Subject: The Covenant – TRC Review – High Density Development
The following comments have been received for the December 7, 2016 TRC meeting. Please
resubmit a PDF of the proposed site plan addressing the applicable comments by Monday,
December 5th. An agenda of the TRC meeting will be sent to you once it is completed.

1. Please confirm and illustrate the gross site area (8.57 acres). Does this include the private
drive to Blue Clay Road? Similarly, is the private drive included in the impervious coverage
calculation?
2. Will the 8.57 acres be subdivided from the existing parcel?
3. Rachel’s Place is considered to be an existing development as a preliminary plat (vested
plan) has been approved for the development. Therefore, The Covenant is subject to
increased setbacks, buffering, and density restrictions along the property boundary shared
with Rachel’s Place. Specifically, the setback would be the height of the buildings multiplied
by 3.73, and in no case shall be less than 50 feet. The bufferyard must be half the width
of the setback. Also, please apply the 200’ fringe area to the subject boundary.
4. Curb and gutter is required. Please add a detail for the private drive/road/parking area
or a note stating that the development will be constructed with curb and gutter.
5. Are there any future plans for the remaining portion of the parcel? As proposed, it would
remain (CZD) R-10 and require a rezoning to be developed.
6. Possible Conditions of the SUP:
o A driveway connection must be made to the proposed road stub from Rachel’s Place
and extend north to Galway Road.
o A sidewalk must also extend along the private drive to Blue Clay Road and connect
to the proposed sidewalk system in Rachel’s Place.

o A 20’ access easement must be dedicated to the County along Blue Clay Road for
the purpose of installing a future multi-use path in accordance with the Greenway
Plan.

I have reviewed this project and made a site visit earlier in the week. This project, along with
Rachel’s Place was reviewed and commented on back in early 2016. (Jan/Feb.) I have reviewed
what was intended back then and with the changes that are presented both here and at Rachel’s
Place. They kind of tie together. With this in thought here are my findings on this proposal as
presented.
1. No fire hydrant plan has been submitted, just the water lines are shown.
2. Fire hydrants need to be placed at all entrances to this project as approved previously or
a request needs to be requested through county fire.
3. On a previous plan a fellowship hall was proposed by New Beginnings Church at Blue Clay
Road. Water Lines for Fire Protection will be required. Is the developer / Church in
agreement on this and build into this project if needed future development needs, rather
then upgrade in the future at possibly higher costs.
4. There is only one entrance into this project.
5. The church driveway and parking lot’s are shown.
6. A Private Drive is shown leading out to Blue Clay Road with future Church Development.
7. Galway Drive is suppose to be installed across this property for the Rachel’s Place
subdivision. Is that still occurring?
8. We need to look at both sites to verify all is in compliance and/be updated and agree on
all changes.
9. Based on the single entry way into this project, along with this being Senior / Senior assisted
housing, is the requirement that these units / apartments have installed residential sprinklers

1. The proposed 72 unit project has an Estimated Traffic Impact of less than 100 new trips in
the AM Peak Hour or in the PM Peak Hour. A TIA will not be required for this project.
2. Please contact NCDOT to determine if the project is covered under the driveway permit for
Rachel’s Place project.
3. The proposed street names appear to be missing.
4. The proposed street does not have the sidewalk on one side of R-10 zoned residential
subdivisions required by the NHC Subdivision Ordinance.

6. The proposed street, (24’ private drive), does not meet the minimum 24’ Travelway as
required by the NHC Subdivision Ordinance. The 24’ shown appears to be from B-B of curb
instead of from center of Valley Curb to center of Valley Curb.
7. Provide dimensions for the proposed subdivision streets including minimum horizontal
centerline radius, and street corner radius.
8. Show the street connection to Rachel’s Place Subdivision.
9. Show wheel chair ramps connections for street corners and adjacent sections of sidewalk.
10. Please increase the number of Accessible parking spaces due to the senior housing.
11. Provide a detail for the proposed 24’ private drive and Turn lanes on Blue Clay Rd.
12. Please show whether the proposed recreation areas are active or passive recreation areas.
13. Provide the location of proposed street trees, street lights, and regulatory signs.
14. Provide a detail for proposed 24’ private drive and Blue Clay Rd connection with ingress
& egress lanes.
15. Show standard NCDOT 10’X70’ sight distance triangles at subdivision intersections.

These preliminary comments are based on the plans as submitted for the proposed site and are
subject to further review upon receipt of any additional information. Subsequently, additional
comments and/or requirements may be necessary for this site.
1. A revision to the NCDOT Driveway Permit D-065-13-003, for the parking lot expansion
of the New Beginning Christian Church access on Blue Clay Road (SR 1318), is required.
Submit a plan in accordance with pages 14 and 15 of the Policy on Street and Driveway
Access to North Carolina Highways to include access locations within 500’ of the

proposed access on both sides of the State road. Submit to the local NCDOT District
Engineer’s Office.
2. A NCDOT Encroachment Agreement is required for any utility connections or installation
within NCDOT right-of-way. Exceptions granted for short side taps that will require no
pavement cut or excavation within the 1:1 slope as it relates to existing edge of
pavement.
