rail line originates in Brunswick County, crossing the Cape Fear River into the
City of Wilmington just north of the Isabelle Holmes Bridge. The rail line then continues eastward through
the City before turning south and west again — back toward the river and the Port of Wilmington. The
sweeping path of the rail line thus forms a large "U" (on its side) which, at one time, wrapped around the
eastern limits of the City; and
WHEREAS, today, this same rail line passes through the heart of the City of Wilmington, resulting in
thousands of motor vehicle rail crossings each day and adversely impacting the quiet enjoyment of many
neighborhoods in the city; and
WHEREAS, the City, NCDOT, Wilmington MPO and CSXT are currently working in partnership to
complete a Traffic Separation Study to evaluate 31 roadway rail crossings along the CSXT ACB and
Beltline rail line; and
WHEREAS, the purpose of the Traffic Separation Study is to determine the need for improvements and /or
elimination of public at -grade roadway /railroad crossings to improve safety for motorists, rail passengers
and train crews; and
WHEREAS, a potential alternative solution would be to relocate the existing rail line to a crossing of the
Cape Fear River close to the Port property, thereby eliminating rail traffic through the heart of the city, and
dramatically improving rail access to the Port; and
WHEREAS, the relocation of the rail line would be beneficial to CSXT, the State Ports and the City of
Wilmington by eliminating tens of thousands of at grade vehicular rail crossings on a daily basis,
improving mobility throughout the City of Wilmington, and improving rail operations and safety en route
to the ports; and
WHEREAS, improved rail access to the Ports would also have benefits of Statewide significance, in terms
of economic development of business and industry throughout North Carolina; and
WHEREAS, direct rail access to the ports would also eliminate vehicular /rail conflicts with the proposed
Independence Boulevard Extension project and obviate a primary justification for an elevated highway
through the heart of Wilmington; and
WHEREAS, in addition, the proposal would provide an opportunity to convert the existing heavy rail
corridor, with all of its related safety and noise issues, into a quiet transit corridor; and

WHEREAS, such a conversion would improve the quality of life for nearby neighborhoods and all
citizens of Wilmington, as well as reducing traffic congestion on streets within the city; and
WHEREAS, such a transit service would stimulate investment in the many vacant and underperforming
properties along the existing rail corridor, particularly on the south side of town; and
WHEREAS, properties adjoining new transit lines in other cities have proven attractive for redevelopment
as residential and mixed use centers; and
WHEREAS, in the interim, the existing converted rail corridor could be utilized as a trail /greenway
linking up with other City trails.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners
hereby encourages the MPO, NCDOT and CSXT to complete a feasibility study to evaluate the relocation
of the CSXT rail line across the river via a route that eliminates rail traffic through the heart of the City
and which would provide a more direct rail access corridor to the Port of Wilmington.

APPROVAL OF PUBLIC OFFICIALS BOND
RESOLUTION
WHEREAS, pursuant to Chapter 58 of the North Carolina General Statutes, the Board of County
Commissioners conducts an annual review of public official bonds; and
WHEREAS, said bonds have been reviewed by the County Attorney and found to be in full force
and to be in proper format.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of
Commissioners does hereby approve the Surety Bond for the Finance Officer, Sheriff, Register of
Deeds, and Tax Collector. This designation of approval is hereby incorporated within the respective
bond as if set out in its entirety on the face thereof.

Approval of an Application for the Waiver of Landfill Tipping Fees for Good Shepherd Ministries
BRIEF SUMMARY:
The Environmental Management Department has received an application from Good Shepherd Ministries for
a waiver of landfill tipping fees. This non - profit shelter provides food, clothing and shelter for the homeless
and assists with their transition to permanent housing.
The landfill has waived a total of $78,943 in tipping fees (1549.29 tons) for fiscal year 14 -15 to date.
The Environmental Management Director recommends approval of the waiver request, with a maximum cap
of three (3) tons for fiscal year 14 -15, restricted to waste generated within New Hanover County.

BRIEF SUMMARY:
On November 4, 2014 a bond election was duly called and held for the purpose of submitting to the qualified
voters of New Hanover County the question of authorizing $160,000,000 of general obligation bonds to pay
capital costs of providing facilities for the New Hanover County Schools. The Board has received from New
Hanover County Board of Elections a certification of the results of the election. The question in the form
submitted to the voters was approved by the affirmative vote of a majority of those who voted in the election.

NEW HANOVER COUNTY BOARD OF ELECTIONS
FOR THE REFERENDUM OF THE
COUNTY OF NEw HANOVER ON THE 14TH DAY OF NOVEMBER, 2014
WE, the undersigned Chairman and Members of the New Hanover County Board of Elections,
DO HEREBY CERTIFY that we met on November 14, 2014 at the hour of 11 o'clock, a.m., in the office
of the New Hanover County Board of Elections in Wilmington, North Carolina to canvass the returns of
the special bond referendum held in the County of New Hanover, North Carolina on November 4, 2014.
1. The total number of voters who voted "YES" in answer to the question, "SHALL the
order authorizing $160,000,000 of bonds plus interest to pay the costs of constructing, improving, and
renovating school facilities, specifically including, among other things, the construction and renovation of
classroom facilities and district -wide improvements for safety, security, technology and building
infrastructure, the acquisition and installation of furnishings and equipment, and the acquisition of land or
rights —in —land required therefor, and providing that additional taxes may be levied in an amount sufficient
to pay the principal and interest on the bonds be approved ? ", was 40,888. The total number of voters who
voted "NO" in answer to such question was 23,140. The question in the form submitted was
APPROVED by the vote of a majority of those who voted thereon at said referendum.
2. All persons voting at said referendum were required to use ballots or ballot labels setting
forth the questions to be voted upon in the form prescribers by the Board of Commissioners of the County
of New Hanover, North Carolina.
3. Only the persons who have been duly registered were permitted to vote at said
referendum. The total number of voters who were registered and qualified to vote at said referendum was
159,526.
4. The polls for said referendum were opened at the polling places in the County of New
Hanover, North Carolina on November 4, 2014, at the hour of 6:30 a.m., and were closed at the hour of
7:30 p.m. on that day.
IN WITNESS WHEREOF, we have set our hands for the purpose of certifying the result of the
special bond referendum held for the County of New Hanover, North Carolina on November 4, 2014 to
the Board of Commissioners of said County, this 14th day of November, 2014.

WHEREAS, by direction of the Board of Commissioners (the "Board ") of the County of New
Hanover, North Carolina, a special bond referendum was duly called and held for said County on
November 4, 2014 for the purpose of submitting to the qualified voters of said County the question
hereinafter set forth, and said Board of Commissioners has received from the New Hanover County Board
of Elections a certification of the results of said referendum, and has determined the result of said
referendum to be as hereinafter stated;
NOW, THEREFORE, the Board of Commissioners hereby makes the following statement of the
result of said referendum pursuant to The Local Government Bond Act:

BRIEF SUMMARY:
Chapter 160A- Article 12 of the North Carolina General Statutes governs the sale and disposition of surplus
property. Currently, the County has certain supplies, materials, equipment, and apparatus that are surplus to
its operations. A complete list of these items including a description is attached as Exhibit "A."
Staff proposes to dispose of this personal property according to the procedures prescribed in Chapter 160A-
270(c) which authorizes the disposal of personal property electronically using an existing private or public
electronic auction service.
Staff proposes to utilize the services of GovDeals, an online internet based provider servicing governmental
entities. Any items not sold electronically may be disposed of by any other method authorized by the Statutes
including discarding.

RESOLUTION
DISPOSAL OF SURPLUS PROPERTY
WHEREAS, New Hanover County owns certain personal property itemized on the attached Exhibit A
that is no longer functional for governmental purposes by the County; and
WHEREAS, New Hanover County Board of Commissioners is desirous of declaring this property
surplus and disposing of as authorized by North Carolina General Statute (NCGS) 160A- Article 12; and
WHEREAS, it is the intent of the County to sell said surplus property by electronic public auction
according to the procedures prescribed in NCGS 160A- 270(c) which authorizes the disposal of personal
property electronically using an existing private or public electronic auction service; and
WHEREAS, items not sold by electronic means will be disposed of using any other method authorized in
the NCGS 160A- Article 12 including discarding the items.
NOW, THEREFORE, BE IT RESOLVED, by the New Hanover County Board of Commissioners as
follows:
1. The personal property itemized on the attached Exhibit A is hereby declared to be surplus
property.
2. The Finance Director's designated representative, pursuant to the provisions of G.S. 160A -270
(c), is hereby authorized to dispose of the personal property listed by electronic public auction
and any property not sold by electronic means may be disposed of using any other method
authorized by the NCGS 160A- Article 12, and that said representative be further authorized and
directed to execute necessary documents, transfer title, add /delete items from the surplus list, and
perform all necessary functions associated with this disposal.
3. All surplus property will be sold "as is," all sales will be final and the acceptable forms of
payment are cash, certified check, money order, and Visa or MasterCard. New Hanover County
makes no express or implied warranties of merchantability of any surplus property, or part
thereof, or its fitness for any particular purpose regardless of any oral statements that may be
made concerning the surplus property or any part thereof.
4. A notice summarizing this resolution and the sale of the surplus property shall be advertised on
the County's website and /or in the Wilmington Star News at least ten (10) days prior to the
electronic public auction.

To budget an additional allocation from the Low Income Energy Assistance Program ( LIEAP) in the amount
of $153,035. LIEAP helps eligible households pay their home energy costs. Eligible households receive a one-
time LIEAP heating assistance payment made directly to their heating vendor. The maximum amount eligible
households can receive is $400.00 for the fiscal year. The target population is households with at least one
individual who is age 60 and above or is disabled and receiving services through the Division of Aging and
Adult Services. Household income must be at or below 130% of the poverty level. The Department of Social
Services accepts applications from December 1 st through March 31 st or until funds are exhausted. This
program is 100% state and federally- funded.
Section 3: Documentation of Adoption
This ordinance shall be effective upon its adoption.

To budget an additional allocation for the Smart Start Daycare in the amount of $18,829. The Smart Start
Daycare allocation exceeded the original estimate. The Department of Social Services (DSS) estimates how
many children they can enroll in daycare. DSS makes an assumption that there will be a certain amount of
turnover. Turnover to date has been less than anticpated. Therefore, the waiting list will not be affected by this
budget amendment. Roughly 113 children are funded through Smart Start funding. Currently, there are 770
children on the waiting list.

Merit Compensation for General Manager and CEO of New Hanover County ABC Board
BRIEF SUMMARY:
Current CEO and General Manager Dan Sykes was hired in April 2010. The salary scale for the position at
that time was $84,000 to $130,000. Mr. Sykes starting salary was $105,000.
After Mr. Sykes was hired, the North Carolina State ABC Commission capped the General Manager's salary
to $103,766 based on clerk of superior court's salary for a county population of 150,000 to 249,999.
Exceeding their salary limit is permitted when approved by the local Board of County Commissioners.
A classification and compensation was made at the same time as NHC's by Evergreen Solutions, LLC. The
salary range in the attachment for the CEO position is $92,464, with a midpoint of $124,827, and a
maximum of $157,189.
For the past four and one -half years Mr. Sykes has delivered on all the expectations of the ABC Board of
Directors. The State ABC Board released financial information on all local ABC Boards. New Hanover
ranked second as a profit percentage to sales of 15.09 %. Last week the grand opening of the new distribution
center and LBD facility was celebrated. The cost to build was $5.7 million, including land, and all was paid
from current cash with no financing.

RECOMMENDED MOTION AND REQUESTED ACTIONS:
Approve Mr. Sykes be granted for the past fiscal year, and the future years, the ability to participate in the

increases granted will be subject to the ABC Board approval based on his performance evaluation.

§ 7A -101. Compensation.
(a) The clerk of superior court is a full -time employee of the State and shall receive an
annual salary, payable in equal monthly installments, based on the population of the county as
determined in subsection (al) of this section, according to the following schedule:

When a county changes from one population group to another, the salary of the clerk shall be
changed, on July 1 of the fiscal year for which the change is reported, to the salary appropriate for
the new population group, except that the salary of an incumbent clerk shall not be decreased by
any change in population group during his continuance in office.
(al) For purposes of subsection (a) of this section, the population of a county for any fiscal
year shall be the population for the beginning of that fiscal year as reported by the Office of State
Budget and Management to the Administrative Office of the Courts prior to the beginning of that
fiscal year.
(b) The clerk shall receive no fees or commission by virtue of his office. The salary set
forth in this section is the clerk's sole official compensation, but if, on June 30, 1975, the salary of
a particular clerk, by reason of previous but no longer authorized merit increments, is higher than
that set forth in the table, that higher salary shall not be reduced during his continuance in office.
(c) In ii-I:« of merit and other increment raises paid to regular State employees, a clerk of
superior court shall receive as longevity pay an amount equal to four and eight- tenths percent
(4.8 %) of the clerk's annual salary payable monthly after five years of service, nine and six - tenths
percent (9.6 %) after 10 years of service, fourteen and four- tenths percent (14.4 %) after 15 years
of service, nineteen and two- tenths percent (19.2 %) after 20 years of se vice, and twenty -four
percent (24 %) after 25 years of service. Service shall mean service in the elective position of clerk
of superior court, as an assistant clerk of court and as a supervisor of clerks of superior court with
the Administrative Office of the Courts and shall not include service as a deputy or acting clerk.

RECOMMENDATION 2: Revise existing salary structure to reflect market conditions and best
practices, and transition employees Into the structure.
Fallowing proposed pay plan design discussions with the ABC Board's project team, it was
determined that the ABC Board's desire was to continue utilizing an open range structure
and to improve market competiveness and consistency. The Evergreen Solutions team then
developed a new market based pay plan. Grades were established that can be assigned to

Consideration of Contribution of Funds to City of Wilmington to Fund Forensic Chemist for Forensic

BRIEF SUMMARY:
City, County and Court staff met to determine ways to reduce crime and the jail population. District Attorney
Benjamin David has asked the County to fund a full-time Forensic Chemist for the City of Wilmington
Forensic Lab. The addition of the Chemist will lead to serious drug offenders being sentenced in a more
timely manner, making our community a safer place for our citizens. Secondly, the Chemist may reduce the
amount of time serious offenders are housed in the detention center awaiting trial, which will reduce
detention center population and costs.
The interlocal agreement will run from January 1, 2015 until June 30, 2018. At that time, the effectiveness of
the additional position will be evaluated. The annual cost of the position is $83,459. Funds have been
identified in the existing FY14 -15 budget for the contribution, and the FYI 5-16 budget will include funding
for the continuation of the position.

THIS INTERLOCAL AGREEMENT entered into this day of , 2014
by and between NEW HANOVER COUNTY, a political subdivision of the State of North
Carolina, hereinafter referred to as "County ", and the CITY OF WILMINGTON, a
municipal corporation of the State of North Carolina and County of New Hanover,
hereinafter referred to as "City ";
WITNESSETH:
WHEREAS, the availability of a full time chemist for the Wilmington Police
Department will facilitate prioritizing narcotics testing for drug cases; and
WHEREAS, said expedited testing shall promote more effective law enforcement
investigations and District Attorney prosecution, resulting in more timely trial of
dangerous perpetrators of drug offenses; and
WHEREAS, New Hanover County is agreeable to funding said chemist position.
NOW, THEREFORE, in consideration of the mutual benefits set forth above, the
parties agree as follows:

1. Position Funded. County shall provide funding for the employment of a
forensic chemist at the City of Wilmington Police Department Forensic Lab.
The annual personnel cost inclusive of benefits is $75,574. Together with
associated supplies and training, County agrees to provide the annual cost
not to exceed $83,459. Employment shall commence mid - fiscal year with the
cost for the 2014 -2015 Fiscal Year being $41,729. The Forensic Chemist
shall be an employee of City only and shall not be entitled to any County
salary or benefits.
2. Term. The term of this Agreement shall run from January 1, 2015 through
June 30, 2018.
3. Immunity Not Waived. This Agreement is government in nature and for the
benefit of the public and is not intended to be for private profit or gain, and

I am writing to you to present a proposal that would enhance the public safety of
our County, inclusive of it municipalities. As I am sure you are aware, the
Wilmington Police Department has a Forensic Lab that staffs one full -time
Chemist, one part-time Chemist, and one part-time Forensic Technologist. The
Police Department's Forensic Lab has been operational since 2009. We have the
ability to complete blood alcohol tests (BAC) with a two week turn around, which
assists with expediting DWI criminal trials. Conducting such trials in a timely
manner has the effect of removing dangerous drivers off our streets and highways.
Further, the Police Department's Forensic Lab conducts BAC testing for external
stakeholders. The New Hanover County Sheriff's Office and the North Carolina
Highway Patrol are two of our largest external stakeholders.
The Department's lab is also capable of testing illegal and legal narcotics. Some
of the narcotics we are able to test include Heroin, Cocaine, Marihuana, and
prescription pills such as synthetic opioids and methamphetamines. Currently, our
chemists conduct narcotics testing on a case -by -case basis.
Benjamin David, our District Attorney has expressed the desire to expedite high
priority drug cases and offenders. Many of these cases include trafficking
offenses. Furthermore, many offenders are in the County jail awaiting trial; many
are out on bond. The Police Department's lab is not staffed to prioritize narcotics
testing and therefore unable to take the time to prioritize pending drug cases for
the entire County. For these reasons I am proposing that New Hanover County
identify and locate funds to provide for a full -time Forensic Chemist to be
employed by the Police Department's lab. This particular position would test and

complete all high priority drug cases awaiting trial for cases derived throughout
all of New Hanover County.
The benefits derived from having a full -time Forensic Chemist to prioritize drug
testing would most certainly provide similar results experienced with the
Department's BAC testing. The Department's Forensic Lab can provide drug
testing results in less than 60 days. The current turnaround time with the State's
lab is approximately one year. Criminal trials can be conducted in a timelier
manner, which will result in the incarceration of dangerous offenders.
Additionally, offenders being sentenced to the State's prison system or the
Federal prison system would shift the costs of housing those offenders awaiting
trial away from the local tax payer.
The cost of funding a Forensic Chemist for one year, inclusive of benefits is
$75,574. With supplies and necessary training the total cost to fund for this
position for one year is $83,459. The City is willing to start mid fiscal year and
would prorate associated costs for funding a Forensic Chemist. At 1/2 year the cost
would be approximately $41,729.
This proposal provides a win -win situation where serious drug offenders are
sentenced in a timelier manner, making our community a safer place for our
citizens. Second, there is an opportunity to free up jail space at our County
facility, which may reduce the cost of housing serious offenders while awaiting
trial.

Planning Board Action
At their November 6, 2014 meeting, the Planning Board unanimously (6 -0) passed a motion to
recommend approval of the Special Use Permit request with no conditions.
Summary of Request
American Towers, LLC, applicant, is requesting a Special Use Permit to construct and operate a
195' monopole telecommunications tower facility on a 70' x 136' leased area on a 52.83 acre
site located at 5500 block of Marvin K. Moss Lane.
The property currently hosts the UNCW Center for Marine Science /CREST Research Park that
was originally approved by Special Use Permit in 1991 and subsequently modified in 2000,
2003, 2007, and 2010. The development on site encompasses the development approved with
the original SUP approval and modifications.
A 70' x 136' leased area is proposed, which will encompass the tower, equipment pads, and
required 25' buffer and fence. The tower area is situated adjacent to the stormwater
management pond and an existing parking area, in the central area of the CREST Research Park
site.
The parcels immediately surrounding the site remain largely undeveloped, and the existing land
uses in the area primarily consist of single family residential uses along Myrtle Grove Road.
Preliminary Staff Findings of Fact
(In Accordance with Section 71 of the New Hanover County Zoning Ordinance)
Finding 1: The Board must find that the use will not materially endanger the public health or
safety where proposed and developed according to the plan as submitted and approved.
A. Water and sewer infrastructure and capacity are available to serve the site, but not
necessary for the proposed use.

B. The subject property is located in the New Hanover County South Fire Service District.
C. Access to the tower site will be provided by a 12' wide access easement /drive from
Marvin K. Moss Lane.
D. The subject site does not host any known cultural or archaeological resources.
Staff Suggestion: Evidence in the record at this time supports a finding that the use will not
materially endanger the public health or safety where proposed.
Finding 2: The Board must find that the use meets all required conditions and specifications
of the Zoning Ordinance.
A. Telecommunication Communication Facilities, Cellular, and Related Towers are allowed
by Special Use Permit in the R -15 zoning district provided that the project meets the
Standards of Section 63.5 -1 of the Zoning Ordinance.
B. Section 63.5 -1(A) requires that the setback from any existing residential property line or
residential zoning district boundary for any tower, antenna, or related structure in any
zoning district be a distance equal to the height of the tower as measured from the base
of the tower. The location of the proposed 195' tall tower is at least 245 feet from all
adjacent property lines as well as any existing residential uses, exceeding the setback
requirement of Section 63.5 -1(A).
C. Section 63.5 -1(B)1 requires that the minimum distance between the tower and any
other adjoining parcel of land or road must be equal to the minimum setback described
in Section 63.5 -1(A), plus any additional distance necessary to ensure that the tower, as
designed, will fall within the tower site. The proposed location complies with this
provision, and no evidence has been submitted suggesting that additional distance is
necessary.
D. Section 63.5 -1(B)2 requires the applicant to submit photographs and statements as to
the potential visual and aesthetic impacts on all adjacent residential zoning districts. A
report sufficing this requirement was submitted as part of the application.
E. Section 63.5 -1(C) requires a landscaped buffer with a base width not less than 25 feet
and providing 100% opacity, in addition to a minimum 8 ft. tall fence surrounding the
tower base. The proposed plans suffice this requirement.
F. Section 63.5 -1(D) requires that applicants seeking construction of new towers,
antennas, and related structures demonstrate through submitted written evidence that
collocation on any existing tower, antenna, or usable structure in the search area for the
new tower is not reasonable or possible. A report (RF Justification for AT &T Wireless
Site 478 -112) has been submitted with the application, meeting this requirement.
G. Section 63.5 -1(E) requires that towers 150' tall or less be engineered to accommodate a
minimum of one additional provider. Evidence has been submitted demonstrating that
this requirement has been met, and a Collocation Certification was also submitted by
the applicant.
H. Section 63.5 -1(F) requires certification that the construction or placement of the
proposed facility complies with several federal regulations. An FCC Compliance

Assessment has been submitted and demonstrates compliance with the federal
regulations mentioned in Section 63.5 -1(F).
I. Section 63.5 -1(1) regulates the signage allowed on the tower and related equipment.
The signage proposed is compliant with this ordinance provision.
J. Section 63.5 -1(J) prohibits the storage of equipment, hazardous waste, or materials not
needed for the operation, prohibits outdoor storage yards in a tower equipment
compound, and prohibits habitable space within the compound area. The applicant's
proposal complies with this ordinance section.
K. Section 63.5 -1(L) requires that, when the proposed tower site is within 10,000 feet of an
airport or within any runway approach zone, the applicant submit Form 7460 to the
Federal Aviation Administration (FAA) to assure compliance with all FAA standards. An
FAA Aeronautical Evaluation was included with the application and indicates that the
site is approximately 46,141 feet from the Wilmington International Airport and will
comply with FAA regulations.
Staff Suggestion: Evidence in the record at this time supports a finding that the use meets all of
the required conditions and specifications of the Zoning Ordinance.
Finding 3: The Board must find that the use will not substantially injure the value of adjoining
or abutting property or that the use is a public necessity.
A. The location of the proposed tower is in an area of the UNCW CMS /CREST Research Park
that does not conflict with the other existing or planned uses of the facility. The site is
significantly buffered from adjacent properties and existing residential uses.
B. A 25' wide buffer surrounding the tower base will provide visual screening for future
development.
C. No evidence has been submitted that this project will decrease the property values of
adjacent or nearby properties.
Staff Suggestion: The evidence in the record at this time supports a finding that the use will not
substantially injure the value of adjoining or abutting property.
Finding 4: The Board must find that the location and character of the use if developed
according to the plan as submitted and approved will be in harmony with the area in which it
is to be located and in general conformity with the plan of development for New Hanover
County.
A. The 2006 Wilmington -New Hanover County CAMA Land Use Plan classifies the area
proposed for the tower site as Watershed Resource Protection, and the proposal is not
in conflict with the intent of the Transition land use classification, and additionally, not
in conflict with any other policy of the 2006 CAMA Land Use Plan.
Staff Suggestion: Evidence in the record at this time supports a finding that the use is general
conformity with the plan of development for New Hanover County.

SUMMARY
Staff concludes that the applicant has demonstrated that the proposal complies with Section
63.5 -1 of the Zoning Ordinance Zoning Ordinance as well as the findings of fact specified in
Section 71 of the Ordinance. Staff also concludes that, with the information submitted, the
applicant has demonstrated that the proposal is not in conflict with the management strategy
for the Watershed Resource Protection land use classification, and not in conflict with any other
policies of the CAMA Land Use Plan.
Note: A Special Use Permit is a quasi - judicial action requiring an evidentiary hearing and
findings of fact.

APPLICATION OVERVIEW
In order to assist petitioners through the process for obtaining a Special Use Permit, petitioners are highly
encouraged to attend a pre - application conference prior to application submittal. Petitioners are requested
to review the sections of the Zoning Ordinance specific to Special Use Permits prior to submission, and
advised to contact Planning Staff with any questions. The following sections of the Zoning Ordinance
pertain specifically to Special Use Permits:
• Section 70: Objectives and Purposes of Special Use Permits
• Section 71: General Requirements of Special Use Permits
• Section 72: Additional Restrictions Imposed on Certain Special Uses
• Section 111: Petitions
Applications for Special Use Permits (with the exception of single family dwellings on individual lots)
must first be considered by the New Hanover County Planning Board at a public hearing. The Planning
Board will make a recommendation to the County Commissioners which will take final action on the
permit application in a quasi - judicial public hearing. Attendance at all public hearings is required. The
public hearings will allow staff, the applicant, proponents and opponents to testify in regards to the
request. Unless otherwise published or announced, Planning Board meetings are held on the first
Thursday of each month at 6:OOPM in the Commissioner's Assembly Room at the Historic County
Courthouse located at Third and Princess Streets, Wilmington, North Carolina. All meeting dates and
application deadlines are published on the New Hanover County Planning website.

APPLICATION REQUIREMENTS
In order to assist petitioners through the process for obtaining a Special Use Permit, petitioners are highly
encouraged to attend a pre - application conference prior to application submittal. Applications must be
reviewed by Planning Staff for completeness prior to being officially accepted. Applications must be
submitted to Planning Staff at least twenty (20) working days before the Planning Board meeting at which
the application is to be considered. Once accepted, the Planning Board will consider the application at the
assigned meeting unless the applicant requests a continuance.
Applications for single - family dwellings, including mobile homes, on individual lots do not require
Planning Board review and must be submitted to Planning Staff twenty (20) working days before the
Commissioners meeting. For High Density Residential projects, a High Density Residential application
and High Density Checklist must also accompany this application. The New Hanover County Technical
Review Committee (TRC) must also review a High Density Residential project prior to submitting this
application.

(1) General Requirement #1 -- that the use will not materially endanger the public
health or safety if located where proposed and developed according to the Alan as
submitted and approved:
The proposed use will not materially endanger the public health or safety, if located and
developed according to the plan submitted. The proposed use will have virtually no impact on
traffic conditions in the vicinity or on the provision of services and utilities. It will not require
water, sewer, or garbage collection services. The proposed facility will have virtually no impact
on soil erosion or sedimentation and meets or exceeds all setback requirements. The proposed
tower will fully comply with all FCC rules and standards regarding maximum permissible
exposure to radio frequency emissions and public safety. The proposed use will be constructed
to meet or exceed all ANSI and FAA requirements. Finally, the proposed use will have virtually
no adverse impact on the protection of public, community, or private water supplies, including
possible adverse effects on surface waters or groundwater. Thus, the proposed development will
maintain the public health and safety of the community and will not materially endanger the
public safety.
To the contrary, the proposed use will enhance public safety. Wireless
telecommunications services provide an alternative method of communication, which has proven
crucial in times where the traditional, land -line communications systems are either inaccessible
(e.g., when one's car breaks down while traveling or when boating) or are downed by extreme
winds and weather. Towers of the type proposed here have consistently provided the only means
of communication with family and emergency personnel in times of flood, high winds and other
extreme weather conditions. Wireless towers, similar to the one proposed here, have withstood
hurricane -force winds consistently without failing. Also, many households have either dropped
their land -line phones and have become wireless only or even if they have a land -line phone,
they prefer using their wireless device primarily for communication. In fact, most calls to 911
are now from wireless devices. In this case, the proposed tower will additionally provide service
to the waterways to the east. Finally, all of the regulations and requirements applicable to the
proposed use have been met and exceeded to ensure that the proposed use will have no adverse
effect whatsoever on the public health or safety.
(2) General Requirement #2 — that the use meets all required conditions and
specifications of the Zoning Ordinance,
The proposed use of the property is for an unmanned radio telecommunications facility
consisting of a 199 foot monopole in a 20' X 86' lease area. The proposed use is in compliance

with the purpose and intent of the plan of development of New Hanover County, North Carolina
Land Use Zoning Ordinance and is a compatible use in the areas where it is located.
The development of an unmanned radio telecommunications facility on the Site will be
consistent with New Hanover County's goals to maintain the county's character and
environmental well - being.
The property is zoned R -15 under the Zoning Ordinance, and wireless communications
facilities are allowed in the R -15 district with a Special Use Permit. The Site meets all
Ordinance technical requirements for unmanned radio telecommunications facility and is
consistent with the Land Use Plan. The proposed facility will not emit any significant noise or
glare and will not be lighted. The proposed facility will be in compliance with the general plan
for the physical development of New Hanover County as embodied in the Ordinance.
(3) General Requirement 0 — that the use will not substantially iniure the value of
adjoining or abutting property or that the use is a public necessity_.
American Towers LLC is sensitive to the placement of towers and selected this Site in an
effort to minimize the visual impact on the surrounding area. The proposed tower will be a 199'
monopole tower, and will be well hidden because of existing trees. The tower compound and
ground equipment will be screened with landscaping as required by the County's ordinance.
The development of an unmanned radio telecommunications facility on the Site will enhance
wireless telecommunications service in this area of New Hanover County for the benefit of
UNCW, local residents and businesses. UNCW is in great need of better wireless coverage at
this location and American Tower, who will build this tower, already has interest from AT &T,
Verizon and T- Mobile to locate on this site, which will greatly enhance mobile coverage in this
area. Numerous studies, including an Impact Study prepared specifically in connection with this
Application, have demonstrated that similar towers do not substantially injure the value of
neighboring or nearby land. For all these reasons, American Towers LLC submits that the
proposed tower will maintain or enhance the value of adjoining property.
(4) General Requirement #4 — that the location and character of the use if developed
according to the plan as submitted and approved will be in harmony with the area in which
it is to be located and in general conformity with the plan of development for New Hanover
County.
The location and character of the proposed use will be in harmony with the scale, bulk,
coverage, density and character of the area in which it is located. The proposed facility will not
emit any substantial noise or glare. Because the proposed use is listed as a permitted special use
in the zoning district in which the parcel at issue is located, there has been a legislative
determination that the proposed use is in harmony with other permitted uses in the area.
Furthermore, the proposed facility will be visually buffered as required by the Ordinance. In
addition to the required landscape buffer, the proposed lease area and facility is surrounded by

existing mature trees. As evidenced by the enclosed photo simulation, the proposed facility is
only visible when looking east by northeast towards the site, and even then the visibility is
minimal. Moreover, the proposed unmanned radio telecommunications facility will be in
compliance with the general plan for the physical development of New Hanover County as
embodied in the Ordinance and is consistent with other existing sites within the County's
jurisdiction. Therefore, the proposed development will be in harmony with the area in which it is
located.

American Towers LLC ( "AT ") is one of the leading independent owner and operator of shared
wireless infrastructure. The core business of American Towers LLC involves the engineering,
deployment, marketing, ownership, operation and leasing of shared wireless communications
sites. The sharing of infrastructure among multiple services lies at the heart of American
Tower's business philosophy. Our portfolio of wireless communication sites, including existing
towers and rooftops, enables our customers to serve their markets more efficiently and with
sensitivity to local planning and zoning jurisdictions. American Towers LLC designs all of our
facilities for multiple collocation opportunities for our customers. We endeavor to assist
communities in reducing the number of towers in a given jurisdiction by supplying our
customers with locations that are ready for them "Just in Time" for their coverage design and
wireless performance needs. As one of the largest tower companies in the world, American
Towers LLC has master lease agreements, negotiated at arms - length, with all major wireless
carriers licensed to operate in North Carolina. In negotiating the rental rates of these master
lease agreements, American Towers LLC considers the competitive environment of its business
and the presence of other major tower companies such as Crown Castle and SBA. This ensures
that American Towers LLC charges only reasonable rates to service providers.
Colocation Certification
American Towers LLC agrees to comply with the Zoning Ordinance of New Hanover County,
NC and is willing to permit other user(s) to attach communication equipment which do not
interfere with the primary purpose of the tower, provided that such other users agree to negotiate
a reasonable compensation to the owner from such Iiability as may result from such attachment.

IMPACT STATEMENT
This report addresses whether the proposed use is in compliance with the purpose and
intent of the plan of development of New Hanover County, N. C., Land Use and Zoning
Ordinance, and is a compatible use in the area where it is to be located. In preparing this
report, I inspected the site and surrounding areas in the district and reviewed the site plans
for the facility provided by Tower Engineering Professionals, for an application for a
Special Use Permit by American Tower Corporation. I have also consulted and reviewed
with area local appraisers, developers, tax authorities and reviewed the public records in
similar recent zoning cases in various jurisdictions in New Hanover County and prior
applications in New Hanover County, NC and the City of Wilmington, N. C.
PROPOSED FACILITY
The proposed facility will consist of a One Hundred Ninety Five Foot (195.0') monopole
wireless communications tower. The site will be comprised of a developed area as
described in the site plans and engineering plans that were submitted. The fencing
surrounding the site will be a chain link fence at least eight (8.0') feet in height, around
the twenty foot by eighty six foot compound (20.0' by 86.0'); located in the developed
lease area as described in the plans that were submitted. There will be a six (6) inch thick
gravel weed barrier inside the fenced area and extending one (1) foot outside the fenced
area. Landscaping will meet or exceed the Ordinance requirements for this project. The
area is zoned mostly R -15. The parent tract is shown in the County Records as Tax
Parcel Number: R07600 -003- 017 -000.

BACKGROUND
In general we have found that the factors that primarily affect property values are use,
zoning, topography, and market demand. As the factors change, so do the current market
value and development potential of any parcel of real estate.
While the value of a parcel of real property may be affected by the use of adjoining or
surrounding property, that use must be significant in its intrusiveness or lack of
compatibility in order to override the primary factors that affect property values. Uses
which generate significant traffic, noise, odor, or dangerous conditions are generally the
types of uses which are so intrusive as to override the normal factors affecting property
values, and result in a material adverse impact on surrounding properties. For example,
hog farms, rock quarries, paper mills, manufacturing plants, adult entertainment
establishments, and similar uses, are generally believed to have a negative impact on the
value of surrounding properties. In addition, development of property in a manner, which
is significantly incompatible with existing or planned use of surrounding property, can
result in a negative impact on property immediately adjacent to the incompatible use.
Our examination of the effects of the existing transmission tower and broadcast tower
sites on surrounding properties, and our examination of other studies on this subject and
available data, indicates that, in general, these type towers are not the type of use, which
is so intrusive as to have an inherently negative impact on surrounding properties so long
as the set backs are sufficient as to not cause an adjoining property to not be able to be
used or developed for its highest and best use under the jurisdictions zoning restrictions.

SUMMARY
My personal inspection of the site and surrounding areas, and public records revealed the
following:
1. Located immediately to the north of the proposed site and parent tract is heavily
wooded land of the UNCW Marine Sciences Campus and further north a single
family residential development along Captains Lane.
2. Located immediately to the west of the proposed site is the heavily wooded and
undeveloped campus lands along Marvin K. Moss Lane out to Masonboro Loop
Road where there are single family homes, and developments that will have very
limited view of the proposed tower facility.
3. Located to the south of the proposed site are heavily wooded lands, scattered
single family homes, and a proposed single family /recreational development that
will have access east to the Inland Waterway.
4. Located east of the proposed site is the UNCW Marine Sciences Campus and its
facilities with boat and marine equipment.
S. That the visibility of the facility will be very limited along Masonboro Loop Road
at ground level due to the existing vegetation, placement and separation from the
existing developed and uses around the parent tract. (As demonstrated in the
Photo Simulation and Annotated Aerial and Ground Map Report). The areas
outside fenced compound will be left undisturbed in order to maintain the existing
wooded areas and vegetation near the site.
In summary, my personal inspection of this proposed site and other tower locations in
North Carolina, in the jurisdictions of Cumberland, Robeson, Bladen, Onslow, Moore,
Sampson, Cities of Fayetteville, Raleigh, Wilmington and many others, my personal
Expert Witness Testimony in over one thousand seven hundred (1,700) zoning hearings
for the record in these and many other jurisdictions across the southeast, my review of
industry data regarding all types of wireless transmission towers, indicates that, in
general, wireless telecommunication tower facilities do not have a inherently deleterious
affect on surrounding properties. Our review of the Facility to be constructed at the Site,
and personal inspection of the Site and surrounding area, indicate that the planned facility

is generally compatible with the area's existing and proposed uses, and developed as
proposed it will have no substantial negative impact on existing or planned development
of the surrounding properties.
Moreover, this Telecommunications Facility, built as planned, will have no detrimental or
injurious effect on the property values of the surrounding neighborhood or other
improved or unimproved properties in the general vicinity. Finally, the nature of this
location, with its separation from the residential arterials located to the north of the
proposed site, the unimproved areas and mixed uses nearby, heavily wooded areas, is
such that the proposed development will not create any negative aesthetic effects on
scenic roadways or other unique natural features.

SUBJECT: FCC Compliance Assessment for Proposed AT &T Mobility Site 478 -112
AT &T Mobility has been requested to evaluate the radio frequency emissions of our proposed site
478 -112. In addition, AT &T Mobility has been requested to address other RF related topics such as
transmitter operation and maximum permissible output power levels. The remainder of this report will
address all RF related items requested by New Hanover County ZoninglPIanning for proposed site 478-
112.
Transmitter Operation
AT &T Mobility owns the C LTE Bands and B PCS Band PCS licenses in New Hanover County.
The transmitters being used on the proposed site are authorized to operate in the 740 -746 and 1950 -1965
Megahertz (MHz) frequency range. The Ericsson Node B base station transmitters AT &T Mobility utilizes
have a maximum output level of 60 watts. AT &T Mobility utilizes the GSM, LTE and UMTS digital
technology. As a result our transmitters utilize Gaussian Minimum Shift Keying (GMSK), 16 -State
Quadrature Amplitude (16QAM), 64 -State Quadrature Amplitude (64 QAM) and Quadrature Phase Shift
Keying (QPSK) modulation. Precision filters limit unwanted and spurious emissions to levels below the
FCC specification. The signals being transmitted will not interfere with the operation of commercial radio,
cellular radio, television, telephone or other FCC approved communication equipment. For our proposed
site 478 -112, GSM technology will not be deployed.
Maximum Permissible Output Power
The maximum permissible output power for 1900 band per sector is 1640 Watts of effective
radiated power (ERP) from the antennas in New Hanover County. The proposed site 478 -112 is only
transmitting 506 total watts ERP.
The maximum permissible output power for 700 band per sector is 1000 Watts of effective
radiated power (FRP) from the antennas in New Hanover County. The proposed site 478 -112 is only
transmitting 143 total watts ERP.
RF Exposure (VIER levels)
The FCC states in 47 CFR 1. 13 10 that the maximum permissible exposure (MPE) level from non -
ionizing electromagnetic radiation (NIER) to the general population at cellular and PCS frequencies is 1.0
milliwatt per centimeter squared (mWfcml). MPE is a measure of the RF power density at or below which
there are no potential harmful effects from the exposure_
Power density calculations are based on guidelines given by the ANSI Standard C95.1 -1992 and
are based on a worst case scenario. For analysis purposes, worst case conditions were chosen for all output
power levels based on the deployment of LTE and UMTS technologies. The site is being deployed initially
with 6 transmitters. For analysis purposes, 15 transmitters were used. A summary of the results of the
power density calculations for site 478 -112 is listed below in Table 1 and Table 2.

As shown in Table 1, the maximum power density will not exceed 0.0004441mW /cmz at ground
level in 1900 Band and as shown in Table 2, the maximum power density will not exceed
0.0000761 mW /cmz at ground level in 700 Band. Moreover, the average energy expected near ground level
is less than 1% of the MPE level. This level does not exceed the MPE limit set by the Federal
Communications Commission or the American National Standards Institute.
Based upon the ANSI/FCC standard and the predicted levels of electromagnetic energy emitted by
site 478 -112, this installation will be of no safety concern to the general public.

The above referenced 195' Steel Tapered Pole is designed to meet the specified loading
requirements in accordance with ASCE 7 -10 Ultimate Wind Speed (No Ice) of 147 MPH & 30
MPH with 0.25 inches of radial ice as per ANSI /TIA/222 -G -2. Structure Class 11, Exposure
Category C; Topographic Category: 1.
It is our understanding that the design of the referenced pole may require consideration of a
contained fall radius in the event a catastrophic wind speed were to result in a failure. Although
the pole is not designed to fail, stronger sections than required by analysis are provided in the
lower portion of the pole. This would result in an increased safety factor in the lower sections.
This design would enable the pole to fail through a combination of bending and buckling in the
upper portion of the pole should a catastrophic wind loading occur. Failure in this manner would
result in the upper portion of the pole folding over the lower portion resulting in a fall radius
equal to 35 feet. The failure mode would theoretically be a local buckling failure involving a
crippling of the pole on one side of the pole as opposed to the pole shearing off or completely
breaking off and hitting the ground.

BRIEF SUMMARY:
The request is for a major modification of a 6.89 -acre parcel that is a CZD B -2 Conditional Zoning District
to develop a self- storage and recreational vehicle and boat trailer storage facility at 5112 Carolina Beach
Road. A major modifications is treated procedurally the same as a new conditional rezoning. The subject
property is located along the southwest side of the 5100 block of Carolina Beach Road, approximately 0. 65
mile south of the intersection of Carolina Beach Road and South College Road, in an area known as Monkey
Junction.
The property is currently zoned CZD B -2, Highway Business Conditional Zoning District as a result of a
rezoning from R -15 that was approved on July 21, 2014. This conditional rezoning allowed for expansion of
the existing self - storage business onto the subject property. The approval included a site plan consisting of
three 21,000 sq. ft. climate- controlled storage buildings, one covered boat trailer and recreational vehicle
storage area, a building for specialty retail, and related landscaping, drives, and parking areas.
The new proposal eliminates two 21,000 sq. ft. climate controlled self - storage buildings and a 10,000 sq. ft.
specialty retail area and replaces them with a 20,550 sq. ft. climate controlled storage building, two three -
sided, covered recreational vehicle and boat trailer storage areas and one enclosed boat storage area. With the
current proposal, internal traffic circulation is also reconfigured and a driveway to Carolina Beach Road is
eliminated.
The proposal's projected peak hour trip generation does not warrant a full Traffic Impact Analysis; revised
traffic figures have been provided by the applicant and project a decrease in peak hour trips with the current
proposal.
Zoning of the land in the vicinity consists of a mixture of B -2, CZD (B -2), R -15, R -10, and multifamily
zoning (Willoughby Park). Existing land uses in the area consist of a modular home park to the southeast of
the site, residential to the south, and a variety of commercial uses around the Monkey Junction area.
Directly adjacent to the site is Monkey Junction Self Storage; the rezoning request would expand this
existing business onto the subject site.
At their November 6, 2014 meeting, the Planning Board voted 6 -0 to recommend approval of the rezoning
request. No one from the public spoke either in favor of or opposed to the proposal.
The subject property is classified as Urban and Conservation Area according to the 2006 CAMA Land Use
Plan.

Existing Site Conditions
The site features 200' of direct frontage along Carolina Beach Road. The site is currently undeveloped
except for a residential structure near the frontage along Carolina Beach Road, and a small accessory
building to the rear of the home. Some areas of wetlands exist on the southwestern portion of the
parcel, but are not in the subject rezoning area nor will they be subject to direct impact due to the
development.
Motts Creek transverses the southwestern portion of the property, outside the area subject to the
rezoning request and proposed development. Some areas of the parcel contain AE and AE Floodway
Special Flood Hazard Areas; however, development encroachment in these areas would be limited to a
portion of the drive terminus and the stormwater management features. No CAMA Areas of
Environmental Concern exist within the subject rezoning or development areas.
Traffic and Transportation
Wilmington Metropolitan Planning Organization Staff conducted a traffic count in August 2013 in the
vicinity of the project at the intersection of Carolina Beach Road and just north of Antionette Drive. The
count yielded an average daily trip count (ADT) of 30,262. This figure represents an "F" Level of Service
(LOS) meaning that traffic counts are exceeding the design capacity of the road, which is listed at 29,300,
and a Volume to Capacity Ratio of 1.03.
Community Services
Water and Sewer:
The property is within the Urban Services boundary and is within the CFPUA service area. However, the
proposed use should have minimal impact on water and sewer demand.
Fire Protection:
The property is served by New Hanover County Fire Services and located in the New Hanover County
South Fire District.
Schools:
The property is located within the school districts for Williamson Elementary, Myrtle Grove Middle, and
Ashley High schools. The proposed use should have minimal impact on schools.
Conservation, Historic, and Archaeological Resources
The subject property does not host any known conservation, historic, or archaeological resources.
PETITIONER'S REQUEST:
The petitioner is seeking a major modification of the conditional zoning of a 6.89 acre parcel that is a
CZD B -2, Highway Business Conditional Zoning District to develop a self- storage and recreational vehicle

conditional zoning district by eliminating two 21,000sf climate controlled self- storage buildings and a
10,000sf specialty retail area and replacing them with a 20,550sf climate controlled storage building,
two three - sided, covered recreational vehicle and boat trailer storage areas and one enclosed boat
storage area. With the current proposal, internal traffic circulation is also reconfigured and a driveway
to Carolina Beach Road is eliminated.
STAFF POSITION:
Zoning Ordinance Considerations
The Ordinance states that the purpose of the B -2 Highway Business district is to provide for the proper
grouping and development of roadside business uses which will best accommodate the needs of the
motoring public and businesses demanding high volume traffic. Principal means of ingress and egress
should be along collector roads, minor arterials, and /or major arterials as designated on the County's
Thoroughfare Classification Plan. Finally, B -2 districts shall be a minimum of five (5) acres in area. Staff
opines the proposal is consistent with the purpose and intent of the B -2 zoning district, as well as the
district acreage requirements.
The New Hanover County Zoning Ordinance permits both self- storage facilities and recreational vehicle
and RV /boat trailer storage facilities within the B -2 zoning district.
Procedurally, the Zoning Ordinance treats major modifications to conditional zoning districts the same
as a new conditional rezoning.
Traffic
A Traffic Impact Worksheet has been submitted indicating that peak hour trips resulting from the
proposed use (18 peak AM hour trips and 32 peak PM hour trips) are below the threshold that would
require a Traffic Impact Analysis. Additionally, the traffic projections for the revised proposal offer a
reduction in peak hour trips from the previously approved proposal through the elimination of the
10,000sf specialty retail area.
Further, the previous proposal included a new driveway onto Carolina Beach Road, which is also
eliminated with the current proposal. Access will be provided from Archmil Way, which directly
connects to Carolina Beach Road.
Environmental
The project will be subject to several environmental regulations and permits. Stormwater management
will be reviewed by New Hanover County Engineering, along with sediment and erosion control.
Landscaping and Buffering
Landscaping and buffering shall be required per Zoning Ordinance regulations, which include the 20'
wide buffer areas along the perimeter as shown on the site plan, as well as streetscaping along Carolina
Beach Road. The proposed landscaping, buffering, and parking meet the requirements of the Zoning
Ordinance.
Land Use Plan Considerations
The majority of the subject area is classified as Urban by the 2006 CAMA Plan. The purpose of this land
use classification is to provide for continued intensive development and redevelopment of existing

urban areas. Some of the area at the "rear" of the site is classified as Conservation Area; however, the
project should have minimal to no direct impact to the areas classified as Conservation.
In summary, the proposal is consistent with the Urban land use classification and does not conflict with
any goal or policy within the Land Use Plan.
REVIEW AND ACTION:
This request is being facilitated by Section 55.3 — Conditional Zoning District of the County's Zoning
Ordinance, and has been processed and reviewed per Section 110 — Amending the Ordinance. A
community meeting was held on Thursday, October 9, 2014 in accordance with the requirements for
such a request. No members of the public attended the meeting, and no changes to the proposal were
made as a result of the community meeting.
Staff recommends the approval of the proposal as requested. Although considered a major
modification to the approved Z -933 conditional zoning district, Staff feels that the revised proposal
remains consistent with the previous rezoning and the surrounding community.
Staff concludes that the request is consistent with the requirements of the Zoning Ordinance and also
the 2006 Wilmington -New Hanover County CAMA Land Use Plan. Specifically, the location of the
subject property is very close to a large heavy commercial node, supporting Policy 4.3 of the CAMA Land
Use Plan:
Maximize effectiveness of commercial uses by assuring that land is available for commercial uses
within close proximity to the markets they serve and by ensuring that such commercial uses do
not diminish the quality of life in nearby residential areas.
The southwest area of the subject parcel contains both wetlands and flood hazard areas, both of which
are mostly avoided with the current proposal. The CAMA Land Use Plan offers guidance through Policy
3.9 to discourage development within the flood hazard areas for hazard mitigation:
Carefully control development activities within the 100 -year floodplain (1% annual chance
floodplain) according to density and impervious surface limits to protect the public safety, reduce
the risk of property damage, and provide for the long -term protection and management of these
environmentally significant resources.
The petitioner's proposal offers not only hazard mitigation but would create an undeveloped buffer area
between the existing and proposed development and Motts Creek, a tributary draining to the Cape Fear

Petitions must be reviewed by Planning & Zoning for completeness prior to acceptance. For petitions involving five (5) acres or
less, a fee of $400 .00 will be charged; for those of greater than five (5) acres a fee of $600,0 will be charged. This fee, payable
to New Hanover County, MUST accompany this petition. $500-00 / $700.00
In addition to the attached site plan check list, the following supplemental information is required:
1. Copy of the New Hanover County Tax Map, which delineates the property requested for rezoning.
2. Legal description (by metes and bounds) of property requested for rezoning.
3. Copy of the subdivision map or recorded plat which delineates the property.
4. Site Plan as outlined in section 59.10 -3. For plans larger than 1 Ix17, please provide ten (10) copies for the Planning
Board meeting. You will be asked for an additional thirteen (13) copies of your site plan if your proposal moves
forward to the County Commissioners. Also, please include one (1) reduced copy of the site plan. Digital submission
may be substituted when accurate scaling can be assured.
5. Authority for Appointment of Agent form (if applicable). The owner or authorized agent is required to attend the
Planning Board meeting. The owner or an attorney is required to attend the County Commissioners meeting.
6. Requirements of Section 59.10 -2.
7. Applicant's answers to the questions on this application.
8. Signed site plan check list.
9. A report of the required public information meeting outlined in Section 111 -2.1.
REVIEW PROCEDURES
Petitions for conditional change of zoning are first referred to the New Hanover County Planning Board and then acted
upon by the New Hanover County Board of Commissioners.
Complete petitions and all supplementary information must be accepted by Planning & Zoning twenty (20) working
days before the Planning Board meeting to allow adequate time for processing and advertisement as required by the North
Carolina General Statutes.

Planning Board meetings are held at 5:30PM in the Commissioner's Assembly Room in the Old County Courthouse, at
Third and Princess Streets, Wilmington, North Carolina, on the first Thursday of each month.
If the Planning Board approves your petition, the request will automatically be referred to the Board of County
Commissioners. if your petition is denied, you may appeal to the Board of Commissioners. Planning & Zoning can advise you
regarding appeal procedures.
Uses and Development Requirements: Within a Conditional District, the Permit may specify additional conditions and
requirements which represent greater restrictions on development and use of the tract than the corresponding General Use
District regulations, or other limitations on land which may be regulated by state law or local ordinance. Such conditions and
requirements shall not specify ownership status, race, religion, character or other exclusionary characteristic of occupant, shall be
objective, specific and detailed to the extent necessary to accomplish their purpose, and shall relate rationally to making the
Permit compatible with the New Hanover County Land Use Plan, and other pertinent requirements of the Zoning Ordinance, and
to securing the public health, safety, morals, and welfare.
WHAT YOU MUST ESTABLISH
FOR A CHANGE OF ZONING
Conditional District Zoning is established to address situations where a particular land use would be consistent with the New
Hanover County Land Use Plan and the objectives of this ordinance and where only a specific use or uses is proposed for the
project. You must explain in the space below how your request satisfies each of the following requirements: (attach additional
sheets if necessary)
1. How would the requested change be consistent with the County's Policies for Growth and Development?
Policies for growth encourage continued efforts to attract and retain businesses. The proposal
is essentially to expand an existing successful business with a small portion of specialty retail
area and additional storage space. The business is located on a busy traffic corridor.
2. How would the requested zone change be consistent with the property's classification on the Land Classification
Map?
The site is located in an "Urban" CAMA land classification. These areas are intended for
intensive urban development. They are appropriate for medium- density uses when direct
access can be provided to major traffic corridors and public services are available.
3. What significant neighborhood changes have occurred to make the original zoning inappropriate, or bow is the land
involved unsuitable for the uses permitted under the existing zoning?
Carolina Beach Road continues to develop with commercial and higher - density uses and the Monkey
Junction intersection has become a major commercial node in the County, serving the many
residential neighborhoods one - tier - removed from the busy highway thoroughfares. Smaller lots and
smaller homes have led to storage facilities being successful because of an established need.
4. List proposed conditions and restrictions that would mitigate the impacts of the proposed use(s).
Zoning Ordinance requirements, including buffering and directional light control, will be applied.
Landscape requirements addressing the streetscape and interior aesthetics will also serve to
mitigate impacts on adjacent properties. Permits for driveway access, stormwater management,
etc. will be required before actual development, assuring compliance to all rules and regulations.

Re: MJ Storage Expansion
A proposal for expansion of the Monkey Junction Self Storage facility onto the adjacent tract was
approved by the Board of Commissioners on July 21, 2014. A copy of the site plan is attached,
labelled "Old Plan."
The developers have researched market trends and determined that they need to revise their
business model somewhat. In response to that, minor changes have been made to the site plan,
also attached and labelled "New Plan," as follows:
• The specialty retail building and associated parking at the Carolina Beach Road frontage
has been eliminated, and replaced by climate - controlled storage.
• The rear two (2) previously proposed climate- control storage buildings have been
replaced by a structure designed for boat trailer and RV covered storage.
Positive justifications to these changes include:
• The driveway onto Carolina Beach Road has been eliminated.
• The retail use would have had a greater trip generation than the storage use, thereby
reducing overall traffic volume on Carolina Beach Road.
• The large paved turnaround at the rear of the site has been eliminated. Vehicle
circulation will be directional around the rear building. As such, the coverage area has
been reduced — further away from the special flood hazard area.
• The total impervious surfaces area remains the same as on the previously approved
plan.
• No other changes to the conditions of approval are proposed. The architecture,
landscaping and overall aesthetics of the existing business will be duplicated in the
expansion.
The County has determined that these changes represent enough of a modification to require re-
approval of the Conditional Zoning District by the Board of Commissioners. That process requires
that the developer hold another meeting for all property owners within a 500 -foot perimeter of the
tract boundary, and any and all other interested parties. This provides neighbors with an
opportunity for explanation of the proposal and for questions to be answered concerning project
improvements, benefits and impacts.
This meeting is going to be held at the Monkey Junction Storage office, 5044 Carolina Beach Road,
at 5:30 p.m., Wednesday, October 8th. If you cannot attend, you are also welcome to contact me

or more. The scope of the TIA shall be determined by concurrence of the Planning
Director, the MPO coordinator and NCDOT traffic engineer. Any mitigation measures
