Meeting Minutes
Chairman Barbour called the Port, Waterway & Beach Commission (PWBC) meeting to order at
~4:00. Participant introductions were made; the meeting’s attendance sheet is attached. The
June 2018 meeting minutes were approved.
Current Efforts
Wrightsville Beach’s (WB) Coastal Storm Damage Reduction (CSDR) Project, Post
Authorization Change Report (PACR):
The US Army Corps of Engineers (USACE) has proposed a June 2019 DRAFT PACR
release date. The USACE’s FY18 CSDR maintenance event’s final accounting of costs
and volumes will be shared when received.
Carolina Beach (CB) CSDR Project, Beach Renourishment Evaluation Report (BRER):
The USACE has proposed a DRAFT BRER release date in May 2019.
CB and Kure Beach (KB) FY19 CSDR Maintenance Projects:
A pre-solicitation release meeting was held on 26 June 2018 at CB Town Hall. The
attendees were N. Avery, KB; M. Sanders, KB; M. Crammer, CB; J. Medlock, USACE
and L. Bedsole, NHC. J. Medlock provided an overview of the placement and the
borrow locations. The USACE’s bid volumes are ~650K cy on CB and ~450K cy on
KB; the bid solicitation is targeted for late July with a notice to proceed in late October
and a start date no earlier than 16 November.
Mason Inlet Relocation Project (MIRP):
The 2018 Engineering Analysis confirms the inlet footprint remains well within the
engineering corridor. Barring unforeseen weather events, a 2019 relocation maintenance
event is not warranted. However, the Atlantic Intracoastal Waterway (AIWW) crossing
at Mason Creek is shoaling. The USACE is preparing a federal solicitation for multiple
NC AIWW features and will include the Mason Creek crossing within the federal
solicitation at full non-federal costs. As a contract option, the County will be allowed to
review the USACE bid tab before a non-federal fund transfer. As a combined element in
the USACE’s solicitation, Staff cautiously anticipates a potential cost reduction from
previous AIWW crossing maintenance events.
Carolina Beach Inlet (CBI):
25 July is the most current start date for the next CBI maintenance dredging event. The
USACE’s special purpose dredge Murdenis scheduled for a 7-day event. Staff continued
coordination with the agencies regarding use of the inshore dredge material management
site outside the environmental window (15Nov – 31Mar). Otherwise, the USACE will
make less efficient use of the nearshore ocean disposal site.
Shoreline Mapping Program:
The 2018 shoreline field transects are complete; the engineering analysis is underway.
Refined Coastal Modeling (RCM):
CB and KB analyses are complete; the reports are in progress.
Legislative Updates:
Ruth Smith updated County lobbying efforts in Washington. A Congressional Water
Resource Development Act (WRDA) is anticipated in the fall. Staff and Prime Policy
continue supporting the BRER’s 15-year extension beginning at initial construction and
support of an additional 3-year extension allowing the CB CSDR to compete for funds
through 2023 and ensuring BRER completion. Staff and Prime Policy are also
advocating for additional language ensuring an expedited completion of WB’s PACR.
Staff provided a brief overview of a NC General Assembly action regarding sandbags
and “intertidal marine rock outcroppings”. Vice-chair Andrew noted the Coastal
Resources Commission (CRC) will likely discuss the topic during the September CRC
meeting scheduled to be held in Wilmington, location yet to be announced.
Public Comment:
Vice-chair Andrew noted recent events and discussions regarding dredge material
management sites located along the AIWW and a new USACE policy of federal use only.
Vice-chair Andrew noted this as another likely agenda item at the September CRC
meeting. K. Riley also noted the issue as a NC Beach Inlet and Waterway Association
objective.

Placement volumes are estimated at ~650,000 cubic yards and ~450,000 cubic yards respectively.
Efforts to potentially include a CB Inlet maintenance event with the FY19 CB CSDR event continue.
Mason Inlet Relocation Project (MIRP)
The MIRP’s 2018 Engineering Report is in final editing; a FY19 relocation event is not warranted at this time
(2016-2018 bathymetrics attached).
At non-federal expense, the Mason Creek Atlantic Intracoastal Waterway (AIWW) crossing is tentatively
included in the USACE FY19 AIWW scope of work.

TheMurdenis scheduled for a mid-July, seven-day (12-hrs/day) event.

permitted prior to July 1, 1995, if the Commission finds that (i) the structure is located adjacent to an intertidal marine rock
outcropping designated by the State as a Natural Heritage Area pursuant to Part 42 of Article 2 of Chapter 143B of the
General Statutes and (ii) the replacement structure will comply with all applicable laws and with all rules, other than the rule
or rules with respect to which the Commission granted the variance, that are in effect at the time the structure is replaced.

placementofdredgedorexcavatedmaterialinfederalnavigationprojectDredgedMaterial
PlacementFacilities(DMPFs)bynonfederalinterestsandotherspursuanttoSection217(b)of
theWaterResourceDevelopmentActof1996andSection401(c)oftheFederalWater
PollutionControlAct(the"CleanWaterAct").Thepurposeoftheguidancewastoaddressthe
authorities,requiredfindings,andproceduresforpermittingplacementofdredgedor
excavatedmaterialinfederalnavigationprojectDMPFsbynonfederalinterestsandother
eligibleentities.FinalapprovalforusageofaDMPFisnolongermadebythelocalCorpsDistrict
Office,butisnowmadebytheCorpsDivisionOfficeinAtlanta,onceallrequired
documentationandsubmittalsarereceived.TheDivisionalsodeterminesallfeestobe
charged,whichwillincludecubicyardagecostsandadministrativefees.
WhatisSection217(b)andSection401(c)?
Section217(b)oftheWaterResourceDevelopmentActof1996,PublicLaw104303,as
amended(33U.S.C.§2326a(b)),authorizestheSecretaryoftheArmytopermitanonfederal
interesttouseanyDMPFunderthejurisdictionof,ormanagedby,theSecretaryifthe
Secretarydeterminesthatsuchusewillnotreducetheavailabilityofthefacilityforproject
purposes.Section221oftheFloodControlActof1970,PublicLaw91611,asamended(42
U.S.C.1962d5(b)),defines"nonfederalinterest"tomeanalegallyconstitutedpublicbody
(includingafederallyrecognizedIndiantribe)oranonprofitentitywiththeconsentofthe
affectedlocalgovernment,thathasfullauthorityandcapabilitytoperformthetermsofits
agreementandtopaydamages,ifnecessary,intheeventoffailuretoperform.
Section401(c)oftheFederalWaterPollutionControlAct(the"CleanWaterAct"),PublicLaw
92500,asamended(33U.S.C.§1341(c)),authorizestheSecretaryoftheArmy,actingthrough
theChiefofEngineers,topermittheuseofaDMPFundertheSecretary'sjurisdictionbyfederal
licenseesorpermittees,ifitisdeemedtobeinthepublicinterest.Thisauthorityappliesto
federallicenseesorpermittees,whodonotqualifyasnonfederalinterests.
DMPFDefinition:
Forpurposesoftheguidance,theterm"DMPF"meansafederaldredgedmaterialplacement
facilityandanyimprovementsonlandsorsubmergedlandsthatenabletheplacementof
dredgedorexcavatedmaterialasaresultofnonfederalworkassociatedwiththeconstruction,
operation,ormaintenanceoffederalnavigationprojectsforharbors,inlandharbors,orinland
waterways.Suchimprovementsmayinclude,butarenotnecessarilylimitedto,retainingdikes,
wasteweirs,bulkheads,embankments,monitoringfeatures,stillingbasins,ordewatering
pumpsorpipes.Thetermalsoincludesmodificationstoadredgedorexcavatedmaterial
placementfacilitytoincreasecapacitybeyondthatcreatedbyregularrecurringoperationand
maintenanceactivities.
Sections217(b)and401(c)applyonlytoDMPFsthatareconstructedandmaintainedbythe
Corpsandarelocatedon:
LandsownedinfeebyeithertheUnitedStatesorthenonfederalsponsorofa
1.
federalnavigationproject;
LandsoverwhichtheUnitedStatesorthenonfederalsponsorofafederal
2.
navigationprojectholdsaneasement,leaseorrightofway;or
SubmergedlandswithinthenavigationservitudeoftheUnitedStates

GeneralQualificationRequirements:
Inordertoqualityforconsideration,arequesttouseaDMPFmustmeetthefollowing
minimumrequirements:
Sufficientplacementareacapacitymustbeavailabletoaccommodatetheproposed
1.
nonfederaldredgedmaterialwithoutreducingtheavailabilityofthefacilityfor
federalprojectpurposes.Excessplacementcapacitymustexistintherequested
DMPF,eitherbecausetheDMPFwasdesignedwithacapacityinexcessofthe
capacityrequiredtomeetestimateddredgedmaterialplacementrequirementsfor
theassociatedfederalnavigationprojectoverthelifeoftheDMPF,orbecause
estimateddredgedmaterialplacementrequirementsfortheassociatedfederal
navigationprojectdonotexceedactual,demonstrateddredgedmaterialplacement
capacityrequiredforthefederalnavigationproject.Theexcesscapacitymustbe
sufficienttoaccommodatetheestimatedvolumeofnonfederaldredgedmaterial
proposedforplacementintheDMPF;andtheproposedplacementofnonfederal
dredgedmaterialintheDMPFcannotinterferewithscheduledfederalactions
associatedwiththeDMPF(e.g.,federaldredgedmaterialplacementorDMPFdike
raises).
Theproposedplacementofnonfederaldredgedmaterialmustbefornavigation

purposesdirectlylinkedtouseofthefederalnavigationprojectassociatedwiththe
DMPF.
Theproposedplacementofnonfederaldredgedmaterialmustbeenvironmentally
3.
acceptable.Thedredgedmaterialmustmeetapplicablestateandfederal
requirementsfordredgedmaterialplacementandapprovedCorpssedimenttesting
protocols.
Therequestingentitymustprovidedocumentationofarightofaccessforthe
4.
purposeofdredgedorexcavatedmaterialplacementfromallpartiesthatholdareal
propertyinterestintheDMPF,toincludetheunderlyingfeeownerofDMPFsthat
arelocatedonsubmergedlandswithinthenavigationservitudeoftheUnited
States.
ApplicationProcedures:
NonfederalinterestsorothereligibleentitiesseekingtoplacedredgedmaterialinaDMPF
withinNorthCarolinamustsubmitrequestsinwritingtotheCorpsWilmingtonDistrictOfficeat
least9to12monthsinadvanceofanyplanneddredgingprojectisexpectedtobegin.
Toinitiatearequest,anapplicantmustsubmitthefollowinggeneralinformation:
thepurposeandneedofproposednonfederaldredgingactivity,

mapofthelocationwheredredgedmaterialwillberemoved(animagefromGoogleEarth,

Googlemaps,oranothermappingprogramissufficient),
