RESOLUTION
APPROVAL OF POINT SECURITY, INC. AS A SOLE SOURCE VENDOR
FOR THE PURCHASE OF SMITHS DETECTION X -RAY INSPECTION SYSTEM
WHEREAS, New Hanover County Sheriffs Office desires to replace the current scan machine
being used for security at the Courthouse due to its lack of reliability; and
WHEREAS, the current machine is a Smiths Detection product and the Sheriffs office would like
to replace the equipment with the same type equipment due to the fact that Smiths Detection
equipment is currently being used at the County's Jail, Juvenile Justice Building, and Department
of Social Services; and
WHEREAS, Point Security, Inc., is the sole distributor of the Smiths Detection X -Ray system to
the North Carolina marketplace as confirmed in a letter dated April 23, 2018, from the
manufacturer, Smiths Detection; and
WHEREAS, North Carolina General Statute (NCGS) 143- 129(e)(6) exempts purchases of
apparatus, supplies, materials, or equipment when: (i) performance or price competition for a
product are not available; (ii) a needed product is available from only one source of supply; or (iii)
standardization or compatibility is the overriding consideration; and
WHEREAS, standardization is the overriding consideration for the purchase of this equipment
from Point Security, Inc.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of
Commissioners approves Point Security, Inc. as a sole source vendor for the purchase of Smiths
Detection X -Ray Inspection System in the amount of $35,394 in accordance with the provisions
of NCGS 143- 129(e)(6).

Section 2: Explanation
BA 18 -057 budgets additional funds from the North Carolina Department of Agriculture and Consumer
Services, Division of Soil & Water Conservation, to remove from streams debris resulting from past and
recent hurricanes, ice storms, and tornadoes. On September 18, 2017 a budget amendment was done for the
original award of $152,000. This amendment adds $75,540 to the existing award amount; total award amount
$227,540. The project title is "Stream Debris Removal Project." This award is funded by state appropriations
from the Disaster Recovery Act of 2016. The required match of $66,000 will be met by using existing
budgeted salaries and funds budgeted in the existing storm water drainage project.

Section 2: Explanation
BA 18 -058 budgets a three -year grant award from Cape Fear Memorial Foundation Grant in the amount of
$56,000 for a Mobile Meals Application for the Home Delivered Meals (HDM) Program (year one
$22,000, year two $17,000 and year three $17,000). The Mobile Meals Application is a cloud -based
extension of the automated meals delivery software currently being utilized to manage volunteers, track
participation in Senior Resource Center (SRC) programs, and maintain records of nutrition program
participants. Senior Resource Center delivers approximately 360 meals daily to homebound seniors with
the help of 130 volunteers. Adding the Mobile Meals Application will allow the SRC to serve participants
more efficiently and reduce the amount of time spent by SRC staff creating and maintaining over 30 daily
meal routes. There is no County match required.

BA 18 -059 budgets grant funds received from the Good Shepherd Home, a local organization promoting
the G.R.E.A.T. (Gang Resistance Education and Training) program. These funds will be used to purchase
t -shirts for participants in the Safe Summer Camp, a program that gives children the life skills necessary to
avoid involvement with drugs, gangs and violence. No County match is required.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
RESOLUTION TO RECOGNIZE THE 35" ANNIVERSARY OF THE
FIFTH JUDICIAL DISTRICT GUARDIAN AD LITEM PROGRAM
WHEREAS, in 1983 the North Carolina Guardian ad Litem Program was established in the North
Carolina Administrative Office of the Courts by the General Assembly; and
WHEREAS, all 100 counties in North Carolina have a Guardian ad Litem program which provides court
appointed volunteers who are trained, independent advocates who provide a powerful voice for abused,
neglected, and dependent children in the state court system in addition to attorney advocates; and
WHEREAS, Guardian ad Litem volunteers are adults who come from diverse communities, cultures, and
life and work experiences; and
WHEREAS, the Guardian ad Litem pilot program was started for the Fifth Judicial District in 1983 and
Chief District Court Judge J.H. Corpening, II served as the first attorney advocate; and
WHEREAS, in 2017, over 40 community members were sworn-in as Guardian ad Litem volunteers in
the Fifth Judicial District. The majority of volunteers stay with the program for over the minimum
requirement of two years. In 2017, the Fifth Judicial District had one community member, Judy Neblett,
reach a milestone of 25 years of service with the program as a Guardian ad Litem volunteer; and
WHEREAS, in 2017, 180 Guardian ad Litem volunteers advocated for the best interests of 692 children
in New Hanover County throughout the course of a year. This equates to a conservative estimate of 30,000
volunteered hours; and
WHEREAS, due to the opioid epidemic, the Fifth Judicial. District Guardian ad Litem program's case
load increased ten percent from 2016 to 2017; and
WHEREAS, at any moment in time, an average of 25 children are in need of a Guardian ad Litem
volunteer in New Hanover County.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners
recognizes the 35th anniversary of the Fifth Judicial District Guardian ad Litem program and its efforts to
represent and promote the best interest of children in the state court system to ultimately ensure a safe,
permanent home for the children.

RESOLUTION
IN SUPPORT OF HOUSE BILL 409
WHEREAS, there is a national movement to increase employment opportunities for people with past
criminal convictions by removing questions from the employment application regarding past criminal
history; and
WHEREAS, the inability to obtain employment contributes to a host of problems including high rates of
unemployment, recidivism and increased crime; and
WHEREAS, New Hanover County amended its employment application to no longer require disclosure
of past criminal history during the initial application process for positions within the County; and
WHEREAS, county positions that work with vulnerable populations including children and the elderly and
safety- sensitive positions continue to require full criminal background investigations on job applicants; and
WHEREAS, many other counties and cities throughout North Carolina have joined New Hanover County
in adopting new employment application practices in support of the national movement; and
WHEREAS, the State of North Carolina finds the ability to procure meaningful employment is essential
to reinstating good citizenship for individuals who have a criminal record; and
WHEREAS, reducing barriers to employment for persons with a criminal history is a matter of statewide
concern.
NOW, THEREFORE, BE IT RESOLVED, BY THE NEW HANOVER COUNTY BOARD OF
COUNTY COMMSSIONERS that New Hanover County supports House Bill 409, which was passed by
the North Carolina House of Representatives in April 2017, requiring fair assessments of persons with
criminal histories applying for employment with the State of North Carolina by not considering the criminal
history of an applicant for employment, or include any such inquiry on an initial employment application
form, until the applicant has received an interview and is under consideration for a specific position and
has authorized the appropriate release of such information; and be it further resolved, the Board calls on its
local legislative delegation to work to advance House Bill 409 in the 2018 Short Session.

BA -18 -063 budgets Room Occupancy Tax (ROT) fund balance to pay the requested non - federal cost share
of $6,580,000 to the United States Army Corps of Engineers ( USACE) for the Carolina Beach and the Kure
Beach Coastal Storm Damage Reduction Projects scheduled for FY 18-19. Even though the projects are
scheduled for next fiscal year, the payment is due to the USACE in June 2018. The appropriation of
$5,580,000 in ROT fund balance combined with $1,000,000 available in the FY 17-18 budget will provide
the cost sharing requirements specified in the Project Cooperation Agreements.

RESOLUTION
AUTHORIZING THE EXECUTION AND DELIVERY OF AN INSTALLMENT PURCHASE
CONTRACT WITH SOUTH STATE BANK TO FINANCE THE ACQUISITION OF A
PIERCE ENFORCER PUMPER AND SELF CONTAINED BREATHING APPARATUS FOR
USE BY NEW HANOVER COUNTY, NORTH CAROLINA AUTHORIZING THE
EXECUTION AND DELIVERY OF RELATED INSTRUMENTS AND CERTAIN RELATED
MATTERS AND MAKING RELATED FINDINGS
WHEREAS, New Hanover County proposes the financing of the acquisition of a Pierce Enforcer
Pumper and Self Contained Breathing Apparatus, as more fully described in the hereinafter named
Contract; and
WHEREAS, the most advantageous manner of financing thereof is by an installment contract
pursuant to Section 160A -20 of the General Statutes of North Carolina, as amended; and
WHEREAS, pursuant to said Section 160A -20, New Hanover County is authorized to finance the
acquisition of real and personal property, including fixtures, by installment contracts that create a
security interest in the property financed to secure repayment of the financing; and
WHEREAS, South State Bank has proposed that South State Bank finance the acquisition
pursuant to an Installment Purchase Contract between New Hanover County and South State Bank.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of
Commissioners authorizes the following:
Section 1. The New Hanover County Board of Commissioners does hereby find and determine:
(a) New Hanover County proposes the financing of the acquisition of a Pierce Enforcer
Pumper and Self Contained Breathing Apparatus, as more fully described in the
hereinafter named Contract;
(b) The most advantageous manner of financing thereof is by an installment contract
pursuant to Section 160A -20 of the General Statutes of North Carolina, as amended;
(c) Pursuant to said Section 160A -20, New Hanover County is authorized to finance the
acquisition of real and personal property, including fixtures, by installment contracts
that create a security interest in the property financed to secure repayment of the
financing; and
(d) South State Bank has proposed that South State Bank finance the acquisition
pursuant to an Installment Purchase Contract between New Hanover County and
South State Bank.
Section 2. The New Hanover County Board of Commissioners hereby authorizes and directs the
County Manager, the County Attorney, and the Chief Financial Officer to execute, acknowledge
and deliver the Contract on behalf of New Hanover County in such form and substance as the
person executing and delivering such instruments on behalf of New Hanover County shall find
acceptable. The Clerk to the Board is hereby authorized to affix the official seal of New Hanover
County to the Contract and attest the same.
Section 3. The proper officers of New Hanover County are authorized and directed to execute and
deliver any and all papers, instruments, opinions, certificates, affidavits and other documents and
to do or cause to be done any and all other acts and things necessary or proper for carrying out this
Resolution and Contract.
Section 4. Notwithstanding any provision of the Contract, no deficiency judgment maybe rendered
against New Hanover County in any action for breach of a contractual obligation under the
Contract and the taxing power of New Hanover County is not and may not be pledged directly or
indirectly to secure any moneys due under the Contract, the security provided under the Contract
being the sole security for South State Bank in such instance.
Section 5. The Purchaser covenants that to the extent permitted by the constitution and laws of the
State of North Carolina, it will comply with the requirements of the Internal Revenue Code of
1986, as amended (the "Code ") as required so that interest on New Hanover County's obligations
under the Contract will not be included in the gross income of South State Bank.
Section 6. It is hereby determined and approved that (i) the proceeds of the Contract shall be used
for the financing of the acquisition of a Pierce Enforcer Pumper and Self Contained Breathing
Apparatus, (ii) the maximum principal amount expected to be incurred is $1,420,020 with 10
installment payments over 59 months.
