TECHNICAL REVIEW COMMITTEE AGENDA
JUNE 7, 2017
New Hanover County’s Technical Review Committee (TRC) will meet next Wednesday, June 7, 2017 at
2:00 p.m. in the Lucie Harrell Conference Room (601), New Hanover County Government Center, 230
Government Center Drive to review the following:

2:30 p.m. Item 2: Myrtle Landing Entrance Gate – Request by Jeff Malpass for Tribute Properties to
discuss the feasibility of providing a gate near the entrance to Myrtle Landing subdivision
and a maintenance building/car wash inside the residential project. The existing project
is located near the 7200 block of Myrtle Grove Road.
2:45 p.m. Item 3: Landing at Lewis Plantation – Request by McAdams Homes, LLC to discuss
proposed site plan consisting of 236 single family lots, 192 apartment units (428 total
units) near the 4600 block of Gordon Road.

RE: Myrtle Oaks – Updated TRC Submittal
Dear Mr. Burgess:
Please see attached revised preliminary plat for the Myrtle Oaks project for your review and approval. We
have revised the plans per comments emailed to us on March 23, 2017. For clarity, we have broken down all
the comments by stating the staff comment first in italics and are then followed by our responses in bold.
PLANNING STAFF OBSERVATIONS:
1. Label “Performance Residential” in title block of site plan.
• “Performance Residential” has been added in the title block of the preliminary plat.
2. Label the “passive” and “active” rec space with acreage on site plan.
• The passive and active rec space, with respective acreage, has been added to preliminary
plat.
3. Land Classification in notes is “General Residential.”
• The land classification in the site development data table has been updated to read
“General Residential”.
4. Label area between property owners Meredith & Henry (access or drainage/utility easement?)
• The 30’ drainage easement in between the aforementioned properties has been labeled on
the preliminary plat.
5. A multi-use path may be considered at TRC along project road frontage in conjunction with adopted
Greenway Plan.
• Noted. This option has been looked at, and we feel that this multi-use path is not necessary
because it would not provide any meaningful connectivity to surrounding areas as there
are no existing paths or roads to connect to.
6. Links vs Nodes is .67 (1.4 required). May request a waiver front inter-connectivity requirements in writing
prior to TRC meeting.
• Noted. We are submitting a waiver request with this submittal.
7. Note on plan the approximate number of bedroom per lot.
• The approximate number of bedrooms per lot has been added in the site development data
table and in the general notes on the preliminary plat.

9. Add a note concerning street lights to site plan.
• Note 16 has been added under general notes to address this comment.
10. Add Private Road cert (unsigned) to plat.
• The private road certification (unsigned) has been added to the plat.
Please find attached with the letter, the Street Connectivity Waiver Request, an updated Preliminary Plat and
the Tree Removal Plan. With this submittal, we feel we have addressed all the concerns and comments from
the County Staff. Please let us know if you have any further comments or concerns and thank you for your
work on this project thus far.

RE: Myrtle Oaks Subdivision
NHC Subdivision Ordinance - Section 41-1-7-f – Street Connectivity
Waiver Request
Dear Mr. Weaver:
On behalf of the applicant, we would like to formally request a waiver from the Street Connectivity
requirements in the New Hanover County Subdivision Ordinance for the above referenced project. From our
interpretation of the ordinance, this project has a link to node ratio of 1.0 (3 links and 3 nodes), which is below
the requirement of a ratio of 1.4, stated in the ordinance.
Due to the location and site restraints for the project, we are not able to meet the link to node requirements
for New Hanover County. Reasons for not being able to meet the requirement include:
1. Access off of Grissom Road is limited to only one entrance. NCDOT will not allow multiple accesses
to Grissom Road for the project.
2. The project is boxed in by existing development with no access to stub a connection road to.
3. Limited amount of space for the project to successfully develop the land in a means that is beneficial
for the developer and can meet all other local, state and federal regulations.
It would be greatly appreciated if the board would consider this waiver request for the Myrtle Oaks
Subdivision, so that the development can be constructed to not only the high standards of New Hanover
County, but those of the applicant/developer. It is ours and the applicant’s intention to design and construct
a community that is of the highest quality that is both aesthetically pleasing and will last far into the future.

7.ALL MATERIAL CLEARED OR DEMOLISHED BY THE CONTRACTOR IN ORDER TO CONSTRUCT THE WORK SHALL BECOME THE PROPERTY OF THE CONTRACTOR AND
SHALL BE PROPERLY DISPOSED OF OFF-SITE.
8.ALL WORK BY THE CONTRACTOR SHALL BE WARRANTED BY THE CONTRACTOR FOR A PERIOD OF ONE YEAR AFTER THE OWNER ACCEPTS THE WORK.
9.CONTRACTOR SHALL CALL THE NORTH CAROLINA ONE-CALL CENTER AT 811 AND ALLOW THE CENTER TO LOCATE EXISTING UTILITIES BEFORE DIGGING.

9.THE CONTRACTOR IS RESPONSIBLE FOR THE LOCATION AND PROTECTION OR EXISTING UTILITIES DURING CONSTRUCTION. DAMAGED ITEMS SHALL BE REPAIRED TO AT
LEAST THE QUALITY OR WORKMANSHIP FOUND IN THE ORIGINAL ITEM.
10.THE BELLSOUTH CONTACT IS STEVE DAYVAULT, BUILDING INDUSTRY CONSULTANT, AT 910-392-8712. CONTACT HIM PRIOR TO STARTING THE PROJECT IN ORDER TO
FACILITATE GOOD COMMUNICATION AND MAXIMUM FLEXIBILITY.
11.THE PROCESS FOR TELEPHONE CABLE PLACEMENT:

11.2.POWER WILL PLACE THEIR CABLE FIRST - APPROXIMATELY 3' DEEP.

2.SIGNIFICANT TREES: HARDWOOD AND CONIFER TREES AT LEAST 24" DBH, AND DOGWOODS,
AMERICAN HOLLIES AND FLOWERING TREES AT LEAST 8" DBH ANYWHERE ON THE SITE SHALL BE
CONSIDERED PROTECTED, AND MUST BE PRESERVED OR THEIR REMOVAL MITIGATED AS
HEREINAFTER PROVIDED, REGARDLESS OF LOCATION ON THE SITE, UNLESS THE TREES ARE
SHOWN TO BE DEAD DYING OR SEVERELY DAMAGED OR DISEASED AS A RESULT OF NATURAL
FACTORS.
2.1.29 SIGNIFICANT TREES SHALL BE REMOVED
3.REASONS FOR CLEARING THE NOTED TREES INCLUDE THE FOLLOWING:
3.1.TREES COVER MORE OF THE SITE AREA THAN IS REQUIRED TO BE LANDSCAPED AND THE
PARCEL WILL BE FULLY USED.
3.2.IT IS IMPOSSIBLE TO POSITION BUILDINGS ON THE PARCEL AND MEET SETBACK
REQUIREMENTS WITHOUT TREE REMOVAL.
4.A MINIMUM OF 15 TREES AT LEAST 2" IN DIAMETER (MEASURED 6: ABOVE THE GROUND) SHALL BE
RETAINED OR PLANTED ON THE PARCEL FOR EACH ACRE OR PROPORTIONATE AREA DISTURBED BY
DEVELOPMENT.
