Exhibit Book L_Page 3 NEW HANOVER COUNTY BOARD OF COMMISSIONERS FIRE PREVENTION WEEK PROCLAMATION WHEREAS, New Hanover County is committed to ensuring the safety and security of all those living in and visiting our county; and WHEREAS, fire is a serious public safety concern both locally and nationally, and homes are the locations where people are at greatest risk from fire; and WHEREAS, if a fire breaks out in the home, you may only have a few minutes to get out safely once the smoke alarm sounds; and WHEREAS, according to an NFPA survey, only one of every three American households have actually developed and practiced a home fire escape plan; and WHEREAS, New Hanover County residents should discuss, make, and practice a home escape plan; and WHEREAS, the 2017 Fire Prevention theme, "Every Second Counts: Plan 2 Ways Out!" effectively serves to remind us that all residents should draw a map of their household marking two exits from each room and a path to the outside from each exit, practice a home fire drill at least twice a year, and teach children how to escape on their own. NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that October 8 -14, 2017 be recognized as "Fire Prevention Week" in New Hanover County. All the people of New Hanover County are urged to create an exit plan for their household and to support the many public safety activities and efforts of New Hanover County Fire Rescue during Fire Prevention Week 2017. (a) Use of Remedies Barred. — No county or municipality may maintain an action or procedure to enforce any remedy provided by law for the collection of taxes or the enforcement of any tax liens (whether the taxes or tax liens are evidenced by the original tax receipts, tax sales certificates, or otherwise) unless the action or procedure is instituted within 10 years from the date the taxes became due. Therefore, on this the 2nd day of October, 2017, Collector of Revenue, Allison Snell, asks the New Hanover County Board of Commissioners to release the levy for tax year 2007 from the charge as the 10 -year statute of limitations prohibits the Collector from using forced collection measures to collect these taxes. and WHEREAS, the effects of domestic violence are far - reaching and may have lifetime implications for families, the criminal justice system, and our community; and WHEREAS, Domestic Violence Shelter and Services, Inc. provides emergency crisis intervention and ongoing support and services in New Hanover County for victims and survivors of domestic abuse; and WHEREAS, 1,132 adults and 223 children received direct services such as court accompaniment, advocacy, empowerment groups, and counseling; including 127 adults and 118 children who received emergency shelter through Domestic Violence Shelter and Services, Inc. in the year 2016; and WHEREAS, on September 4, 2002, Gladys Bryant, an employee of New Hanover County for more than two decades, and on August 6, 2008, Tarica Pulliam, an employee of New Hanover County for two years, lost their lives in acts of domestic violence exhibiting to all their coworkers and friends, the prevalence of domestic violence and its consequences; and WHEREAS, many other persons throughout New Hanover County and the United States find themselves in abusive relationships and need to find a safe and empowering environment; and WHEREAS, this year's theme Do Small Things With Great Love serves as a call to action to citizens of New Hanover County to encourage, support and empower one another to live lives free from violence. NOW, THEREFORE, BE IT PROCLAIMED that the New Hanover County Board of Commissioners refuses to tolerate domestic violence in any form and wishes to create a society that promotes strong values, fosters a safe and loving home environment for every family, and encourages our citizens to enhance their efforts to work together to address the problem of domestic violence. BE IT FURTHER PROCLAIMED by the New Hanover County Board of Commissioners that October 2017 be recognized as "Domestic Violence Awareness Month" in New Hanover County. FOR THE CONSTRUCTION OF THE MIDDLE SOUND GREENWAY TRAIL WHEREAS, after due advertisement, two bids were received and recorded by the Finance Department at 10:00 a.m. on July 28, 2017, at the New Hanover County Government Center, 230 Government Center Drive, Wilmington, North Carolina; and WHEREAS, the bid tabulation included two bidders, Lanier Construction Company, Inc. in the amount of $530,978.50 and Barnhill Contracting in the amount of $1,042,627.32; and WHEREAS, funds for this project are available in the Capital Improvements Budget in fiscal year 2017 from funding through Safe Routes to School Grant G0358 and Transportation Alternatives Program Grant G0397. NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby authorizes the award of construction services to Lanier Construction Corporation, Inc. in the amount of $530,978.50 and any change orders within the budgeted amount for the Middle Sound Loop Greenway Trail, pending concurrence with award by the North Carolina Department of Transportation and the New Hanover County Board of Commissioners Chairman is authorized to execute the contract on behalf New Hanover County. The additional funds consist of a Federal Safe Routes to School grant increase in the amount of $110,000, with no match requirement, and a Federal TAP (Transportation Alternatives Program) grant in the amount of $136,372 that requires a County match of $34,093. The match is available in the Bike and Pedestrian Path Capital Project Fund. Section 3: Documentation of Adoption This ordinance shall be effective upon its adoption. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County, North Carolina, that the Ordinance for Budget Amendment 18 -016 amending the annual budget ordinance for the fiscal year ending June 30, 2018, is adopted.
