New Hanover County’s Technical Review Committee (TRC) will meet Wednesday, February 8, 2017
at 2:00 p.m. in the Lucie Harrell Conference Room (601) of the New Hanover County Government
Center located at 230 Government Center Drive to review the following:
2:00 p.m. Item 1: Clay Crossing (aka Middle Grove) – Request by Dan Hilla for TRC to
consider a one (1) year performance extension for a 21 lot residential division
located near the 7300 block of Darden Road, east side (Middle Sound Community).
Middle Grove History
Performance site plan was preliminarily approved by TRC April 22, 2015 with four
(4) conditions). Preliminary site plans are valid for a period of two years unless a
final plat is submitted for all or a portion of the project. One (1) year preliminary
site plan extensions may be granted by TRC. To date, no construction plans or final
plat(s) have been submitted to the County for review.

approval.
2) A NCDOT Driveway Permit and encroachment agreements will be required.
3) All local, State, and Federal regulations may be applicable to the project.
A waiver was granted by TRC on the length of the cul-de-sac due to
topographical conditions.

at 4713 Carolina Beach Road (Conditional Use District Application).

The development, previously entitled Aaronfield Cove, was submitted as Conditional
Use Zoning District application last year, and was approved by the Board of
Commissioners on May 2, 2016. This application is proposing to modify this
approval to allow for 16 additional units. This modification requires approval from
the Board of Commissioners.

The following comments have been received for the February 8, 2017 TRC meeting. Please resubmit
a PDF of the proposed site plan addressing the applicable comments by Monday, February 6th.
An agenda of the TRC meeting will be sent to you once it is completed.

1. Please add all setback lines and the density fringe area. The property line along Belle
Meade Village is subject to increased setbacks and density limitations in accordance with
Section 72-43 (5)(B).
2. Bufferyards must be installed in accordance with Section 62. The bufferyards are required
along any property line that adjoin a residential use or zoning district. No buildings are
permitted within the bufferyards (garages).
3. A text amendment application must be submitted in order to allow for the buildings to be
40’ in height.
4. Please label the use of the structure within the recreation area.
5. Please provide the status of Sikes Drive in regards to acceptance into Wilmington’s
maintenance system. The current SUP for the property restricts the access to Sikes Drive until
the construction of the project has been completed.
6. Please extend the interior sidewalks to connect to the sidewalks along Sikes Drive and to
the potential sidewalk/multi-use along Carolina Beach Road.
7. Possible conditions of the SUP:
o Prior to issuance of a Certificate of Occupancy, Sikes Drive shall be dedicated as a
public right-of-way.
o A 10’ multi-use path shall be installed along Carolina Beach Road in accordance
with the Wilmington/New Hanover County Comprehensive Greenway Plan. The
multi-use path shall be constructed to the adjoining property lines and shall include
any necessary crosswalks, boardwalks, or bridges.

1. Land disturbing and stormwater permits required.
2. LD fees to be paid prior to C/O.
3. Pond needs to be in a drainage easement/common area.
4. 10’ access berm required around pond. Needs to remain free of obstructions, including
landscaping.
5. Additional topo information is required to confirm pond has a viable outlet to carry water
offsite.
6. If existing topography of the lot lends to the site draining at multiple points (basins), the
stormwater design needs to make sure that the concentrated outlet at the pond does not
exceed what the site’s original runoff was for that one basin. Each basin needs to meet
pre/post requirements to satisfy the stormwater ordinance.
7. Roadway typical and public/private designation not provided.
8. City limits adjacent to project should be labeled.

1. Provide additional plan sheets that contain information for existing conditions, tree
inventory/survey, grading and drainage, demolition, landscaping and site details sheets.
2. The proposed Garages appear to be backing out into the stem area of the parking lot.
Please consider shifting the garage parking further into the site, to allow vehicles to enter
and exit the site safely.
3. Provide dimensions for the site plan, such as cross section dimensions, for the driveway/
parking area, parking dimensions, street corner radius, sidewalk width, etc.
4. A minimum R25 for street corner radius and radius on landscape islands must be maintained
to provide adequate access for Fire, Emergency vehicles and Trash Trucks.
5. Show details for the proposed curb and gutter, pavement cross section, and sidewalk.
6. Show fire hydrants and street lights on the site, landscaping and utility sheets.
7. Provide a pedestrian access easement along Carolina Beach Rd for the 10’ multi-use trail
shown within the NHC Greenway Plan. Connect the Greenway to the proposed 10’ Multi-
use path for the existing Belle Meade Apartments.
8. Provide sidewalk along the Sikes Lane frontage.
9. Connect the existing sidewalk/ proposed sidewalk from each frontage, (Carolina Beach
Road, Sikes Lane, and the adjacent parking area.
10. The site does not have sidewalk access to the Garage area. Ensure the sidewalk reaches
this area, along with the dumpster, and recreation areas.
11. The proposed Handicap Accessible parking spaces do not appear to be located close to
the primary entrances for these apartments. The parking spaces appear to be over 100’
from the apartment entrances. Please relocated these spaces closer.
12. Provide Handicap Accessible parking in the Garages.

I HAVE REVIEWED THIS PLAN AS REQUESTED AND HAVE THESE COMMENTS: The soils are), Kureb
sand (Kr), Leon sand (Le), Lynn Haven fine sand (Ly), and Seagate fine sand (Se).
According to the booklet, , “Wilmington/New Hanover Classification of soils for Septic Tank
Suitability, Kureb, is Class I soil, Seagate is a Class II soil, Leon, and Lynn Haven is Class III soil.
The Soil Survey of New Hanover County lists Kureb and Rimini as excessively well drained Leon
and Lynn Haven as poorly drained, and Seagate as somewhat poorly drained.
Leon and Lynn Haven, are on the New Hanover County Hydric Soils “A” list which means they are
possibly wetland areas and subject to regulation under the Clean Water Act. Kureb Sand Seagate
are on the Hydric Soils “B” list, which means it may contain areas of wetland. It should be noted,
according to the Soil Survey of New Hanover County, the limitation for dwellings with or without
basements and for small commercial buildings is severe for all of the soils on this site. The limitations
are due to flooding and/or wetness. An adequate drainage and maintenance plan is needed for
suitable housing.
The U.S. Army Corps of Engineers has federal jurisdiction over 404 Permits and the NCDEHNR,
Dept. of Water Quality, has state jurisdiction over 401 Permits under the Clean Water Act. Before
disturbing possible wetland areas, developers should contact these agencies to stay in compliance
with State and Federal regulations.
We encourage you to incorporate Low Impact Development Strategies, such as stormwater
wetlands, as outlined in the New Hanover County/City of Wilmington LID manual. You can access
the manual online by visiting the NHC Planning Department’s website and clicking on the Low Impact
Development tab.

These preliminary comments are based on the plans as submitted for the proposed site and are
subject to further review upon receipt of any additional information. Subsequently, additional
comments and/or requirements may be necessary for this site.
1. The requirements of the Belle Meade Traffic Impact Analysis (TIA) have been fulfilled. A
NCDOT Driveway Permit is not required. The proposed driveways are served internally.
2. A NCDOT Encroachment Agreement is required for any utility connections or installation
within NCDOT right-of-way. Exceptions granted for short side taps that will require no
pavement cut or excavation within the 1:1 slope as it relates to existing edge of pavement.
