Board of Commissioners - April 4, 2016 ITEM: 1 NEW HANOVER COUNTY BOARD OF COMMISSIONERS REQUEST FOR BOARD ACTION MEETING DATE: April 4, 2016 CONSENT DEPARTMENT: Environmental Management PRESENTER(S): Joe Suleyman, Environmental Management Director CONTACT(S): Joe Suleyman SUBJECT: Approval of an Application for the Waiver of Landfill Tipping Fees for the 2016 North Carolina Azalea Festival BRIEF SUMMARY: The Environmental Management Department has received an application from the 2016 North Carolina Azalea Festival for the waiver of landfill tipping fees. The event will be held April 6 -10, 2016, and is estimated to generate 10 -15 tons of waste, resulting in the waiver of approximately $780 in tipping fee revenues. The tonnage requested to be included with this request is equivalent to disposal representing less than one (1) hour of one (1) day of airspace capacity on an annual basis. The waste will be transported by Coastal Ladies Carting (Pink Trash) and Rent -A -John. The landfill has waived a total of $ 89,207 in tipping fees (1,740 tons) for the current fiscal year through the end of February, from all sources. The Environmental Management Director recommends approval of the waiver request, with a maximum cap of 15 tons eligible for the fee waiver for the duration of the event. Rowe SUBJECT: Approval of Eight Donations for Accession into the Museum's Permanent Collection BRIEF SUMMARY: The Museum collects items pertaining to the history, science, and cultures of the Lower Cape Fear region. Submitted for approval are eight donations to be added to Museum's permanent collection. Donations are carefully documented. The Curator reviews each item's provenance, condition, relevance to the collection, potential for exhibition, and a variety of similar criteria. A report on each object is reviewed carefully by the Director and Collections Committee. The objects presented have passed this scrutiny and were approved at the Museum Advisory Board meeting of March 13, 2016. Each item offered has a special story to preserve. From the local film industry, to promotional brochures, to a 1940s wedding ensemble, the objects document 300 years of the region's stories. Rowe SUBJECT: Approval of 100 Items to Deaccession from the Museum Collection BRIEF SUMMARY: Museum staff and the Museum Advisory Board have been diligently culling items from the permanent collection that have no relevant provenance, are in very poor condition, or are duplicates of better examples. This process is a recommended step in effective collections management. The items recommended for deaccession have all been reviewed by the Curator, Director, Collections Committee, and Museum Advisory Board at their March 13, 2016, meeting. Recommendations for disposition are also provided. Many of the listed items are recommended for transfer to a more appropriate collecting institution. If declined, they may be transferred the Museum's teaching collection, or offered for auction, a procedure which removes the sale from immediate conflict of interest with the Museum. Income earned from items sold at auction goes into a restricted account used to conserve or purchase artifacts for the collection. Board of Commissioners - April 4, 2016 ITEM: 5 NEW HANOVER COUNTY BOARD OF COMMISSIONERS CHILD ABUSE PREVENTION MONTH PROCLAMATION APRIL 2016 WHEREAS, children are vital to our state's future success, prosperity and quality of life as well as being our most vulnerable assets; and WHEREAS, all children deserve to have safe, stable, nurturing and healthy homes and communities that foster their well- being; and WHEREAS, child abuse and neglect is a public responsibility affecting both the current and future quality of life of a state; and WHEREAS, parents need support and resources to help cope with stress and nurture their children to grow to their full potential; and WHEREAS, effective child abuse prevention strategies succeed because of partnerships created among citizens, human service agencies, schools, faith communities, health care providers, civic organizations, law enforcement agencies, and the business community; and WHEREAS, New Hanover County is committed to preventing child abuse and calls upon the citizens from all walks of life to increase their participation in efforts to support families, and thereby prevent child abuse and strengthen communities. NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that the month of April 2016 will be recognized as "Child Abuse Prevention Month" in New Hanover County. The Board calls upon all citizens, community agencies, father groups, medical facilities, elected leaders and businesses to increase their participation in our efforts to support families, thereby preventing child abuse and strengthening the community in which we live. Both programs engage and utilize the skills of seniors 55 years of age and older to volunteer in a variety of New Hanover County's nonprofit and government agencies. In New Hanover County we have over 900 volunteers serving at over 40 stations such as New Hanover County Schools, Home Delivered Meals, Assisting Seniors Navigate Medicare, Volunteer Income Tax Assistance, Historical and Cultural Attractions, Disaster Preparedness, Literacy and Computer Training, Local Food Banks, Hospital and Hospices in New Hanover County, and assisting our local Veterans. The Senior Corps volunteers improve the lives of fellow citizens. In addition to giving back to the community, research indicates that volunteers enjoy better health, make new friendships, stay active and involved in the community, and learn new skills. Volunteers provide many intangibles that can not be easily quantified. However, in Fiscal Year 2014 -2015, New Hanover County's Senior Corps Program volunteers gave our community 145,493 in volunteers hours worth $3,356,523. (c) Inability to access appropriate therapeutic interventions due to limitations for coverage by both Medicaid and private insurance companies. Recommendation — Expand insurance coverage to include services for therapeutic interventions for children and adults in need of these services to ensure child safety. Ensure appropriate client advocacy on behalf of children and adults who are in need of mental health services by improving communication with local mental health management entities. 2. Substance Abuse - Involved Families Substance abuse by parents and caretakers continues to be a prevalent contributory factor in child maltreatment. The negative impact that results from substance abuse involves children being left unsupervised, children born testing positive for a controlled substance such as prescription medications or illegal drugs, caretakers involved in criminal behavior leading to incarceration and sadly child fatalities. Of particular concern is our local opiate abuse epidemic. This issue is compounded by our local proliferation of providers who deliver minimal oversight and intervention regarding medication management, i.e. Methadone, Subutex, and Suboxone. Recommendation — Increase community awareness through education regarding intervention and better outcomes. Continue collaboration with community partners to develop policy and procedures regarding the safety of children when a parent or caretaker is in substance abuse treatment. 3. Lack of Affordable Non - Subsidized Housing Families who are at or just above the current poverty guidelines are not eligible for subsidized housing. They struggle to find affordable, adequate housing in New Hanover County. Too often the results are families being forced to live in unsafe neighborhoods; multiple families residing in a single residence, or tragically enough, homelessness. Recommendation — Provide funding to community agencies to develop innovative housing initiatives /solutions that meet the needs of all our populations in New Hanover County, particularly the working poor, and require strict enforcement of housing regulations. 4. Service barriers for undocumented families Systemic barriers exist for undocumented families' ability to access basic services that would adequately meet the needs of their children, i.e. medical care, dental care, mental health treatment, and housing. Recommendation — Ensure that basic needs for ALL children are met regardless of citizenship through advocacy at the local and state level. 5. Increased youth gang involvement Our community has seen a meteoric rise in gang violence. Sadly, a great deal of this gang activity involves our Board of Commissioners - April 4, 2016 ITEM: 10- 1 - 2 children. We have seen cases where children are killing children and where gangs exert greater influence on the children than do their parents. Recommendation — Continued support of the local leadership's efforts to combat gang activity within our community in order to keep our children from choosing this lifestyle. 2015 ACCOMPLISHMENTS Investments in preventing child abuse and neglect pay rich dividends in the life of a community. The purpose of our group is to not only identify gaps in services, but to also provide opportunities to organize others around the cause of child abuse prevention. When we protect and nurture our children, we ensure a bright future for the whole community. In 2015 we sponsored the following events: • "Great Childhoods for all Children" — In April 2015, during Child Abuse Prevention Month, we held the Annual Flower Launch on the Henrietta. This event honors community members and professionals who work every day to nurture and protect our children. Each flower that is launched into the Cape Fear River represents an individual or agency that has positively impacted the lives of local children. • Community Education on Reporting Child Abuse and Neglect -- Training was provided to all county fire departments, local law enforcement, and New Hanover County School Counselors /Social Workers on how to recognize, respond, and report child abuse and neglect. This is an ongoing effort by our membership. • "Dynamics of Domestic Violence" Training — Judge J. Corpening provided the staff of DSS with training regarding the effects of domestic violence on children and families. • "The ABC's of CME's" Training — Dr. Mollie Berkhoff and her staff from the University of North Carolina Medical Center provided the community with an extensive training regarding the use of Child Medical Evaluations in diagnosing child abuse. This training was attended by a wide variety of community professionals, including law enforcement, medical professionals, foster parents, social workers, and parents. • Child Fatality Protocol — The Department of Social Services and the District Attorney's Office collaborated on an updated version of our community's Child Fatality Protocol and provided education to numerous professionals throughout the county. • "Infant Safe Sleeping Tips" is a flyer developed and distributed to educate the public in reducing the risk of SIDS and sleep - related causes of infant death. This was a project that we partnered with the New Hanover County Child Fatality Prevention Team. Parent Skill Building Programs Board of Commissioners - April 4, 2016 ITEM: 11-1 -1 NEW HANOVER COUNTY JUVENILE CRIME PREVENTION COUNCIL 2016 -2017 FUNDING AND REVIEW COMMITTEE RECOMMENDATIONS The New Hanover County Juvenile Crime Prevention Council is allotted $433,344 (pending legislative /budget approval) in funding for fiscal year 2016 -2017. Three grant applications were received (not including administration). The combined Juvenile Crime Prevention Council request for these three grant applications was $416,467. After carefully reviewing the grant applications, the Funding and Review Committee recommends the following: Administration Requested: $7,600 Committee Recommendation: $7,600 The amount recommended will be used as follows: $3,600.00 for an administrative assistant and $4000.00 toward food, RFP advertising, supplies and other necessary purchases to ensure the JCPC operates according to general statute. Youth Empowerment Services Requested: $345,132 Committee Recommendation: $345,132 This program addresses funding priorities one, two and tour. line program contains both an assessment and counseling component. Funding priority number two is addressed in the Community Service /Restitution program and funding priority number four is addressed in the Home -Based Family Services component. This program has been highly praised by the Juvenile Court Counselor's office and identified as a needed service in the community. The Funding and Review Committee recommends funding this program. Teen Court Requested: $46,375 Committee Recommendation: $45,725 This program addresses funding priority number three. Teen Court has received high praise from the Juvenile Court Counselors office and is a model Teen Court program for the State. The Funding and Review Committee recommends fully funding this program. Strenotheninsa Families Requested: $23,905 Committee Recommendation: $34,887 This program addresses funding priority five. The Funding and Review Committee met with the program manager to discuss the program and if excess JCPC funds were available, the possibility of adding additional sessions of Strengthening Families. Each session is 8 weeks in duration. The program manager was in agreement to add additional sessions to the program agreement. The Funding and Review committee recommends funding the Strengthening Families program at $34,887. Our community was one of six that participated in this team challenge, sponsored by Governor McCrory, along with the Department of Veterans Affairs and the North Carolina Coalition to End Homelessness. A press release is attached. They set an aggressive 100 -day goal: to house 24 of the veterans known to be homeless in January by May 25th and to house all newly identified veterans within 90 days. There a few ways in which they hope to accomplish this goal, which require support from the greater community. They would like to share this information with the commissioners and citizens of New Hanover County at the April 4th meeting. More than 80 state, federal and veteran service providers focusing on homeless veterans opened a two -day event at the McKimmon Center today to coordinate innovative actions to address homelessness among former service members. The Rapid Results Veteran Boot Camp is part of Governor Pat McCrory's initiative to end military veteran homelessness in North Carolina. "Homelessness is often the result of many difficulties a veteran is facing," Governor McCrory said. "The experts at this gathering will share their knowledge and experience to come up with practical, common -sense solutions that will help our veterans who have done so much to protect us." In June, Governor McCrory announced a statewide strategy to end veteran homelessness in the state. The North Carolina Departments of Military and Veterans Affairs and Health and Human Services initiated this first -of -its kind event in North Carolina. The departments partnered with the Rapid Results Institute to assemble teams across the state which are being tasked with meeting specific targets in a 100 -day time frame. Community teams have been formed for Onslow, Pender, New Hanover, Brunswick, Wake, Durham, Orange, Rowan and Buncombe counties. An additional team will focus on less populated areas of the state. Teams are comprised of those who work directly with homeless veterans including representatives of the Veterans Administration Medical Centers, Supportive Services for Veterans and Their Families, Grant Per Diem, NCWorks, Continuum of Care, Behavioral Health, and community and faith leaders. The Rapid Results Veteran Boot Camp event is sponsored by the Task Force for Ending Veteran Homelessness in North Carolina, a committee of the Governor's Working Group on Veterans and Their Families. The 2006 CAMA Land Use Plan classifies the property as Aquifer Resource Protection. The Plan suggests that areas within this classification be developed with larger lots if septic systems are used to prevent cross contamination of wells, or have water and sewer services extended to curtail septic system use. Density in developments that utilize septic systems should be limited to 2.5 dwelling units per acre, while urban densities are appropriate for developments connected to sewer service. Uses of land that pose risk of spill of hazardous materials should also be prevented in the Aquifer Resource Protection areas. Water and sewer services have been extended to the area, and the services would be required to be extended though the proposed development. Therefore, the goals of the Aquifer Resource Protection area would be achieved with the proposed development. At their March 3, 2016 meeting, the Planning Board voted 5 -0 to recommend approval of the rezoning with conditions, finding that the application is: 1. Under the performance residential standards, developments within the R -10 district are allowed up to 3.3 units per acre. Because the trips do not exceed 100 in the peak hours, a Traffic Impact Analysis (TIA) is not required to be completed. A TIA was recently completed for Rachel's Place, a proposed 154 lot subdivision adjoining the subject property to the south. The TIA found that intersections in the area, including Blue Clay Road at North Kerr Avenue and the subdivision's site access on Blue Clay Road, will operate at a Level of Service of B or better during the peak hours when the development is expected to be completed in 2018. The Wilmington Metropolitan Planning Organization (WMPO) conducted a traffic count in 2014 on Blue Clay Road, between Kerr Avenue and Old Mill Road. The count yielded an Average Daily Traffic (ADT) of 5,576 trips. Blue Clay Road has a design capacity of 15,600 daily trips, and therefore it is classified as having an "A" Level of Service (LOS) with a Volume of Capacity Ratio of 0.36. Environmental The subject property is classified as Aquifer Resource Protection, which is where the Castle Hayne and Pee Dee Aquifers secondary recharge occurs. Development strategies for land within this classification are detailed below in the Land Use Plan Considerations. Z -950, (3/16) Board of Commissioners - April 4, 2016 ITEM: 13- 3 - 4 Page 4 of 8 The property does not contain any Special Flood Hazard Areas or Natural Heritage Areas. Wetland data provided by NC Division of Coastal Management shows wetlands may exists in the northwest portion of the property. Verification of regulated wetlands will occur during the subdivision review process. For septic suitability, the property contains Class II and Class III soils. Class II soils have moderate limitations, which require moderate modification and maintenance, and Class III soils have severe limitations, which requires extensive modification and intensive maintenance. However, this project will be required to install public water and sewer service in accordance with the standards of the CFPUA and the County's subdivision ordinance. Land Use Plan Considerations According to the 2006 CAMA Plan, the site is classified as Aquifer Resource Protection, a subclass of the Resource Protection classification. The purpose of the Resource Protection classification is to provide for the preservation and protection of important natural, historic, scenic, wildlife and recreational resources. The Aquifer Resource Protection subclass occurs in the Northwest part of the County, north of Smith Creek, and is the area where the Castle Hayne and Pee Dee Aquifers secondary recharge occurs. The impacts that the resource is being protected from is diminished recharge of the aquifer and contamination of the aquifer by inappropriate land uses. The Plan suggests that if septic systems are to be used, development with the Aquifer Resource Protection subclass should be on large lots to prevent cross contamination of wells. Alternatively, water and sewer services should be extended to the area to curtail septic system use. Density in developments that utilize septic systems should be limited to 2.5 dwelling units per acre, while urban densities are appropriate for developments connected to sewer service. Uses of land that pose risk of spill of hazardous materials should also be prevented in the Aquifer Resource Protection areas. Water and sewer services have been extended to the area, and the services would be required to be extended through the proposed development. Further, due to the area needed to accommodate septic systems and repair areas, it is not common for lots within the R -10 district to use that form of wastewater disposal. Instead, developments within R -10 districts typically connect to a centralized sewer system in order to achieve the density allowed in the district. Therefore, the goals of the Aquifer Resource Protection area would be achieved with the proposed development. Z -950, (3/16) Board of Commissioners - April 4, 2016 ITEM: 13- 3 - 5 Page 5 of 8 Draft Comprehensive Plan The County is currently going through a process to create a new comprehensive land use plan. The current draft of the new Comprehensive Plan classifies the property as Community Mixed Use on the Future Land Use Map. The Community Mixed Use Place Type focuses on small - scale, compact, mixed use development patterns that promote multimodal travel and act as an attractorfor county residents and visitors. These areas share several qualities with higher- intensity mixed use place types, including a combination of ground floor retail with officespace and housing above, wider sidewalks, and an emphasis on streetscaping. However, these centers are generally small, no more than a few square blocks. Civic uses, particularly recreation and public gathering places, are particularly encouraged here. Ideally, large- scale, lower density commercial and industrial developments are prohibited. In regards to single - family residential development, the ideal density within the Community Mixed Use Place Type is 8± dwelling units per acre. Therefore, the proposed development is consistent with the current draft of the Comprehensive Plan. REVIEW AND ACTION: This request is being facilitated by Section 55.3 — Conditional Zoning District of the County's Zoning Ordinance, and has been processed and reviewed per Section 110 — Amending the Ordinance. A community meeting was held on Wednesday, January 27, 2016 in accordance with the requirements for such an application. The applicant has provided a summary of the meeting which includes the concerns and comments brought up by the attendees. Staff recommends approval of the application with conditions. Staff concludes that the application is consistent with the requirements of the Zoning and Subdivision Ordinances and also the 2006 Wilmington - New Hanover County CAMA Land Use Plan. Consistent with Policy 3.28 of the Land Use Plan, this application should preserve the Castle Hayne and Pee Dee aquifers in their present unpolluted state as the primary groundwater resources for the County because the development of the properties will require the extension of water and sewer to serve the area. Although a traffic impact analysis would not be required for this development, one was completed for an adjacent project. The addititional trip generation expected from this community would have little to no more impact to the traffic service level. The first is a legislative action on the rezoning to the Conditional Use District, and the second is a quasi-judicial action on the companion Special Use Permit for the proposed use. If the rezoning is approved, then the next step is to consider the Special use Permit. If the rezoning is denied, then no action is needed on the Special Use Permit. Also, if the Board wishes to add conditions to the proposed development, then the conditions must be added to the Special Use Permit, and not to the zoning district. The zoning in the vicinity consists mostly of the R -15 district. Commercial zoning runs along N. College Road and is part of a commercial node located at the intersection of N. College Road and Murrayville Road. The Northchase Planned Development is located to the north of the subject property. Land uses in the area consists of a mixture of single - family residential, retail, and institutional uses. Laney High School adjoins the property directly to the north. The site and surrounding area are classified as both Transition and Conservation according to the 2006 CAMA Land Use Plan. The purpose of the Transition classification is to provide for future intensive development on lands that have been or will be provided with necessary urban services. Residential development within the Transition classification can exceed 25 percent impervious coverage and 2.5 units per acre provided the development is compatible with existing and proposed surrounding land uses and it is served by public sewer and water systems and has direct access to a minor arterial or larger access road. The purpose of the Conservation class, on the other hand, is to provide long -term management and protection of significant, limited or irreplaceable natural resources while also protecting the rights of the property owner. Generally, estuarine areas of environmental concern (AEC's) as defined by the State of North Carolina and adjacent lands within the 100 -year (AE) floodplain have been classified as Conservation. Staff has reviewed the preliminary site plan and feels comfortable that it meets the intent of the Conservation classification. The layout of the proposed buildings and impervious areas have been positioned to be mostly located within the Transition classification. Only a small portion of the development's parking and driveway is within the Conservation classification. Specifically, 7,348 square feet of impervious coverage is located within the Conservation classification, which equates to 4.3% of the classification. That proposal included a fast -food restaurant and a mixed -use building consisting of 120 dwelling units and office /retail space. The improvements required as part of that TIA have been installed, including the addition of a center turn lane along N. College Road. The TIA can be found online here. The TIA further stated that with the installation of the required improvements, the proposed site access will operate at a Level of Service (LOS) of E during the AM peak and a LOS of D during the PM peak. This is an improvement from LOS F, which is what the site access was experiencing when the TIA was originally completed. As the current proposal does not exceed 100 peak hour trips, and the fact that the previous required improvements have been installed, a new or updated TIA was determined to be unnecessary by county staff, the WMPO, and NCDOT. Environmental The proposed development is subject to several environmental regulations and permits. Stormwater management will be reviewed by New Hanover County Engineering and by the NC Division of Energy, Mineral and Land Resources. The development must also obtain a soil erosion and sedimentation control permit. The applicant has performed a preliminary wetland assessment of the property. Conducted by Withers & Ravenel, the assessment identifies a small portion of the property where regulated wetlands may exist, and a perennial stream. The potential wetland area must be further delineated by the Army Corps of Engineers prior to building permit issuance, however it is outside of the proposed development area. The stream may be subject to additional buffering standards required by the NC Division of Water Resources. Portions of the property are within an AE Special Flood Hazard Area, which are classified as Conservation in the 2006 CAMA Land Use Plan. New Hanover County is in the process of analyzing new preliminary flood maps provided by the NC Floodplain Mapping Program. Under the preliminary flood maps, the entire property is proposed to be within a Special Flood Hazard Area. Regardless, any development must comply with applicable flood regulations. For septic suitability, the property contains Class II, Class III, and Class IV soils. Class II soils have moderate limitations, which require moderate modification and maintenance, Class III soils have severe limitations, which require extensive modification and intensive maintenance, and Class IV soils are unsuitable for septic systems. That being said, this project will be required to install public water and sewer service in accordance with the standards of the CFPUA and the County's Zoning Ordinance. Land Use Plan Considerations The site and surrounding area are classified as both Transition and Conservation according to the 2006 CAMA Land Use Plan. The purpose of the Transition classification is to provide for future intensive development on lands that have been or will be provided with necessary urban services. Residential development within the Transition classification can exceed 25 percent impervious coverage and 2.5 units per acre provided the development is compatible with existing and proposed surrounding land uses and Z -951, (3/16) Board of Commissioners - April 4, 2016 ITEM: 14- 3 - 5 Page 5 of 13 it is served by public sewer and water systems and has direct access to a minor arterial or larger access road. The purpose of the Conservation class, on the other hand, is to provide long -term management and protection of significant, limited or irreplaceable natural resources while also protecting the rights of the property owner. Generally, estuarine areas of environmental concern (AEC's) as defined by the State of North Carolina and adjacent lands within the 100 -year (AE) floodplain have been classified as Conservation. Conservation areas should be preserved in their natural state, however exceptional developments preserving natural features which are sensitively designed to be in harmony with the site's natural functions, and provide a balance with the highest and best use of the property, may be allowed within the Conservation areas. Such projects minimize erosion, runoff and siltation; minimize impervious surface's impacts and protect estuarine resources; do not interfere with access to or use of navigable waters; do not require extraordinary public expenditures for maintenance; ensure that ground absorption sewage systems, if used, meet applicable standards; and should be aware of and not damage historic, architectural or archeological resources. As stated above, impervious surfaces shall be limited in Conservation areas. In no case shall impervious surface coverage exceed 25 %. In some cases, impervious surface coverage may be required to be as low as 15% or less, depending on the environmental constraint. Staff has reviewed the preliminary site plan and feels comfortable that it meets the intent of the Conservation classification. On the site plan, the proposed buildings and impervious areas have been positioned to be mostly located within the Transition classification. Only a small portion of the development's parking and driveway is within the Conservation classification. Specifically, 7,348 square feet of impervious coverage is located within the Conservation classification, which equates to 4.3% of the classification. In summary, the proposal is consistent with both the Transition and Conservation land use classifications and does not conflict with any goal or policy within the Land Use Plan. Draft Comprehensive Plan The County is currently going through a process to create a new comprehensive land use plan. The current draft of the new Comprehensive Plan classifies the property as Community Mixed Use on the Future Land Use Map. The Community Mixed Use Place Type focuses on small - scale, compact, mixed use development patterns that serve multimodal travel and act as an attractor for county residents and visitors. These areas share several qualities with higher- intensity mixed use place types, including a combination of first floor retail with office and housing above, wider sidewalks, and an emphasis on streetscaping. However, these centers are generally small, no more than a few square blocks. Civic uses, particularly recreation and public gathering places, are particularly encouraged here. Ideally, large- scale, lower density commercial and industrial developments are prohibited. In regards to multi - family residential development, the ideal density within the Community Mixed Use Place Type is 12 -15 dwelling units per acre. Therefore, the proposed development is consistent with the current draft of the Comprehensive Plan. College Road. Shown below is the proposed network for the surrounding area. The plan suggests that a greenway be installed along the west side of N. College Road, and that it continue on the east side of the road, from Northchase Parkway NE to the southern portion of Laney High School, where it would then head east to Olsen Park. The exact location of the proposed greenway does not cross the subject property, however, the TRC has recommended it be extended to do so. Due to Laney High School being located directly north of the subject property, the area is currently subject to pedestrian travel generated by the students attending the school. The extension of the greenway would allow for safe pedestrian travel of those students and for the residents of the proposed high density development. It would also give the residents of the proposed high density development access to the proposed greenway connecting to Olsen Park. Therefore, staff is recommending a condition be added to the Special Use Permit which would require in the installation of a 10' multi -use path in front of the subject property along N. College Road. The multi -use path would be located within the right -of -way and be maintained by the County. The applicant has agreed to this condition and has added the multi -use path to the site plan. College Road This area of the County, along North College Road, has become a major growth corridor. The location of the schools, NorthChase housing, commercial and industrial park development, and Olsen Park recreation facilities are just a few of the various reasons. The primary area of the tract is classified by the County as "transition." The transition classification is to provide for future intensive urban development on lands that have been, or will be provided with necessary urban services. The location of these areas in based upon land use planning policies requiring optimum efficiency in land utilization and public service delivery. Demographic studies are suggesting that aging, empty- nester, and single - person households will dominate America's future housing markets. This all adds up to the potential for important changes in housing demand that planners need to anticipate. Shifting housing preferences and tightening of financial regulations suggest that higher- density housing options appear to be outpacing the demand for detached houses. Having a mixture of uses in the same vicinity provides innovative opportunities for integrating diverse but compatible uses. Providing convenient services in proximity of housing facilities increases pedestrian activity and decreases reliance on individual vehicles. Building up instead of sprawling out with vast land coverage of a site enhances environmental quality. College Apartments The property owner is interested in developing an 88 -unit apartment complex on land within the proximity of your property. This proposal would require Conditional Zoning District and Special Use Permit approvals from New Hanover County. You may recall that a previous plan for 120 units, in a four -story building along with some commercial space, was proposed back in 2012. That project never proceeded. In the meantime, both the Dollar General store and Taco Bell restaurant have been constructed. Road improvements, including a traffic signal at Long Ridge Drive, have also been completed. These approvals allow particular uses to be established only in accordance with specific standards and conditions pertaining to each individual development project. Essentially, this means that only that use, structures and layout of an approved proposal can be developed. This is a much less intensive proposal. A plan of the project is enclosed. The County requires that the developer hold a meeting for all property owners within 500 feet of the tract boundary, and any and all other interested parties. This provides neighbors with an opportunity for explanation of the proposal and for questions to be answered concerning project improvements, benefits and impacts.
