Collections for October 2015 are ahead of collections for October 2014. This continues to be the trend based on the earlier generation and mailing of tax notices in July 2015 compared to being mailed in August 2014. Another factor in the increase over last year is increased usage of the installment payment coupons. The City of Wilmington is the lead agency for this grant, which totaled $71,478. The Sheriffs Office will use its share of the award to pay for electrical wiring upgrades for the SABLE helicopter. No County match is required. The grant was approved by the Board of Commissioners at the June 8, 2015 meeting. This project will identify community stakeholders to collaborate on vector control improvement activities, use the vector control population health driver diagram as a framework or reference for the development of quality improvement (QI) projects, and participate in in- person basis. Vector Control's participation in this project will help improve their skill in using quality improvement methods and tools to achieve desired results. In addition, funds will be used for the printing and purchase of educational materials to be distributed in places like local schools. No County matching funds are required. BA 16 -050 The Health Department has been awarded two grants from the Food and Drug Administration (FDA) as part of the Retail Standards grant program. The first will be used for travel and training associated with an upcoming FDA Retail Food Safety Seminar which updates staff on changes to the FDA Food Code, Standardization Procedures, Retail Program Standards, new industry retail food safety initiatives, funding opportunities and emerging science and technology related to retail food safety. The second will be used to implement intervention strategies including educating staff of food service establishments about such things as cold holding, cooling, date marking and/or bare hand contact with ready -to -eat foods. In addition, funds will be used to purchase special data recording thermometers and probes_ No County matching funds are required. Local governing boards' code of ethics: (a) Governing boards of cities, counties, local boards of education, unified governments, sanitary districts, and consolidated city- counties shall adopt a resolution or policy containing a code of ethics to guide actions by the governing board members in the performance of the member's official duties as a member of that governing board. Chairman Dawson requested this item be added at the agenda review meeting on December 30, 2015. Board of Commissioners - January 4, 2016 ITEM: 6 NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION ADOPTING A CODE OF ETHICS WHEREAS, G.S. 160A -86 requires local governing Boards to adopt a code of ethics; and WHEREAS, New Hanover County citizens deserve to be served by public officials who maintain the highest ethical standards; and WHEREAS, the stability and proper operation of democratic representative government depends upon public confidence in the integrity of the government, and upon responsible exercise of the trust conferred by the citizens upon their elected officials; and WHEREAS, Board members must act in a manner that maintains their integrity and independence and be responsive to the interests and needs of those they represent; and WHEREAS, Board members must know how to distinguish among their various roles, to determine when each role is appropriate, and to act accordingly: 1. As advocates, who strive to advance the legitimate needs of their citizens. 2. As legislators, who balance the public interest and private rights in considering and enacting ordinances and resolutions, and 3. As fair and impartial decision - makers, when making quasi-judicial and administrative determinations. NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners does hereby adopt the following Code of Ethics to guide the Board of County Commissioners in its decision - making. The Board of Commissioners directs all County boards and committees to respect and abide by this Code of Ethics in the performance of their duties. CODE OF ETHICS Purpose. The purpose of this Code of Ethics is to establish guidelines for ethical standards of conduct for the Board of County Commissioners. It should not be considered a substitute for the law or for a Board member's best judgment. Section 1. A. Board members should obey all laws that apply to their official actions. The spirit as well as the letter of the law should guide their actions. Board members should feel free to assert policy positions and opinions without fear of reprisal from fellow Board members or citizens. B. Board members should endeavor to keep themselves current, through the County Attorney and other sources, of the most pertinent constitutional, statutory, and other legal requirements with which they must be familiar in order to meet their legal responsibilities. C. Board members shall comply with G.S. 160A -87 in receiving two clock hours of ethics education within twelve months of each election or appointment to office. Section 2. Board members should act with integrity as they exercise the functions of their offices. Characteristics and behaviors that are consistent with this standard are: A. Behaving consistently and with respect towards everyone with whom they interact. B. Exhibiting trustworthiness. C. Living as if they are on duty as elected officials regardless of where they are or what they are doing. D. As part of the NCDWR grant application, the Board of Commissioners is required to adopt a resolution, which is attached, documenting the County's intent and understanding of the grant nuances. If approved, grant reimbursements would be dependent on approved and provided project invoices. Any future potential MIRP use of the Shallow Draft Fund would require a resubmittal incorporating event specific details. The inlet complex design, alignment and template dimensions allow for healthy inlet shoulders, sediment flushing and tidal prism access as a connecting channel from the Atlantic Ocean to the AIWW. Design elements of the inlet complex have template dimensions similar to many shallow draft inlets managed in southeastern NC. The Mason Inlet Relocation Project (MIRP) has multiple maintenance event triggers. The navigation trigger is the shoaling within the AIWW crossing. The primary maintenance trigger is a shoaling accumulation exceeding 375,000 cubic yards (cy) within the project template. A third trigger ensures the inlet complex is maintained within the engineering corridor safeguarding the inlet's location and retaining healthy inlet shoulders. The 2015/2016 maintenance event has been triggered by the USACE's mandated AIWW crossing's navigational access and the creek/inlet shoaling volumes (approximately 475,000 cubic yards). Additional inlet shoaling occurred during the extreme lunar tides and as Hurricane Joaquin passed off -shore in early October. NHC also manages the financial administration of the MIRP including assessment of each parcel owner within the MIPG for the cost of maintaining and managing the project. The project is funded through the NHC room occupancy tax which is reimbursed during each five -year MIPG assessment effort. In 2013, the NC General Assembly established the Shallow Draft Navigation Channel Dredging and Lake Maintenance Fund. That application included the subject property and two additional parcels of land, and it proposed to rezone the parcels to a general R -10 district. The application was denied by the Board of Commissioners, therefore the property owner of the subject property is now asking for it to be rezoned to a conditional R -10 district. The zoning in the vicinity consists of mostly residential and industrial districts. The residential districts, including R -10, R -15, and R- 20 can be found to the west and north of the property. Adjacent to the property to the north is a large tract of R -10 zoning, approximately 260 acres in area, which contains the Ivy Woods and Runnymeade subdivisions. The industrial districts, including I -2 and Al, are located to the east and south of the property, and contain the North Kerr Industrial Park and Wilmington International Airport. The 2006 CAMA Land Use Plan classifies the property as Aquifer Resource Protection. The Plan suggests that areas within this classification be developed with larger lots if septic systems are used to prevent cross contamination of wells, or have water and sewer services extended to curtail septic system use. Density in developments that utilize septic systems should be limited to 2.5 dwelling units per acre, while urban densities are appropriate for developments connected to sewer service. Uses of land that pose risk of spill of hazardous materials should also be prevented in the Aquifer Resource Protection areas. Water and sewer services have been extended to the area, and the services would be required to be extended though the proposed development. Therefore, the goals of the Aquifer Resource Protection area would be achieved with the proposed development. At their December 3, 2015 meeting, the Planning Board voted 6 -0 to recommend approval of the rezoning, finding that the application is: Consistent with the purposes and intent of the 2006 CAMA Land Use Plan because the proposed performance residential subdivision must install water and sewer service, and thus it should not diminish the recharge of surrounding aquifers, thereby complying with the development strategies of the Aquifer Resource Protection land use classification and Policy 3.28 of the Land Use Plan. Reasonable and in the public interest because it provides for increased density in areas best suited for development while not impeding the quality of life of the existing residential communities. A 20 -foot easement shall be dedicated to New Hanover County along Blue Clay Road for the purpose of installing a future multi -use path in accordance with the 2008 Blue Clay Corridor Study. Additional access must be provided to the active recreation area located in the center of the proposed subdivision by relocating lot 121 to another portion of the subdivision, and by adding a pedestrian access to the recreation area from the north. At the meeting, the Planning Board expressed concerns with the limited access to the recreation area located in the center of the proposed development. Because of this, a condition ( #3 above) was added with the applicant's agreement that would increase access to the area. The proposed site plan has been updated to comply with the added condition, therefore it is not included in staff's recommendation. If the site plan is modified in a way that would substantially reduce the amount of access to the recreation area, staff would considered it a major modification to the district, which would require approval by the Board of Commissioners. Because of this, a condition ( #3 above) was added with the applicant's agreement that would increase access to the area. The proposed site plan has been updated to comply with the added condition, therefore it is not included in staff's recommendation. If the site plan is modified in a way that would substantially reduce the amount of access to the recreation area, staff would considered it a major modification to the district, which would require approval by the Board of Commissioners. The property was originally zoned R -20 when zoning was initially applied to this area in 1974. The zoning in the vicinity consists of mostly residential and industrial districts. The residential districts, including R -10, R -15, and R -20 can be found to the west and north of the property. Adjacent to the property to the north is a large tract of R -10 zoning, approximately 260 acres in area, which contains the Ivy Woods and Runnymeade subdivisions. STAFF POSITION: Zoning and Subdivision Ordinance Considerations The R -10 district is established as a district in which the principal use of land is for residential purposes with access to either public water or public sewer. Under the performance residential standards, developments within the R -10 district are allowed up to 3.3 units per acre. A conceptual site plan is included as part of the application and is shown below. The applicant is proposing to develop a 154 lot performance residential subdivision with the following conditions: 1. Streetyard plantings for the non - residential use in a residential district will be installed along the Holland Drive Frontage. 2. Therefore, a Traffic Impact Analysis (TIA) has been completed in accordance with the county's regulations. The TIA examined three intersections in the area: Blue Clay Road at North Kerr Avenue, Blue Clay Road at Site Access 1, and Holland Drive at Site Access 2. It found that those intersections will operate at a Level of Service of B or better during the peak hours when the development is expected to be completed in 2018. The TIA recommended that a northbound left turn lane be installed at Blue Clay Road and Site Access 1 to accommodate the vehicles entering the development. The turn lane would consist of 100 feet of storage and appropriate taper. The TIA was approved by NCDOT and the WMPO with the stated recommendation. Z -947, (12/15) Board of Commissioners - January 4, 2016 ITEM: 9 - 3 - 4 Page 4 of 8 Intersections examined with Blue Clay Road and Holland Drive The Wilmington Metropolitan Planning Organization (WMPO) conducted a traffic count in 2014 on Blue Clay Road, between Kerr Avenue and Old Mill Road. The count yielded an Average Daily Traffic (ADT) of 5,576 trips. Blue Clay Road has a design capacity of 15,600 daily trips, and therefore it is classified as having an "A" Level of Service (LOS) with a Volume of Capacity Ratio of 0.36. Environmental The subject property is classified as Aquifer Resource Protection, which is where the Castle Hayne and Pee Dee Aquifers secondary recharge occurs. Development strategies for land within this classification are detailed below in the Land Use Plan Considerations. The property does not contain any Special Flood Hazard Areas, wetlands, or Natural Heritage Areas. For septic suitability, the property contains Class II and Class III soils. Class II soils have moderate limitations, which require moderate modification and maintenance, and Class III soils have severe limitations, which requires extensive modification and intensive maintenance. However, this project will be required to install public water and sewer service in accordance with the standards of the CFPUA and the County's subdivision ordinance. Land Use Plan Considerations According to the 2006 CAMA Plan, the site is classified as Aquifer Resource Protection, a subclass of the Resource Protection classification. The purpose of the Resource Protection classification is to provide for the preservation and protection of important natural, historic, scenic, wildlife and recreational resources. Z -947, (12/15) Board of Commissioners - January 4, 2016 ITEM: 9 - 3 - 5 Page 5 of 8 The Aquifer Resource Protection subclass occurs in the Northwest part of the County, north of Smith Creek, and is the area where the Castle Hayne and Pee Dee Aquifers secondary recharge occurs. The impacts that the resource is being protected from is diminished recharge of the aquifer and contamination of the aquifer by inappropriate land uses. The Plan suggests that areas within the Aquifer Resource Protection subclass are developed with larger lots if septic systems are used to prevent cross contamination of wells, or have water and sewer services extended to curtail septic system use. Density in developments that utilize septic systems should be limited to 2.5 dwelling units per acre, while urban densities are appropriate for developments connected to sewer service. Uses of land that pose risk of spill of hazardous materials should also be prevented in the Aquifer Resource Protection areas. Water and sewer services have been extended to the area, and the services would be required to be extended though the proposed development. Further, due to the area needed to accommodate septic systems and repair areas, it is not common for lots within the R -10 district to use that form of wastewater disposal. Instead, development within the R -10 district typically connects to a centralized sewer system in order to achieve the density allowed in the district. The current draft of the new Comprehensive Plan classifies the property as Community Mixed Use on the Future Land Use Map. The Community Mixed Use Place Type focuses on small - scale, compact, mixed use development patterns that serve multimodal travel and act as an attractor for county residents and visitors. These areas share several qualities with higher- intensity mixed use place types, including a combination of retail with office and housing above, wider sidewalks, and an emphasis on streetscaping. However, these centers are generally small, no more than a few square blocks. Civic uses, particularly recreation and public gathering places, are particularly encouraged here. Ideally, large- scale, lower density commercial and industrial developments are prohibited. Z -947, (12/15) Board of Commissioners - January 4, 2016 ITEM: 9 - 3 - 6 Page 6 of 8 In regards to single - family residential development, the draft Comprehensive Plan suggest that the ideal density within the Community Mixed Use Place Type is +/- 8 dwelling units per acre. This ideal density reflects the average density needed to support the small - scale, compact, mixed use development patterns that the Place Type promotes. In this application, the maximum density of 3.3 units per acres allowed in the R -10 zoning increases the maximum density of 1.9 units per acre currently allowed in the R -20 zoning district, aligning with the development strategies of the Community Mixed Use Place Type. REVIEW AND ACTION: This request is being facilitated by Section 55.3 — Conditional Zoning District of the County's Zoning Ordinance, and has been processed and reviewed per Section 110 — Amending the Ordinance. A community meeting was held on October 28, 2015 in accordance with the requirements for such an application. The applicant has provided a summary of the meeting which includes the concerns and comments brought up by the attendees. Staff recommends the approval of the application with two conditions as requested. Staff concludes that the application is consistent with the requirements of the Zoning and Subdivision Ordinances and also the 2006 Wilmington -New Hanover County CAMA Land Use Plan. Consistent with Policy 3.28 of the Land Use Plan, this application should preserve the Castle Hayne and Pee Dee aquifers in their present unpolluted state as the primary groundwater resources for the County because the development of the properties will require the extension of water and sewer to serve the area. The policy further states that densities in the Aquifer Resource Protection classification should be limited to 2.5 units per acre unless sewer service is provided. Applications must be reviewed by Planning Staff for completeness prior to being officially accepted. For petitions involving greater than 5 acres, $700 g 5 Page 2 of 3 Board of Commissioners - January 4, 2016 04%14 ITEM: 9 - 11 - 2 CRITERIA REQUIRED FOR APPROVAL OF A CHANGE OF ZONING Conditional Use District Zoning is established to address situations where a particular land use would be consistent with the New Hanover County Land Use Plan and the Zoning Ordinance objective but for which none of the general zoning classifications which would allow that use are acceptable. The applicant should explain, with reference to attached plans (where applicable), how the proposed use satisfies these requirements. The applicant has the burden of proof and must provide sufficient evidence in order for the required findings to be met. You must explain in the space below how your request satisfies each of the following requirements (attach additional sheets if necessary): 1. How would the requested change be consistent with the County's Policies for Growth and Development? The policies for growth and development encourage safe and affordable housing to be available to every citizen. Sustainability of the County depends on sensible in -fill and maximizing use of lands already accessible to urban services. More density of ,single- family development not only increases tax base, but makes better use of the existing infrastructure. 2. How would the requested zone change be consistent with the property's classification on the Land Classification Map? The Aquifer Resource Protection land classification is intended to protect the secondary recharge area for the Castle Hayne and Pee Dee Aquifers, with a strategy to encourage larger lots when public utilities are not available. However, public water & + ,sewer services are now available in this area, thereby eliminating the issue. 3. What significant neighborhood changes have occurred to make the original zoning inappropriate, or how is the land involved unsuitable for the uses vermitted under the existing zoning? Public utilities have been extended to the area in proximity to the subject tract. There is an R -10 development in the area, so expanding the same zoning district in the vicinity would not be uncommon. Rezoning this property for moderate density 'allows more flexibility in lot layout, more green space, sidewalks and other positive features. 4. List proposed conditions and restrictions that would mitigate the impacts of the proposed use(s). Orientation of the lots internal to the development, and providing a greenspace buffer along Holland Drive provides a `separation between these smaller lots to the larger, more traditional lots in the Wrightsboro neighborhoods. A traffic impact analysis has been completed. Road improvements will be made as recommended. Detail design and permitting by all agencies will be required If an applicant requests delay of consideration from the Planning Board or Board of County Commissioners before notice has been sent to the newspaper, the item will be calendared for the next meeting and no fee will be required. If delay is requested after notice has been sent to the newspaper, the Board will act on the request at the scheduled meeting and are under no obligation to grant the continuance. If the continuance is granted, a fee in accordance with the adopted fee schedule as published on the New Hanover County Planning website will be required. Table 2.2 contains the dates these counts were conducted. Traffic volumes were balanced between the study intersections by using the greater of adjacent volumes. Per the WMPO staff, there are two developments seeking approval in the vicinity of the project that will be incorporated into the analysis. River Bluffs is a multi - development consisting of single family homes, condominiums, small retirement community and a country store located off of Chair Road whose TIA was completed by Ramey Kemp & Associates in 2008. This development is estimated to generate 4,555 daily site trips (251 trips in the AM peak and 393 trips in the PM peak). Trasco Distribution Center is a 205,000 square foot building located on North Kerr Avenue between Blue Clay Road and North Kerr Avenue whose TIA was completed by Ramey Kemp & Associates in 2014. This development is estimated to generate 1,776 daily site trips (360 trips in the AM peak and 340 trips in the PM peak). Riverside Development is a multi - family consisting of 165 single family detached homes and 72 apartments located off of North Kerr Avenue whose TIA was completed by DAVENPORT in May 2015. This development was analyzed for two (2) phases. Phase 1 (2016) will consist of 100 single family homes. Full Build (2019) will consist of 165 single family homes and 72 apartments. Since Riverside Development will be phase constructed before and after the Rachel's Place Subdivision, the Phase 1 trips were used in the analysis. The Phase 1 development is estimated to generate 1,050 daily site trips (80 trips in the AM peak and 105 trips in the PM peak). The site trips for each development were incorporated into all future build conditions. More information can be found in the Supporting Documents section of the Appendix. 3.2 Committed Improvements Committed Improvements are improvements that are planned by NCDOT or a developer in the area, but not yet constructed. Per WMPO, there are recommended committed improvements in the study area due to the two approved developments. Figure 6 shows 2018 future no build traffic volumes for AM and PM peaks. 4.5 2018 Build Total Traffic The 2018 build -out traffic volume was obtained by summing the 2018 future no build volumes and site trips due to the proposed development. There are currently six levels of service ranging from A to F. Level of service "A" represents the best conditions and Level of Service "F" represents the worst. Synchro Traffic Modeling software was used to determine the level of service for studied intersections. Note for unsignalized intersection analysis, the level of service noted is for the worst approach of the intersection. This is typically the left turn movement for the side street approach, due to the number of opposing movements. All worksheet reports from the analyses can be found in the Appendix.
