TECHNICAL REVIEW COMMITTEE MEETING
MARCH 8, 2017
New Hanover County’s Technical Review Committee (TRC) will meet on Wednesday, March 8, 2017
at 2:00 p.m. in the Lucie Harrell Conference Room (601), New Hanover County Government
Center, 230 Government Center Drive, to review the following:
2:00 p.m. Item 1: Westview @ River Oaks (Performance Re-Approval) – Request by
Signature River Oaks NC, Ltd for TRC to consider preliminary site plan re-approval
of a 22 lot single family enclave located near the 8000 block of River Road, east
side.
Westview History
TRC preliminarily approved the site plan in April, 2014.
Preliminary site plans are valid for a period of two (2) years unless a final plat
for all or a portion of the project has been submitted, reviewed, and approved
by the County.
A final plat for phase 1 of the project was submitted for review in February,
2017.

Required Conditions of April, ’14 Plan Approval
No gates, traffic calming devices or on-street parking permitted unless reviewed
by TRC.
Active recreation space will require a fee in lieu.
An approved water and sewer capacity letter is needed from Aqua of North
Carolina.
2:20 p.m. Item 2: The Oaks at Anchors Bend (Performance) – Request by Raleigh-
Wilmington Investors, LLC for TRC to consider preliminary plat for a 39 lot single
family subdivision located near the 2400 block of Middle Sound Loop Road.
The Oaks at Anchors Bend History
The property was rezoned to (CZD) R-20 in January in order to develop the
proposed performance residential subdivision.
The Board of Commissioners placed the following conditions on the approval:
1. Duplex, multi-family, and mobile home housing shall be prohibited.
2. Impervious coverage shall not exceed 30% of the site.
3. In addition to meeting the county and state stormwater requirements, the
development shall incorporate Low Impact Development (LID) techniques
as described in the City of Wilmington/New Hanover County LID
Guidance Manual, and qualify as a LID project as determined by the
County’s Technical Review Committee (TRC).
4. Existing vegetation located within the proposed open space areas shall
be preserved to the maximum extent practicable, and only be removed
in order to install necessary infrastructure needed to comply with
applicable county and state regulations.
5. A 20 foot access easement shall be dedicated to the County along
Middle Sound Loop Road for the purpose of installing a future
pedestrian facility.

The following comments have been received for the March 8, 2017 TRC meeting. Please resubmit
a PDF of the proposed site plan addressing the applicable comments by Tuesday, March 7th. An
agenda of the TRC meeting will be sent to you once it is completed.

1. As conditioned by the Board of Commissioners, the development must qualify as a Low
Impact Development (LID) as determined by the TRC. Please submit the LID application and
supporting documentation. The TRC must approve the LID design prior to approving the
preliminary plat.
2. Please provide a tree mitigation plan for the significant trees that will be removed.
Mitigation may be provided by either planting additional trees or by paying a fee into the
County’s tree bank.
3. Please provide the Jurisdictional Determination from the US Army Corps of Engineers.
4. Please add the development type “Performance Residential” into the title block.
5. What is the status of Loftin Drive? Will it be abandoned, and will access improvements be
made to the lots currently using the road? NCDOT previously stated “Road A” may not be
meeting the driveway separation requirements in regards to its location to Loftin Drive.
6. Please clarify the property lines of lot 1. Does it include the 20’ pedestrian access
easement?

1. Low Impact Development (LID) application and plan need to be provided. At a minimum, a
narrative describing what LID techniques will be used. Subdivision must be approved for
LID by TRC before it can be approved as a preliminary plan. All stormwater controls shown
do not appear to incorporate LID techniques.
2. LID techniques must be written into the covenants with a maintenance plan for upkeep.

3. 10 foot utility easement must be included along all lots.

1. Remove Hydrant at lot 19/20. (A hydrant this far into a Cul-de-sac is not practical for fire
suppression operations)
2. Relocate Hydrant at lot 10/11 lot 11/12. (Shifting this hydrant will ensure lots in the Cul-

3. Place a hydrant at the intersection of Road A and Middle Sound Loop. (This will provide for
a hydrant to serve the homes at the beginning of the development)

2. CFPUA water and sewer available (existing waterline location will need to be verified to
determine if main line extension will be required).
3. Capacity is available at PS-146 (Falcon Pointe) and PS-141 (Buckeye).
4. DWQ permit application will require a Planning FTSE; as we are working towards
incremental capacity upgrades in Pump Station 89 (Smith Creek).
5. Capacity is also dependent on the analysis of the pipe collection system (gravity and force
mains).
6. A capacity determination can be provided upon submittal of the NC DWQ FTA/FTSE
Application Form and a Preliminary Plan, this determination does not guarantee capacity.
7. Capacity is issued to projects on a first come, first serve basis, when capacity is available,
the plans meet Authority requirements, and the NC DWQ FTA/FTSE forms are signed by
the Authority.

The soils are predominantly Lakeland sand (La), Leon sand (Le), Murville fine sand (Mu), and
Seagate fine sand (Se).
According to the booklet, , “Wilmington/New Hanover Classification of soils for Septic Tank
Suitability, Lakeland is Class I soils, Seagate is Class II soils, and Leon and Murville are Class III
soils.
The Soil Survey of New Hanover County lists Lakeland as excessively drained, as well drained,
Seagate as somewhat poorly drained, Leon as poorly drained, and Murville as very poorly
drained.
Leon and Murville are on the New Hanover County Hydric Soils A list which means they are possibly
wetland areas and subject to regulation under the Clean Water Act. Seagate is on the Hydric Soils
B list, which means it may contain areas of wetland. It should be noted, according to the Soil Survey
of New Hanover County, the limitation for dwellings with or without basements and for small
commercial buildings is severe for all of the soils on this site. The limitations are due to flooding
and/or wetness. An adequate drainage and maintenance plan is needed for suitable housing.
The U.S. Army Corps of Engineers has federal jurisdiction over 404 Permits and the NCDEHNR,
Dept. of Water Quality, has state jurisdiction over 401 Permits under the Clean Water Act. Before
disturbing possible wetland areas, developers should contact these agencies to stay in compliance
with State and Federal regulations.
We encourage you to incorporate Low Impact Development Strategies, such as stormwater
wetlands, as outlined in the New Hanover County/City of Wilmington LID manual. You can access
the manual online by visiting the NHC Planning Department’s website and clicking on the Low Impact
Development tab.

It is difficult to offer any comments with the onset of the 2017 coastal rules. I don’t know how
Paramounte plans to get the site permitted. If it’s via the new Fast Track process, they will only
submit minimal information up front to get the “Authorization to Construct” and we’ll issue the final
permit on the back end after we receive all the as-built information and conduct a compliance
inspection. The fast track process requires compliance with the 2017 Minimum Design Criteria
(MDC).
The disturbed area listed on the plans is almost 17 acres, so a stormwater permit will be needed.
And it appears to be high density due to the extent of piping. They are showing wet ponds and
infiltration basins on the site, so the intent appears to be to treat that runoff.

These preliminary comments are based on the plans as submitted for the proposed site and are
subject to further review upon receipt of any additional information. Subsequently, additional
comments and/or requirements may be necessary for this site.
1. A NCDOT Driveway Permit is required. Submit a plan in accordance with pages 14 and 15
of the Policy on Street and Driveway Access to North Carolina Highways to include access
locations within 500’ of the proposed access on both sides of the State road. Submit to the
local NCDOT District Engineer’s Office.
2. A NCDOT Encroachment Agreement is required for any utility connections or installation
within NCDOT right-of-way. Exceptions granted for short side taps that will require no
pavement cut or excavation within the 1:1 slope as it relates to existing edge of pavement.
3. If the developer anticipates adding or petitioning for addition of this subdivision to the state
system, all roads/streets shall be designed and constructed in conformance with the current
North Carolina Department of Transportation Subdivision Roads Minimum Construction
Standards. Contact the District Engineers office with regards to submittals, telephone
910.251.2655.
4. It is necessary to provide 425 feet of sight distance on the southwest approach of Middle
Sound Loop Road. Provide this information on the plan sheet.
