THIS AGREEMENT is made and entered into on the last date executed below, by and between the
North Carolina Department of Transportation, an agency of the State of North Carolina, hereinafter
referred to as the °Departmenr, and the New Hanover County, hereinafter referred to as the
"County."
WITNESSETH:
WHEREAS, the Department and the County on 6/1812014, entered into a certain Project Agreement
for the original scope: the construction of a multi -use path along Middle Sound Loop Road from
Oyster Lane to the Middle Sound Village driveway, programmed under Project U -5527 C; and
WHEREAS, the Department and the County agree to modify the project scope and to increase the
funding participation; and,
WHEREAS, the County has requested an extension of time to complete the Project.
NOW THEREFORE, the parties wish to supplement the aforementioned Agreement whereby the
following provisions are amended:

SCOPE
The Project consists of a multi -use path along Middle Sound Loop Road from Oyster Lane to the
eastern property line of the Middle Sound Village development, in lieu of a multi -use path along
Middle Sound Loop Road from Oyster Lane to the Middle Sound Village driveway.
FUNDING
The Department's original participation was $90,000. The Department agrees to reimburse the
County an additional $50,000 of Surface Transportation Block Grant Program funds. The County
shall provide a local match, as detailed below. The County shall be responsible for all costs that
exceed the total estimated cost.

RESPONSIBILITIES
TIME FRAME
The County shall complete all work outlined in the Agreement by 12/31/2021. Completion for this
Agreement is defined as completion of all constriction activities or implementation activities,
acceptanoe4 of the project, and submission of a final reimbursement package to the Department.
Except as hereinabove provided, the Agreement heretofore executed by the Department and the
County on 6/1812014, is ratified and affirmed as therein provided.
