Subdivision-AppealPage 1 of 1 SA-05/10 Name of Appellant Date Staff Use Only Application Number Address City, State, Zip Email Address Telephone Number Reason for Appeal Section of Ordinance Violated FILING A NOTICE OF APPEAL Appeals must be reviewed by Planning & Zoning and County Attorney for completeness and “eligibility to appeal” prior to being heard. Appeals will be limited to individuals with a significant interest in the plan (legal standing). A $150.00 fee payable to New Hanover County must accompany the appeal from the TRC. An additional $150.00 is required for any appeal from the TRC to the Board of Commissioners. The appeal must state the alleged error(s) the Technical Review Committee or the Planning Board made in rendering the decision being appealed and specify why the decision was in error. The scope of the appeal shall be limited to those errors identified on this form. Subdivision appeals are first acted upon by the New Hanover County Planning Board. Appeals from the Planning Board may be made to the County Commissioners. Appeals must be submitted to Planning & Zoning within ten (10) working days after the decision being appealed. Upon receipt of a complete and eligible appeal, Planning & Zoning will prepare a staff report summarizing the case. No later than five (5) business days prior to the appeals hearing, responding parties with standing may present written submittals to Planning & Zoning staff for inclusion in the appeal. Planning & Zoning staff will prepare a notice of the appeal hearing to be published in a local newspaper as part of the scheduled agenda. The Appellant Board may affirm, modify or supplement the decision of the Technical Review Committee or Planning Board. Planning & Zoning can advise you regarding these appeal procedures.
