Riverside_Ph1_approvalChris O'Keefe Planning Director 10/1/07 Cindee Wolf 7040 Wrightsville Ave. Suite 101 Wilmington, NC 28403 Subject: River Side (Performance Plan) New Hanover County Government Center 230 Government Center Drive, Suite 150 Wilmington, NC 28403 P 910.798.7165 F 910.798.7053 Dear Ms. Wolf, In regular session on September 26, 2007, the County's Technical Review Committee (TRC) voted 3-0 to approve River Side Subdivision for a total of 160 residential lots as displayed on your revised preliminary site plan. Preliminary site plan approval of the project comes with the following requirements: 1. With the size of the project directly impacting the County's water supply system, your client will be responsible for increasing capacity to the system. Details concerning the increase capacity will need to be worked out with the County Engineering staff. County sewer availability will be limited to 40 lots per final plat or per County Engineering criteria. 2. The entrance to the project beginning at the T intersection of Castle Hayne Road and North Kerr Avenue and extending west into the project will be dedicated, platted, and constructed as a 60' right of way. This segment of the road will also be designated as a "public" road. 3. All TIA requirements embraced by NCDOT and the City/County MPO will be constructed. A completed and approved NCDOT Driveway permit will need to be submitted prior to final plat approval. 4. Road stubs displayed on the site plan will be constructed prior to final plat approval. 5. The TRC granted your request to have private roads (for public use) within the project. Attending the TRC meeting were TRC Chairman David Adams (Planning Board), Sam Burgess (Planning Staff), Jim Iannucci (County Engineering), and Ray Griswold (Fire Services). Also, attending the meeting were Sharon Huffman (County Legal), Bobby Harris (Planning Staff), Vernon Weedon (School System), Matt Murphy (developer), and you. River Side Subdivision will be valid as a preliminary site plan for two years. If final plats are not submitted within the 24-month time limit, the plat must be resubmitted as a preliminary plan in accordance with the Subdivision Ordinance. Otherwise, the preliminary plan approval shall become void. A preliminary plan extension may be granted by the TRC for 12 months prior to expiration. The TRC may grant up to a maximum of two one-year extensions. In the future, County sewer may serve this project. However, due to the limited capacity of the County's wastewater treatment facilities, sewer capacity may not exist. DEHNR wastewater sewer construction and operations permits and/or final plat approval of sections may be withheld, if in the opinion of the County Engineer, adequate sewer capacity does not exist. Please also be advised that all other local, State and Federal regulations will be applicable. As you know, final plat approval for all or a part of the project cannot be obtained until construction plan drawings are submitted and approved by County Engineering staff.
