TECHNICAL REVIEW COMMITTEE AGENDA
JULY 26, 2017
New Hanover County’s Technical Review Committee (TRC) will meet on Wednesday, July 26, 2017 at 2:00
p.m. in the Lucie Harrell Conference Room (601), New Hanover County Government Center, 230
Government Center Drive to review the following:
2:00 p.m. Item 1: Deer Crossing: Phase 3 (Performance Plan Re-Approval) – Request by Tripp
Engineering for Lumina Reality of NC, LLC for TRC to consider preliminary site plan re -
approval of a 39 lot phase of the project located near the 6500 block of Myrtle Grove
Road, west side.

July, 2013 - Phase 3 preliminary site plan approved by TRC for 39 lots
June, 2015 – Phase 3 preliminary site plan extended one year by TRC for 39 lots
due slow economic growth in area
July, 2016 – Second one -year preliminary site plan extension approved by TRC for
39 lots based on lot line and storm water calculation adjustments
In accordance with Section 33 of the County’s Subdivision Ordinance, a petitioner
shall submit a final plat for all or a part of the approved preliminary plan within 24
months of the approval date. If a final plat is not submitted within the twenty-four
(24) month time frame, the plan must be re-submitted as a preliminary site plan,
otherwise the plan is void. Two separate one- year extension may be granted. Both
extension requests have been exhausted with preliminary site plan re-approval
required.
On behalf of his client, Tripp Engineering is requesting preliminary site plan re-
approval for two years based on economic conditions. All necessary permits have
been obtained and the developer is ready to begin construction. (See letter)

Planning Staff Recommendations (from July, 2013 & July 2016)
1) No gates, traffic calming devices or on-street parking unless reviewed by TRC
2) The pedestrian cross-walk beginning at the entrance to Oak Canopy Drive and
extending to the sidewalk at Deer Hill Drive be coordinated with NCDOT and
display on the site plan.
3) The road connection between phases 2 & 3 be constructed prior to final plat
approval.

4) Several significant and flowering trees are scheduled for removal. A written tree
mitigation plan will need to be submitted to Planning staff prior to the issuance of
a Sedimentation/Erosion Control permit thru County Engineering.
5) Other local, State, and Federal mandates may be applicable to the project.
2:20 p.m. Item 2: Whiskey-Navajo Development (Gate Reconsideration) - Request by County
Planning staff for TRC to reconsider the denial of a gate proposal by Whiskey-Navajo
Partners anchored between South College Road and Navaho Trail.
Whiskey-Navajo Project History
October, 2016 – Preliminary site plan approved by TRC for 170 residential units.
Project included public streets with good inter-connectivity to Mohican and
Navaho Trails.
March, 2017- Project was downsized to 156 units. Plan included public streets and
road inter-connectivity.
June 2017 – Petitioner requested TRC to re-designate road network from public to
private due to technical NCDOT issues along with installation of three (3) gates.
TRC approved the re-designation of the road network to private and denied the
installation of gates based on not meeting the road inter-connectivity index of 1.4
as prescribed in the County’s Subdivision Ordinance (Section 41-1(7)(f).
July, 2017 – County Planning receives a completed appeal application to Planning
Board asking for a reversal of TRC’s decision denying the installation of gates in
accordance with the County’s Subdivision Ordinance.

County Legal Staff Interpretation
On June 21, 2017, Whiskey-Navajo Development Partners, LLC for the Whiskey Creek subdivision was
denied approval by the TRC on the issue of connectivity and privacy gates. Upon further review of the
County’s Subdivision Ordinance, it has been determined that the road inter-connectivity section [ (41-
1(7)(f)] was applied incorrectly. Since the basis for denial was the incorrect application of the ordinance,
this issue should return to the TRC for reconsideration. (See inter-connectivity map).
