New Hanover County Sheriffs Office desires to replace the current scan machine being used for security at
the Courthouse. The current equipment was purchased sixteen (16) years ago and at times fails to function
properly. The machine is a Smiths Detection product and the Sheriffs office would like to replace the
equipment with the same type equipment. This is due to the fact that Smiths Detection equipment is
currently being used at the County's Jail, Juvenile Justice Building, and Department of Social Services.
Point Security, Inc., is the sole distributor of the Smiths Detection X -Ray system to the NC
marketplace. This has been confirmed in a letter dated 4/23/2018 from the manufacturer, Smiths Detection.
NCGS 143- 129(e)(6)exempts purchases of apparatus, supplies, materials, or equipment when: (i)
performance or price competition for a product are not available; (ii) a needed product is available from only
one source of supply; or (iii) standardization or compatibility is the overriding consideration. This exception
is referred to as Sole Source and must be approved by the Board prior to the award of the contract or
issuance of purchase order. Standardization is the overriding consideration for the purchase of this
equipment from Point Security, Inc.
The total cost of the equipment is $35,394. Funds are available in the Sheriffs Office FY 17 -18 budget for
this purchase.

APPROVAL OF POINT SECURITY, INC. AS A SOLE SOURCE VENDOR
FOR THE PURCHASE OF SMITHS DETECTION X -RAY INSPECTION SYSTEM
WHEREAS, New Hanover County Sheriffs Office desires to replace the current scan machine
being used for security at the Courthouse due to its lack of reliability; and
WHEREAS, the current machine is a Smiths Detection product and the Sheriff s office would like
to replace the equipment with the same type equipment due to the fact that Smiths Detection
equipment is currently being used at the County's Jail, Juvenile Justice Building, and Department
of Social Services; and
WHEREAS, Point Security, Inc., is the sole distributor of the Smiths Detection X -Ray system to
the North Carolina marketplace as confirmed in a letter dated April 23, 2018, from the
manufacturer, Smiths Detection; and
WHEREAS, North Carolina General Statute (NCGS) 143- 129(e)(6) exempts purchases of
apparatus, supplies, materials, or equipment when: (i) performance or price competition for a
product are not available; (ii) a needed product is available from only one source of supply; or (iii)
standardization or compatibility is the overriding consideration; and
WHEREAS, standardization is the overriding consideration for the purchase of this equipment
from Point Security, Inc.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of
Commissioners approves Point Security, Inc. as a sole source vendor for the purchase of Smiths
Detection X -Ray Inspection System in the amount of $35,394 in accordance with the provisions
of NCGS 143- 129(e)(6).

Travel Policy - Revised
Effective: Approved by the NHC ABC Board April 18, 2018; pending approval of the New
Hanover County Commissioners; pending approval by the NC ABC Commission
1. Purpose:
a. The purpose of this policy is to provide ABC Board members and employees
detailed information on the policies and procedures required when traveling on
authorized ABC Board business when Board funds are being used. This Board
policy is intended to supplement the New Hanover County Travel Policy
(Memorandum No. 15 -004, issued March 31, 2015) to include the New Hanover
ABC Board (hereafter referred to as the "Board "). Specific mandates for NC ABC
Boards appear near the end of this document.
b. This policy was developed to provide a clear and consistent understanding of the
Board's definition of business related expenditures. These are expenditures
incurred while executing official Board business whether out of town or a day trip.
c. This policy includes specific requirements and guidelines for payment and
reimbursement of all allowable authorized travel expenses. The ABC Board
assumes no obligation to reimburse expenses that are not in compliance with this
policy. Any exceptions or deviations from this policy will require Board Chair (or
his /her designee) approval before the related expenditure will be reimbursed.
2. Organization /Individuals Affected:
a. This Travel Policy and related procedures applies to the New Hanover ABC Board,
its Board members and Board employees (hereafter collectively referred to as
"travelers ").
3. Definitions and Related Forms:
a. Business Travel — Appropriately authorized travel by a Board member or employee,
deemed necessary to conduct official business, relating to training sessions,
conferences, conventions or other authorized meetings which will provide business
value or promote professional development that benefits the NHC ABC Board.
b. Authorized Travel Expenses — Reasonable expenses incurred as part of business
travel that are properly documented and consistent with the policies and guidelines
contained in the Travel Policy.
c. Board Procurement Card/P -card — Board issued credit /debit card provided to
certain personnel in order to make purchases of goods and/or services required by
the Board.
d. Forms —
a.Travel Authorization Report, NHC ABC Board Form 001 — Pre -
authorization for travel and cash advances.

b.Travel Expense Report, NHC ABC Board Form 002 — Reimbursement
Request and documentation.
4. Travel Authorization:
a. All Board members and the CEO must have all travel requests approved by the
Board Chair (or Vice Chair); the Finance Officer must appropriate funds in advance
of the trip, and pre -audit the instrument in the manner required by G.S. 1813-702.
b. All employees, except the CEO, must have all travel requests authorized by the
CEO (or designee); the Finance Officer must appropriate funds in advance of the
trip, and pre -audit the instrument in the manner required by G.S. 1813-702.
5. Travel Advances:
a. In order to avoid financial hardships for employees who are required to travel on
official Board business, the Board will pre -pay and / or advance up to 100% of the
estimated travel expenses, so long as total requested advance for expenses is at least
equal to the standard daily meal per diem limit. Advances are to be used for those
employees who need the funds prior to their travel.
b. Whenever possible, accounts payable checks should be used to pay for
transportation, registration, and lodging to keep the actual out -of- pocket expenses
requiring an advance to a minimum.
c. Travel Advance Limits:
Minimum: Estimated expenses are equal to the standard daily meal per diem limit.
Maximum: 100% of estimated travel expenses.
d. NO TRAVEL ADVANCES will be issued for meal per diem for same -day travel
trips.
e. The Travel Authorization Report (TAR), with estimates / documentation for all
trip - related costs and necessary approval signatures /e- mails, must be sent to
Finance no less than ten (10) business days prior to the expected departure if an
advance is requested.
f. The Finance Officer will not issue a travel advance if the traveler has an outstanding
advance that has not been reconciled and cleared by a corresponding Travel
Expense Report (TER) according to the guidelines. Travelers who are routinely late
in submitting travel reconciliations (the travel expense report) will not receive
future advances.

6. Transportation:
a. In determining the mode of transportation to be used for travel, the Board will pay
either the standard mileage reimbursement (IRS business rate), the cost of air fare
at the coach rate, or other similar fare for other modes of transportation (i.e. rail,
rental vehicle, etc.) depending on which is economically reasonable.
b. The person approving the travel should determine the most suitable travel mode,
based upon factors such as convenience and time. When more than one employee
is attending the same function, etc., carpooling is strongly encouraged.
c. Board Vehicle
a. Board owned passenger vehicles may be used for any authorized travel. The
requesting traveler must obey all laws of the jurisdiction in which the
vehicle is being operated and will be responsible for any parking or traffic
violations incurred while using the Board vehicle.
b.The Board vehicle should be used in conducting official Board business
only. A minimal amount of personal use, such as driving the vehicle to and
from a meal is allowed. If family members accompany travelers on a
business trip, a personal vehicle must be used.
c. Employees are strongly encouraged to use a Board vehicle when available
for same day travel, particularly travel within New Hanover County.
d.The Board has fuel cards for the specific purpose of purchasing fuel for
Board owned vehicles; these cards must be used with an assigned PIN. The
Board receives a discount when these cards are used. Avoid using personal
card charges to purchase fuel for Board vehicles.
d. Rental Vehicles
a. Travelers must obey all laws of the jurisdiction in which the rented vehicle
is being operated; drivers will be responsible for any parking or traffic
violations incurred while using the vehicle.
b.The classes of cars approved by the Board that are available for rent include
Economy, Compact and Intermediate. When Board travelers are carpooling
to a travel destination, a larger rental vehicles may be leased for the
benefit /comfort of those carpooling /traveling together.
c. The Board provides insurance for business rentals. Travelers must refuse
Loss /Collison Damage Waiver (LDW) and Personal Accident Insurance
(PAI) for domestic business travel; travelers will not be reimbursed if they
purchase this coverage.

e. Personal Vehicle
a. If a personal vehicle is used, it is the responsibility of the owner of the
vehicle being used for Board business to have customary automobile
liability insurance coverage including medical payments, for their
protection and that of their passengers. If a traveler drives a personal
vehicle, his /her insurance policy covers vehicle damage and any expenses
incurred in an accident.
b.Reimbursement for miles traveled in a personal vehicle will be at the
maximum rate allowed by the Internal Revenue Service (IRS) which is
updated annually on the first day of January.
c.Any Board employee who receives an automobile allowance is NOT
eligible for mileage reimbursement.
d.When a private vehicle is used for travel, only the owner of the private
vehicle is to be reimbursed the applicable mileage rate. The same guidelines
for determining allowable mileage as used by the Internal Revenue Service
(IRS) will be used by the Board.
1. Mileage from home to a place other than the traveler's normal place
of work should be calculated net of the traveler's regular commuting
mileage (from home to work).
2. Travel from home to work is NOT allowable mileage, unless the
employee is in a call -back status.
3. Board members are eligible for personal vehicle reimbursement for
official Board - related travel except for travel-to-from regular
Board meetings.
4. Voluntary travel for personal benefit is NOT allowable mileage.
e. To process a reimbursement request, mileage with appropriate descriptions
of travel incurred, business purpose and destination must be noted on the
Travel Expense Report. A printed map with estimated miles from one of
Internet map providers will be sufficient documentation of miles driven.
f. If the traveler chooses to drive a personal vehicle greater than 400 miles one
way instead of flying to a destination, reimbursement for the use of the
personal vehicle (including additional lodging costs, meal and incidental
expenses and parking necessitated by this mode of travel) shall not exceed
the coach airfare rate to the destination plus any additional costs that would
have been incurred as a result of air travel.

f. Air Travel
a.Air travel should be arranged and tickets purchased, after receiving all
necessary authorizations for the trip, as early as possible to assist in keeping
costs at a minimum. Airline flights must be booked at no more than the
coach rate fare. Air travel may be booked via an airline direct or with an on-
line discount broker, such as Expedia or Orbitz.
b.If a flight reservation is changed or cancelled and results in additional fees,
aw written explanation approved by the Board Chair (for Board members)
or the CEO (for employees) must be provided. If the change is not Board
related, the traveler will be responsible for the additional fee unless an
emergency occurs and is approved by the Chair or CEO, respectively.
c. The Board will pay one baggage fee each way when traveling by air. The
traveler should retain the E- ticket, Internet receipt, or boarding pass and the
receipts for the baggage fees, report the amounts on the Travel Expense
Report and attached the receipts as documentation to show that the
expenditure was actually incurred. The traveler will be responsible for
additional fees, including any overage fees for excess weight.
g. Other Travel Transportation/Parking Fees
a. Ground Transportation includes trains, airport shuttles, buses, and taxis and
is authorized when incurred while out of town on Board business. Ground
transportation includes travel to /from the airport and hotel, travel to /from
hotel and location of business /conference /meeting, and travel to /from hotel
and restaurant, etc.
b.Parking charges and tolls will be reimbursed. Receipts are required and will
be reimbursed at actual cost.
7. Meals
a. To be eligible to receive payment of the meal per diem, traveler must be in travel
status. Travel status occurs when traveler incurs over 50 miles of one way travel
from his /her New Hanover ABC Board work facility to arrive at his /her business
destination.
b. Meals will be reimbursed using the per diem rate per the U.S. General Services
Administration (GSA) and are updated annually, effective each October V. (US

d. Receipts: No receipts are required for per diem reimbursements that comply with
these guidelines. Tips for meals, vending machine, and snacks are included in the
per diem meal allowance rate and are not reimbursable.
e. No travel related meals should be charged to a Board charge card, unless
special circumstance have been approved by the Finance Officer.
f. Travelers will not be reimbursed for alcoholic beverages and alcoholic
beverages should not be charged to a Board charge card.
g. Same Day Travel Meals: IRS regulations state that meals claimed for non -
overnight trips are to be reported as taxable income. Therefore, meal
reimbursements for same day travel will be reimbursed to the traveler via the
payroll system and will be reported with taxable wages.
h. Overnight Travel Meals:
i. When a meal is provided as part of a conference or meeting, or including
with lodging (hotel), including continental breakfast, per diem will not be
paid for that particular meal, regardless if the employee chooses to eat that
meal or not.
ii. Room service is discouraged and must be paid by the traveler with his /her
personal funds at the time of check out. Room service meals may not be
charged to a Board charge card.
8. Lodging:
a. Reimbursement of lodging (hotel /motel) costs shall be for the traveler only, at the
single room rate (unless sharing the room with another Board employee).
b. Travelers are expected to use good judgement and fiscal prudence when making
reservations. It is recommended that when attending conferences and conventions,
travelers should use the discounted lodging rate offered by the conference
organizers for conference attendees. If a traveler chooses not to stay at the
conference hotel, the traveler will only be reimbursed up to the conference rate and
should choose comparably priced hotels.
c. Whenever possible, travelers should utilize discounts available to them, such as the
government employee rate offered by many hotels. Reimbursements of lodging will
be based upon submission of the official hotel receipts showing all charges and
payments and must show a zero balance due.

d. Normally, reservations made with a charge card will guarantee a late arrival.
Travelers may request a direct payment of one night's lodging as a deposit to the
hotel if the traveler does not have a charge card. If the traveler cancels the
reservation, it is the traveler's responsibility to ensure that the room reservation is
cancelled in compliance with the cancellation terms established by the hotel, and
obtain prompt refund of any deposit made by the Board.
e. When two (2) or more Board travelers share a room, all room expenses shall be on
one (1) traveler's expense report. The Travel Authorization Report and Travel
Expense Report should reflect a notation in the comment box stating travelers
shared lodging to document the overnight stay.
f. If a traveler chooses to arrive at the location of the training/conference /meeting the
night before it begins, the Board will not pay the lodging expense if it is within 100
miles from his /her Board work -site (or the travelers home whichever is closer) and
if the training/conference /meeting begins at 10 AM or later.
9. Conference / Class Registration Fees
a. Registration fees may be paid in advance using Board charge card (if applicable)
or with an Accounts Payable check once the appropriate Travel Authorization form
has been approved. If the registration fees will exceed $1,000, submit a copy of the
Travel Authorization Request to the Finance Officer to allow payment.
b. Any registration fees for guests must be paid in advance by the Board member or
employee. The Finance Officer must not allow for the Board to pay for guests, then
deduct the expense later from the traveler's expense report.
c. Conference or seminar registration fees paid onsite should be reported on the Travel
Expense Report with the receipt for the payment attached.
10. Other Expenses
a. Internet — Lodging Internet connection charges related to conducting Board
business are reimbursable. The traveler should include the expenditure on the
Travel Expense Report, identify the charge and indicate the business purpose on
the lodging bill submitted with the Travel Expense Report.
b. Telephone — Any telephone charges related to conducting Board - related business
are reimbursable. The traveler should include the expenditure on the Travel expense
Report, identify the charge (including the telephone connection fee charged by the
hotel /motel) with the submission of the detail listing of calls, purpose and
associated fees.

c. Dry Cleaning — Dry cleaning services or laundry services are reimbursable up to
$10.00 for trip exceeding five working days. A receipt must be provided with the
related expense report.
11. Miscellaneous
a. Tips will be at the traveler's expense (for example, valet parking, concierge,
baggage handling, etc.).
b. Personal entertainment will be at the expense of the traveler (for example, movie
rentals, etc.).
c. The Board recognizes that the County residents receive benefits by providing Board
members and employees the opportunity to participate in various conference event
that provide value in their role as representatives of the ABC Board. Any additional
event cost not included in the base registration fee must be easily justifiable and
benefit the ABC Board within the duties of those attending the event.
d. Any other required Board - related business expenditure will be reimbursed at actual
cost. Receipt and justification must be submitted with the Travel Expense Report.
12. Travel Accompanied by Non -Board Persons (Individuals who are not Board
members or Board Employees):
a. A traveler may be accompanied by a guest (for example, family member,
companion, etc.) on a Board authorized travel at their own expense.
b. The traveler is responsible for allocating only his/her portion of the actual costs on
the Travel Expense Report.
c. The traveler is only responsible for any incremental cost of lodging (hotel /motel) if
the accommodation was modified from the single rate due to the attendance guest.
d. Non -Board business associates (for example, contract ABC Officers, etc.) may
accompany Board travelers in Board vehicles when they have a business interest in
the purpose of the trip.
e. Costs should be shared and split accordingly.
f. Only ABC Board members and employees are authorized to drive a vehicle owned
by or rented by the ABC Board.

13. Cancellations
a. In the event of cancelled travel, all efforts must be made to eliminate related
expenses. It is the traveler's responsibility to cancel the lodging reservation,
meeting/conference /school registration, and any other travel plans.
a. The traveler should request and record the cancellation number for lodging
in case of billing disputes. If the travelers fails to cancel the reservation, a
written explanation for the failure to cancel is required with approval by the
Board Chair for Board members or CEO for employees.
b. The traveler may be held personally responsible for no show fees if he /she
fails to take appropriate action to cancel the travel plans. In the event of
accidents, serious illness or death with the traveler's immediate family (as
defined by the Board's Bereavement Policy) or other critical circumstance
beyond the control of the traveler, the Board Chair may authorize the
Finance Officer to pay the penalties and charges for a reasonable amount.
b. Any travel advance funds received for travel that is cancelled must be paid back to
the Board immediately.
14. Internal Controls
a. For this policy to function effectively, there are certain responsibilities that the
individuals who use the policy must assume:
a.Out -of -town, over -night travel relating to conducting Board business or
attending a seminar is a privilege. Therefore, the traveler should exercise
good judgement when incurring travel expenses and use the Board's funds
prudently.
b.When two or more travelers are going to the same destination, they should
make every effort to use special group travel discounts and jointly use
transportation including taxicabs and carpooling in Board - owned, rented or
privately owned vehicles.
c. The Board Chair, CEO, and Finance Officer should ensure that Board
travelers are aware of, and will abide by, this Travel Policy and related
procedures.
d.The applicable person approving the travel should ensure that:
1. The trips is necessary.
2. Business value will be derived from it.
3. Funds are available in the budget account identified.

4. Expenses charged by the traveler are reasonable and reported
accurately.
e. The Finance Officer will reimburse travel expenses that have been approved
as reasonable, are appropriately documents, and are within the guideline of
this policy.
f. The traveler must refund the Board for any funds that have been reimbursed
directly to the traveler by grant funds or third -party reimbursements. The
traveler is responsible for obtaining the reimbursement due to the Board.
g.Petty Cash may not be used to support travel or travel reimbursements.
h.If a Board member or a Board employee is authorized funds for travel and
violates the written policies herein, the Finance Officer or CEO shall, unless
the violation is correct or satisfactorily explained, report the violation to the
Board Chair (if a Board member or CEO) or report to the CEO (if a Board
employee). In the case of the Board Chair, the matter may be further referred
to the Board of Commissioners.
15. Mandates (specific for NC ABC Boards):
a. NC GS 18B- 700(g2), states, "Travel Allowance and Per Diem Rates: Approved
travel on official business by members and employees of local boards shall be
reimbursed pursuant to G.S. 138 -61 unless the local board adopts a travel policy
that conforms to the travel policy of the appointing authority and such policy is
approved by the appointing authority. The local Board shall annually provide the
appointing authority's written confirmation of such approval to the Commission
and a copy of the travel policy authorized by the appointing authority. Any excess
expenses not covered by the local board's travel policy shall be paid with the
written authorization of the appointing authority's finance officer. A copy of the
written authorization for excess expenses shall be submitted to the Commission by
the local board within 30 days of approval."
b. NC Administrative Code (4 NCAC 2R.0909) established Travel Policy
requirements which supplement the General Statutes mentioned above; refer to this
Rule for details.
c. Although not specifically mentioned above, the ABC Commission expects the
following from the local ABC board:
a.Ensure the ABC Board's policy is amended as necessary each time the
County's policy is amended.

BA 18 -057 budgets additional funds from the North Carolina Department of Agriculture and Consumer
Services, Division of Soil & Water Conservation, to remove from streams debris resulting from past and
recent hurricanes, ice storms, and tornadoes and allow Soil and Water to do incremental projects. On
September 18, 2017 a budget amendment was done for the original award of $152,000. This amendment
adds $75,540 to the existing award amount; total award amount $227,540. The project title is "Stream Debris
Removal Project." This award is funded by state appropriations from the Disaster Recovery Act of 2016. The
required match of $66,000 will be met by using existing budgeted salaries and funds budgeted in the existing
storm water drainage project.

BA 18 -058 budgets a three -year grant award from Cape Fear Memorial Foundation Grant in the amount of
$56,000 for a Mobile Meals Application for the Home Delivered Meals (HDM) Program (year one
$22,000, year two $17,000 and year three $17,000). The Mobile Meals Application is a cloud -based
extension of the automated meals delivery software currently being utilized to manage volunteers, track
participation in Senior Resource Center (SRC) programs, and maintain records of nutrition program
participants. Senior Resource Center delivers approximately 360 meals daily to homebound seniors with
the help of 130 volunteers. Adding the Mobile Meals Application will allow the SRC to serve participants
more efficiently and reduce the amount of time spent by SRC staff creating and maintaining over 30 daily
meal routes. There is no County match required.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
RESOLUTION TO RECOGNIZE THE 35th ANNIVERSARY OF THE
FIFTH JUDICIAL DISTRICT GUARDIAN AD LITEM PROGRAM
WHEREAS, in 1983 the North Carolina Guardian ad Litem Program was established in the North
Carolina Administrative Office of the Courts by the General Assembly; and
WHEREAS, all 100 counties in North Carolina have a Guardian ad Litem program which provides court
appointed volunteers who are trained, independent advocates who provide a powerful voice for abused,
neglected, and dependent children in the state court system in addition to attorney advocates; and
WHEREAS, Guardian ad Litem volunteers are adults who come from diverse communities, cultures, and
life and work experiences; and
WHEREAS, the Guardian ad Litem pilot program was started for the Fifth Judicial District in 1983 and
Chief District Court Judge J.H. Corpening, II served as the first attorney advocate; and
WHEREAS, in 2017, over 40 community members were sworn -in as Guardian ad Litem volunteers in
the Fifth Judicial District. The majority of volunteers stay with the program for over the minimum
requirement of two years. In 2017, the Fifth Judicial District had one community member, Judy Neblett,
reach a milestone of 25 years of service with the program as a Guardian ad Litem volunteer; and
WHEREAS, in 2017, 180 Guardian ad Litem volunteers advocated for the best interests of 692 children
in New Hanover County throughout the course of a year. This equates to a conservative estimate of 30,000
volunteered hours; and
WHEREAS, due to the opioid epidemic, the Fifth Judicial District Guardian ad Litem program's case
load increased ten percent from 2016 to 2017; and
WHEREAS, at any moment in time, an average of 25 children are in need of a Guardian ad Litem
volunteer in New Hanover County.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners
recognizes the 35th anniversary of the Fifth Judicial District Guardian ad Litem program and its efforts to
represent and promote the best interest of children in the state court system to ultimately ensure a safe,
permanent home for the children.

BRIEF SUMAAARY:
House Bill 409 has been introduced to direct state agencies to modify employment practices in an effort to
reduce barriers to employment for individuals with a criminal history to successfully reintegrate them.
Reducing barriers to employment for persons with a criminal history is a statewide concern, and the State
finds the ability to obtain meaningful employment is essential to reinstating good citizenship for individuals
with a criminal history.
The bill ensures an equal hiring opportunity to all qualified applicants for jobs by eliminating any inquiry into
an applicant's criminal history, prior to being considered and interviewed for a specific position and upon
authorization by the applicant to release such information. Effective July 1, 2016, New Hanover County
amended its practices regarding inquiry to an applicant's criminal history, which are in alignment with those
outlined in HB409.
It is being requested that the New Hanover County Board of Commissioners adopt the attached resolution in
support of HB409.

RESOLUTION
IN SUPPORT OF HOUSE BILL 409
WHEREAS, there is a national movement to increase employment opportunities for people with past
criminal convictions by removing questions from the employment application regarding past criminal
history; and
WHEREAS, the inability to obtain employment contributes to a host of problems including high rates of
unemployment, recidivism and increased crime; and
WHEREAS, New Hanover County amended its employment application to no longer require disclosure
of past criminal history during the initial application process for positions within the County; and
WHEREAS, county positions that work with vulnerable populations including children and the elderly and
safety- sensitive positions continue to require full criminal background investigations on job applicants; and
WHEREAS, many other counties and cities throughout North Carolina have joined New Hanover County
in adopting new employment application practices in support of the national movement; and
WHEREAS, the State of North Carolina finds the ability to procure meaningful employment is essential
to reinstating good citizenship for individuals who have a criminal record; and
WHEREAS, reducing barriers to employment for persons with a criminal history is a matter of statewide
concern.
NOW, THEREFORE, BE IT RESOLVED, BY THE NEW HANOVER COUNTY BOARD OF
COUNTY COMMSSIONERS that New Hanover County supports House Bill 409, which was passed by
the North Carolina House of Representatives in April 2017, requiring fair assessments of persons with
criminal histories applying for employment with the State of North Carolina by not considering the criminal
history of an applicant for employment, or include any such inquiry on an initial employment application
form, until the applicant has received an interview and is under consideration for a specific position and
has authorized the appropriate release of such information; and be it further resolved, the Board calls on its
local legislative delegation to work to advance House Bill 409 in the 2018 Short Session.

AN ACT DIRECTING STATE AGENCIES TO ADJUST EMPLOYMENT PRACTICES TO
REDUCE BARRIERS TO EMPLOYMENT FOR INDIVIDUALS WITH A CRIMINAL
HISTORY.
The General Assembly of North Carolina enacts:
SECTION 1. Article 6 of Chapter 126 of the General Statutes is amended by adding
a new section to read:
"& 126 -20. State agency hiring practices; criminal histories.
Ca) Definitions. — The following definitions apply in this section:
W Applicant. — Any individual considered for, or who requests to be considered for,
employment with the State or any current State employee considered for, or who
requests to be considered for, another position in State employ
Q Criminal history. — A State or federal conviction of a crime, whether a misdemeanor or
felony, that bears upon an applicant's fitness for public employment. The term includes
a record of arrests that have not resulted in a conviction and those that have resulted in
a favorable disposition such as a dismissal or a verdict of not guilty.
Inquiry. — Any direct or indirect conduct intended to gather information, using any
mode of communication.
Findings and Purpose. — The General Assembly finds that the ability to procure meaningful
employment is essential to reinstating good citizenship for individuals who have a criminal record. The
General Assembly declares that the State encourages the successful reintegration of people with a criminal
history and recognizes that reducing barriers to employment for persons with a criminal history is a matter
of statewide concern. The purpose of this section is to implement hiring �practices that will increase
employment opportunities and will reduce recidivism and improve community stability.
Lc) Scope. — This section applies to all State agencies and positions in State government
employment, except that this section does not apply to any of the following_
A public employer that is required by State or federal law to conduct a criminal history
inquiry as a preliminary qualification to be considered for public employment.
A position that includes law enforcement or public safety.
A position that involves direct interaction with minors or the elderly.
Applicant Criminal History. — An applicant shall not be asked to disclose, orally or in writing_,
information concerning the he applicant's criminal record or history, including aninquiry on any ployment

application, until the applicant (i) has signed the appropriate waiver authorizing release, (ii) is being
considered for a specific position, and (iii) has received an interview.
(e) Considerations. — If a background check has been lawfully completed and a criminal history
exists, the following criteria shall be considered by the State agency before either proffering �ying an
offer of employment:
The nature and rg avity of the offense.
The length of time that has elapsed since the offense occurred.
The age of the person at the time of the conviction.
Whether the offense is reasonably related to the duties and responsibilities of the
employment sought b, t�pplicant.
Any information pertaining to the degree of rehabilitation that may have taken place in
the applicant.
The State agency must inform the applicant of the potential adverse employment decision based on the
background check report prior to a final decision and must provide the applicant an opportunity to
demonstrate that the applicant was not correctly identified in the background check report or that the report
is otherwise inaccurate.
ff Record of Arrest. — A record of arrest that did not result in conviction shall not be the basis for
disqualification from public employment.
W Violations of This Section. — A grievance concerning an n alleged violation of this section may
be brought by an j1pplicant under G.S. 126 -34.01 and G.S. 126 - 34.02.
Data Collection. — The Office of State Human Resources shall do the following:
Record and log the positions that are statutorily required to conduct background checks
prior to a conditional offer of employment.
Conduct quarterly reviews to determine compliance with this Article and make a report
on all such reviews to the General Assembly annually.
Collect, and make available to the public, data on:
a. The number of applicants for public employment with criminal histories
given conditional offers of employment.
b. The number of applicants for public employment with criminal histories
who are subsequently employ
C. The retention rate of public employees with criminal histories.
0 Non -State Employers. — The General Assembly encourages comparable hiring practices among
local governments and private employ, esoperating in the State."
SECTION 2. G.S. 126- 34.02(b) is amended by adding a new subdivision to read:
"(b) The following issues may be heard as contested cases after completion of the agency grievance
procedure and the Office of State Human Resources review:
Criminal history. — A grievance arising under G.S. 126 -20 that is related to an
applicant's or State employee's criminal history."
SECTION 3. G.S. 126 -5 is amended by adding a new subsection to read:
" cam) Notwithstanding any other provision of this Chapter, the provisions of G.S. 126 -20 apply to all
State emnlovees and annlicants for State emnlovment, except as snecifcally excluded by that section."
SECTION 4. This act is effective when it becomes law and applies to positions posted
for State employment on or after that date.

The US Army Corps of Engineers (ACES) has requested the non - federal cost share of $6,580,000 for the
FYI Carolina Beach (CB) and Kure Beach (KB) Coastal Storm Damage Reduction (CSDR) maintenance
events. This payment was originally anticipated for the FYI budget, however, the USACE has requested the
funds be paid by June 4, 2018 to allow for early bidding to obtain more favorable pricing. The cost sharing of
these projects is 65 percent federal and 35 percent non - Federal. Activities performed by the USACE include
completing project design, awarding a construction contract, and administering the contract through
completion for the upcoming nourishment cycle for Carolina Beach and Kure Beach. The proposed funding
breakdown is as follows:

budget. This amount will be treated as revenue in the Room Occupancy Tax fund when received.

Section 2: Explanation
BA -18 -063 budgets Room Occupancy Tax (ROT) fund balance to pay the requested non - federal cost share
of $6,580,000 to the United States Army Corps of Engineers ( USACE) for the Carolina Beach and the Kure
Beach Coastal Storm Damage Reduction Projects scheduled for FYI 8-19. Even though the projects are
scheduled for next fiscal year, the payment is due to the USACE in June 2018. The appropriation of
$5,580,000 in ROT fund balance combined with $1,000,000 available in the FY17 -18 budget will provide
the cost sharing requirements specified in the Project Cooperation Agreements.
Section 3: Documentation of Adoption
This ordinance shall be effective upon its adoption.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover

The Board of Commissioners approved in the FY 17 -18 budget ordinance the purchase and intent to finance
a Pierce Enforcer Pumper and Self Contained Breathing Apparatus. The County has purchased and received
the equipment, and on April 24, 2018, the Finance Office solicited proposals to finance $599,500 for the
purchase of the Pierce Enforcer Pumper and $820,520 for the purchase of the Self Contained Breathing
Apparatus for a total of $1,420,020. South State Bank submitted the lowest total interest costs for the
equipment at $112,477 representing a 2.829% rate. The first principal and interest payment is due in FY 18-
19 and is included in the recommended FY 18 -19 budget. Annual debt service will be $306,500. Staff
recommends the approval of the installment purchase contracts to South State Bank.

WHEREAS, New Hanover County proposes the financing of the acquisition of a Pierce Enforcer

Contract; and
WHEREAS, the most advantageous manner of financing thereof is by an installment contract

and deliver the Contract on behalf of New Hanover County in such form and substance as the
person executing and delivering such instruments on behalf of New Hanover County shall find
acceptable. The Clerk to the Board is hereby authorized to affix the official seal of New Hanover
County to the Contract and attest the same.
Section 3. The proper officers of New Hanover County are authorized and directed to execute and
deliver any and all papers, instruments, opinions, certificates, affidavits and other documents and
to do or cause to be done any and all other acts and things necessary or proper for carrying out this
Resolution and Contract.
Section 4. Notwithstanding any provision of the Contract, no deficiency judgment may be rendered
against New Hanover County in any action for breach of a contractual obligation under the
Contract and the taxing power of New Hanover County is not and may not be pledged directly or
indirectly to secure any moneys due under the Contract, the security provided under the Contract
being the sole security for South State Bank in such instance.
Section 5. The Purchaser covenants that to the extent permitted by the constitution and laws of the
State of North Carolina, it will comply with the requirements of the Internal Revenue Code of
1986, as amended (the "Code ") as required so that interest on New Hanover County's obligations
under the Contract will not be included in the gross income of South State Bank.
Section 6. It is hereby determined and approved that (i) the proceeds of the Contract shall be used
for the financing of the acquisition of a Pierce Enforcer Pumper and Self Contained Breathing
Apparatus, (ii) the maximum principal amount expected to be incurred is $1,420,020 with 10
installment payments over 59 months.

Consideration of Declaration of Covenants, Conditions, and Restrictions for Oak Grove Cemetery
and Flemington Cemetery

New Hanover County owns two cemeteries: Oak Grove Cemetery and Flemington Cemetery.
Oak Grove Cemetery, which is located on 16th and 17th Streets, was established by the City of Wilmington
in 1870 and was known as the City Cemetery. In 1882, ownership of the cemetery was transferred to New
Hanover County and renamed Oak Grove Cemetery. The cemetery was used for both indigent and public
burials. The last burial took place prior to 17th Street being extended in 1961.
Flemington Cemetery, which is located at 612 Sampson Road, was acquired in the early 1960s for the
purpose of relocating all of the headstones from Oak Grove Cemetery and the graves that were located in the
area of the extension of 17th Street. In addition, at least 10 burials have taken place since the property was
acquired. In 1999, 162 graves from Pine Tree Cemetery, which was previously owned by New Hanover
County, were relocated to the cemetery.
In order to preserve the historic character and the solemnity and dignity of the two cemeteries, staff is
requesting that the Board of Commissioners adopt the attached Declaration of Covenants, Conditions, and
Restrictions. Following are the main points of the Declaration:

This Declaration of Covenants, Conditions, and Restrictions is entered into this the
day of May, 2018 by New Hanover County, a political subdivision of the State of
North Carolina, (hereinafter "Declarant ").
WITNESSETH:
Whereas, Declarant is the owner of those parcels in the County of New Hanover, State of
North Carolina, known as the former public burial ground or Oak Grove Cemetery, and being
those certain tracts or parcels of land more particularly described in Book 1078 at Page 609;
Book 1018 at Page 23; Book 1309 at Page 1329; Book 501 at Page 65; Book UUU at Page 560;
Book 61 at Page 271; Book 68 at Page 43; Book 68 at Page 44; Book 1438 at Page 453 and
Book 1450 at Page 15, New Hanover County Registry; and the burial ground or Flemington
Cemetery (aka Flemington Oak Grove Cemetery), and being those certain tracts or parcels of
land more particularly described in Book 723 at Page 198, and recorded in Map Book 8 at Page
68, New Hanover County Registry; and

Whereas, it is in the best interest of the Declarant and public that certain covenants,
conditions, and restrictions governing and regulating the use and occupancy of the property be
established, to preserve the historic character and the solemnity and dignity of the former
cemeteries, and
Whereas, Declarant desires to provide for the preservation of the cemeteries and the
appearance and dignity of said property; and for the continued maintenance and custodianship of
the sites.
Now Therefore, in consideration of the premises, the Declarant agrees that the property
described herein shall be and is hereby subject to the following restrictions, covenants, and
conditions, relating to the use and occupancy thereof, which shall be construed as covenants
running with the land which shall be binding on all parties acquiring any right, title or interest in
any of the properties and which shall inure to the benefit of New Hanover County as a political
subdivision of the State of North Carolina.
ARTICLE I
PROPERTIES SUBJECT TO THIS DECLARATION
The property which shall be subject to this Declaration is located in the County of New
Hanover, State of North Carolina, and is more particularly described as being all of the property
recorded in Book 1078 at Page 609; Book 1018 at Page 23; Book 1309 at Page 1329; Book 501
at Page 65; Book UUU at Page 560; Book 61 at Page 271; Book 68 at Page 43; Book 68 at Page
44; Book 1438 at Page 453 and Book 1450 at Page 15, New Hanover County Registry, being the
parcels previously used as an indigent and public cemetery, also known, in whole or part, as the
Oak Grove Cemetery, and all that property more particularly described as Flemington Cemetery
(aka Fleming Oak Grove Cemetery) recorded in Deed Book 723 at Page 198 and recorded in
Map Book 8 at Page 68, New Hanover County Registry.
ARTICLE II
SPECIFIC COVENANTS, CONDITIONS AND RESTRICIONS
The subject parcels shall be preserved and maintained as burial sites. No burial
monuments or markers and no caskets or human remains shall be removed or disinterred without
the express written consent of the Board of County Commissioners, authorized in a public
meeting after a public hearing with a four -fifth (4/5) majority. No non - county owned structures
or buildings of any sort shall be erected on the subject parcels without the express written

ARTICLE III
GENERAL PROVISIONS
Section 1. Enforcement. New Hanover County, acting by and through its Board of
County Commissioners, have the right to enforce, by any proceeding at law or in equity, all
restrictions, conditions, covenants, and provisions of this Declaration. Failure to enforce any
covenant or restriction herein contained shall in no event be deemed a waiver of the right to do
so thereafter.
Section 2. Severability. Invalidation of any one of these covenants or restrictions by
judgment or court order shall in no way affect any other provisions which shall remain in full
force and effect.
Section 3. Amendment. The covenants and restrictions of this Declaration shall run with
and bind the land, for a term of twenty (20) years from the state the Declaration is recorded, after
which time they shall automatically extend for successive periods of twenty (20) years, unless
revoked or amended by the New Hanover County Board of County Commissioners, in a public
meeting after a public hearing with a four /fifth (4/5) majority. While ownership remains with
New Hanover County, the Declaration may be revoked or amended at any time by resolution of
the New Hanover County Board of County Commissioners adopted in a public meeting after a
public hearing with a four -fifth (4/5) majority and thereafter recorded in the New Hanover
County Register of Deeds.

ADULT CARE HOME COMMUNITY ADVISORY COMMITTEE
Number of Members: 13 State mandated; May appoint up to 18 (1 member for each permitted
facility). The Adult Care Home Administrators may nominate one -third of the members. If
possible, one member must be a person involved in the area of mental retardation.
Compensation: None, but may be reimbursed for actual expenses.
Term of Office: 1 year term initially; 3 year term thereafter
Qualifications: Must be a resident of New Hanover County. No person or immediate family
member of a person with a financial interest in a home served by the committee, or employee or
governing board member of a home served by the committee, or immediate family member of a
resident in a home served by the New Hanover County Adult Care Home Community Advisory
Committee may be a member of this committee. Immediate family is defined as mother, father,
sister, brother, child, grandmother, and grandfather, as well as in -laws. See Volunteer Job
Description for more information.
Purpose: The committee supports the spirit of the Adult Care Home Resident's Bill of Rights,
visits adult care homes quarterly, promotes the wellbeing of residents and encourages community
