Board of Commissioners - November 14, 2016 ITEM: 2 NEW HANOVER COUNTY BOARD OF COMMISSIONERS REQUEST FOR BOARD ACTION MEETING DATE: November 14, 2016 CONSENT DEPARTMENT: Engineering PRESENTER(S): Layton Bedsole, Shore Protection Coordinator CONTACT(S): Jim Iannucci, County Engineer, and Layton Bedsole SUBJECT: Approval of 2016/2017 Mason Creek/Atlantic Intracoastal Waterway Crossing Maintenance Dredging Event BRIEF SUMMARY: In coordination with the Mason Inlet Preservation Group (MIPG), New Hanover County has managed the Mason Inlet complex inclusive of Mason Creek and the Atlantic Intracoastal Waterway (AIWW) crossing since 2002 (Figure One). The proposed project will remove sand that has shoaled within the Mason Creek and AIWW crossing. The Mason Inlet Relocation Project (MIRP) is authorized under the North Carolina Division of Coastal Management (NCDCM) permit #151 -01 and the US Army Corps of Engineers (USACE) Permit #1999 - 01052. The MIRP has multiple facets which act as trigger points for maintaining inlet system features. The USACE, Wilmington District evoked Federal Permit Condition 17 on 8 July 2016 via the attached letter. USACE Permit Condition 17 states: "If the District Engineer, in his sole discretion, determines that shoaling has occurred within the AIWW on Tangent 12, Section 3 between monuments T12 -8 and T12 -41, at any time during the life of the project and that such section should be dredged in order to maintain safe and efficient navigation on the AIWW, he will so notify the permittee in writing." Gahagan and Bryant, the managing engineering firm of record, opened bids on 9 Nov 2016. The engineer's bid tab is attached and an apparent low and acceptable bidder Marcol Dredging with a total base bid of $523,050.00 has been determined. With your approval, a contract will be negotiated and a notice to proceed will be issued; the project completion date is 31 March 2017. The room occupancy tax will be reimbursed by elements of the MIPG and the NC Shallow Draft Inlet Fund. The purpose of this letter is to make you aware of accumulated sediments within the Federal Channel at the mouth of Masons Inlet where it intersects with the Atlantic Intracoastal Waterway (AIWW). U.S. Army Corps of Engineers Navigation Department's recent hydrographic surveys have revealed increased shoaling in this area (see attached), which may result in a possible hazard to navigation. The Inlet Crossing at Section 3 Tangent 12 is federally authorized to -12 feet with the ability to overdredge by 2 additional feet (to a maximum of -14'). The Corps requests that you complete this requirement within the next November 15 — March 30 work window. Please respond in writing that you acknowledge this requirement and provide a proposed plan of action and project timeline. Local governments can request up to $500,000 and must match at least $1 of local funds for every $4 in grant funds. In 2016, New Hanover County worked closely with Trillium Health Resources to develop an inclusive playground and splashpad in Hugh MacRae Park. This process raised staff's awareness for more facilities like this in our region. NHC is home to a higher than average population of citizens with mobility challenges. Since we are a "beach town" the focus on water access is important. Our beach municipalities work hard to provide adequate access to our community beaches with their beach wheelchair programs but access for many is still difficult. New Hanover County also lacks access to public pool facilities for all residents. There are limited public pool facilities and most of them are aged, with limited access for the physically challenged. Through the development of the Hugh MacRae facilities, we have found that accessible splashpads are an excellent alternative. Splashpads, sometimes referred to as urban beaches, offer accessible surfaces that allow individuals of all abilities to join the fun. NHC Parks & Gardens Department would like to apply for the grant in the amount of $296,029 with a local match of $74,007 to construct an inclusive splashpad at Ogden Park. The local match is to come from existing FYI general fund dollars. Ogden Park is located at 615 Ogden Park Drive in northeastern New Hanover County. Ogden Park consist of 175 acres and offers tennis, baseball /softball, multi- purpose fields, a 1 -mile multi - purpose trail, skatepark, dog park, playground, picnic facilities and restrooms. New Hanover County Parks & Gardens Department is proposing a 3,000 square foot inclusive splashpad be added near the existing playground. In 2016, New Hanover County worked closely with Trillium Health Resources to develop an inclusive playground and splashpad in Hugh MacRae Park. Parks staff worked closely with Trillium staff and representatives with the NHC Schools Adapted Physical Education Program and the disAbility Resource Center in Wilmington to develop facilities that would allow all participants, regardless of their ability level to play together, without the usual barriers those utilizing mobility devises experience. "In North America, Splash pads have been at the top of the list for planned additions at facilities of all kinds for several years running." (Recreation Management 2011). Splash pads, undoubtedly, can be part of the solution since they improve physical, cognitive, and social health. Splash pads are ADA compliant, and a splashpad experience may have additional physical, psychological, social, and cognitive benefits for children with different types of challenges or disabilities. It has been shown that water activities have calming effects on many children with autism who experience sensory difficulties. Project design should minimize adverse impacts on the environmentally sensitive features of the site. Each item must be accurately and adequately addressed to allow the Department of Natural and Cultural Resources to determine if the proposed project will comply with the requirements of the State Environmental Policy Act (SEPA). 1. Site Description: Ogden Park consists of 175 acres and has nine tennis courts, four baseball /softball fields, multi - purpose fields, a 1 -mile multi- purpose trail, skatepark, dog park, playground, picnic facilities, restrooms and a manmade pond. The site is situated at an approximate elevation of 45 feet above sea level and topography slopes to the southeast. 2. PastlCurrent Property Use: New Hanover County developed the park in 1999 and the land was previously undeveloped land. 3. Wetlands: The US Fish and Wildlife Service identifies a wetland area on the park property. This wetland area is defined as a forested palustrine system with needle - leaved evergreen vegetation with surface saturation for an extended period during the growing season and is partially drained /ditched. There will be no disturbance of wetlands needed to develop the proposed project. 4. Floodplains: There are no floodplain areas within or adjacent to the site. 5. Tree and wildlife species: The proposed area is turf. There are several oak, loblolly pine and crape myrtle trees nearby. A ditch and small, man -made pond are close to the area. The predominant trees on the edge and in the pond are bald cypress. Several holly bushes are near the shoreline. The pond contains fish such as Gambusia spp. and members of the Sunfish family (Centrerchidae). Many different species of dragonflies frequent the area. Laughing gulls and Canada geese are often present as well as songbirds such as the Eastern bluebird and the Carolina chickadee. 6. Archaeological or historical sites: There are no known historical sites within the project site or in the vicinity of the site. 7. Existing Structures: Ogden Park consists of 175 acres and offers nine tennis courts, four baseball /softball fields, multi - purpose fields, a 1 -mile multi - purpose trail, skatepark, dog park, playground, picnic facilities and restrooms. Planning New Hanover County recently completed the design and installation of an inclusive playground and splashpad at Hugh MacRae Park in Wilmington, NC with funds from a Play Together Grant from Trillium Health Resources- a local governmental agency that manages mental health, substance abuse and intellectual /developmental disability services in eastern North Carolina. In addition to working with Trillium on the project, Parks staff worked closely with representatives from New Hanover County Schools Adapted Physical Education Program and the disAbility Resource Center in Wilmington to design new facilities that would allow all participants, regardless of their ability level, to play together without the usual barriers those utilizing mobility devices experience. The county also received support for the project from Easter Seals UCP and ACCESS of Wilmington. High utilization of the new facility and feedback from the community has proven the need for additional accessible facilities in the county. NHC Parks & Gardens has also completed some smaller projects to improve park facilities to meet ADA requirements including modernization of bleachers and accessible routes. In 2013, the county partnered with the City of Wilmington to build an accessible playground at Olsen Park. Over the past year, Parks & Gardens has been working with nationally -known parks and recreation management consulting firm Greenplay, LLC on a 10 -Year Master Plan update. During this process, an assessment of all facilities and amenities was completed. The inventory assessment emphasized the need for more accessible features in our county parks and improvements to existing facilities. Accessibility is referenced multiple times throughout the attached plan — pages 5, 57, 63, 64 and 69. Page 63 specifically notes: The county should continue to find opportunities to install splashpads at existing facilities. Through the success of the Trillium grant program, the addition of accessible playgrounds will improve the social and physical accessibility of the overall park system. Additional existing sites should be evaluated for future grant opportunities with a goal of having an accessible playground at each major park within the county corresponding with the overall population distribution. New Hanover County government is also committed to serving community members of all abilities. This is evidenced in "Plan NHC'- the county's first Comprehensive Plan, adopted in July 2016. The result of a three -year planning process involving citizens, elected officials, appointed officials, stakeholder groups and planning staff, the plan will chart the course for the county over the next 25 years. The following reference to serving citizens with disabilities can be found in Chapter 5, page 17 of the attached plan, under the "Strategic Plan Focus Area: Superior Public Health and Public Safety" section: Board of Commissioners - November 14, 2016 ITEM: 4 - 2 - 11 Goal XX: Support health promotion and disease prevention while minimizing debilitating effects of mental and physical disabilities. Additionally, the Town of Wrightsville Beach, located in New Hanover County, recently completed the addition of a new inclusive playground in 2016. B. level of public involvement in developing and supporting the project New Hanover County has employed multiple methods of public involvement in its planning processes. Parks & Gardens specifically sought out the expertise of local organizations that represent children with disabilities such as Trillium Health Resources, New Hanover County Schools Adapted Physical Education Program and the disAbility Resource Center in Wilmington in designing the new accessible playground at Hugh MacRae Park. During the 10 -Year Parks Master Plan process, public input was sought out through nine public meetings, a statistically -valid survey conducted by RRC Associates and an open -link survey available to the general public. In November 2016, there were four public meetings open to the general public, three stakeholder meetings and two Parks & Gardens staff meetings. Stakeholders included representatives from local jurisdictions, UNC Wilmington, teens from Hoggard High School and various business and civic organizations. There was a total of 75 attendees present for the nine meetings. All meetings were advertised on the Parks & Gardens and New Hanover County websites and social media pages. Press release announcements also went out to the local media. A schedule of meetings, as well as, a list of the questions asked during the meetings is attached. In February 2016, RRC Associates conducted a statistically -valid survey with a random sampling of New Hanover County residents. They used a mail -back survey and an online, invitation -only web survey in order to receive a maximum number of responses. Of the 3750 surveys distributed, 511 responses were received, resulting in a relatively high response rate of 13.8 percent and a good representation of the community. Parks & Gardens also posted an open -link survey on their website and social media pages that was open to all members of the community from which there were 1034 completed responses. Copies of the surveys and the response report are attached. Parks & Gardens gained valuable feedback through these surveys. Seven percent of the invitation respondents and four percent of the open -link respondents indicated that their household has the need for ADA accessible facilities. Also, eight percent of survey respondents ranked "Accessibility" as one of the "Top Three Areas Parks & Gardens Should Focus on Improving (page 22)" and 16 percent ranked "Accessibility" in the "Most Important Areas that Would Increase Use of Facilities (page 25)." Public recreational facilities provided by the project One of the main reasons we have chosen to propose a splashpad is not only because it echoes the atmosphere of our community, being a "beach town" but also because we feel that it is a great example of universal design. Constructing a play facility for all helps reduce the stigmas often associated with "special facilities." Our goal is to break the stereotype that those who are physically or mentally other - abled cannot play together with all other participants and create an environment that is welcoming and enjoyable for all. The elements we will incorporate into the design provide easy access by foot or in a wheelchair. There are various levels of water pressure which offer opportunities for a sensory rich experience but still allow for various levels of intensity based on tolerance. The elements do not require a lot of physical activity and are intuitive but still welcome and encourage creative play. We will also incorporate shade to minimize environmental conditions like sun, wind, and heat exposure- allowing users to engage in play for longer periods of time, especially those with sun sensitivities. We also plan to introduce a hydraulophone at the splashpad. This unique musical feature is not available in any of our parks. This water organ, is an interactive water feature that is also a musical instrument. It produces a rich, unique, and soulful sound when a player touches, covers, or blocks its water jets. It is easy to play, and yet capable of a large repertoire of musical pieces. The water jets are laid out in a simple musical scale, like the keys of a piano, making it easy for beginners as well as trained musicians at the same time. The play environment created by this new splashpad will strategically provide endless inclusive, intergenerational, and equitable play experiences that support both the physical and social inclusion of all ages and abilities. The site of the proposed splashpad, Ogden Park, is home to many community gatherings from non - profits to birthday parties and family reunions. In addition to individual use, we expect the splashpad to be a popular field trip destination for school groups, daycare providers and summer camps. D. Accessibility features of the project 1. Completed "Approach and Entrances" checklist attached 2. The design and elements of the proposed splashpad incorporate all seven of the Universal Design Principles: 1. Equitable Use: We believe that the splashpad will be marketable to a variety of people but our focus will be children. Being a coastal community, there is a large focus on water activities. The splashpad will allow all users to easily participate regardless of their age, size or ability. Accessible routes of travel will offer equitable access to all water elements throughout the play area so that individuals will be able to participate together rather than individually by ability. New Hanover County will provide a loaner water wheelchair for those who do not have access to one that can tolerate moisture. Simple and intuitive Use: Some of the elements function differently based on interaction but all help increase understanding of cause and effect, promote learning, and create interaction between users. These features encourage children of all abilities to play side by side. 4. Perceptible Information: The splashpad elements provide compatibility with a variety of techniques or devices used by people with sensory limitations. 5. Tolerance for Error: The flat, solid surfaces of the splashpad and entrances allow participants to walk or roll with ease onto the play area without hazard. 6. Low Physical Effort: The splashpad elements are touch activated so they do not require a lot of physical activity. Also, participants with limited mobility may enjoy the play area with little or no movement. The space allows participants in wheelchairs to remain in their chairs and New Hanover County will provide a loaner wheelchair for those whose wheelchairs cannot tolerate moisture. 7. Size and Space: The proposed splashpad will provide ample space for easy access by those on foot or those utilizing mobility devices, no matter their size. The water features are spaced adequately so that all participants can easily maneuver around them and have easy access to them all. This project will double the amount of evidence storage that is currently in the building and also provide a better way for officers to turn in and process evidence. This project went out for bids with five contractors placing bids. Integrity Builders, LLC was identified as the lowest bidder with a negotiated bid of $526,230 dollars. If awarded substantial completion will be achieved by April 26, 2017. Additional funds were appropriated as part of the Adopted FYI 6-17 Budget Ordinance and Capital Project Ordinance to fully fund this contract. They are children of all races. Many have been neglected, abandoned, abused and /or exposed to drugs and alcohol. Others are brothers and sisters who want to grow up together. They need our care and they need security; and WHEREAS, many children find permanent homes through adoption by their foster families or relatives, thereby creating an ongoing need for new foster and adoptive families; and 45 children in New Hanover County found permanence through adoption this past fiscal year. NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that November 2016 will be recognized as "Adoption Awareness Month" in New Hanover County. Board of Commissioners - November 14, 2016 ITEM: 12 NEW HANOVER COUNTY BOARD OF COMMISSIONERS REQUEST FOR BOARD ACTION MEETING DATE: November 14, 2016 REGULAR DEPARTMENT: Planning PRESENTER(S): Chris O'Keefe, Planning & Land Use Director CONTACT(S): Ken Vafier, Planning Manager; Ben Andrea, Current Planning & Zoning Supervisor SUBJECT: Public Hearing Zoning Ordinance Amendment Request (A- 425, 9/16) — Request by Planning Staff to Amend Zoning Ordinance Section 70, Section 71, Section 23, and Section 50 Regarding Special Use Permit Requirements and the Table of Permitted Uses BRIEF SUMMARY: As part of an ongoing dialogue about the county's special use permit (SUP) regulations, New Hanover County staff facilitated a meeting in early March 2016 with community representatives both in support and opposition to draft ordinance revisions that were created after a series of stakeholder input meetings. After the March 2016 meeting, Planning staff took the lead on developing a new draft that embellished the points of improvement that were largely supported throughout the ongoing dialogue, including describing a clear and predictable process for application, review, and decision making, in addition to revising the table of permitted uses in a manner that provided clarity for discerning how a particular industry is classified and regulated by the county. At the directive of the Board of Commissioners, the new staff - drafted amendment proposal was then provided to LSL Planning, the consultation team contracted to work with both the City and the County for comprehensive land use regulation updates. LSL Planning created reports providing recommendations and feedback on the language proposed by staff for Sections 70 and 71 of the ordinance, in addition to suggesting how the table of permitted uses could be revised to improve organization and provide clarity for industrial use classification utilizing the North American Industrial Classification System (NAICS) coding. After an initial work session on August 30th, the Planning Board tabled this item at their September 8th meeting. The Planning Board held two additional public work sessions on September 22nd and September 29th to further work on the draft amendment. The draft text amendment in this package includes changes recommended by the consultant, much of planning staff's suggested language, and the changes discussed at the August 30, September 22, and September 29 Planning Board work sessions. The Planning Board did not propose changes to the recommended version of the Table of Permitted Uses (TOPU) during the preliminary work sessions. As such, four options were agreed upon for further discussion by the Planning Board: 1) NC Coastal Federation version of the TOPU; 2) Planning Board recommended version of the TOPU from 2014; 3) Wake County TOPU provided at the 9/29/16 work session, for consideration of the format of the document; 4) Receive LSL's Policy Audit and prepare the TOPU based on this analysis. At the October 17th Board of County Commissioners meeting, to allow for consideration of the draft text amendment pending the Planning Board's recommendation, the board directed staff to include consideration of the special use permit language including the Table of Permitted uses in the public hearing announcement for the County Commissioner's November 14th meeting. Board of Commissioners - November 14, 2016 ITEM: 13 The Planning Board considered this text amendment at their November 3rd Planning Board meeting. Eleven people spoke on various elements contained in the amendment and about the time line for the Planning Board's consideration. Much of the deliberation focused on three elements: the inclusion of an extended checklist; a review of external effects; and, the disclosure of what types of permits would be required from federal or state agencies. After these deliberations, the Planning Board voted 5 -0 to continue the item to a future date. This version shows how Article VII of the New Hanover County Zoning Ordinance would appear based on changes made after the 8/30/16, 9/22/16, and 9/29/16 Planning Board work sessions. This draft also includes the staff clarification presented at the November 3rd planning board meeting (line 75 -76). 1 ARTICLE VII: PROVISIONS FOR USES ALLOWED AS SPECIAL USES 2 3 Section 70: General Information, Applications, Process, Public Notice, Public Hearings, Review and 4 Decision, and Conclusions Required for Approval 5 6 70 -1: General 7 Rte. 8 (1) Special Use Permits add flexibility to the Zoning Ordinance. Subject to high 9 standards of planning and design, certain property uses may be allowed in the 10 several districts where these uses would not otherwise be acceptable. By means 11 of controls exercised through the Special Use Permit procedures, property uses 12 which would otherwise be undesirable in certain districts may be developed to 13 minimize any negative external effects they might have on surrounding 14 properties. 15 16 (2) Any use or development designated by applicable zoning district regulations as a 17 special use, or as allowed only pursuant to a special use permit, may be 18 established in that district only after the use or development is authorized by a 19 validly issued special use permit. 20 21 70 -2: Applications 22 23 (1) Applications for a Special Use Permit shall be submitted to the Planning Director 24 or their designee by the owner or owners, or their duly authorized agent, of the 25 property subject to the Special Use Permit petition at least 20 business days prior 26 to an adopted Planning Board meeting date. For Intensive Manufacturing uses, 27 the application must be submitted at least 35 business days prior to the Planning 28 Board meeting date. A schedule of adopted Planning Board meeting dates and 29 the application deadlines shall be available at the Planning Department. Any 30 additional information, documents, etc. submitted after the application deadline 31 must be submitted no later than 10 business days prior to the Planning Board 32 meeting date to be included in the Planning Board agenda package. This review for completeness is to ensure 70 that each of the applicable documents have been submitted as part of the 71 application, and not to verify or substantiate the information provided within the 72 application package. 73 74 (3) Applications with no omissions to the requirements under Section 70 -2(2) shall 75 be deemed complete and be calendared for a public hearing at the next 76 scheduled Planning Board meeting satisfying the application requirements. The 77 Planning Director or their designee shall respond to the petitioner as soon as 78 possible but at most within 5 business days following the application submission 79 in writing including regular mail or e -mail to notify them that the application was 80 deemed complete and confirm the date of the Planning Board meeting at which 81 the public hearing will be held. 82 83 (4) Within 10 business days following an application deadline, complete applications 84 for special use permit petitions shall be posted on the Planning Department web 85 page ( www. planningdevelopment.nhcgov.com) in addition to the date, time, and Page 2 of 6 Board of Commissioners - November 14, 2016 ITEM: 13- 1 - 2 86 location of the Planning Board meeting at which the public hearing will be 87 calendared. Notification of the posting of the special use permit application(s) 88 and meeting information shall also be sent to the Sunshine List. Any additional 89 information received from the petitioner after the application deadline shall also 90 be posted on the web page. 91 92 (5) In preparation for the public hearing at the Planning Board for a petition for a 93 special use permit, the Planning Director or their designee shall analyze the 94 information and materials provided in the application package to provide a 95 summary of the request and preliminary findings of fact in the form of a report 96 to be included in the agenda package for the Planning Board meeting. The intent 97 of the report is to inform the Planning Board of whether the Conclusions Required 98 for Approval in Section 71 -4 have been met or to identify, from staff's 99 perspective, issues or areas that the Planning Board may need more information 100 on in order to provide a recommendation to the Board of County Commissioners 101 whether each of the required conclusions in Section 70 -7 have been met. The 102 staff analysis report shall be published by the Clerk to the Planning Board as part 103 of the agenda package for the Planning Board meeting. 104 105 (6) In preparation for the public hearing at the Board of County Commissioners for a 106 petition for a special use permit, the Planning Director or their designee shall 107 prepare a report summarizing the Special Use Permit request, the information 108 and materials provided in the application package and presented at the Planning 109 Board public hearing(s), the Planning Board's recommendations, and preliminary 110 findings of fact. The intent of the report is to inform the Board of County 111 Commissioners of whether the Conclusions Required for Approval in Section 71- 112 4 have been met or to identify, from staff's perspective, issues or areas that the 113 Board of County Commissioners may need more information on in order to reach 114 a required conclusion. The staff analysis report shall be published by the Clerk to 115 the Board of County Commissioners as part of the agenda package for the County 116 Commissioners meeting. 117 118 70 -4: Public Notice 119 120 (1) Public notice for a petition for a special use permit shall be disseminated per 121 Section 112.1 of the Zoning Ordinance. 122 123 70 -5: Public Hearings 124 125 (1) A public hearing at the Planning Board for the special use permit application shall 126 be calendared per Section 70 -3(3). 127 128 (2) The public hearing for the special use permit application at the Planning Board 129 shall be held in a quasi - judicial format. At the hearing, the Planning Board hears 130 factual evidence presented at an evidentiary hearing, then makes 131 recommendations for findings of fact supported by competent, substantial, and 132 material evidence. Based on those recommended findings, the Planning Board Page 3 of 6 Board of Commissioners - November 14, 2016 ITEM: 13- 1 - 3 133 may render a recommendation to the County Commissioners on whether each of 134 the required conclusions specified in Section 70 -7 can be reached. 135 136 (3) The Planning Board may continue the hearing to a later meeting to accommodate 137 the presentation of additional testimony or evidence. If the time and place of the 138 continued hearing is announced in open session during the hearing, no further 139 notice need be given for the continued hearing. 140 141 (4) A public hearing at the Board of County Commissioners shall be calendared 142 following the public hearing at which the Planning Board makes a 143 recommendation. 144 145 (5) The public hearing for the special use permit application at the Board of County 146 Commissioners shall held in a quasi - judicial format. At the hearing, the Board 147 hears factual evidence presented at an evidentiary hearing, then makes findings 148 of fact supported by competent, substantial, and material evidence. Based on 149 those findings, the Board of County Commissioners decides whether or not it can 150 reach each of the required conclusions specified in Section 70 -7 below. 151 152 (6) The Board of County Commissioners may continue the hearing to a later meeting 153 to accommodate the presentation of additional testimony or evidence. If the time 154 and place of the continued hearing is announced in open session during the 155 hearing, no further notice need be given for the continued hearing. 156 157 70 -6 Review and Decision: 158 159 (1) The applicant bears the burden of presenting sufficient evidence in support of the 160 application to allow the Board of County Commissioners, after weighing such 161 evidence against that presented in opposition to the application, to make findings 162 of fact that reasonably support each of the required conclusions outlined in 163 Section 70 -7 as well as any applicable specific standards for the proposed use as 164 required by Section 72. If that burden is met, the Board of County Commissioners 165 must approve the application. If that burden is not met, the Board of County 166 Commissioners must deny the application, provided that if the Board of County 167 Commissioners determines that specific minor changes or additions to, or 168 restrictions on, the proposed development are necessary and sufficient to 169 overcome impediments to its reaching the required conclusions, it may approve 170 the application subject to reasonable conditions requiring such changes or 171 additions or imposing such restrictions. Such conditions may include time limits 172 for completion of development or for the start or end of certain uses or activities. 173 174 (2) A motion to approve the application must state the required conclusions and 175 include findings of fact on which the conclusions are based, plus any proposed 176 conditions of approval. The favorable vote of a majority of Board of County 177 Commissioners members present is necessary to pass such a motion. A motion to 178 deny the application must state which of the required conclusions cannot be 179 reached and include findings of fact on which the inability to reach the Page 4 of 6 Board of Commissioners - November 14, 2016 ITEM: 13- 1 - 4 180 conclusions is based. The favorable vote of a majority of Board of County 181 Commissioners members present is necessary to pass such a motion. If a motion 182 to approve the application fails, the application is deemed denied, and those 183 members voting against the motion must state which of the required conclusions 184 they could not reach as well as findings of fact on which their inability to reach 185 the conclusions is based. 186 187 (3) Every decision by the Board of Commissioners issuing or denying a special use 188 permit shall be subject to review by the Superior Court by proceedings in the 189 nature of certiorari. Any petition for review by the Superior Court shall be filed 190 with the Clerk of Superior Court within 30 days after the decision of the Board is 191 filed in the Office of the Clerk to the Board, or after a written copy thereof is 192 delivered to every aggrieved party who has filed a written request for such copy 193 with the Clerk or Chairman of the Board at the time of the hearing of the case, 194 whichever is later. 195 196 70 -7: Conclusions Required for Approval —The Board of County Commissioners shall approve 197 an application for a special use permit if it reaches each of the following conclusions based on 198 findings of fact supported by competent, substantial, and material evidence presented at the 199 hearing. 200 201 (1) The use will not materially endanger the public health or safety if located where 202 proposed and approved. 203 (2) The use meets all required conditions and specifications of the Zoning Ordinance; 204 (3) The use will not substantially injure the value of adjoining or abutting property, 205 or that the use is a public necessity. 206 207 (4) The location and character of the use if developed according to the plan as 208 submitted and approved will be in harmony with the area in which it is to be 209 located and in general conformity with the Comprehensive Land Use Plan for New 210 Hanover County. 211 212 Section 71: Validity, Extensions, and Changes for Approved Special Use Permits; Resubmittals of Denied 213 Applications 214 215 71 -1: Validity and Extensions of Approved Special Use Permits: 216 217 (1) A special use permit, issued by the Board of County Commissioners, shall become 218 null and void if construction or occupancy of the proposed use as specified on the 219 special use permit is not commenced within twenty -four (24) months of the date 220 of issuance. This function involves (a) interpreting the meaning of parts of the Ordinance which are unclear, (b) applying the Ordinance to particular fact situations, and, if necessary, (c) correcting any mistakes or abuses of discretion which the zoning official may have made in administering the Ordinance. In exercising this power, the basic principle for the Board to keep in mind is that it must not vary the Ordinance. Its function here is to interpret and apply what the governing body has written, not to vary that legislative pronouncement to fit its own ideas. Its decisions must be in accord with what the Board believes to be the actual meaning and intent of the Ordinance. Granting of Variances: General Statute 153A- 345(d) provides that, "when practical difficulties or unnecessary hardships would result from carrying out the strict letter of a zoning ordinance, the Board of Adjustment may, in passing upon appeals, vary or modify any regulation or provision of the Ordinance relating to the use of land, so that the spirit of the Ordinance is observed, public safety and welfare secured, and substantial justice done." Basically, a variance is a permit, which the Board may grant in certain situations, enabling a property owner to make use of his property in someway which is in conflict with the literal provisions of the Ordinance. Sometimes a lot so small or so peculiarly shaped that the owner would have great difficulty in complying with the yard requirements and yet erecting a suitable building. Sometimes contours of the terrain are such as to create hardships in complying with these requirements. Sometimes the lot is located in a cluster of nonconforming uses which will prevent the owner from securing any reasonable return from his land if he complies with the Ordinance (as where a lot in a residential district is surrounded by nonconforming business structures).
