Adoption of a Resolution to Donate Sculpture to Cameron Art Museum
BRIEF SUMMARY:
In 1994, the Carolina Courtyard was constructed and a local artist designed a sculpture for the project which
was paid for using monies from a state grant, private contribution, and General Fund. The total cost of
the sculpture including the artist's fees was $13,000.
Carolina Courtyard is in the process of being redesigned and has been renamed Story Park. Story Park will
be an outdoor story and exploration space encouraging physical activity and stimulating literacy through
interactive play for children.
The sculpture will no longer be needed; consequently, the Library would like to donate it to Cameron Art
Museum.
Cameron Art Museum is a non - profit organization that provides a cultural gathering place that enriches the
lives of museum visitors and the community through high - quality exhibitions, dynamic public programs,
unique events and educational opportunities in the visual and performing arts.
Pursuant to North Carolina General Statues 153A -176 and 160A -280, the County may donate to another
governmental unit within the United States, a sister city, or a nonprofit organization incorporated by (i) the
United States, (ii) the District of Columbia, or (iii) one of the United States, any personal property, including
supplies, materials, and equipment, that the governing board deems to be surplus, obsolete, or unused.
The statute requires a public notice be posted at least five (5) days prior to the adoption of a resolution
approving the donation by the Board. The resolution must be adopted prior to making any donation of
surplus, obsolete, or unused personal property.
A public notice has been posted on the County's website as required prior to the adoption of the
attached resolution.

RESOLUTION
DONATION OF SCULPTURE TO CAMERON ART MUSEUM
WHEREAS, the New Hanover County Library has a sculpture that was created by a local artist during
the construction of Carolina Courtyard in 1994; and
WHEREAS, Carolina Courtyard is being redesigned into Story Park which will be an outdoor story and
exploration space encouraging physical activity and stimulating literacy through interactive play for
children; and
WHEREAS, the sculpture will no longer be needed; consequently, the Library would like to donate it to
Cameron Art Museum; and
WHEREAS, Cameron Art Museum is a non - profit organization that provides a cultural

approving the donation.
NOW, THEREFORE, BE IT RESOLVED by the New Hanover County Board of Commissioners that:
1. The sculpture is declared surplus property.
2. The donation of the sculpture to Cameron Art Museum is approved.
3. County staff is directed to process any required documents to complete the transaction.

PUBLIC NOTICE
At their meeting scheduled for Monday, March 21, 2016 at 9:00 AM, New Hanover
County Board of Commissioners will consider a resolution to declare a sculpture created
by a local artist during the construction of Carolina Courtyard in 1994 surplus property
and approval for the sculpture to be donated to Cameron Art Museum. The sculpture was
funded using a state grant, private contribution, and money from the County's general
fund for a total cost of $13,000. The meeting will be held at the New Hanover County

Section 2: Explanation
BA 16 -064 increases the state subsidy funding with IV -E monies reimbursed for August and September of
2015 service months. Once a quarter the state reviews their records and reimburses the County money
spent on IV -E foster children receiving daycare services. These funds are reinvested back into services
funded by State Subsidy funds. As of the end of February 2016, we are currently at a spending rate of
101 %, therefore these funds are being utilitzed to support services for the 1,521 children currently enrolled
in the daycare program. The department is currently looking at reducing services in order to remain within
the state and federal allocations. We are continuing to see an increase in referrals from Child Welfare and
Work First services who by policy must be accommodated for services. Thus resulting in the termination of
services for other families to address the growing needs in those program areas. Currently, it is estimated
that approximately 185 children will have services terminated. No County match is required.
BA 16 -065 is for additional monies received through incentive payments and will be used to administer the
Family Support Program. This program purchases services to assist fathers to become better parents and
support their children financially. It works with non - custodial parents referred from Child Support Court
and the New Hanover County Child Support Office and is 100% funded through child support enforcement
incentive payments. North Carolina earns incentive payments based on the Child Support Program
performance as compared to the other states in the nation. No County match is required.
BA 16 -066 budgets funds from the Casey Family Programs Institute used to provide permanency roundtable
training of our social workers to increase the number of children transitioning out of foster care. There are
no federal, state, or county funds involved. Funds must be spent by June 30, 2016.

Section 2: Explanation
BA 16 -067 The County owns a 250' guyed communications tower which is co- located on the Cape Fear
Public Utility Authority's M'Kean Maffitt Wastewater Treatment Plant site. The tower and equipment
building previously served as the County's primary public radio antenna tower. However, the tower is no
longer in service and all equipment has been removed. Since the tower is no longer used, Cape Fear
Public Utility Authority has requested it be removed. It will cost $24,500 to demolish and remove the
tower. Cape Fear Public Utility Authority has agreed to pay for half of the total cost. The County's
matching funds of $12,250 was included in the FY15 -16 Adopted Budget. BA 16 -067 budgets Cape
Fear Public Utility Authority's contribution to the cost of the project.

Section 2: Explanation
BA 16 -068 budgets the insurance proceeds from the lightning strike of August 3, 2015 at the historic
courthouse and the necessary appropriated fund balance required to make repairs to the damaged systems
and install preventative measures to prevent this from happening again. The breakdown of the expenses are
as follows: $25,000 deductible, $17,686 insurance proceeds and $112,207 expenses in excess of insurance
coverage.

Recognition of Two Senior Resource Center Employees for Cape Fear Council of Government Area
Agency on Aging 2015 Professional Excellence Awards
BRIEF SUMMARY:
Two New Hanover County Senior Resource Center employees were recognized by the Cape Fear Council of
Governments with the Professional Excellence in Aging Awards. Greg Kennedy and Ellen Connor received
this esteemed recognition at the Council's 44th Anniversary Meeting and Awards Banquet on February 23,
2016. The Professional Excellence Award is awarded to dedicated public servants who have demonstrated
exceptional leadership capabilities at the local level in advancing the mission of the Older Americans Act
and preparing communities for our nation's rapidly aging population. Greg and Ellen were selected from a
four- county region that includes New Hanover, Brunswick, Columbus, and Pender.
Greg Kennedy is a Program Manager with the County's Senior Resource Center (SRC) and has more than 30
years of public service experience. He maintains oversight of over 50 instructors, group leaders, and
facilitations for the center's wide range of programs and activities. His work has been instrumental in the
SRC receiving and maintaining the Division of Aging and Adult Service status of "Senior Center of
Excellence." With Greg's work in aging services and as a caregiver, he understands the importance of
providing senior services for our community that engages seniors to be active in programs such as exercise,
lifelong learning, socialization, and more. These vital services promote wellness, encourages independence,
and enhances the quality of life for all older persons.
Ellen Connor is the Nutrition Program Manager at the SRC. She oversees the daily delivery of more than 300
home delivered meals (HDM) to New Hanover County's (NHC's) homebound seniors and more than 60
congregate meals at the center. Ellen also oversees the recruitment and training of over 130 HDM volunteers
that are a critical part of serving some of NHC's most frail population. Ellen holds a cooking class once a
month at the SRC that incorporates herbs and vegetables grown in the SRC raised bed gardens. She also
created and facilitates a successful wellness support group that focuses on living a healthy eating and mindful
lifestyle. Her passion and knowledge have created successful nutrition programs at the center and education
programs, which also includes nutrition counseling for seniors and caregivers so they can reach their
personal health potential. Ellen's mission is to use her skills and passion to serve the public by providing a
safe, healthy, and fun environment as fundamental pathways for improving the lives of seniors.
Greg and Ellen help to improve the lives of our County's seniors every day. New Hanover County is
fortunate to have their passion and dedication to serve the citizens of New Hanover County.

BRIEF SUMMARY:
Notification has been received from the Government Finance Officers Association of the United States and
Canada that New Hanover County has qualified to receive the Distinguished Budget Presentation Award for
the 25th consecutive year. The award is for New Hanover County's budget submitted for the fiscal year
beginning July 1, 2015. The award is the highest form of recognition in governmental budgeting. The budget
is reviewed by a panel of independent budget experts who use extensive criteria to evaluate the effectiveness
of the budget as a policy document, a financial plan, an operations guide, and a communication device.
Award - winning documents must be rated "proficient" in all four categories.

Chicago - -The Government Finance Officers Association of the United States and Canada (GFOA)
is pleased to announce that New Hanover County, North Carolina has received the GFOA's
Distinguished Budget Presentation Award for its budget.
The award represents a significant achievement by the entity. It reflects the commitment of the
governing body and staff to meeting the highest principles of governmental budgeting. In order to
receive the budget award, the entity had to satisfy nationally recognized guidelines for effective
budget presentation. These guidelines are designed to assess how well an entity's budget serves as:
• a policy document
• a financial plan
• an operations guide
• a communications device
Budget documents must be rated "proficient" in all four categories, and the fourteen mandatory
criteria within those categories, to receive the award.
When a Distinguished Budget Presentation Award is granted to an entity, a Certificate of Recognition
for Budget Presentation is also presented to the individual or department designated as being
primarily responsible for its having achieved the award. This has been presented to New Hanover
County Budget Department
For budgets beginning in 2014, 1,491 participants received the Award. Award recipients have
pioneered efforts to improve the quality of budgeting and provide an excellent example for other
governments throughout North America.
The Government Finance Officers Association is a major professional association servicing the needs
of 18,300 appointed and elected local, state, and provincial -level government officials and other
finance practitioners. It provides top quality publications, training programs, services, and products
designed to enhance the skills and performance of those responsible for government finance policy
and management. The association is headquartered in Chicago, Illinois, with offices in Washington
D.C. The GFOA's Distinguished Budget Presentation Awards Program is the only
national awards program in governmental budgeting.

New Hanover County was presented the Certificate of Achievement for Excellence in Financial Reporting by
the Government Finance Officers Association (GFOA) for the fiscal year 2015 Comprehensive Annual
Financial Report. This is the thirty-fifth consecutive year that the County has achieved this prestigious
award.
The Certificate of Achievement is the highest form of recognition in governmental accounting and financial
reporting, and its attainment represents a significant accomplishment by a government and is
management. This report must include all funds and component units in accordance with generally accepted
accounting principles as established by the Governmental Accounting Standards Board (GASB) and must
include the report of an independent auditor on the fair presentation of the financial statements. The report is
thoroughly reviewed and judged by an impartial panel to meet the high standard of the program.

Consideration of the North Carolina Department of Transportation's ( NCDOT) Acquisition of a
Portion of Ogden Park for the Military Cutoff Extension and Request to Budget Proceeds from Sale to
Fund Phase 2 of the Ogden Skatepark and Complete a Walking Trail at Ogden Park
BRIEF SUMMARY:
NCDOT intends to acquire 10.180 acres of undeveloped park land located between the soccer and baseball
facilities, near the Duke Energy utility easement. This acquisition will not alter park use but will split the
parcel into two separate pieces, leaving 65.343 acres to the left of the taking and 62.968 acres to the right of
the taking. In addition, NCDOT intends to acquire 0.44 acre for permanent utility easements located at three
different areas adjacent to the proposed right of way. Though the park parcel will be split into two separate
parcels they will still be linked via Ogden Park Drive. The proposed Military Cutoff extension will bisect the
park property via a bridge spanning Ogden Park Drive.
According to NCDOT the value of right of way and the permanent easement to be acquired is $502,580. It is
the opinion of Roger Kelley, Tax Administrator, that the agreed upon sales price is fair and reasonable. If this
offer is accepted by New Hanover County the executed documents will be returned to the Land Acquisitions
Unit for final review and approval. Payment is generally made within 4 -6 weeks. The transaction will be
finalized by a closing attorney for whom NCDOT pays all of the associated costs (attorney fees, recordation
fee, etc.).
NCDOT anticipates installing and relocating utilities in August 2016. Once that has taken place, the
construction will commence. They anticipate construction beginning in 2017, with the project taking
approximately two years to complete.
Staff is requesting to budget the proceeds from the sale to fund Phase 2 of the Ogden Skatepark and compete
a walking trail at Ogden Park. In addition, budget amendment 16 -071 will recognize $60,783 in
contributions from the Parks Conservancy of New Hanover County to be used to complete Phase 1 of the
Ogden Skatepark.

RESOLUTION APPROVING THE
NCDOT'S ACQUISITION OF OGDEN PARK LAND
WHEREAS, New Hanover County has been contacted by the North Carolina Department of
Transportation ( NCDOT) regarding the acquisition of a portion of Ogden Park for the Military
Cutoff Road extension; and
WHEREAS, NCDOT intends to acquire 10.18 acres of undeveloped park land and 0.44 acre for

and
WHEREAS, this acquisition will not alter park use but will split the parcel into two separate

continue to use the Permanent Utility Easement area(s) in any manner and for any purpose, including but not
limited to the use of said area for access, ingress, egress, and parking, that does not, in the determination of
the Department, obstruct or materially impair the actual use of the easement area(s) by the Department of
Transportation, its agents, assigns, and contractors.
SPECIAL PROVISIONS. This deed is subject to the following provisions only:
It is understood and agreed that the total consideration set forth above shall be made payable to Hawke Law.
PLLC and after satisfaction of all taxes, liens, encumbrances on this parcel, the remaining balance shall be
disbursed in accordance with the Grantors' directions, and the Grantors shall have no claim against the

abutters' rights of access thereto as at common law; subject, however, to the right of the DEPARTMENT to
reasonably regulate said abutters' rights of access in order to protect and safeguard the traveling public.

On March 4, 2016, the evaluation committee met with the vendors who held the top two evaluation scores to
hold additional discussions and address follow up questions. The evaluation committee completed evaluation
discussions and made a decision on March 8, 2016. After careful consideration, the evaluation committee
selected Lanier Parking as the company to recommend to the Board of Commissioners for award of the
contract. Although Lanier was not the vendor with the lowest cost or the highest initial evaluation, the
committee's recommendation was based on the following additional factors:
Vendor currently provides parking services for the County's parking deck and is knowledgeable with
the downtown parking environment as they also serve as the City of Wilmington's parking service
vendor.
Vendor's services proposed include more physical presence on the deck and the surface lot with
addition staff time as compared to the competitor's proposal. Physical presence is important in
easing security concerns on the deck.
County would be obligated to pay an additional $37,721 in fiscal year 2016 for equipment if it
changed from its current vendor. This made the proposal price between the two top vendors much
more comparable.

This Preliminary Engineering Report (PER) has been developed to evaluate the feasibi I ity of
constructing publicwater and wastewater infrastructure throughout the USHighway 421 corridor
in New Hanover County. The County recently completed a comprehensive study of the corridor,
including potential economic growth projections that wouId benefit from the avai I abi I ity of public
water and wastewater utilities. Subsequently, this PER has been developed utilizing the County
projections in concert with Cape Fear Public Utility Authority ( CFPUA), who would ultimately
own and maintain such infrastructure. Figure 1.1 provides the Iocation of the development zones
identified along the U S H ighway 421 that are the basis of the eval uation.
Recommended Alternatives
The recommended wastewater system will consist of a series of pump stations and sewer force
mai ns to convey wastewater to the CFPUA system for treatment. The recommended water system
will consist of the extension of potable water mains in the corridor to provide domestic water
demands and well asfireflow requirements. The estimated project cost is $20.2M and the
anticipated timeline to design, permit and construct is 36 months from the date of design award.
The recommended alternatives will provide public water and wastewater service along the US
Highway 421 corridor from the Pender County lineto the Isabelle Holmes Bridge. The
recommended alternatives for wastewater and water areas shown in Figure 1.2 and Figure 1.3
respectively.
The initial cost of the project could be reduced by eliminating two wastewater pump stations
(designated as PS land PS2 on Figure 1.2) that would serve smaller sub basins. Advantages and
disadvantages of these cost reductions are shown in Table 1 below:

This report does not recommend the cost reduction options as they do not fulfill the full scope of
the project. As noted, implementation of either cost reduction option will not hinder expansion or
additions to the system at a future date.
Appendix A of this report includes the Technical M emorandum Duke Energy Sutton Plant Leachate
Conveyance System prepared for Duke Energy in conjunction with this PER. This document
provided infrastructure recommendations to convey leachate from the proposed Duke coal ash
landfill to the CFPUA system. Recent regulatory requirements have accelerated the Duke Energy
schedule and the benefits of this configuration for Duke Energy would be limited. Currently,
CFPUA is in discussion with Duke Energy to accommodate an estimated 56,000 gallons per day of
leachate in the southern portion of the US421 corridor via CFPUA Pump Station 12.
A summary of the primary sections of the report are briefly described as follows:
• Technical Memorandum 20 Demand Pr4ections - TM 2.0 provides an evaluation of the
identified growth areas in the US Highway 421 corridor. An analysis of developable
acreage, illustrative industries, and job creation was conducted in order to project water
demandsand wastewater flows that could begenerated throughout the corridor.
• Technical Memorandum 3.0 Wastewater Infrastructure Alte 'natives Anal ysis —TM 3.0 includes a
detailed evaluation of feasible options to provide public wastewater infrastructure in the
corridor. Alternatives were evaluated for interim and long -term phasing, opinions of cost,
permit requirements, and anticipated schedule of implementation.
• Technical Memorandum 4.0 Water InfrastructureAlternativesAnalysis— Coroll ary to TM 3.0,
TM 4.0 provides a detailed evaluation of feasible options to provide public water
infrastructure in the corridor. Alternatives included interim and long -term phasing,
opinionsof cost, permit requirements, and anticipated scheduleof implementation.
Additionally, fire flow capacities and water quality concerns are addressed in this TM.

ADULT CARE HOME COMMUNITY ADVISORY COMMITTEE
Number of Members: 13 State mandated; May appoint up to 18 (1 member for each
permitted facility) The Adult Care Home Administrators may nominate one -third of the
members. If possible, one member must be a person involved in the area of mental retardation.
A County Commissioner shall be appointed to serve in an ex- officio capacity.
Compensation: None, but may be reimbursed for actual expenses.
Term of Office: 1 year term initially; 3 year term thereafter
Qualifications: Must be a resident of New Hanover County. No person or immediate family
member of a person with a financial interest in a home served by the committee, or employee or
governing board member of a home served by the committee, or immediate family member of a
resident in a home served by the New Hanover County Adult Care Home Community Advisory
Committee may be a member of this committee. Immediate family is defined as mother, father,
sister, brother, child, grandmother, and grandfather, as well as in -laws. See Volunteer Job
Description for more information.
Purpose: The committee supports the spirit of the Adult Care Home Resident's Bill of Rights,
visits adult care homes quarterly, promotes the wellbeing of residents and encourages

Regular Meeting: Quarterly Meetings are held on the first Wednesday of January, April, July,
