(Woody) Hall, Jr., Ph.D. BRIEF SUMMARY: William W. (Woody) Hall, Jr., Ph.D. will be retiring in May 2015 with almost forty -one years of service to UNCW and New Hanover County. A resolution is attached to recognize and thank him for his public service. Commissioner Watkins plans to present the resolution to Dr. Hall at an upcoming retirement event. Board of Commissioners - March 16, 2015 ITEM: 2 NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION RECOGNIZING WILLIAM W. (WOODY) HALL, JR., PH.D. WHEREAS, William W. (Woody) Hall, Jr., Ph.D., began his career at UNCW in 1974 as one of twelve faculty members in the Department of Business and Economics — now the Cameron School of Business; and WHEREAS, in addition to being a Professor of Economics at UNCW Cameron School of Business, Dr. Hall is Senior Economist at the H. David and Diane Swain Center for Business and Economic Services; and WHEREAS, for over three decades Dr. Hall has provided economic projections and since the inaugural 2004 UNCW Economic Outlook Conference, he has issued eleven economic forecasts for Southeastern North Carolina; and WHEREAS, Dr. Hall will retire effective May 2015, with almost forty -one years of service to UNCW and New Hanover County. NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners does hereby thank and recognize William W. (Woody) Hall, Jr., Ph.D. for many years of loyal service to UNCW, the citizens of New Hanover County and surrounding communities, and wishes him well in his retirement from public service and in his new endeavors. Todd's Recycling, LLC BRIEF SUMMARY: New Hanover County requires a County issued franchise to collect solid waste. Pursuant to Section 44.55, the applicant has provided information about his business organization, equipment, personnel and fiscal responsibility. The Environmental Management Director has no objections to the franchise request. The initial franchise period would run for seven years. County Legal, Finance, and Environmental Management have reviewed and approved the franchise request. STRATEGIC PLAN ALIGNMENT: RECOMMENDED MOTION AND REQUESTED ACTIONS: Authorize franchise award. This matter will then be placed on the next agenda for the second approval required for final franchise award. The following application is in accordance with " Sec 44 -55, Franchise required for soild waste collection section (a)(b)(c) part - 1,2,3,4,5," Applicants requirements for soild waste collection "Sec 44 -55 part (c) 1,2,3,4,5" are as follows (1) C.Todd's Recycling LLC (CTR) Charles Dorman (Chuckie D.) owner 113 Redwood Court Wilmington North Carolina 28412 (2) C.Tood'd Recycling(CTR) at this time has two(2) collection vehicles and Four Hundred(400) ninty five gallon(95) roll carts. One verical bailer. At this time CTR has enough equipment to start servicing 100 trash customers and will obtain new roll carts, a new collection vehicle and a new Vertical bailer as the trash customers demand increases. (3) CTR has two(2) employees at this time and will be hiring four(4) more employees as customer demand increases. 1 Truck Driver and 3 material handlers. (4) C.Todd's Recycling LLC (CTR) was established in February 1, 2007 cleaning up and recycling C &D from new home construction sites, recycling wood, sheet rock, bricks and blocks in New Hanover County. In January of 2008 C.Todds Recycling was awarded an ABC Recycling grant from RBAC and the state of North Carolina. At that time, we stopped with the C &D collections and started collecting glass, cardboard, plastic, tin,and aluminum from bar and restaurants only. CTR presently has 187 New Hanover County ABC permitted customers keeping them in accordance with North Carolina House Bill 1518. 124 ABC permitted customers in Brunswick, Onslow, Dulin and Columbus County. CTR collects about 35 to 60 tons of alcohol related glass, 6,000 lbs of cardboard, 1,000lbs of aluminum, 1,200lbs of plastic and 200lbs of tin each week and depending on the time of the year. CTR provides all customers with approved containers, 95 gallon roll carts, at their location to assist in the collecting of their recyclable materials. CTR stores all recyclable materials at their storage yard. At CTR facility all recyclables are cleaned, bailed, and distributed back into the mainstream economy. Some of the materials that we collected just can't be recycled and it goes to the New Hanover County Land Fill. Board of Commissioners - March 16, 2015 ITEM: 3 - 1 - 1 NEW HANOVER COUNTY BOARD OF COMMISSIONERS REQUEST FOR BOARD ACTION MEETING DATE: March 16, 2015 CONSENT DEPARTMENT: Environmental Management PRESENTER(S): Joe Suleyman, Environmental Management Director CONTACT(S): Joe Suleyman SUBJECT: Approval of an Application for the Waiver of Landfill Tipping Fees for the Wilmington Housing Authority (WHA) BRIEF SUMMARY: The Environmental Management Department has received an application for the waiver of tipping fees from the Wilmington Housing Authority (WHA) and its non - profit agency, Housing and Economic Opportunities, Inc. The mission of the WHA is to provide families with quality, affordable housing in safe, attractive communities. WHA assists over 1,200 low- income families (2,500 residents) via low rents for working families, the elderly and disabled. The Wilmington Housing Authority staff is undertaking efforts to continue the rehabilitation of existing public housing units, as well as expanding efforts to improve the appearance and safety of the sites by keeping them clear of trash and debris. The landfill has waived a total of $119,085 in tipping fees (2,382 tons) for fiscal year 14 -15 to date. The Environmental Management Director recommends approval of the waiver request with a maximum of 180 tons waived per rolling twelve (12) month period for waste generated within New Hanover County. The value of this tipping fee waiver, if the full requested amount of 180 tons per year is authorized and utilized, is $9,900. The items recommended for accessioning have all been reviewed by the Curator, Director, Collections Committee, and were approved by the Museum Advisory Board at their February 18, 2015 meeting. Each item offered has a special story to preserve. From 2014 campaign materials, a break bulk cargo model, mid -20th century toys, to a collection of images from the US Army Corps of Engineers — Wilmington District, the objects document 300 years of the region's stories. Arriving first at the scene, they were alerted by the home's resident that her husband was confined to a wheelchair on the second floor and unable to evacuate. All four deputies entered the smoke and flame filled home; a fire in the downstairs fireplace on a record cold night radiated out to an adjacent closet and was spreading quickly up the walls and throughout the house. Resident George Britt was in his bedroom upstairs, attempting to get in his wheelchair to access a motorized chairlift. Corporal Hollar fought off approaching flames with a fire extinguisher while the resident was carried downstairs and out of the home by Deputies Brothers, Daniels and Gonnelli. To this end, the Boards of CoastalCare and East Carolina Behavioral Health (ECBH) have agreed to consolidate. This consolidation has been approved by the DHHS secretary. The new entity will represent the 24 most easterly counties in the state. The current law restricts the number of board members to 21 members. To ensure local community representation, an alternative board structure is being proposed. The two- tiered board structure will keep governance close to the community through Regional Advisory Boards, which in turn elect representatives to the governing Board of Directors. The Board of Commissioners for each county will appoint two members to their Regional Advisory Board. Board of Commissioners - March 16, 2015 ITEM: 13 NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION OF SUPPORT FOR AN ALTERNATIVE GOVERNANCE STRUCTURE FOR THE AREA AUTHORITY SERVING NEW HANOVER COUNTY WHEREAS, in accordance with N. C. General Statute § 122C — 115 (cl), the Area Board of CoastalCare, an Area Authority serving Brunswick, Carteret, New Hanover, Onslow and Pender Counties and the Area Board of East Carolina Behavioral Health, an Area Authority serving Beaufort, Bertie, Camden, Chowan, Craven, Currituck, Dare, Gates, Hertford, Hyde, Jones, Martin, Northampton, Pamlico, Pasquotank, Perquimans, Pitt, Tyrrell, and Washington Counties, have entered into an agreement to consolidate their agencies into a twenty -four county Area Authority serving all previously named counties; and WHEREAS, the Secretary of the N. C. Department of Health and Human Services has approved this consolidation, as required by law; and WHEREAS, N. C. General Statute § 122C — 118.1, which specifies the composition of an Area Authority Board, permits an alternative Area Board structure to be implemented 1) if the total population of the Area Authority catchment area exceeds 1,250,000 and 2) if the counties which comprise the Area Authority agree by resolution to an alternative structure; and WHEREAS, the total population of the new Area Authority created by the consolidation of CoastalCare and East Carolina Behavioral Health is 1,260,778; and WHEREAS, it is in the best interest of the residents of the twenty -four counties to approve an alternative governance structure for the consolidated Area Authority. NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners does hereby approve the structure of the Area Board and the Regional Advisory Boards of the consolidated Area Authority, as outlined below. To provide a local presence in the counties served and to assure that each county has input into the services received by its residents, the twenty -four county catchment area will have three regions. The regions have been designed to equalize, to the extent possible, the number of counties, population in the region, and overall square mileage of the regions. The three regions and the counties served are: Northern Region: Bertie, Camden, Chowan, Currituck, Gates, Hertford, Martin, Northampton, Pasquotank and Perquimans Counties. Central Region: Beaufort, Craven, Dare, Hyde, Pamlico, Pitt, Tyrell and Washington Counties. Southern Region: Brunswick, Carteret, Jones, New Hanover, Onslow and Pender Counties. The counties in each region will appoint two members to the Regional Advisory Board: one county commissioner or designee and another individual who meets the requirements outlined in N. C. G. S. § 122C — 118.1 (b). In addition, the Regional Advisory Board will include the Chair or designee of the regional Consumer and Family Advisory Committee. Each Regional Advisory Board will establish its own bylaws based on local needs, but in compliance with standardized requirements established by the Governing Board for quorums, frequency of meetings, elections of officers, duties of members, committees and committee appointments, and attendance standards. Such bylaws are subject to the approval of the Governing Board. Each Regional Advisory Board will select four (4) members to serve as the Area Authority Governing Board: one county commissioner, the Consumer and Family Advisory Committee chair or designee, and two other members. In addition, the chair or designee of the Area Authority Network Council shall serve on the Governing Board as a non - voting member. The county commissioner members of the Governing Board shall serve one three -year term without consecutive reappointment, so that commissioner representation on the Governing Board will rotate among the counties in each region. The other members of the Governing Board may serve three, three -year terms. To achieve maximum geographic representation, other than the Consumer and Family Advisory Committee chair, the other Regional Advisory Board members selected for the Area Authority Governing Board shall be from different counties. The Governing Board's primary responsibilities will include determining policy; strategic planning, including consideration of local priorities as determined by the Regional Advisory Boards; budgets; hiring and evaluations of the Chief Executive Officer; monitoring of deliverables, including overall performance and financial management; government affairs and advocacy; reporting to constituent counties; responding to concerns and feedback from the Regional Advisory Boards; reviewing, revising and approving the Regional Advisory Board bylaws; and all other responsibilities outlined in N. The company proposes to invest approximately $50 million and will employ about 1,300 people when the company is fully operational. Over two- thirds of the employees are expected to come from the existing labor market of southeastern North Carolina. The North Carolina Department of Transportation ( NCDOT) is working to ensure adequate improvements to both the rail and street network are in order to meet the company's needs while maintaining the safety of the public and company contractors and employees. NCDOT and the company are currently working to implement rail improvements within the River Road right of way to provide improved rail access to the site. The City has requested the County partner with them in a cost - sharing proposal between the City of Wilmington ($300,000), New Hanover County ($300,000) and NCDOT ($900,000) to help advance development of the site at 202 Raleigh Street. The City of Wilmington, at their meeting on March 3, 2015, agreed to fund this project in the amount of $300,000. This appropriation is contingent upon the County approving the cost - sharing proposal and providing the additional $300,000. The project will extend Raleigh Street to improve connectivity and circulation. The estimated cost of the project is $1.5 million. The following issues were raised at the County's agenda review on February 26, 2015. Following are the issues and their related responses from Mike Kozlosky, Executive Director, Wilmington MPO. 1. Who is the landowner of the site for Vertex's operation? Response: The land owner of record on the NHC Tax Card information is WILMINGTON RALEIGH LLC. It is my understanding that Vertex has a long -term lease with the property owner. 2. is there a problem with the current method of ingress /egress? Response: Vertex plans to open in May (300+ employees) with additional staffing in June (approximately 600 employees) and fully operational by the end of the year with over 1,000 employees. There is queuing on Raleigh Street during the PM peak. NCDOT plans to construct improvements at the intersection of Raleigh Street/Carolina Beach Road, however an additional access will improve connectivity and circulation. 3. Are there guarantees should Vertex not establish their business here or leave sooner than expected? Response: These improvements will have long -term benefits to circulation and connectivity in this area. Based on the scope of work, it is unlikely that the extension and turn lanes improvements will be ready to complete in advance of Vertex's opening in May. If for some reason Vertex chose not to locate here, then we could chose not to expend the funds. Additionally, if the extension is made and Vertex were to leave sooner than expected, the road extension and rail improvements would be in place and potentially make the property more attractive to another industrial use. Response: The road will improve connectivity and circulation in this area. 5. What will happen to the road extension project if the County does not participate? Response: If the County does not participate, additional funding would need to be identified from another source or the improvements would not be constructed. If no funding were identified, then there will be no additional access improvements. The City has committed an amount not to exceed $300,000. If there was a lack of County participation, I believe this would have a significantly detrimental impact and likely could eliminate the possibility for the extension and associated improvements to be constructed. 6. What will happen to the road extension project if NCDOT does not participate? Response: NCDOT is the largest proposed contributor in this effort. We have been in discussions with the Department and they have indicated that this cost sharing proposal is satisfactory to the Department. If NCDOT were not to participate, I do not believe the extension and other associated improvements would be completed. 7. Will there be a rail crossing on the extension? Response: There will be no rail crossing across the extension. NCDOT is, however, working with Vertex to make rail crossing and access improvements along River Road that will improve rail access to the Vertex site. Board of Commissioners - March 16, 2015 ITEM: 16 NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION IN OPPOSITION OF MUNICIPAL BOND TAXATION WHEREAS, North Carolina and local units of government like New Hanover County perform essential capital improvements with the costs of these improvements often financed through the issuance of bonds or other notes of indebtedness; and WHEREAS, tax exempt municipal bonds are the single most important tool in the U.S for financing investment in schools, roads, water and sewer systems, fire stations, airports, bridges, and other vital infrastructure; and WHEREAS, ninety percent of municipal bonds funded these types of projects across the United States over the last ten years with more than 6,600 tax - exempt municipal bonds financing more than $179 billion worth of infrastructure projects in the United States in 2012 alone; and WHEREAS, changes to the tax exemption for municipal bond interest would affect all Americans and American household retirement plans with three - quarters of the municipal bond market held by these households; and WHEREAS, a repeal of the tax - exemption on municipal bonds would disproportionately harm smaller governments causing them to face higher interest rates as they issue large bonds; and WHEREAS, changes to the taxation status of municipal bonds would slow economic recovery and investment, shift the tax burden to the local property tax owners, and cause a loss in local jobs due to an inability to finance critical projects otherwise funded by municipal bonds; and WHEREAS, losing the tax exemption status for municipal bond funding would have a very serious and negative impact on any major capital improvement planning for the future of North Carolina and New Hanover County; and WHEREAS, under current market conditions, New Hanover County would realize a $4.6 million benefit in debt service payments by issuing tax - exempt municipal bonds for all of its currently unissued voter authorized debt; and WHEREAS, opposition to the taxation of municipal bonds is a top priority legislative item for both the North Carolina Association of County Commissioners (NCACC) and the National Association of Counties (NACo). I view public library systems as a key to opening those opportunities, by serving as conduits for education, literacy, and the pursuit of knowledge. Consequently, the NHC Public Library system plays a vital role in the strength of this community by connecting its citizens with opportunities for their own personal and professional growth and advancement. Our libraries also serve as a meeting place for our citizens — a place for the community to gather, interact, and feel safe. Serving as a member of the NHC Library Advisory Board would allow me to lend my talents in service of this community, this important institution, and its important impact. What areas of concern would you like to see addressed by this committee? One particular area of concern I would like to see addressed by the NHC Library Advisory Board is keeping up with technological advancement. The internet, smartphones, e- readers, and other, more dramatic recent technological advances have changed the way people interact with information and each other. Accordingly, it is important that the library stay on the cutting edge of technological developments so that it will continue to serve as a valuable, relevant resource for members of our community. Additionally, I think it is important for the library to stay focused on ensuring that it is an inviting, accessible place to people from the entire spectrum of the New Hanover County population. The NHC Library Advisory Board must ensure that our library system is offering the right programs, engaging in appropriate partnerships, and providing the appropriate resources to meet the needs of our community as a whole. As a public institution, I also believe it is important that we do this in a cost - effective way for our citizens. Qualifications for serving? I have deep roots in the NHC Public Library System. Shortly after my family moved to town in 1991, the public library was the first place my mother took my sister and I in an effort to get us connected to our new community. Growing up in this County, I made frequent use of the library's resources, participated in the summer reading program, and frequently checked out books — all of which served as the basis of my love of reading and continuing interest in the pursuit of knowledge. Beyond my history with the library, I am also qualified to serve on the New Hanover County Library Advisory Board because of my education and experience. As an attorney, I am trained to approach problems systematically, with a focus on outcomes and results.
