Pursuant to NC General Statute 143 -64 relating to purchasing, a Request for Qualifications (RFQ) was
initiated for Solid Waste Engineering Services (including landfill cell construction and closure design and
permitting, wastewater system design and permitting, landfill gas system design and permitting, and other
solid -waste related civil services). After due advertisement, qualifications were received from a total of
seven (7) engineering firms. A team of five (5) members of the Environmental Management Department
independently reviewed the RFQs. Reviewers utilized an objective evaluation score sheet according to the
criteria established within the RFQ. References were checked for each engineering firm, with the results
scored as part of the evaluation process. Two (2) firms were invited to present their qualifications to the
evaluation team.
Upon further analysis of the RFQ responses and scoring, the evaluation team recommended selecting both
CDM Smith, Inc. and SCS Engineers P.C. to provide solid waste engineering services to the Department.
Each firm exhibits unique strengths in various areas of solid waste engineering expertise, and task orders
would be assigned to each based on their focus areas. This approach best serves the County by ensuring that
superior engineering services are always in place for each project undertaken during the contract period.
Work will be conducted via individual task orders. There is no work guaranteed to either engineering firm as
a result of being selected and placed under contract. The County reserves the right to modify the scope of
work as may be necessary to meet the County's overall solid waste management objectives.

RESOLUTION
AUTHORIZING TWO CONTRACTS FOR SOLID WASTE ENGINEERING SERVICES
WHEREAS, after due advertisement, qualifications were received and recorded by the
Environmental Management Department at 5:00 p.m. on the 4th day of January, 2018, at the New
Hanover County Environmental Management Department administrative offices, 3002 U.S.
Highway 421 N., Wilmington, North Carolina; and the following seven (7) firms submitted
qualifications for the provision of solid waste engineering services:
SCS Engineers, P.C. Smith Gardner, Inc.
S &ME, Inc. Garrett & Moore, Inc.
CDM Smith, Inc. Hodges, Harbin, Newberry & Tribble, Inc.
CEC, Inc., and
WHEREAS, the qualifications were evaluated and rated and references checked for each firm
according to the criteria as established within the RFQ, resulting in the list being narrowed to
two firms; and
WHEREAS, SCS Engineers P.C. and CDM Smith, Inc. were invited to make presentations to
the evaluation team; and
WHEREAS, the evaluation team of five (5) members of the Environmental Management
Department determined that each of the two firms exhibited expertise in specific areas of solid
waste engineering, resulting in the team's unanimous agreement to recommend that each firm be
awarded a contract for solid waste engineering services for a period of three (3) years, with the
possibility of three (3) additional one -year extensions, with primary focus in the following areas:

Smith, Inc., and that the County is hereby authorized and directed to negotiate and execute a
contract with each of the two firms, the form of which shall be approved by the County Attorney.

Ratification of TWo Grant Applications Submitted to the Department of Health and Human Services,
Substance Abuse and Mental Health Services Administration
BRIEF SUMMARY:
The County has submitted two grant applications to the Substance Abuse and Mental Health Services
Administration ( SAMHSA). Both applications were due prior to this meeting, therefore staff is requesting
the Board ratify the application submissions. Below-are descriptions of the proposed projects:
SAMHSA Category: Treatment for Individuals Experiencing Homelessness
The Department of Social Services and the Health Department will partner with First Fruits Ministries,
MedNorth, Wilmington Housing Authority and Coastal Horizons to provide case management to homeless
individuals with co- occurring mental illness and substance abuse disorder. These individuals will receive
services such as primary care, crisis intervention and housing. The goal of the project is to reduce the
reliance on crisis services, improve self - sufficiency and increase access to mental health services. There is
no match requirement for this grant. The grant may be funded for five years, with a maximum award of
$500,000 per year. The grant application was submitted on March 9th
SAMHSA Category: Early Diversion Grants
The Sheriff's Office will partner with Coastal Horizons and RHA Crisis Services to apply for a Communityl
Early Diversion grant. The project will serve inmates that are diagnosed with a severe mental illness, with
co- occurring substance abuse disorder, by providing mental health treatment and substance abuse
treatment. In addition, upon release, treatment will continue and include job placement, housing and other
governmental services. The goal of the project is to reduce recidivism, reduce homelessness and improve
mental health and substance abuse treatment access. The grant may be funded for five years. The funding
requested is $247,500 per year and requires a match in the amount of $84,112 per year. If awarded, the
match will be requested as part of the annual budget. The application was submitted on March 5th

April 4, 2018 is the 50th anniversary of the death of Dr. Martin Luther King, Jr. A commemoration
commission was formed to plan an event to celebrate the life and legacy of Dr. King. It will be held April 4,
2018 from 6:30 to 8:00 p.m. in the Williston Middle School gymnasium. All are invited to attend. Please
read the attached press release from New Hanover County Schools for more details and information about
how students may participate in an exciting essay contest.

New Hanover County Schools Supports the
Upcoming 50 Year Commemoration of Dr. Martin Luther King, Jr.
District Students to Participate in Essay Contest
New Hanover County Schools (NHCS) is in support of the Martin Luther King, Jr. (MLK) and Wilmington 50
Year Commemoration Commission's April 4, 2018, event to celebrate the life and legacy of Dr. King and
his commitment to promoting peace, social justice, and reconciliation. The event will be held in the
Williston Middle School gymnasium from 6:30 p.m. to 8:00 p.m. All are invited to attend, and attendees
are asked to wear black and gold.
Dr. King was supposed to be speaking in Wilmington, NC on the day of his assassination. A sanitation strike
in Memphis caused him to cancel his appearance at Williston Senior High School, which had dire
consequences. With the 50th anniversary of Dr. King's death on April 4, 2018, Wilmington is uniquely
situated to commemorate the occasion.
During the event, a historical marker will be unveiled in the Williston Middle School Gymnasium in Dr.

WHEREAS, the Rev. Dr. Martin Luther King, Jr., who was born on January 15, 1929, dedicated his life
to promoting peace, freedom, equality, and justice for all through non - violent means; and
WHEREAS, April 4, 2018 is the 50th anniversary of when an assassin's bullet struck down Dr. King as
he was fighting to improve the lives of Black sanitation workers in Memphis, Tennessee; and
WHEREAS, Dr. King was originally scheduled to deliver an address on April 4, 1968 at Williston Senior
High School in Wilmington, North Carolina; and
WHEREAS, Dr. King canceled his Wilmington appearance on April 1, 1968 to return to Memphis and
delivered his "I've Been to the Mountaintop" address at Mason Temple in Memphis on April 3, 1968; and
WHEREAS, New Hanover County and the City of Wilmington are uniquely positioned to celebrate the
50th anniversary of Dr. King's death because he was supposed to be in Wilmington on the day of his death;

helped change the face of American society and continues to inspire people around the world; and

BRIEF SUMP ARY:
The creeks in New Hanover County provide a wide range of recreational and economic opportunities for
thousands of local citizens and visiting tourists each year. In 1993, continuing closures of shellfishing
waters in the County led to the initiation of two tidal creek monitoring programs funded separately by the
City of Wilmington and New Hanover County.
Coastal Planning & Engineering of North Carolina, Inc. (CPE) began monitoring seven (7) tidalcreeks
within New Hanover County on a monthly basis in November 2007. The information presented in
the annual report focuses on the results of this monitoring between the months of July 2016 and June 2017.
The creeks included in this study are Pages and Futch Creek, which drain into the Atlantic Intracoastal
Waterway (ICW) and Lords, Motts, Barnards, Smith, and Prince Georges Creek, which drain into the Cape
Fear River. Along with examining the data collected from the past 12 months, long term trends have been
assessed using data obtained by CPE since 2007.
In addition to the continued sampling from the seven tidal creeks, three sampling sites from within Airlie
Gardens were included in 2015 -2016 sampling efforts. Airlie Gardens is a 67 -acre public garden owned and
operated by New Hanover County since 1999. The property, located within the Bradley Creek watershed,
includes a 10 -acre freshwater lake. The lake receives input from several stormwater culverts which serves to
manage runoff from nearby development. The purpose of this presentation is for County staff and CP &E
staff to present data from the FY 16 -17 monitoring program as well as trends from past monitoring years.
The results of this year's monitoring effort show some improvement from last year's results. Turbidity and
Chlorophyll -a have remained consistent over the years and have shown to be of little concern. Over the two
years, most creeks, with the exception of Prince Georges Creek demonstrated "Good and Fair" levels of
both parameters. Improvements were seen in Barnards Creek, and Smith Creek in regards to dissolved
oxygen. Improvements were also seen in Enterococcus between the two sampling periods in Barnards Creek,
Futch Creek, Lords Creek, Mott Creek, and Price Georges Creek. Pages Creek and Smith Creek remained
the same at "Poor" and "Fair ", while year -to -year variation is common. The only `Bred flag" highlighted from
the report is the consistency of "Poor" rating from Enterococcus in Pages Creek.
The changes identified in the network of creeks that have been monitored over the past 8 years have been
within the "noise" of the system for the most part. Some sites will improve from one year to the next while
others will diminish. The study is looking at the longer term trends. Fortunately, no new long term trends
were identified during this study period.
As for specific policies or strategies, the only existing long term issue that has been persistent has been the
high levels of bacteria persisting in the Pages Creek watershed in the Bayshore neighborhood. A source
tracking study was performed in 2014 and it was determined that there is a human signature to the bacteria

that was sampled. As a follow-up to the study, the County and CFPUA explored the integrity of the sewer
infrastructure in proximity to the two sampling stations. These facilities were assessed through smoke -tests
and other means. The results showed no compromises to the system. NHC Environmental Health examined
their records to determine if any septic tanks that were to have been abandoned in the area after the
neighborhood was provided sewer in the 1990's may still be functioning. No failing systems were identified
through this effort.
One method utilizing drone technology via Duke University to identify any illicit discharge of septic water
into the creek was thought to be possible. However due to drone regulations and the density of the tree
canopy, this method was not possible. Further investigation by the CFPUA is also possible using more
robust methods than the smoke tests as previously mentioned. Planning staff is also currently looking at
funding opportunities for testing methods recommended by CPE.

FINAL REPORT
EXECUTIVE SUMMARY
This report represents the results of the New Hanover County Water Quality Monitoring Program
between July 2016 and June 2017. Nineteen (19) monitoring stations within seven (7) tidal creeks
in New Hanover County were monitored on a monthly basis for physical, chemical, and biological
parameters of water quality. The results presented in this report are described from a watershed
perspective.
In order to provide a quick - glance assessment of the water quality within a particular sampling
station and watershed, a rating system has been established for a number of parameters. This
quantitative system assigns a rating of "GOOD ", "FAIR ", or "POOR" to a sampling station
depending on the percentage of samples exceeding the State standard for dissolved oxygen,
turbidity, chlorophyll -a, Enterococci, and fecal coliform bacteria. If the recorded value of a
parameter exceeds the State standard less than 10% of the times sampled, the station will receive
a "GOOD" rating for the parameter. A "FAIR" rating is assigned when a parameter exceeds the
State standard 11 -25% of the times sampled. Parameters measured that exceed the State standard
more than 25% of the sampling times are given a "POOR" rating.
As displayed in the table below, turbidity and chlorophyll -a were determined to be "good" within
all watersheds throughout the study period. Dissolved oxygen was deemed to be "good" in Motts
Creek, Pages Creek, and Smith Creek while Barnards Creek, Futch Creek, and Lords Creek were
all deemed to be "fair ". Prince Georges Creek demonstrated "poor" levels of dissolved oxygen
during the study period. Enterococci was problematic within three of these watersheds- Motts
Creek, Pages Creek, and Prince Georges Creek. On the other hand, Futch Creek, Barnards Creek,
and Lords Creek were deemed "good" for Enterococci.

In general, the ratings for Entertococci bacteria improved between the 2015 -2016 and the 2016-
2017 reporting periods with the exception of Pages Creek and Smith Creek which retained their
ratings of "Poor" and "Fair ", respectively. Rain events can facilitate higher concentrations of
bacteria concentration within the watersheds (through surface runoff and/or flushing of
groundwater contaminants). However, rain does not appear to be the driving cause for the
reduction in Enterococci over the past year due to the fact that sampling occurred during rain
events 28% of the time during 2015 -2016 season and 33% of the time during the 2016 -2017
season.

Staff has been working with American Gold Star Mothers, Inc. to construct a Gold Star Families Memorial
near the pond at Hugh MacRae Park. The memorial is a tribute to Gold Star Mothers, Fathers and Relatives
who have lost a family member in the line of duty while serving in the Armed Forces. The monument is
carved from black marble and stands twelve feet by six feet. The monument tells the story of homeland,
family, patriot, and sacrifice along four panels. County staff and the Gold Star Mothers believed this is a
fitting location aside the current war memorial. The cost to purchase and install the memorial is $60,000.
Bailey Granite and Monuments is the lowest qualified bidder. The project would be completed by September
30, 2018.

TX, VA Branson, MO, Fort Chadbourne, TX, Lincoln, NE,
Lexington, KY as well as a GSFMM for Fairmont, WV, the
hometown of Mr. Woody Williams, per his request. We are also

lettering, one 3/4" thick 1 "x1" Bronze cut metal star painted gold.
One 18 "x24 "x8" bevel marker (description ledger) with polished
bevel top and a 1 1 /2" polished margin, the pedestal of the same

There are two advantages your committee will attain by
choosing Bailey Granite as your monument provider. You may be
pleased to know there are no taxes on monuments if purchased in
KY. For this project, that is a savings of approximately $2800. In
addition, our family has been able to purchase a new crane truck.
This truck is fully capable to handle these heavy granite pieces to
complete the job. If we can get very close to the concrete
foundation, (approx. 6 to 8 feet) then we can provide the crane at
no additional charge. This would alleviate an extra burden of the
committee to pay for a crane rental. For this project, we will donate
the use of the crane, so that the committee can put the expense of a
crane rental towards the project.

Consideration of Room Occupancy Tax Audit Program
BRIEF SUNP ARY:
New Hanover County collects a six percent (6 %) room occupancy tax on gross receipts from short term
lodging sales. It is used to provide important services to the residents and visitors of New Hanover County,
most notably being used for coastal storm damage reduction efforts at all three beaches, operations of the
Wilmington Convention Center, and promotion of tourism and various tourism activities.
Room occupancy tax should be collected and remitted to New Hanover County on a monthly basis. The tax
applies to all lodging providers whether that provider be a hotel, motel, inn, bed & breakfast, rental home,
rental room, etc. The increasing presence and use of vacation rental by owner sites such as Airbnb and
HomeAway has made it increasingly difficult to determine if all required room occupancy tax is being
collected by New Hanover County. These websites are numerous and are time consuming to search to
determine if all properties are collecting and remitting its room occupancy tax.
Staff is requesting approval of a more robust audit program to monitor the collection and remittance of
room occupancy tax. This program would incorporate the use of an outside software vendor that is able to
search all vacation rental websites, locate properties that have likely provided short term lodging, and
provide information to the County about the potential stay. The County would use that information to contact
taxpayers, inform them of the requirement to remit and collect room occupancy tax, and collect any room
occupancy tax that may be due.
As a part of this program, staff is also recommending an online filing and remittance portal that will allow a
rental property owner or their designee to file their room occupancy tax online rather than mailing in a paper
form as currently done and will also allow the corresponding payment to be paid online. This will not only
allow the County to collect the information it requires for an effective audit program but will also provide a
more convenient method for payment of the tax.
The Tourism Development Authority adopted a resolution on October 25, 2017 in support of the program.
The cost of the software will be $41,000 annually, which consists of $26,000 for the compliance software
and $15,000 for the online filing and payment system, and will be paid from room occupancy tax
collected. Staff anticipates that the increase in room occupancy tax collected will cover the cost of the
software. It is anticipated that the audit program and online portal will be operational July 1, 2018.

property tax revenues that staff anticipate will be collected by June 30, 2018 based on six (6) months of
actual receipts. The additional revenue was used to reduce appropriated fund balance, to the extent fund
balance was previously appropriated. As required by the General Statutes, the county must transfer the
school system's pro rata share of the increased anticipated sales taxes. The balance of new revenues was

BRIEF SUNAIARY.
Right Angle Engineering, on behalf of the property owner, McCormick Ventures, LLC, is requesting to
modify the conditions of the Northchase Planned Development to allow for an additional driveway access to
N. College Road from property located at 4616 Coddington Loop.
Similar to conditional zoning districts, planned developments are approved with a master plan which
illustrates the general design and layout of the development. Approved planned developments must be
constructed in accordance with the approved master plan, with only minor changes capable of being
approved by staff. Requests for major changes, like this application, must follow the same review
process as a new rezoning application, which includes public hearings with the Planning Board and
Board of Commissioners.
The Northchase Planned Development, consisting of approximately 700 acres, was originally
approved in 1985. As part of that approval, the development was limited to six access points to N.
College Road. The six access points connect to an internal street network that provides access to all of
the properties within Northchase, including both the residential and commercial portions of the
development.
The applicant is requesting to install an additional driveway access point to N. College Road from a
1.15 -acre parcel located at 4616 Coddington Loop Road. The subject property is currently classified
as "Commercial" on the Northchase Master Plan, which would allow for land uses permitted in the B-
1 and B -2 zoning districts. The applicant states that a driveway at this location would improve
business visibility, access, and deliveries by large trucks.
The 2016 Comprehensive Land Use Plan classes the subject property as Employment Center. This
Place Type Serves as an employment and production hub where office and light industrial uses
predominate.
The proposed access point is generally NOT CONSISTENT with the purpose and intent of the
Comprehensive Plan, and is not consistent with the development intent of the Northchase Planned
Development. Allowing additional access points to N. College Rd. will contribute to more
opportunities for traffic conflicts on a key arterial providing access to an anticipated growth node.

The Planning Board considered this application at their January 11, 2018 meeting. At the meeting the
Board discussed the need for the proposed driveway, how the driveway would affect the safety of the
motorists traveling on N. College Road, and NCDOT's position on the driveway. No one from the
public spoke in favor of, or in opposition to, the proposal.
The Planning Board recommended denial (4 -0) of the application, concluding that it is:
1. Not consistent with the purposes and intent of the 2016 Comprehensive Plan because the proposed
driveway will contribute to more traffic conflicts on a key arterial street to an anticipated growth
node.
2. Not reasonable and not in the public interest because the proposed driveway will add an additional
conflict point on N. College Road, thereby increasing the opportunities for traffic congestion and

The applicant is requesting to install an additional driveway access point to N. College Road from
a 1.15 -acre parcel located at 4616 Coddington Loop Road. The subject property is currently
classified as "Commercial" on the Northchase Master Plan, which would allow for land uses
permitted in the B -1 and B -2 zoning districts. The applicant states that a driveway at this location
would improve business visibility, access, and deliveries by large trucks.
When the subject property was first created through a subdivision plat in 1999, access was
provided to the property by a 30 -foot access easement, where a driveway was previously installed
connecting to Northchase Parkway NE. In 2007, a document was recorded in the Register of Deeds
that abandoned that easement and dedicated a new 50 -foot easement in order for the subject
property to utilize Coddington Loop for access and utility purposes (Book 51 60, Page 1614). Two
properties located directly north of the subject property already use Coddington Loop as their sole
access. The location of the proposed driveway would be approximately 300 feet north of the
intersection of N. College Road and Northchase Parkway NE.

generating businesses. Residential and commercial uses are encouraged in
these areas in order to provide nearby housing for workers at those
businesses and needed services for those workers. Ideally, commercial uses
in this place type are not intended to serve the general motoring public.
Analysis
The existing direct access points on N. College Rd. effectively serve the
Employment Center's business and other uses while reducing the likelihood
of traffic congestion common on many of the County's roads (Market St., S.
College Rd., Carolina Beach Rd.) where frequent driveway cuts exist.
Maintaining limits on driveway cuts on N. College Rd. is especially important
given the location of the anticipated high growth area around CFCC North
Campus, immediately north of the Employment Center area. High growth
and high density without access control on the primary through -road has the
potential to increase congestion and roadway conflicts.
The proposed access point is in general NOT CONSISTENT with the purpose

PLANNING BOARD ACTION
The Planning Board considered this application at their January 1 1, 2018 meeting. At the meeting
the Board discussed the need for the proposed driveway, how the driveway would affect the safety
of the motorists traveling on N. College Road, and NCDOT's position on the driveway. No one from
the public spoke in favor of, or in opposition to, the proposal.
The Planning Board recommended denial (4 -0) of the application, concluding that it is:
1. Not consistent with the purposes and intent of the 2016 Comprehensive Plan because the
proposed driveway will contribute to more traffic conflicts on a key arterial street to an
anticipated growth node.
2. Not reasonable and not in the public interest because the proposed driveway will add an
additional conflict point on N. College Road, thereby increasing the opportunities for traffic
congestion and decreasing the overall safety of the road. In addition, the proposed

driveway will not improve the access or vehicular circulation to neighboring commercial
properties within Northchase as they are already served by an existing internal roadway
network.
STAFF RECOMMENDATION
Staff concurs with the Planning Board's action and also recommends denial of this application.
The current roadway network in Northchase, which limits driveways to N. College Road, allows for
better flow of the road by reducing conflict points. In addition, the property already has access to
an internal roadway network that serves every commercial /industrial property located within the
development; approximately 250 parcels of land. The proposed driveway will not improve the
access or vehicular circulation to the neighboring properties that already utilize the existing internal
roadway network. Staff also has concerns that allowance of an additional driveway at the subject
property could start a precedent for adjacent property owners to seek the same request. Overall,
the proposed driveway will only provide benefit to the subject property while increasing the
opportunities for traffic congestion and additional driveways in a planned development that was
designed to minimize conflict points on an arterial street by providing a sufficient and effective
internal street network that every existing business has utilized for their sole access.
Staff requested input from NCDOT regarding this application, and they stated "every additional
driveway along Wilmington's already congested major corridors represents an additional conflict point
creating undue impairment of safety, mobility, and utility of the highway..." Further, NCDOT's "Policy
On Street and Driveway Access to North Carolina Highways" stipulates that NCDOT may deny
access to the adjacent public roadway from "out lots" or "out parcels" of a larger development
where reasonable access can be provided via the larger development's internal circulation system.
It is NCDOT's stance that this subject parcel is part of the overall larger development and therefore
should be served internally. NCDOT's full position on this application is included in the Planning
Board's packet, in email correspondence sent to staff on December 14th

REVIEW PROCESS
Step 1: Pre - Application Conference (Optional)
In order to assist applicants through the conditional rezoning process, applicants are highly encouraged to contact
staff to schedule a pre - application conference prior to application submittal. Applicants are requested to review
the sections of the Zoning Ordinance specific to zoning amendments and conditional zoning districts prior to
submission, and advised to contact Planning Staff with any questions. The following sections of the Zoning
Ordinance pertain specifically to zoning amendments, and conditional zoning districts:
• Section 55.3: Conditional Zoning District
• Section 110: Amending the Ordinance
• Section 1 11: Petition
• Section 112: Approval Process
Step 2: Community Meeting
Prior to application, at least one community information meeting must be held, and a report summarizing the
community information meeting is required as part of the application. The primary purpose of the community
meeting is to explain the upcoming proposal and field questions from people in the surrounding area. The
meeting should focus on information exchange between an applicant and the specific invitees but should be open
to the general public as well.
The community meeting shall comply with the following procedures:
• Notification
• Mailed Notice
■ The applicant must provide written notice by mail or other agreed upon measure at least ten days prior
to the date of the community meeting. Notice shall be provided to each owner of record of land and
any currenttenants within 500feetof and on the property for which development approvals are sought.
• E- Mailed Notice
■ The applicant must provide the Department of Planning & Land Use with a completed community notice
template in a digital format at least twelve days prior to the date of the community meeting. The notice
will be provided to organizations entitled to notice based on a standing written request on file with the
Clerk to the Planning Board ( "Sunshine List ").
Written Summary
The written summary of the community meeting included in the application must include, at a minimum the
following:
1. A list of those that were not able to be contacted and reason(s) why contact was not successful;
2. Date, time and location of the meeting;
3. Roster of the persons in attendance at the meeting;
4. Summary of issues discussed at the meeting; and
5. Description of any changes or adjustments to the application made by the petitioner as a result of the
community meeting.

Step 3: Application Submittal
Applications must be received by the Department of Planning & Land Use by 5:00 PM on the application
deadline date. A complete application consists of the items detailed in the submittal checklist provided in this
application. A schedule of application deadlines is available at planningdevelopment.nhcgov.com or in the
Department of Planning & Land Use office.
Step 4: Staff Review and Recommendation
Upon receiving a completed application, staff may distribute it to certain departments and agencies for review.
County Planning staff will review the application, prepare a staff report, and provide a recommendation on the
application. Staff may propose additional conditions and requirements beyond those listed in the
petition /application.
Step 5: Planning Board Review and Recommendation
The New Hanover County Planning Board will consider the application at a public hearing. The Department of
Planning & Land Use will notify the public of this hearing in accordance with standards of the Zoning Ordinance.
This includes sending mailed notice to nearby residents, posting a sign on the subject property, and advertising
the hearing in a local newspaper.
The public hearing will allow staff, the applicant, proponents and opponents to testify in regards to the request.
The Planning Board will make a recommendation to the County Commissioners.A recommendation for denial ends
consideration of the proposed zoning amendment unless the recommendation is appealed. A recommendation for
approval is automatically forwarded to the County Commissioners for action. The Planning Board may propose
additional conditions and requirements beyond those listed in the petition /application.
Step 6: Board of Commissioners Review and Action
The New Hanover County Board of Commissioners will consider the application at a public hearing. The
Department of Planning & Land Use will notify the public of this hearing in accordance with standards of the
Zoning Ordinance. This includes sending mailed notice to nearby residents, posting a sign on the subject property,
and advertising the hearing in a local newspaper.
At the public hearing, the New Hanover County Board of Commissioners will consider the application along with
the Planning Board's and staff's recommendation. Prior to adopting or rejecting any zoning amendment, the
Commissioners shall adopt a statement describing whether or not the amendment is consistent with the County's
Policies for Growth and Development and explaining why the Commissioners consider the action taken as
reasonable and in the public interest. The Commissioners may propose additional conditions or requirements
beyond those contained in the petition /application.
• The applicant should keep this section of the application for reference. It is not required to be included in the completed
application that is submitted to the County.

and the majority of properties have been built out.
The proposed use on the site isfor equipment salesand repair which having a dedicated driveway would irrprove
the businessvidbility, access, and deliveries by large trucks The proposed site plan depictsa right in/ right out
driveway connection onto Highway 132 while also adding a concrete idand to prevent crossover access This
proposed site plan has received no objection from the NCDOT.

the Institute of Transportation Engineers (ITE) Trip Generation Manual. ATraffic Impact Analysis (TIA) must be completed
for all proposed developments that generate more than 100 peak hour trips, and the TIA must be included with this
application.

CONSIDERATION OF A CONDITIONAL ZONING DISTRICT
The Conditional Zoning District procedure is established to address situations where a particular land use would be
consistent with the New Hanover County Land Use Plan and the Zoning Ordinance objective and where only a specific
use or uses is proposed. The procedure is intended primarily for use with transitions between zoning districts of very
dissimilar character where a particular use or uses, with restrictive conditions to safeguard adjacent land uses, can
create a more orderly transition benefiting all affected parties and the community -at- large. The applicant must
explain, with reference to attached plans (where applicable), how the proposed Conditional Use Zoning District
meets the following criteria.
1. How would the requested change be consistent with the County's policies for growth and development? (For
example: the Comprehensive Plan and applicable small area plans)
- hisproject would benefit the siooessof a business by allowing visibility, connectivity, and aooessfor a local
smll business owner. The current property has not been developed since the inception of Northdhase.
While not necessarily oonsdered infill, the development of this project would irrprove the built landscape
along this stretch of Highway 132.
2. How would the requested Conditional Zoning District be consistent with the property's classification on the
Future Land Use Map located within the Comprehensive Plan?
The project is located directly adjacent to a growth node and within an ernployrr-ent center. This project
would be consistent with the Future Land Use Ran.
3. What significant neighborhood changes have occurred to make the original zoning inappropriate, or how is
the land involved unsuitable for the uses permitted under the existing zoning?
Trafficchanges have ooa.rred since the original Conditional Use in 1985. The NCDOThasno objection to
the proposed driveway connection.

Right Angle Engineering distributed a mailing detailing the conditions of the project and Community Meeting.
The mailing list was developed from New Hanover County tax records and 42 notices were mailed out
November 2, 2017. Two mailings were returned undeliverable.
The meeting was held at Northside Baptist Church Family life center. There were no public attendees at the
meeting, only the Owner, Owner's Attorney, myself, and Brad Schuler with New Hanover County.
The meeting was adjourned at 6 pm with no questions about the project.

As discussed, NCDOT supports New Hanover County in the denial of an additional driveway on NC 132 (N. College Road).
As each and every additional driveway along Wilmington's already congested major corridors represents an additional
conflict point creating undue impairment of safety, mobility, and utility of the highway, the number of street and
driveway connections permitted to serve a single property or commercial development along a State maintained
roadway will be the minimum deemed necessary by the NCDOT for reasonable service to the property. Guidance from
NCDOT's "Policy On Street And Driveway Access to North Carolina Highways" stipulates that NCDOT may deny access to
the adjacent public roadway from "out lots" or "out parcels" of a larger development where reasonable access can be
provided via the larger development's internal circulation system. The NCDOT may require construction of an internal
street system or service road to eliminate or reduce multiple lot access connections directly to the adjacent public
roadway system (Pg. 36). As the county has brought to our attention, this subject parcel is part of the overall larger
development and therefore should be served internally.

NEW HANOVER COUNTY
ADULT CARE HOME COMMUNITY ADVISORY COMMITTEE
Number of Members: 13 State mandated; May appoint up to 18 (1 member for each permitted
facility) The Adult Care Home Administrators may nominate one -third of the members. If
possible, one member must be a person involved in the area of mental retardation. A County
Commissioner shall be appointed to serve in an ex- officio capacity.
Compensation: None, but may be reimbursed for actual expenses.
Term of Office: 1 year term initially; 3 year term thereafter
Qualifications: Must be a resident of New Hanover County. No person or immediate family
member of a person with a financial interest in a home served by the committee, or employee or
governing board member of a home served by the committee, or immediate family member of a
resident in a home served by the New Hanover County Adult Care Home Community Advisory
Committee may be a member of this committee. Immediate family is defined as mother, father,
sister, brother, child, grandmother, and grandfather, as well as in -laws. See Volunteer Job
Description for more information.
Purpose: The committee supports the spirit of the Adult Care Home Resident's Bill of Rights,
visits adult care homes quarterly, promotes the wellbeing of residents and encourages community

Terms of Office: Initial terms shall commence December 1, 2017. Terms will be staggered as
determined by the Board of Commissioners to serve one -year, two -year, and three -year terms.
All appointees will serve in at -large capacities.
Purpose: Cooperative Extension is a partnership between New Hanover County Government
and North Carolina's two Land Grant universities — N.C. State in Raleigh and N.C. A &T State in
Greensboro. Primary responsibilities include:
1. Provide input and direction for educational programming conducted by Cooperative
Extension staff and volunteers in the areas of Consumer and Commercial
Horticulture, 4 -H Youth Development, Family and Consumer Sciences, and
Environmental Education.
2. Serve as an advocate for Cooperative Extension with citizens, community leaders,
and elected officials.
3. Participate in and support Cooperative Extension programs and events.
4. Partner with the New Hanover County Friends of the Arboretum, the New Hanover
County Master Gardener Association, other agencies, non - profit organizations, and
companies to improve /expand facilities and services.
Meetings: Four times yearly, held in auditorium at the New Hanover County Arboretum

NURSING HOME COMMUNITY ADVISORY COMMITTEE
Number of Members: 11 State mandated; may appoint up to 16 based on the number of nursing
homes. The Nursing Home Administrators may nominate one -third of the members.
Term of Office: 1 -year term initially; 3 -year term thereafter
Brief on the functions: Each member shall be aware of the general conditions under which the
persons are residing in the homes, and shall work for the best interests of the persons in the homes.
This may include assisting persons who have grievances with the home and facilitating the resolution
of grievances at the local level. Each member shall make quarterly visits to the nursing home it
serves and more often if it is necessary to carry out the duties. Statute or cause creating Board:
N.C. General Statute 131 E -128.
Qualifications: Must be a resident of New Hanover County. No person or immediate family
member of a person with a financial interest in a home served by the committee, or employee or
governing board member of a home served by the committee, or immediate family member of a
resident in a home served by the New Hanover County Nursing Home Community Advisory
Committee maybe a member of this committee. Immediate family is defined as mother, father, sister,
brother, child, grandmother, and grandfather, as well as in -laws. See Volunteer Job Description for

Regular Meeting: Quarterly Meetings are held on the second Tuesday of January, April, July, and

SPECIAL BOARD OF EQUALIZATION AND REVIEW
Number of Members: 5 Regular Members and 2 Alternates, in the following categories when
possible:
• North Carolina licensed property appraiser
• Attorney, accountant, or other professional
• Business owner
• Individual engaged in the commercial production of agricultural, livestock, timber,
or horticultural products, or a North Carolina licensed real estate broker
• Single- family residential property owner
Function: The Special Board of Equalization and Review will meet to hear appeals filed by
property owners on their tax assessment. Duties are set forth under Article 21 of the Machinery
Act of North Carolina.
Term of Office: 1 year; the Board will remain active until the conclusion of the tax appeals.
Compensation: $50 for half day meetings and $100 for full day meetings, effective 3/16/2015.
Qualifications: Applicant must be a resident of New Hanover County for a minimum of two
years and have paid all taxes imposed by the county, municipalities, service districts, and any
property tax abatements and special assessment taxes currently due. Each member must take
an oath of office.
Regular Meetings: As required and called by the Tax Administrator (may require weekly
meetings for several months)
Statute or cause creating Board: NCGS 105 -322 authorizes Boards of County
Commissioners to appoint by resolution a Special Board of Equalization and Review to hear tax
appeals; the Commissioners adopted resolution on January 20, 2009.
